Abstract

The Indonesian Constitution stipulates in Article 28H paragraph (1) as follows: “everyone has the right to live in physical and spiritual prosperity, to live and to have a good and healthy environment, and to have the right to health services”. The principle of a prosperous life as the right of every person is further regulated in Article 9 paragraph (2) of Law Number 39 of 1999 which stipulates as follows ” everyone has the right to live in peaceful, safe, peace, happy, physical and spiritual prosperity. One aspect of supporting a prosperous life is food. Food is one of the basic human needs that must be met in order to live a prosperous life. The Indonesian state and nation really understand the urgency of food in human life so that they can live in prosperity. Based on the idea of the urgency of food in a prosperous human life, Indonesia stipulates Law No. 18 of 2002 on Food. The Indonesian state is determined to achieve the ideals of "food sovereignty" as an ideal condition that is expected to support the welfare of the Indonesian nation. The Indonesian people are determined to be sovereign in the food sector in the sense of having the ability to determine food policies that guarantee the right to food so that the Indonesian people can live in prosperity. However, in reality, the world is experiencing a food crisis at this time. The reality of the food crisis that is hitting the world at this time is one of the agendas promoted by President Joko Widodo, who serves as the G-20 Presidency, as one of the main agendas of the G-20 meeting in the months ahead. Can President Joko Widodo as the G-20 Presidency garner the agreement of G-20 countries to cooperate and work together to overcome the world food crisis as one of the main agendas of the G-20 meeting? This research uses juridical-normative research methods and other research methods that are deemed necessary and can support the success of the research. According to the author, as the G-20 Presidency, President Joko Widodo will be able to forge an agreement with G-20 member countries to work together and work together to overcome the world food crisis that is happening at this time. The reason is that all G-20 member countries and all countries in the world will be affected by the global food crisis in due time, so if they do not want to be affected by the global food crisis, all G-20 member countries and the other countries on the surface of the earth must work together to tackle the global food crisis. All G-20 member countries are advised to take concrete steps to overcome the food crisis in their respective countries as has been done by Indonesia as stated in President Joko Widodo's program.

Abstract

Pembatasan distribusi minuman kemasan perlu dilakukan dalam UU Nomor 17 Tahun 2023 tentang Kesehatan. Pembatasan yang dimaksud berkaitan dengan minuman kemasan yang marak dan berdampak buruk pada kesehatan Masyarakat. Sementara Undang Nomor 18 Tahun 2012 tentang Pangan juga tidak mengatur pembatasan makanan dan minuman, hanya mengatur pengelolaan keamanan, mutu, gizi, dan tidak bertentangan dengan agama, keyakinan, dan budaya Masyarakat. Penelitian yang digunakan adalah penelitian yuridis normatif, mengkaji hukum dalam wujud peraturan perundang-undangan. Pendekatan yang digunakan adalah pendekatan perundang-undangan dan pendekatan konseptual. Hasil kajian menunjukkan bahwa UU Kesehatan memasukkan makanan dan minuman menjadi elemen penting dalam kesehatan Masyarakat. Tidak ada pengaturan pembatasan distribusi makanan dan minuman, telah menyebabkan proses legislasi dalam UU Kesehatan tidak mengevaluasi norma UU Pangan. Padahal minuman kemasan menyebabkan degradasi kualitas kesehatan masyarakat. Apabila masyarakat mengalami permasalahan dan gangguan kesehatan maka akan berdampak simultan bagi kerugian negara. Tanggung jawab negara untuk membatasi distribusi minuman kemasan adalah mutlak dilakukan. UU Pangan dan UU Kesehatan tidak mempertimbangkan aspek kesehatan dalam distribusi minuman kemasan, hanya memperhatikan aspek terpenuhinya kebutuhan dasar individual. Pemenuhan kebutuhan dasar harus ditujukan pada peningkatan kualitas hidup sehat dan demi kesejahteraan umat manusia. Setiap distribusi minuman yang ada harus memenuhi standar kesehatan, bahkan pembatasan distribusi produk minuman kemasan wajib dilakukan. Hukum administrasi kesehatan mengarah pada pemenuhan hidup yang sehat dan terpenuhinya kebutuhan dasar individual. Pembatasan distribusi minuman kemasan dilakukan untuk memberikan kehidupan yang baik, sehat, serta sejahtera lahir dan batin sebagai bagian dari jaminan hak asasi manusia.

Abstract

The Applicability of Law No. 11 of 2020 of Cipta Kerja, signifies the implementation of the concept of risk-based business licensing that shares risks at low, medium, and high levels. This concept is not much different from general licensing which also pays attention to risk as the basis for issuing permits, only that it focuses more on simplifying permits in obtaining them and monitoring them. Indigenous peoples and local communities will compete with other business perpetrator based on the level of risk in accessing coastal waters. The state is responsible for protecting indigenous peoples and local communities, so as not to lose their rights to coastal waters. This paper to study whether risk-based business licensing protects these communities. Meanwhile, the research method used is normative juridical using literature studies.

