Abstract

This study aims to determine the effect of the Problem-Based Learning (PBL) model, supported by the AMK (Mystery Case Envelope) medium, on the critical thinking skills of third-grade students in the Civic Education subject at MI Mathlaul Anwar. The research method used was a quantitative approach with an experimental design. The sample consisted of 60 students divided into an experimental class (30 students) and a control class (30 students). The data analysis technique used was an essay test that had been tested for validity and reliability. The results showed that the average posttest score of the experimental class (83.80) was higher than that of the control class (75.73). The independent sample t-test yielded a significance value of 0.000 < 0.05, indicating a significant effect of the PBL model supported by the AMK media on students’ critical thinking skills

Abstract

Kurangnya pemahaman masyarakat tentang pengucapan talak tiga di luar pengadilan menimbulkan persoalan ketika terjadi perbedaan antara keabsahan menurut fiqh dan pengakuan menurut hukum negara yang berpotensi menimbulkan dualisme keabsahan terhadap status talaknya. Penelitian ini bertujuan untuk memberikan pemahaman kepada masyarakat tentang akibat yang ditimbulkan jika mengucapkan talak di luar pengadilan dan memberikan kepastian hukum yang tidak sekadar persepsi agama pribadi tetapi harus sesuai regulasi hukum yang berlaku sehingga menghindari talak liar. Penelitian ini merupakan penelitian kualitatif dengan pendekatan yuridis-normatif yang digunakan untuk memahami norma-norma hukum yang berlaku untuk mengatur talak tiga dan pendekatan komparatif yang berguna untuk membandingan antara pandangan mazhab syafi’i dan Kompilasi Hukum Islam. Hasil penelitian menunjukkan bahwa menurut mazhab syafi’i, talak selama rukun dan syaratnya terpenuhi maka talak tersebut dianggap sah, pengucapan talak tiga di luar pengadilan tidak mempengaruhi keabsahan nya, berbeda dengan kompilasi hukum islam yang berpendapat bahwa talak harus diucapkan di depan hakim pengadilan agama. Kesimpulannya menunjukkan bahwa fiqh dan hukum positif bergerak pada ranah yang berbeda, Bukan karena isinya bertentangan, tapi karena yang dinilai berbeda levelnya, fiqh menilai keabsahan hukum di agama dan hukum negara menilai akibat hukum dan pengakuan resmi di administrasi negara.

Abstract

Mediation is a mandatory dispute resolution mechanism in civil cases, including divorce cases in Religious Courts, as regulated by Supreme Court Regulation Number 1 of 2016. The high divorce rate in Bogor Regency, particularly at the Cibinong Class IA Religious Court, indicates that marital conflicts are often unresolved by the parties. This study aims to analyze the effectiveness of mediators in handling divorce cases and identify the factors influencing mediation outcomes.This research uses a qualitative approach with a case study method and field research design. Data were collected through in-depth interviews, direct observation, and document analysis. The findings show that mediator effectiveness is influenced by competence, professionalism, communication skills, mediation techniques, and institutional support. However, mediation is often hindered by emotional tensions, prolonged conflicts, and lack of good faith from the parties. Supporting factors include the mediator’s patience, persuasive approach, and shared interests such as children and family continuity. Overall, mediation has not fully achieved optimal effectiveness in resolving divorce disputes. Mediator effectiveness plays a crucial role in determining the success of mediation in divorce cases. Strengthening mediator capacity and encouraging good faith among parties are essential to improve mediation outcomes.
