Abstract

The problems in this research are (1) To what extent is the implementation of the North Central Timor Regency DPRD's supervisory function for the 2019-2024 period regarding the implementation of North Central Timor Regency Regional Regulations according to Law Number 23 of 2014 concerning Regional Government (2) What are the factors inhibiting the supervisory function? North Central Timor Regency DPRD for the 2019-2024 Period Regarding the Implementation of North Central Timor Regency Regional Regulations According to Law Number 23 of 2014 concerning Regional Government.The research method uses empirical legal research. Aspects of the research include the rights of the DPRD in carrying out supervisory functions and the factors that inhibit the DPRD of North Central Timor Regency in implementing the Regional Regulations of North Central Timor Regency according to Law No. 23 of 2014 concerning Regional Government. The approach method uses a conceptual approach and a sociological approach. The types and sources of data for this research are primary data and secondary data. Respondents in this research were the Chair of the DPRD of North Central Timor Regency, members of the DPRD and the Secretary of the Council. Data collection techniques include interviews and observations. Data processing takes the form of data checking, data systematics and data tabulation. Data analysis was carried out in a qualitative descriptive juridical manner.he results of the research and discussion show that the implementation of the DPRD's supervisory function regarding the implementation of Regional Regulations in North Central Timor Regency has not been implemented optimally. Factors that influence the DPRD's supervisory function regarding the implementation of Regional Regulations consist of internal factors including the level of formal education of DPRD members generally in the secondary or high school education category so that it does not support the effective implementation of supervision because the average level of education of regional government officials is higher, namely Master's level. Meanwhile, development activities for council members through strengthening informal education and work experience of DPRD members are not sufficient to support the human resources of DPRD members in carrying out supervisory functions.

Abstract

This study discusses two issues, namely: (1) To what extent is the implementation of the function of the Regional Development Planning Agency of North Central Timor Regency in terms of the Regional Regulation of North Central Timor Regency Number 9 of 2008 concerning the Organization and Work Procedures of the Regional Development Planning Agency, Inspectorate and Other Regional Technical Institutions of North Central Timor Regency? (2) What are the factors that are obstacles in the implementation of the functions of the Regional Development Planning Agency of North Central Timor District? The research method used is the empirical method, which is research conducted directly to related parties to obtain primary data directly from respondents. The data collection techniques used are: observation, interviews, and documentation. The results of research and discussion: (1) The implementation of the functions of the Regional Development Planning Agency (BAPPEDA) in terms of Regional Regulation Number 09 of 2008 concerning the Organization and Work Procedures of the Regional Development Planning Agency, Inspectorate and Other Regional Technical Institutions of North Central Timor Regency in the process of regional development planning in North Central Tmor Regency is through Village/Village level Development Planning Deliberations, District Development Planning Deliberation, and finally the District Government Work Plan Development Planning Deliberation where the aspirations and proposals of the community are as a determination of the formation of the Regional Long-Term Development Plan (RPJPD), Regional Medium Term Development Plan (RPJMD) and then make a Regional Apparatus Work Plan (RKPD), as a strategy used by BAPPEDA for development programs in North Central Timor District. (2) Inhibiting factors in the implementation of the function of providing support for the implementation of local government in the field of development planning and the function of guidance and implementation of tasks in accordance with the scope of Bappeda's duties in North Central Timor Regency. There are several obstacle factors such as: Aspects of Geography and Domography related to human resources, aspects of community welfare, aspects of public services, and aspects of regional competitiveness.

Abstract

Based on the author's observations, the background to the main problem can be formulated as to what extent the conditions for implementing Village expansion and what are the influencing factors, the implementation of Village expansion is related to the expansion of Oenitas village, West Rote District, Rote Ndao Regency. The purpose of this research is to find out and analyze the implementation of village expansion and identify factors inhibiting the implementation of village expansion in Oenitas Village, West Rote Ndao Regency, Rote District. This research is based on primary, secondary, and tertiary data using an empirical juridical approach, and it was carried out using the Qualitative Descriptive Analysis Method in accordance with the data obtained while still paying attention to theories, principles, and legal rules in order to address this problem. The study's findings demonstrate that when implementing Village expansion, the Village requirements are in accordance with the stages, namely the requirements consist of population size, territorial boundaries, and infrastructure. the existence of tug-of-war interests between communities and the lack of natural resources, human resources (HR).