Abstract

The development of digitalization is something that has become a necessity in all levels of society and all fields of activity, including education. The use of technology for society is used to support activities. The dependence of society on the use of social media, through various social media tools such as Facebook, Instagram, Twitter, Tik Tok and others, opens up new job opportunities related to technology and digitalization. Digitalization allows for wider relationships, so it is often used in the fields of marketing and production. Social media is a platform that allows its users to create, share, and participate in content. In this case, there is a need for legal recognition through counseling related to protection for content creator business actors. The increase in the use of social media by students then opens up new opportunities in pursuing a profession in the digital era, one of which is becoming a Content Creator. The content created is not only useful for the fields of production and marketing, but can also be useful for Education, where students can use it in relation to learning and Education. Content creation in the layman's view is considered easy, but in fact it is not, because a content creator needs to think about engagement, awareness, personal branding. With this understanding, it is necessary for students of MAN 13 South Jakarta to get an introduction to becoming a content creator and how to get legal protection in running the business, so that they do not experience obstacles in starting to create content.

Abstract

The purpose of this study was to analyze norms that do not regulate the requirements for candidates for legislative members (DPR) without being accompanied by a police record certificate (SKCK) which has a material impact on their duties and responsibilities in establishing law. The research method used in this study is normative juridical with a conceptual approach and a statutory approach. This research is very important in filling public positions because the lack of conditions in question is a form of institutional imbalance in the DPR compared to the requirements for the candidacy of the President and Vice President, Governors, Mayors, and Regents. Even though all of them are public positions that directly receive a mandate from the people. The form of a rule of law requires checks and balances, which upholds Indonesia's constitutional cultural values and places greater emphasis on the harmony and integration of shared values. Meanwhile, the invalidity of the SKCK as a condition for candidacy for members of the DPR is a form of denial. So this has implications for the integrity and quality of prospective members who will occupy the DPR positions. As a law-forming institution, quality and integrity are important parts that must be attached to them, so that in carrying out their duties it will result in the formation of laws that are oriented towards the protection of human rights. The novelty of this research is the analysis of the importance of regulating the requirements for police record certificates in the Election Law as a basis for measuring the filling of public office. Tujuan penelitian ini adalah untuk menganalisis norma yang tidak mengatur syarat calon anggota legislatif (DPR) tanpa disertakan dengan surat keterangan catatan kepolisian (SKCK) yang secara materiil berdampak pada tugas dan tanggungjawabnya dalam pembentukan hukum. Metode penelitian yang digunakan dalam penelitian ini adalah yuridis normatif dengan pendekatan konseptual dan pendekatan perundang-undangan. Penelitian ini sangat penting dalam pengisian jabatan publik, sebab ketiadaan syarat yang dimaksud adalah bentuk ketidakseimbangan kelembagaan DPR dibandingkan dengan syarat pencalonan Presiden dan Wakil Presiden, Gubernur, Walikota, dan Bupati. Padahal semuanya sama-sama jabatan publik yang langsung menerima mandat dari rakyat. Bentuk negara hukum menghendaki adanya checks and balances, yang menjunjung nilai-nilai budaya konstitusional Indonesia dan lebih menekankan harmoni dan integrasi nilai-nilai bersama. Sedangkan ketidakberlakuan SKCK sebagai syarat pencalonan anggota DPR adalah bentuk pengingkaran dimaksud. Sehingga hal ini berimplikasi terhadap integritas maupun kualitas dari calon-calon anggota yang akan menduduki jabatan DPR. Sebagai lembaga pembentuk undang-undang kualitas dan integritas adalah bagian penting yang harus melekat bagi mereka, sehingga dalam menjalankan tugasnya akan menghasilkan pembentukan undang-undang yang beorientasi pada perlindungan hak asasi manusia. Adapun kebaharuan penelitian ini adalah analisis mengenai pentingnya pengaturan mengenai syarat surat keterangan catatan kepolisian dalam UU Pemilu sebagai dasar tolak ukur pengisian jabatan publik.

Abstract

The basis of this research is that hospitals must implement a hospital health data information system, including telemedicine health data. These provisions are regulated in Law Number 17 of 2023 about Health. Existing norms still need to be clarified because there are no further regulations in the health law regarding hospital health data specifically for telemedicine health data protection. Meanwhile, Law Number 27 of 2022 about Personal Data Protection explains that health data is protected. At this point, legal construction is necessary to understand the health data of hospital telemedicine patients, which is an essential part of the health omnibus law. A comprehensive idea of what hospital telemedicine health data means is needed. The research method used is normative juridical, analyzing statutory regulations using conceptual and statutory approaches. The research results are that the concept of hospital telemedicine health data developed using technology must have legal protection. Norms governing hospital telemedicine health data should not harm patients. Meanwhile, there is no order to delegate regulation to statutory regulations under the law regarding telemedicine health data in the Health Law. In this context, it is necessary to interpret hospital telemedicine health data as national health information protected by the state.

