Abstract

This research aims to examine the views of Shafi’i ulama regarding the concealment of objectivity in merchandise in the context of sharia economics, using an analysis method of the hadith ahkam on sharia economy. This study identifies the views of Shafi’i scholars on the practice of hiding relevant information in business transactions, as well as its theological and practical implications in the modern economic context. This study is library research. The data collection technique used is documentation. The analysis technique used is descriptive qualitative. This study analyses the relevant hadiths to provide an in-depth understanding of how the principles of Islamic economics can be applied in daily business practices. The findings of this research reinforce the importance of transparency, honesty, and objectivity in business transactions according to the views of Shafi’i scholars and provide a significant contribution to the development of contemporary sharia economics. Thus, this research provides valuable insights for business practitioners, academics, and policymakers in understanding Islamic principles in the context of the modern economy. Penelitian ini bertujuan untuk mengkaji pandangan ulama Syafi'i terkait dengan penyembunyian objektivitas pada barang dagangan dalam konteks ekonomi syariah, dengan menggunakan metode analisis terhadap hadis-hadis Ahkam ekonomi syariah. Kajian ini mengidentifikasi pandangan ulama Shafi'i terhadap praktik menyembunyikan informasi relevan dalam transaksi bisnis, serta implikasi teologis dan praktisnya dalam konteks ekonomi modern. Studi ini adalah penelitian pustaka. Teknik pengumpulan data yang digunakan adalah dokumentasi. Adapun teknik analisa yang digunakan adalah diskriptif kualitatif. Studi ini menganalisa hadis-hadis relevan memberikan pemahaman yang mendalam tentang bagaimana prinsip-prinsip ekonomi syariah dapat diaplikasikan dalam praktek bisnis sehari-hari. Temuan dari penelitian ini memperkuat pentingnya transparansi, kejujuran, dan objektivitas dalam transaksi bisnis menurut pandangan ulama Shafi'i, serta memberikan kontribusi yang signifikan dalam pengembangan ekonomi syariah kontemporer. Dengan demikian, penelitian ini memberikan wawasan yang berharga bagi praktisi bisnis, akademisi, dan pengambil kebijakan dalam memahami prinsip-prinsip Islam dalam konteks ekonomi modern.

Abstract

This literature aims to determine the mudharabah in banking in Indonesia. The results of the literature show that Murabahah is considered one of the products that is widely criticized by academics because in this scheme, there is no risk sharing between banks and customers. The absence of risk on the side of Islamic banking causes the risk to be fully borne by the customer, while Islamic banks are relatively safe from risk. The Mudharabah system is actually a promising alternative when compared to the interest system. This is because in the mudharabah system there is a principle of justice in it by positioning the owners of capital (rabb al mal) and entrepreneurs (mudharib) as partners. On the liability side, mudharabah is applied to: Time savings, ordinary deposits and special deposits, while on the asset side, mudharabah is set at: Working capital financing and special investments.

Abstract

This study aims to understand the practice of online marriage that can be integrated with the provisions stipulated in Islamic Family Law. In the growing digital age, the trend of online marriage is growing among the Muslim community. This has driven the need to adapt traditional wedding practices to digital technology. This research identifies and explores challenges in the integration between Islamic marriage practices and digital technologies. This research uses qualitative methodology with data collection through literature study and document analysis. The main results show that the integration of online marriage applications in Islamic Family Law is possible through specific adjustments to the provisions applicable to Islamic family law and the technology used, including digital identity verification and video conferencing for brides-to-be. As for prospective husbands, guardians, and witnesses are required to meet face to face offline in one assembly. The research also found that negotiating and recording dowries digitally can be done with transparency and in accordance with Islamic law. These results have significant implications for the practice of marriage in Islam, and show that with the right approach, technology can be a tool that enriches the practice of Islamic marriage, as well as enabling society to maintain traditions in this digital age. As such, the research contributes to an understanding of the adaptation of Islamic law in the digital age, and provides new insights into the potential and challenges of technological integration in Islamic marriage practice.

Abstract

The issue of a wife leaving her husband or vice versa before an official divorce is a critical topic in Islamic jurisprudence (fiqh), raising legal, ethical, and social concerns. This study examines the legal status of such separations through the lens of various schools of thought (madhhab), analyzing spousal rights and obligations in pre-divorce contexts. Employing a qualitative method, it draws from primary Islamic legal sources, as well as contemporary statutory frameworks in Muslim-majority countries. Findings reveal that Islamic law distinguishes between justified and unjustified separation. A wife who separates without valid reason may be deemed nusyuz, which affects her right to nafaqah (maintenance), while a husband remains responsible for financial obligations until the divorce is finalized. Conversely, if separation is due to harm, negligence, or abuse, mechanisms such as fasakh (annulment) or khulu' (divorce initiated by the wife) may be pursued under Islamic principles. These doctrines aim to protect the rights of both parties and prevent injustice in marital relationships. From the perspective of civil law, legal separation is not explicitly codified, but courts may provide temporary arrangements through mediation and judicial orders. Customary law often manages informal separations through community mediation and traditional consensus. In Indonesia, religious courts (peradilan agama) handle pre-divorce separations as part of divorce proceedings, emphasizing mediation and evaluating interim living arrangements, financial duties, and child custody. Beyond legal analysis, the study highlights broader social consequences: women and children are often left vulnerable during informal separations, while unresolved conflicts can fragment social harmony

