Abstract

This study examines the integration of social engineering and policy innovation within Indonesia’s legislative framework for drug rehabilitation, focusing on restorative justice principles. Through a juridical analysis of Law No. 35 of 2009 on Narcotics and related policies, the research highlights the shift from punitive measures to rehabilitation-focused approaches. Findings reveal that while legislative provisions align with restorative justice ideals, significant gaps in implementation—such as inadequate rehabilitation infrastructure, social stigma, and weak stakeholder coordination—hinder their effectiveness. Drawing insights from international best practices, the study proposes actionable reforms, including enhanced judicial guidelines, public awareness campaigns, and integrated policy frameworks, to promote a comprehensive and sustainable approach to drug rehabilitation in Indonesia. This research underscores the potential of restorative justice as a transformative tool for addressing drug addiction as a public health and social issue.

Abstract

This study explores the legislative frameworks governing drug rehabilitation and the reintegration of former drug addicts into society through a normative juridical analysis. The research examines how laws and policies influence the recovery journey, highlighting critical gaps in anti-discrimination measures, public health integration, and societal reintegration mechanisms. Comparative case studies from countries with progressive approaches, such as Portugal and Norway, illustrate effective models for aligning legal systems with public health strategies. The findings emphasize the need for legislative reforms that promote inclusivity, support long-term recovery, and foster societal acceptance. Recommendations include expanding anti-discrimination protections, incorporating restorative justice mechanisms, and enhancing interagency collaboration to ensure holistic rehabilitation programs. This research contributes to the discourse on aligning law and social policy to address the multifaceted challenges of drug addiction and reintegration.

Abstract

This study examines the legal mechanisms for the social reintegration of drug addicts, focusing on rehabilitation as a transformative approach to enabling individuals to re-enter society as productive citizens. Using a normative juridical analysis, the research explores the alignment of national legal frameworks with international human rights standards and evaluates the challenges in implementing rehabilitation-focused policies. Findings reveal that while laws and policies supporting rehabilitation exist, their effectiveness is hindered by societal stigma, inconsistent application, and resource limitations. The study emphasizes the need for policy alignment with international standards, expansion of community-based programs, public awareness campaigns, and strengthened monitoring systems. These measures are essential for creating a supportive legal and social environment conducive to the successful reintegration of drug addicts into society.

Abstract

The research investigates law's role in promoting transformative justice through social engineering, focusing on rehabilitation and reintegration processes of drug addicts into society. This study applies a normative-juridical approach to evaluate Indonesia's legal frameworks for their effectiveness in handling addiction as a public health issue. Comparative analyses with international models, such as the decriminalization in Portugal and harm reduction policies in the Netherlands, show what a change of heart in legal philosophy might achieve. The findings put forward the majors lacuna in the present legislation: undue punitive, lack of supportive infrastructure, and stigma among society. Recommendations offered by the study go on to include legislative reform for rehabilitation, supportive infrastructure development, public-private partnership for effective reintegration. This paper advocates for a compassionate justice system that embeds transformative justice principles into legal frameworks, promoting societal productivity and inclusivity.

Abstract

Progress in this digital era and the growing economic activity that occurs in human existence, this is also what can be the focus. Due to the widespread use of the internet and social media in the country, the growth of the digital economy in Indonesia is considered to have great potential. In an economic context in this digital era, this is evidence that growth and development are growing. As a result, more and more commerce and commercial transactions use the Internet as a digital medium for communication, collaboration, and joint ventures between individuals or businesses. Cryptocurrencies are one of those things that are now making it easier for people to make virtual commercial transactions. Cryptocurrency is a technique that uses a cryptographic technology system to assist in processing cryptocurrencies, and digital assets. The Greek words graphein, meaning writing or science, and kriptó, meaning hidden or secret, are the sources of the words cryptology and cryptography. In this case, to be able to find out the regulations regarding the legitimacy of using crypto assets in the form of bitcoin to be used as a transaction tool in paying attention to the regulations of the Currency Law, ITE Law, and Bank Indonesia Regulations. Abstract

The commercial music concert industry in Indonesia involves complex legal relationships among creators, performing artists, and concert organizers, particularly with respect to the obligation to pay music performance royalties. This study examines the legal framework governing royalty payment responsibility under Law Number 28 of 2014 concerning Copyright and Government Regulation Number 56 of 2021 concerning the Management of Song and/or Music Copyright Royalties, and critically evaluates the conformity of Jakarta Central Commercial Court Decision Number 92/Pdt.Sus-HKI/Cipta/2024/PN Niaga Jkt.Pst with those instruments. The study employs a normative juridical method with statutory and case approaches, drawing on primary legal materials and Scopus-indexed secondary sources. The findings indicate that the applicable regulatory framework unambiguously places royalty payment obligations on the concert organizer as the commercial user of copyrighted musical works, not on the performing artist whose remuneration constitutes a service fee rather than proceeds from commercial exploitation. The court's imposition of royalty liability on the singer departs from this statutory scheme, mischaracterizes the legal nature of the performance fee, and undermines the collective management mechanism established under the Copyright Act. This study concludes that judicial clarification, regulatory refinement, and stronger enforcement of pre-event licensing compliance are necessary to restore legal certainty and protect creators' economic rights within Indonesia's music industry.

