Abstract

Perkembangan media sosial telah secara fundamental mengubah dinamika komunikasi publik, memungkinkan warga negara untuk berpartisipasi aktif dalam wacana demokrasi melalui kritik terhadap kebijakan pemerintah dan pejabat publik. Namun, perkembangan ini juga telah mengintensifkan perdebatan hukum mengenai kriminalisasi kritik publik, khususnya di bawah UU ITE (UU Teknologi Informasi dan Transaksi Elektronik) Indonesia, yang sering dikritik karena ketentuan-ketentuannya yang luas dan ambigu tentang pencemaran nama baik dan penghinaan. Studi ini meneliti implikasi Putusan Mahkamah Konstitusional No. 105/PUU-XXII/2024 dalam mengatasi ketegangan antara kebebasan berekspresi dan tanggung jawab pidana dalam kasus kritik publik di media sosial. Dengan menggunakan metode penelitian hukum normatif, studi ini menganalisis peraturan perundang-undangan, ketentuan konstitusi, dan doktrin hukum yang relevan, serta penalaran yudisial dari Mahkamah Konstitusional. Temuan menunjukkan bahwa Mahkamah memperkuat perlindungan konstitusional terhadap kritik publik sebagai bagian dari partisipasi demokratis, sekaligus menegaskan bahwa perlindungan tersebut tidak mencakup ekspresi yang merupakan kebohongan yang jahat atau serangan yang tidak beralasan terhadap reputasi individu. Keputusan tersebut mempersempit ruang lingkup interpretasi ketentuan pencemaran nama baik pidana dan menekankan proporsionalitas dalam penerapan hukum pidana. Meskipun demikian, tantangan tetap ada dalam praktik hukum karena interpretasi dan penegakan yang tidak konsisten, yang terus menciptakan ketidakpastian hukum dan potensi efek penghambatan terhadap kebebasan berekspresi. Studi ini menyimpulkan bahwa meskipun keputusan tersebut merupakan langkah signifikan menuju penguatan perlindungan konstitusional, klarifikasi legislatif dan doktrinal lebih lanjut diperlukan untuk memastikan perlindungan yang konsisten terhadap kebebasan berekspresi di ruang digital.

Abstract

Konflik sosial tetap menjadi tantangan yang signifikan dalam masyarakat pluralistik, memerlukan kerangka hukum yang komprehensif untuk memastikan pencegahan, penyelesaian, dan pembangunan perdamaian yang berkelanjutan. Studi ini bertujuan untuk menganalisis pencegahan dan pengelolaan konflik sosial berdasarkan Undang-Undang Nomor 7 Tahun 2012 tentang Pengelolaan Konflik Sosial melalui pendekatan yuridis normatif. Penelitian ini mengkaji ketentuan undang-undang, prinsip hukum, dan mekanisme kelembagaan yang mengatur pencegahan konflik, penyelesaian, dan pemulihan pasca-konflik di Indonesia. Bahan-bahan hukum dianalisis menggunakan metode interpretasi undang-undang, konseptual, dan sistematis untuk mengevaluasi koherensi dan efektivitas kerangka regulasi. Temuan menunjukkan bahwa undang-undang menekankan deteksi dini, partisipasi masyarakat, koordinasi antarlembaga, dan perlindungan hak asasi manusia sebagai unsur fundamental pencegahan konflik. Selain itu, undang-undang menyediakan mekanisme terstruktur untuk mediasi, penegakan hukum, dan rehabilitasi sosial guna menangani konflik secara komprehensif. Namun, tantangan tetap ada dalam hal koordinasi institusional, harmonisasi hukum, dan implementasi yang konsisten di tingkat regional. Studi ini menyoroti pentingnya memperkuat kejelasan hukum, meningkatkan tata kelola kolaboratif, dan mengembangkan strategi adaptif untuk merespons dinamika sosial yang terus berkembang. Analisis yuridis normatif ini berkontribusi pada pemahaman yang lebih dalam tentang bagaimana kerangka hukum dapat berfungsi sebagai alat untuk menjaga stabilitas sosial dan mempromosikan pengelolaan konflik yang berkelanjutan di Indonesia.

