Abstract

The technological revolution is now entering the fourth wave called the industrial revolution 4.0. Industry 4.0 is a technological revolution that gave birth to digital technology. The business world is undergoing a major transformation where most of the production processes shift from conventional technology to digital technology. Industry 4.0 transformation also provides benefits for industrial companies by increasing efficiency, improving machine and equipment performance, increasing the speed of production operations and product quality. The acceleration of digital transformation is a must to improve the manufacturing industry sector. Efforts to accelerate the transformation of industry 4.0 are to increase awareness and assist the industry in transforming. The formulation of the problem in this study is (1) how to develop Human Resources for innovation, in order to achieve organizational performance to meet the Industrial Revolution 4.0 in the legal field? (2) How has the acceleration of digital transformation become imperative to improve the manufacturing industry sector? The method research used is normative and descriptive. Abstract

The government needs to develop a franchise business in order to expand job opportunities, for that the government creates efforts to protect franchisees and franchisors so that the government issues government regulation no. 42 of 2007 concerning franchise business (Franchise). However, the reality is that there are still many franchises that do not fulfill their obligations to franchisors, such as some franchises that do not carry out SOPs (Standard Operating Procedures) with initial provisions. The problems raised in this study are about how the legal protection for the parties concerned in the franchise agreement, namely the franchisor and the franchisee and the forms of rights and obligations between the franchisor and the Fremilt product franchise, Pasar Kliwon Surakarta branch. This type of research uses empirical research, namely individual research related to social life, in this study the researcher tries to uncover legal protection for franchisees and franchisors of Fremilt products, Pasar Kliwon Surakarta branch. This research is taken from many facts in society. Based on the research, it was found that there is legal protection for franchisees and franchisors so that the taste of the product will be maintained its authenticity and between the two parties can run the SOP in accordance with the provisions of the agreement at the beginning. In addition, the franchisee and the franchisor will feel protected and will get a guarantee of certainty if something goes wrong that harms both parties

Abstract

Pengaduan melalui Aplikasi Portal Perlindungan Konsumen (APPK) terdapat 11.195 pengaduan dan dari jumlah itu, sebanyak 1.320 pengaduan diproses ke LAPS SJK. Berdasarkan Pasal 6 POJK Nomor 61 Tahun 2020 tentang Lembaga Alternatif Penyelesaian Sengketa Sektor Jasa Keuangan (LAPS SJK), sengketa adalah perselisihan antara konsumen dengan Pelaku Usaha Jasa Keuangan (PUJK) yang ada kerugian dan/atau kerugian materiil, wajar secara langsung pada konsumen karena PUJK tidak memenuhi perjanjian dan/atau dokumen transaksi keuangan yang telah disepakati. Secara rinci sengketa fintech 12,01%, pembiayaan modal kerja 7,79%, kartu kredit 6,82%, pembiayaan kendaraan bermotor 6,17%, dan tabungan 5,19%. Tujuan Penelitian ini adalah untuk mendeskripsikan problematika hukum bagi pengguna layanan fintech lending Syariah dan perlindungan hukumnya di Indonesia. metode penelitian hukum normatif untuk menemukan suatu aturan hukum, prinsip-prinsip hukum, maupun doktrin-doktrin hukum guna menjawab isu hukum yang dihadapi. Pendekatan yang digunakan dalam penulisan artikel ini adalah pendekatan undang-undang (statute approach) dilakukan dengan menelaah semua undang-undang regulasi yang bersangkutan paut dengan permasalahan yang sedang ditangani. Pendekatan Perundang-undangan adalah pendekatan dengan menggunakan legilasi dan regulasi. Pendekatan perundang-undangan difokuskan pada ketentuan mengenai rechterlijk pardon (permaafan hakim) dalam peraturan perundang-undangan hukum pidana yang berlaku. Teknik analisis bahan hukum yang digunakan ialah metode deduktif. Penggunaan metode deduksi ini berpangkal dari pengajuan premis mayor, kemudian diajukan premis minor. Lalu, dari kedua premis tersebut ditarik suatu kesimpulan. Hasil Penelitian ini problematika hukum diantaranya pelanggaran hukum dalam kegiatan bisnisnya seperti kecurangan, penipuan dan pencurian data pribadi. Kejahatan fintech syariah jika ditinjau dari perspektif hukum jinayah masuk kedalam konsep ta’zir. Suatu pelanggaran yang tidak termasuk dalam konsep hudud, qishas dan diyat maka dinyatakan masuk kedalam konsep ta’zir. Perlindungan hukum terhadap pengguna layanan fintech Syariah atas sengketa dan kejahatan fintech syariah dapat dikenai sanksi ta’zir. Dalam menentukan sanksi ta’zir diserahkan kepada Ulil Amri kepada pelaku kejahatan fintech syariah dengan mempertimbangkan nilai-nilai kemaslahatan. Dengan demikian Jika terjadi kejahatan fintceh syariah maka, penegakan hukumnya sesuai dengan perundang-undangan yang sudah ada dengan seadil-adilnya dan dilakukan tanpa pandang bulu serta disiplin bahwa benar-benar melakukan sanki ta’zir kepada tindak kejahatan fintech Syariah.

Abstract

Mindring is a business carried out by someone who sells goods using an installment payment system. In the mindring activity itself, it is actually very necessary to have a written agreement between the business actor and the buyer to provide legal certainty to the parties. The method used in carrying out the service is by presenting the material through a lecture, after completing the presentation of the material there is a discussion and question and answer session. Based on the results of the service we carried out, it shows that the implementation of credit for goods (mindring) in villages is still widely carried out by mothers in order to meet the need for household furniture, this is done because the payment system can be done online. However, the problem is that this agreement still uses an oral agreement, where if one day there is fraud or default, one of the aggrieved parties cannot have strong evidence for court proceedings. Therefore, this community service can help residents in the process of crediting goods by making written agreements.