Abstract

This research aims (1) to find out the regulation of the authority of the Sabu Raijua Regency Government in dealing with drought, and (2) to find out the government's efforts in dealing with drought in Sabu Raijua Regency. and (3) to find out the factors that hinder government efforts in dealing with drought in Sabu Liae District, Sabu Raijua Regency. This research uses a normative juridical approach and is supported by empiricial juridicial research. Data collection techniques in this study are interview data collection, and literature study, and analyzing data descriptively and perspectively. The results of the study indicate that (1) Sabu Raijua Regency has the authority to set policies according to its territory, so it is necessary to set policies in dealing with drought, the policies needed to deal with drought include various elements that can help better manage water resources and reduce the impact of drought so that there is no clean water crisis, in this case it must include various initiatives and actions, depending on local conditions and problems faced. (2) Efforts made by the government in dealing with drought in Sabu Raijua Regency include: reforestation programs, extension programs, reservoir construction programs, and clean water distribution programs. (3) Factors that hinder government efforts in dealing with drought in Sabu Liae District, Sabu Raijua Regency include several factors, namely community legal awareness, cost factors, and facility factors. Based on the results of the research, it is hoped that the Sabu Raijua Regency government can be more reactive and proactive in making policies governing water resources by making local regulations on water resources in mitigating and adapting to climate change, including soil and water conservation programs.

Abstract

The purpose of this study is to analyze the legal position of the Minister of Ttriumvirat in the Constitutional system of the Republic of Indonesia. This research method is normative law (library research), this research examines legal materials, books, and laws and regulations that are closely related to the legal issues studied. The results showed that the legal position of the triumvirate minister as the executor of the Presidential duties in the constitutional system of the Republic of Indonesia is specifically regulated in the constitution of the Republic of Indonesia, namely contained in article 8 paragraph 3 and also in the hierarchy of laws and regulations in MPR Decree Number VII / MPR / 1973, precisely article 5 as the basis for legitimacy and recommendations in terms of filling the vacancy of the office of president and vice president. The basis for considering the Triumvirate Minister as the executor of Presidential duties if the president and / or vice president quits in the middle of his term of office is because they are considered to understand the course of government and have responsibility for foreign policy, domestic government, and national defense.

Abstract

This study examines the implementation of the legislative duties and functions of the House of Representatives of the Republic of Indonesia (DPR RI) during the 2019–2024 period. Legislative function, as stipulated in Article 20A of the 1945 Constitution of the Republic of Indonesia, constitutes one of the core and most influential functions of the DPR, enabling it to affect various aspects of national governance. However, in practice, this function has not been carried out optimally. Legislative performance is evaluated not only in terms of the quantity of legislation produced but also in the quality of the laws enacted. Using a normative juridical research method, grounded in positivist legal theory. The findings indicate that throughout the 2019–2024 period, the DPR’s legislative performance has fluctuated and remained suboptimal. Of the 256 bills included in the National Legislative Program (Prolegnas), only 63 were enacted into law. Several inhibiting factors were identified, including the competency of members, lengthy decision-making procedures, political party composition, and limited public participation. This study underscores the importance of enhancing the capacity of DPR members through regular training and education. Greater transparency in the legislative process is also crucial to maintaining public trust. Furthermore, streamlining bill deliberation mechanisms and fostering inter-factional dialogue are essential strategies to accelerate consensus and improve legislative outcomes.

Abstract

Street Children are one of the complex social problems in big cities in Indonesia The Kupang City Government has issued a policy through Kupang City Regional Regulation No. 8 of 2013 which regulates the Handling and Empowerment of Street Children, Vagrants, and Beggars in its area. The Social Service has not been fully effective in supporting social welfare. This can be seen from the problem of Street Children in Kupang City, where there are still many underage children who are often seen wandering the streets. They are involved in various activities, such as selling newspapers, snacks, and even begging to anyone who stops. The type of research used in this study uses empirical legal research where this research method functions to see the law in a real sense and examine how the law works in the community. The results of the research and discussion show that (1) the results of the research conducted at the Kupang City Social Service are related to the Duties and Responsibilities of the Social Service in providing social welfare services for street children. This refers to the Kupang City Regional Regulation Number 8 of 2013 concerning the Handling and Empowerment of Street Children. As the implementer, the Social Service has the authority to provide guidance and control to street children. In addition, the implementing agents involved also carry out their duties and functions in accordance with their roles as regional apparatus, ensuring that the coaching process runs in accordance with the responsibilities carried out. (2) Factors that hinder the city social services in providing services in the field of social welfare for street children in Kupang City include internal factors.

Abstract

This study analyzes the legal aspects in the application of the e-voting system in the election of village heads as a form of technological innovation in voting. With a normative legal approach, this research is based on relevant laws and regulations, including Law Number 6 of 2014 concerning Villages and its amendments in Law Number 3 of 2024. The results of the study show that the e-voting regulation is not explicitly contained in the law, but gives authority to local governments to design village head election policies, which is strengthened by the Constitutional Court Decision Number 147/PUU-VII/2009. In addition, the e-voting mechanism meets the principle of legality in the elections, emphasizes the principle of luberjurdil, and is in line with democratic values. The conclusion of this study emphasizes that the implementation of the election with the e-voting method can be applied by paying attention to the legal standards and cumulative requirements that have been set.