Abstract

Penelitian ini mengenai bentuk perjanjian magang dan bentuk perlindungan hukum pekerja magang serta ketetapan upah tenaga kerja magang. Metode penelitian yuridis normatif. Bertujuan untuk mengetahui bagaimana pelaksanaan peraturan perundang-undangan tentang ketenagakerjaan terutama mengenai bagaimana pemenuhan hak seorang tenaga kerja magang yang telah memenuhi seluruh kewajiban dalam pelaksanaan program pemagangan. Penelitian ini sangat penting dilakukan karena hak dan kewajiban tenaga kerja magang telah diatur dalam peraturan perundang-undangan di Indonesia. Mengenai hak dan kewajiban pekerja magang sesuai dengan PERMENAKER 6/2020. Berdasarkan hal tersebut, pemerintah secara bertahap terlibat dalam menangani masalah ketenagakerjaan sejak saat itu melalui berbagai peraturan perundang-undangan yang memberikan kepastian pengaturan mengenai hak dan kewajiban pengusaha dan pekerja. Perjanjian magang dilakukan berdasarkan: Hak dan kewajiban peserta   magang, hak dan kewajiban penyedia pemagangan, program magang, periode Pelajar dan jumlah uang saku yang diatur dalam PERMENAKER No. 6 dari 2020. Upah sesuai dengan Hukum Ketenagakerjaan adalah hak pemagang yang diterima uang saku dari perusahaan yang ditentukan sesuai dengan kontrak kerja, perjanjian atau persyaratan hukum, termasuk ganjaran kepada pekerja magang. Undang-Undang No. 13 2003 tentang Ketenagakerjaan, yaitu: perlindungan keselamatan kerja, kesehatan kerja dan perlindungan norma kerja perlindungan atas jaminan sosial tenaga kerja.

Abstract

Concurrent with economic expansion and demographic growth, land scarcity has intensified, necessitating state intervention to maintain equilibrium among competing stakeholders. The Basic Agrarian Law establishes land reform provisions encompassing ownership restructuring and tenure relationships, with Articles 7 and 17 mandating restrictions to prevent land concentration amongst particular groups. Despite legislative requirements that residential land ownership limitations be codified through Government Regulation, such implementing regulation remains absent. Consequently, the State Minister of Agrarian Affairs/Head of the National Land Agency promulgated Decree Number 6 of 1998, restricting residential land ownership to five parcels not exceeding 5,000 square metres cumulatively. This research employs normative juridical methodology with statute approach, examining regulatory hierarchies and enforcement mechanisms. Analysis reveals that whilst Decree 6/1998 constitutes a regulation pursuant to Law 12/2011 Article 100, fundamental deficiencies compromise its efficacy. The Decree lacks prescribed sanctions for violations, contains no supervisory mechanisms, and inadequately addresses ownership restrictions, applying solely to rights elevation rather than rights transfer mechanisms. Furthermore, hierarchical incongruence exists whereby ministerial decree implements primary legislative mandates absent intermediary Government Regulation as constitutionally required. Land office administrative systems lack comprehensive ownership data, rendering declaration verification practically impossible. These findings corroborate previous scholarship documenting weak enforcement mechanisms whilst revealing novel dimensions concerning hierarchical legitimacy and category-specific regulatory dysfunction. The absence of administrative, civil, or criminal sanctions substantially undermines legal enforcement, rendering residential land ownership restrictions ineffective in preventing ownership concentration and achieving equitable distribution objectives.

Abstract

Penelitian ini bertujuan untuk menganalisis hubungan antara intensitas penggunaan media sosial dengan perilaku bullying di kalangan remaja. Pelaksanaan kegiatan dilakukan melalui beberapa tahapan, meliputi tahap identifikasi masalah dan analisis kebutuhan, perencanaan program dan penyusunan materi, pengumpulan data, pelaksanaan sosialisasi dan edukasi, pelatihan keterampilan sosial dan pengelolaan emosi, pelibatan guru, orang tua, dan lingkungan sekolah, serta evaluasi program. Hasil kegiatan menunjukkan adanya hubungan positif antara intensitas penggunaan media sosial dengan kecenderungan terjadinya perilaku bullying, di mana remaja dengan durasi penggunaan media sosial yang tinggi cenderung lebih sering terlibat dalam perilaku bullying, baik sebagai pelaku maupun korban. Interaksi daring yang bersifat terbuka, cepat menyebar, serta minim kontrol sosial langsung meningkatkan potensi terjadinya konflik dan komunikasi yang kurang empatik. Selain itu, fitur media sosial memungkinkan tindakan perundungan terjadi secara berulang dan menjangkau audiens yang lebih luas, sehingga dampak cyberbullying menjadi lebih kompleks dan berkelanjutan. Temuan ini menegaskan bahwa upaya pencegahan bullying perlu dilakukan secara komprehensif melalui peningkatan literasi digital, penguatan pendidikan karakter, serta penumbuhan empati dan tanggung jawab sosial agar remaja mampu menggunakan media sosial secara lebih sehat dan bertanggung jawab.