Abstract

This study aims to identify the main obstacles faced by Istana IV Syariah Hotel in business development and to formulate appropriate solutions and strategic priorities. The study employed the Analytic Network Process (ANP) using Super Decisions software. Data were collected through pairwise comparison questionnaires administered to respondents consisting of sharia hotel experts and practitioners. The findings indicate that internal factors represent the primary challenge in developing the sharia hotel business, followed by external factors. Human resource issues and sharia hotel management emerged as the most significant internal constraints, while time-related factors and regulatory policies were identified as the main external challenges. The priority solutions emphasize strengthening internal capacity, particularly through improving human resources and management practices. The strategic priorities focus on enhancing competitiveness without engaging in price wars, targeting appropriate market segments, improving service quality and customer experience, strengthening partnerships with travel aggregators, and optimizing digital marketing through social media, email marketing, retargeting, and content development. These findings provide practical guidance for improving the competitiveness and sustainable development of sharia hotels in North Sumatra. Penelitian ini bertujuan untuk mengidentifikasi kendala utama yang dihadapi Hotel Istana IV Syariah dalam pengembangan usaha serta merumuskan solusi dan prioritas strategi yang tepat. Penelitian ini menggunakan metode Analytic Network Process (ANP) dengan bantuan perangkat lunak Super Decisions. Data diperoleh melalui kuesioner perbandingan berpasangan yang diberikan kepada responden yang terdiri atas pakar dan praktisi perhotelan syariah. Hasil penelitian menunjukkan bahwa faktor internal merupakan kendala utama dalam pengembangan bisnis hotel syariah, diikuti oleh faktor eksternal. Permasalahan sumber daya manusia dan manajemen hotel syariah menjadi kendala internal yang paling dominan, sedangkan keterbatasan waktu dan kebijakan regulasi merupakan kendala eksternal yang paling penting. Solusi yang diprioritaskan berfokus pada penguatan kapasitas internal, terutama melalui peningkatan kualitas sumber daya manusia dan pengelolaan hotel. Adapun strategi utama yang direkomendasikan meliputi peningkatan daya saing tanpa melakukan perang harga, penentuan segmen pasar yang tepat, peningkatan kualitas layanan dan pengalaman pelanggan, penguatan kerja sama dengan agregator perjalanan, serta optimalisasi pemasaran digital melalui media sosial, email marketing, retargeting, dan pengembangan konten. Temuan ini memberikan rekomendasi praktis bagi peningkatan daya saing dan pengembangan hotel syariah yang berkelanjutan di Provinsi Sumatera Utara.

Abstract

This study discusses the prohibition of receiving proceeds from sexual transactions in prostitution practices based on the perspective of the economic aḥkām hadith. Prostitution, as a form of sexual deviation and adultery, is not only seen as damaging to moral and social order, but also contrary to the principles of sharia economics which emphasize the permissibility and blessing of income sources. The focus of the study is to analyze authentic hadiths, especially those narrated by al-Bukhārī, Muslim, al-Bayhaqī, and Ibn Mājah, which explicitly prohibit mahr al-baghī (prostitutes' wages) as a form of illicit wealth. Using a qualitative method based on literature studies through the analysis of sanad, matan, and istinbāṭ law, this study finds that all forms of receiving wealth from prostitution activities are illegitimate according to sharia because they contradict the maqāṣid al-shari'ah, especially the protection of honor and offspring. The findings of this study confirm that income from prostitution cannot be considered halal (lawful) assets, cannot be used as an object of transaction, and has no economic blessings. Furthermore, the study identifies several challenges in the implementation of Islamic law regarding prostitution, such as weak legal socialization, lack of public understanding, and minimal social and economic policy intervention. This research contributes to strengthening the study of Islamic economics and provides a normative foundation for developing policies to combat prostitution based on Islamic values.

Abstract

IntroductionSharia-compliant hotels play an important role in supporting the development of halal tourism in Indonesia. However, their competitiveness remains challenged by conventional hotels that increasingly provide halal-friendly services, especially in regional destinations outside major tourism centers. In Padang Lawas Regency, North Sumatra, Sharia hotel management faces complex issues related to weak differentiation, limited facilities, uneven implementation of Islamic principles, underdeveloped human resource professionalism, and suboptimal digital marketing.ObjectivesThis study aims to analyze the management strategies of Sharia-compliant hotels in facing competition within the halal tourism industry from an Islamic economic perspective. It specifically examines marketing strategy, operational management, human resource management, digital marketing, and the implementation of maqāṣid al-sharī‘ah in hotel management.MethodThis study used a descriptive qualitative approach. Data were collected through semi-structured interviews, direct observation, and hotel documentation involving managers, key staff, and supporting personnel of Sharia-compliant hotels in Padang Lawas Regency, North Sumatra, Indonesia. The data were analyzed using the interactive model of data reduction, data display, and conclusion drawing. Data validity was strengthened through source triangulation, technique triangulation, and member checking.ResultsThe findings show that Sharia-compliant hotels have implemented Islamic values through halal food, prayer facilities, modest service norms, ethical communication, and guest regulations. However, these practices have not yet developed into an integrated competitive strategy. Marketing remains largely conventional, operational standards are inconsistent, human resource development is still informal, and digital marketing is not yet used strategically to strengthen halal brand image and consumer trust. The implementation of maqāṣid al-sharī‘ah is visible in basic religious service attributes but remains limited in broader dimensions such as employee welfare, business sustainability, transparent governance, and community benefit.ImplicationsThis study indicates that the competitiveness of Sharia-compliant hotels requires substantive differentiation, credible Sharia governance, professional human resources, stronger digital visibility, and maqāṣid-oriented management. Regional halal tourism development also requires collaboration among hotel managers, local government, religious authorities, communities, and digital platforms.Originality/NoveltyThis study contributes to halal tourism and Islamic economics literature by integrating strategic management, Islamic marketing, human resource management, digital marketing, Sharia governance, and maqāṣid al-sharī‘ah into one analytical framework for Sharia hotel competitiveness in a regional Indonesian context.