Abstract

Budidaya hidroponik telah muncul sebagai teknologi pertanian alternatif untuk mengatasi keterbatasan lahan, masalah efisiensi sumber daya, serta meningkatnya permintaan akan sayuran berkualitas tinggi. Namun, keberhasilan produksi selada hidroponik sangat bergantung pada praktik manajemen budidaya, khususnya intensitas penyiraman dan pemilihan media tanam. Penelitian ini bertujuan untuk mengkaji pengaruh intensitas penyiraman dan media tanam terhadap pertumbuhan selada hidroponik di Malang. Penelitian ini menggunakan pendekatan kuantitatif dengan melibatkan 65 petani selada hidroponik sebagai responden. Data dikumpulkan melalui kuesioner terstruktur dengan skala Likert lima poin dan dianalisis menggunakan SPSS versi 25 melalui analisis deskriptif, uji validitas dan reliabilitas, uji asumsi klasik, analisis regresi linear berganda, uji-t, uji-F, serta analisis koefisien determinasi. Hasil penelitian menunjukkan bahwa intensitas penyiraman berpengaruh positif dan signifikan terhadap pertumbuhan selada hidroponik. Selain itu, media tanam juga menunjukkan pengaruh positif dan signifikan terhadap pertumbuhan selada. Hasil pengujian secara simultan mengonfirmasi bahwa intensitas penyiraman dan media tanam berpengaruh signifikan terhadap pertumbuhan selada hidroponik. Nilai koefisien determinasi (R²) sebesar 0,554 menunjukkan bahwa kedua variabel independen tersebut menjelaskan 55,4% variasi dalam pertumbuhan selada hidroponik. Temuan ini menunjukkan bahwa manajemen irigasi yang efektif dan pemilihan media tanam yang tepat merupakan faktor penting untuk meningkatkan produktivitas selada hidroponik. Penelitian ini memberikan implikasi praktis bagi petani hidroponik di Malang dengan menekankan pentingnya manajemen budidaya terpadu untuk mencapai produksi sayuran yang berkelanjutan dan efisien.

Abstract

Penelitian ini mengkaji peran inovasi produk dalam meningkatkan keunggulan kompetitif di kalangan Usaha Mikro, Kecil, dan Menengah (UMKM) di sektor kuliner. Dengan pendekatan kuantitatif, data dikumpulkan dari 100 pemilik dan manajer UMKM kuliner melalui kuesioner terstruktur yang menggunakan skala Likert lima poin. Data dianalisis menggunakan SPSS Versi 25, termasuk statistik deskriptif, uji reliabilitas dan validitas, korelasi, dan analisis regresi. Temuan menunjukkan bahwa inovasi produk memiliki efek positif yang signifikan terhadap keunggulan kompetitif, menunjukkan bahwa MSMEs yang secara aktif memperkenalkan produk baru, meningkatkan penawaran yang ada, dan merespons secara kreatif preferensi pelanggan mencapai posisi pasar yang lebih kuat dan pertumbuhan bisnis yang berkelanjutan. Studi ini menyoroti pentingnya inovasi produk yang berkelanjutan sebagai alat strategis untuk keunggulan kompetitif dan keberlanjutan jangka panjang di sektor kuliner.

Abstract

The rapid growth of equity crowdfunding in Indonesia has introduced new opportunities for public participation in investment activities while simultaneously creating challenges related to information uncertainty, investor vulnerability, and trust formation. Unlike conventional investment markets, equity crowdfunding involves greater information asymmetry because investors often evaluate privately held businesses with limited operational history and incomplete information. Therefore, mechanisms that enhance information transparency and investor protection are essential to strengthening investor confidence and supporting rational investment decisions. This study aims to examine the influence of information transparency and investor protection on investment decision-making through the mediating role of investor trust in the context of equity crowdfunding in Indonesia. This research employs a quantitative approach using survey data collected from 100 equity crowdfunding investors in Indonesia. Data were gathered through a structured questionnaire using a five-point Likert scale and analyzed using Partial Least Squares Structural Equation Modeling (PLS-SEM) with SmartPLS 3. The results indicate that information transparency has a positive and significant effect on investor trust, while investor protection demonstrates a stronger positive influence on investor trust. Furthermore, investor trust significantly affects investment decision-making. Information transparency and investor protection also directly influence investment decision-making, with investor trust partially mediating these relationships. The findings demonstrate that transparent information disclosure and effective protection mechanisms are critical factors in reducing uncertainty, strengthening investor confidence, and encouraging participation in equity crowdfunding markets. This study contributes to the fintech and investment behavior literature by highlighting the importance of governance mechanisms in developing a trustworthy and sustainable equity crowdfunding ecosystem in emerging markets such as Indonesia.

Abstract

This study examines the protection of Indigenous Peoples’ land rights within the framework of agrarian reform policy through a normative and implementational legal analysis. The research aims to analyze the extent to which existing legal frameworks recognize and protect Indigenous land rights, identify inconsistencies within regulatory structures, and evaluate the effectiveness of their implementation in practice. Employing a normative juridical approach, this study analyzes constitutional provisions, statutory regulations, and relevant legal doctrines, complemented by a qualitative assessment of implementation challenges. The findings reveal that although Indigenous land rights are formally recognized in the legal system, such recognition remains conditional and fragmented across sectoral regulations. Overlapping authorities between land, forestry, and other resource-related laws create legal uncertainty and hinder the effective protection of customary land. Furthermore, the implementation of agrarian reform policies often fails to accommodate the collective nature of Indigenous land tenure, resulting in the marginalization of Indigenous communities. Bureaucratic complexities, limited institutional coordination, and weak enforcement mechanisms further exacerbate these challenges, leading to persistent land conflicts and dispossession. This study highlights a significant gap between normative legal guarantees and practical realities. It emphasizes the need for a more integrative and responsive legal framework that harmonizes regulations, strengthens the recognition of customary land rights, and ensures meaningful participation of Indigenous Peoples in agrarian reform processes. By bridging normative analysis with implementation perspectives, this research contributes to the development of more equitable and inclusive land governance systems that uphold Indigenous rights and promote social justice.