Abstract

ABSTRAKPutusan Mahkamah Agung Nomor 175 PK/TUN/2016 telah membuka ruang kewenangan peninjauan kembali permohonan fiktif positif. Alasan dikabulkannya peninjauan kembali untuk perbaikan kualitas pelayanan publik. Kualitas pelayanan publik merupakan asas-asas umum pemerintahan yang baik dalam Undang-Undang Administrasi Pemerintahan. Rumusan masalah yang akan diuraikan dalam tulisan ini adalah bagaimanakah penerapan asas-asas umum pemerintahan yang baik terhadap upaya peninjauan kembali permohonan fiktif positif ditinjau dari Undang-Undang Administrasi Pemerintahan. Tulisan ini menggunakan metode penelitian yuridis normatif, dengan pendekatan teoritis konseptual serta pendekatan perundang-undangan dan putusan pengadilan. Hasil analisis terhadap Putusan Mahkamah Agung Nomor 175 PK/TUN/2016, pengadilan judex facti menunjukkan bahwa pengadilan tidak mempertimbangkan asas pelayanan yang baik dalam Undang-Undang Administrasi Pemerintahan dan Undang-Undang Pelayanan Publik untuk memeriksa permohonan fiktif positif. Asas pelayanan yang baik yaitu memberikan pelayanan yang tepat waktu, prosedur dan biaya yang jelas, sesuai dengan standar pelayanan. Asas pelayanan yang baik merupakan perluasan dari Undang-Undang Administrasi Pemerintahan dan Undang-Undang Pelayanan Publik. Kesimpulan dari penelitian ini adalah bahwa perluasan penggunaan asas-asas umum pemerintahan yang baik pada Undang-Undang Pelayanan Publik telah melengkapi asas-asas umum pemerintahan yang baik pada Undang-Undang Administrasi Pemerintahan khususnya asas pelayanan yang baik. Pertimbangan hukum majelis hakim peninjauan kembali terkait kualitas pelayanan publik yang baik, harus memenuhi standar pelayanan. Kata kunci: asas-asas umum pemerintahan yang baik; fiktif positif; pelayanan publik. ABSTRACT Supreme Court Decision Number 175 PK/TUN/2016 has opened up space for extraordinary appeals on positive ctitious requests. The reason for being granted extraordinary appeal is to improve the quality of public services. The quality of public services is the general principles of good governance in the Government Administration Law. The formulation of the problem that will be described in this paper is how to apply the general principles of good governance to the extraordinary appeal of positive ctitious petitions in terms of the Government Administration Law. This paper uses a normative juridical research method, with a conceptual theoretical approach as well as a statutory approach and court decisions. The results of the analysis of the Supreme Court Decision Number 175 PK/TUN/2016, the judex facti court showed that the court did not consider the principles of good service in the Government Administration Law and the Public Service Law to examine ctitious positive applications. The principle of good service is to provide services that are on time, clear procedures and costs, in accordance with service standards. The principle of good service is an extension of the Government Administration Law and the Public Services Law. The conclusion of the study is that the expansion of the use of general principles of good governance in the Public Service Law has complemented the general principles of good governance in the Government Administration Law, especially the principle of good service. Legal considerations of the panel of judges on extraordinary appeal related to the quality of good public services must meet service standards. Keywords: general principles of good governance; fictive positive; public service.

Abstract

This research analyzes the challenges associated with legislative candidates simultaneously registered by two distinct political parties and engaging in electoral processes. The requirement of a statement for a candidate to be nominated by only one political party in the general election needs to be revised to address the problem at hand. Efforts are needed to enhance the role of political parties participating in the election. Political parties face a challenging task as institutions authorized to register their members as legislative candidates. The institutional strengthening of the role of political parties in political recruitment is necessary. The selection process carried out by political parties aims to produce competent individuals prepared to assume public office. Apart from that, the moral attitudes of political party cadres as legislative candidates are tested before taking office. All mechanisms employed by political parties should be conducted democratically and with integrity. One proposed mechanism is to set a requirement that legislative candidates must have been members of a political party for at least five years. This five-year membership requirement should be introduced alongside the requirement for candidates to be nominated by only one political party. Consequently, it is imperative to amend the election law by including a provision that mandates a minimum five-year membership in a political party. This study adopts a normative juridical methodology underpinned by a conceptual framework guided by the relevant statutory regulations.