Abstract

Komite Olahraga Nasional Indonesia (KONI) adalah satu-satunya organisasi yang berwenang dan bertanggung jawab mengelola, membina, mengembangkan dan mengkoordinasikan seluruh pelaksanaan kegiatan olahraga prestasi setiap anggota di Indonesia. Akan tetapi, pengurus dari KONI tersebut merangkap jabatan dalam menjalani tugas sebagai ketua KONI dan tidak sesuai dengan Pasal 40 Undang-Undang Nomor 3 Tahun 2005 tentang Sistem Keolahragaan Nasional. Adapun rumusan masalah yakni : Bagaimana Independensi Jabatan dalam kepengurusan Komite Olahraga Nasional Indonesia di Nusa Tenggara Timur, Apa dampak rangkap jabatan dalam Kepengurusan Komite Olahraga Nasional Indonesia dan Apa faktor penghambat Independensi Jabatan Dalam Kepengurusan Komite Olahraga Nasional Indonesia Dalam penelitian ini penliti menggunakan metode penelitian normatif empiris, dimana yang dilakukan penelitian dengan menggunakan Metode Analisis Deskriptif Kualitatif sesuai dengan data yang diperoleh dengan tetap memperhatikan teori, asas dan kaidah hukum maka penelitian ini merupakan penelitian yang bersumber : pada data primer, sekunder maupun tersier dengan menggunakan pendekatan yuridis empiris. Hasil penelitian ini menunjukan bahwa Dalam menjalankan tugas dan fungsi Dispora khususnya dibidang olahraga tentunya kami punya program kerja untuk pembinaan olahraga. Salah satu program utama kami yakni Pembinaan dan Pemasyarakatan Olahraga dengan tujuan agar nantinya mampu meningkatkan prestasi olahraga khususnya cabang olahraga sepakbola di berbagai event dan tentunya sasaran kami yaitu event Porprov karna ini merupakan kegiatan rutin dari Pemprov, Pengawasan mempunyai perananan atau kedudukan yang penting sekali dalam sebuah manajemen organiasi, mengingat mempunyai fungsi untuk menguji apakah dalam pelaksanaan kegiatan tertib, terarah atau tidak. Apabila pelaksanaan kegiatan tidak terarah, maka tujuan yang dimaksud tidak akan tercapai seperti pembekuan organisasi, Penundaan Pendanaan Olahraga, dan Salah satu faktor pendukung terpenting dalam upaya mensukseskan program pembinaan prestasi olahraga khusunya olahraga sepakbola adalah tersedianya dana yang memadai. Berbagai sumber dana alternatif perlu digali dalam upaya memenuhi kebutuhan dana untuk pembinaan cabang olahraga prestasi seperti olahraga sepakbola. Pendanaan mempunyai peranan yang sangat penting bagi pembinaan olahraga sepakbola, cabang olahraga yang memiliki managemen Komunikasi organisasi cabor yang tidak baik, kepengurusan yang tidak baik, tata kelola program kerja yang terukur dan menghasilkan prestasi yang tidak baik dan ketidaksesuaian dengan target Koni Nusa Tenggara Timur dan Rangkap jabatan kepala daerah kini sedang hangat dibincangkan publik, lantaran saat ini dari kasus yang terjadi pada KONI Nusa Tenggara Timur.Kesimpulan dari penelitian diatas yakni : Independensi Jabatan dalam kepengurusan Komite Olahraga Nasional Indonesia di Nusa Tenggara Timur dalam lingkup keolahragaan akan berjalan kurang baik apabila terjadi hubungan kelakuan yang efektif antara organisasi yang bergerak dibidang yang sama dalam hal ini bidang olahraga sehingga tidak dapat bekerjasama secara efisien dan dengan demikian tugas-tugas dalam organisasi bisa tercapai tujuanya.

Abstract

This study aims to examine the implementation of the duties and functions of the National Land Agency (Badan Pertanahan Nasional/BPN) of Kupang Regency in the process of land certificate issuance for former East Timor communities in Tuapukan Village, East Kupang District, Kupang Regency, as well as to identify the factors that hinder its implementation. The background of this research is based on the ongoing land-related problems faced by former East Timor communities who have chosen Indonesian citizenship, particularly regarding legal certainty over land ownership. Land certification is a crucial instrument to ensure legal certainty, improve economic welfare, and support the social integration of former refugees. This research employs a normative legal research method with a juridical approach, focusing on the analysis of land-related laws and regulations, particularly Law Number 5 of 1960 on Basic Agrarian Principles, Government Regulation Number 24 of 1997 on Land Registration, and other relevant regulations. The findings indicate that the BPN of Kupang Regency has carried out its duties and functions in land certificate issuance through land registration procedures, measurement and mapping, collection of physical and juridical data, and issuance of land title certificates. However, several obstacles remain, including the lack of integrated commitment between central and local governments, limited technical support and professional capacity of human resources, low community participation, incomplete land ownership documents, and unclear legal status of disputed lands. These constraints have resulted in suboptimal legal certainty over land ownership for former East Timor communities in Tuapukan Village. This study concludes that strengthening inter-agency coordination, enhancing institutional capacity of the National Land Agency, and increasing public awareness and participation are essential to improve the effectiveness of land certification for former East Timor communities in order to ensure legal certainty and agrarian justice.