Abstract

This study analyzes corporate liability for environmental crimes within industrial supply chains in Indonesia through a normative legal approach integrating criminal and administrative law perspectives. The research examines the adequacy of the existing legal framework, particularly Law No. 32 of 2009 on Environmental Protection and Management, in addressing corporate accountability for environmental harm. By applying statutory, conceptual, and case approaches, this study identifies key challenges in enforcement, including difficulties in proving corporate intent, fragmentation of responsibility within supply chains, and the predominance of administrative sanctions over criminal prosecution. The findings indicate that although Indonesian law formally recognizes corporate criminal liability and incorporates strict liability principles, practical implementation remains limited due to evidentiary constraints, institutional weaknesses, and regulatory gaps. Furthermore, the complexity of industrial supply chains enables corporations to diffuse responsibility through subcontracting and outsourcing practices. This study proposes an integrated liability model that strengthens coordination between criminal and administrative enforcement, expands corporate responsibility across supply chains, and enhances the deterrent effect of sanctions. The study contributes to legal scholarship by offering a holistic framework for corporate environmental accountability and provides policy recommendations to support sustainable industrial governance in Indonesia.

Abstract

The enactment of Law No. 1 of 2023 concerning the Indonesian Criminal Code marks a significant transformation in Indonesia’s criminal justice system by introducing probation and community service as principal non-custodial sanctions. These forms of punishment reflect a shift from a predominantly retributive approach toward a more rehabilitative, proportional, and restorative-oriented sentencing policy. This study aims to analyze the legal construction of probation and community service under Law No. 1 of 2023 and to assess their consistency with the principles of restorative justice. The research applies a normative legal method using statutory, conceptual, and comparative approaches. The legal materials consist of Law No. 1 of 2023, Law No. 22 of 2022 concerning Corrections, relevant international instruments, and scholarly literature on restorative justice and non-custodial sanctions. The materials are analyzed qualitatively through descriptive, systematic, and prescriptive legal interpretation. The findings show that probation and community service provide progressive alternatives to short-term imprisonment by supporting offender rehabilitation, maintaining family and employment relationships, reducing prison overcrowding, and encouraging accountability through supervision and socially beneficial work. However, these sanctions do not fully constitute restorative justice mechanisms because victim participation, mediation, restitution, and reconciliation remain limited. Their effectiveness depends on comprehensive implementing regulations, institutional readiness, judicial consistency, qualified supervisory personnel, inter-agency coordination, and community involvement. The study concludes that Law No. 1 of 2023 establishes an important normative foundation for restorative-oriented sentencing in Indonesia, although further institutional and procedural development is required to ensure that probation and community service effectively achieve justice, legal certainty, social benefit, and public protection.

Abstract

The rapid expansion of social media has significantly transformed the way individuals access, consume, and disseminate information. While these platforms facilitate communication and knowledge sharing, they also accelerate the spread of anti-religious disinformation, which may contribute to religious intolerance, social polarization, and conflict in multicultural societies such as Indonesia. This study aims to examine the influence of religiosity and digital literacy on the behavior of spreading anti-religious disinformation among social media users in Indonesia. A quantitative cross-sectional research design was employed involving 150 active social media users selected through purposive sampling. Data were collected using a structured questionnaire measured on a five-point Likert scale and analyzed using IBM SPSS Statistics version 25. The analytical procedures included descriptive statistics, validity and reliability tests, classical assumption tests, multiple linear regression analysis, t-tests, F-tests, and the coefficient of determination (R²). Based on the simulated findings, religiosity had a significant negative influence on the behavior of spreading anti-religious disinformation, indicating that individuals with stronger religious values tend to communicate more ethically and responsibly in digital environments. Digital literacy also exhibited a significant negative effect and emerged as the strongest predictor, suggesting that individuals with better critical evaluation and information verification skills are less likely to disseminate misleading religious content. Simultaneously, religiosity and digital literacy significantly influenced anti-religious disinformation-sharing behavior, explaining 38.9% of the variance in the dependent variable (R² = 0.389). The findings highlight the complementary roles of ethical religious values and digital competencies in reducing harmful online behavior. The study recommends strengthening integrated programs that combine digital literacy education with inclusive religious values to promote responsible social media use and enhance resilience against anti-religious disinformation in Indonesia.
