Abstract

This paper provides input on where Tahkim or arbitration which is a form of dispute resolution outside the court and aims to reconcile the conflicting parties has existed and has long been practiced in the customs and culture of the Indonesian nation. However, with the increasing need for a peace model to resolve conflicts amid the rapid development of sharia business in Indonesia today, it is necessary to formulate a sharia tahkim model that accommodates local values. The fiqh rules clearly state that al-hukmuyadurruma’aillatihi wujudan waadaman, that the law is enforced according to ilat whether it exists or does not exist, as well as the taghayyural-ahkam bitaghayural amkinat waal-azman rule that the law changes according to changes in place and time. The type of this research is juridical philosophical with maslahah approach. The data sources used are secondary and consist of three legal materials: primary, secondary, and tertiary. The data sources used are secondary data sources consisting of three legal materials, namely primary, secondary and tertiary. The analysis was carried out using a descriptive inductive technique. The results of this study are that several ijtihad methods such as istihsan, maslahah mursalah, and especially the technique of establishing law with 'urf can be used to realize Indonesian Tahkim fiqh. The selection of these three methods, especially the 'urf which is based on benefit and istihsan is very suitable for conditions in Indonesia, considering that a culture of peace rooted in adat is still very strong.

Abstract

One of the work programs of class 56 KKN students group 22 UIN K.H. Abdurrahman Wahid Pekalongan is increasing the selling value of MSME products in Keseirejo Village through halal certification and digital marketing. The targets for this activity are MSMEs who produce processed food and beverage products. This research includes objectives that contribute to the development of MSMEs so they are able to compete in an increasingly competitive market. The method used in this research is a survey to collect data from a number of MSMEs on a wider scale and direct dissemination of explanations. Observations in this research were carried out directly by visiting and observing the operational conditions of MSMEs. The results of the research show that halal certification and labeling is a form of reform in the food and public consumption sector. Halal certification and digital marketing can improve the people's economy.

Abstract

The present study aims to explore the depth of conflict of legal norms between the Sharia Economic Law Compilation (KHES), Financial Authority Services (OJK) regulations, and the National Sharia Board of the Indonesian Ulema Council (DSN-MUI) fatwas, investigate the causes of this normative divergence, and explore harmonization strategies to create legal certainty for Sharia financial institutions in Indonesia. Designed with normative legal research methodology, this study garnered data through literature review and analyzes it using interpretation method. Study findings demonstrate that there are eighteen different norms in the three regulations, with some differences resulting in conflict. The causes of these conflicts vary, including the use of ambiguous terms, adoption of conventional definitions, errors in translation of terms, and inconsistencies in concept development. In addition, the concurrent application of rules, differences in terminology, time gaps in issuance, and overlapping authorities also contribute to disharmony. This research contributes by offering a comprehensive solution, which includes identifying the sources of disharmony, harmonizing concepts and definitions, and applying legal interpretation and construction methods. This approach addresses the discrepancies and create a harmonious normative balance in policy and regulation. The implications of this research are very significant for Sharia financial institutions in Indonesia, as it identifies conflicts of legal norms between KHES, OJK regulations, and DSN-MUI fatwas and explores harmonization strategies

Abstract

Tugas utama kepala desa berdasarkan pasal 26 ayat 1 Undang-Undang Nomor 6 tahun 2014 tentang desa diantaranya yaitu melaksanakan pembinaan masyarakat, dalam hal apakah pembinaan masyarakat telah dilaksanakan oleh kepala desa Karangrejo Kecamatan Kesesi, dibutuhkan penelitian langsung kedesa tersebut. Oleh karena itu, tujuan penelitian ini untuk mengetahui bagaimana efektivitas pelaksanaan kewenangan kepala desa dalam pembinaan masyarakat sebagaimana tertuang dalam Undang-Undang Nomor 16 Tahun 2014 tentang desa, serta implikasi dalam hal Kepala Desa Karangrejo Kecamatan Kesesi tidak melaksanakan kewenangannya. kata kunci: desa, efektifitas, pembinaan

Abstract

Pemerintahan desa merupakan salah satu pelaksana kebijakan dari pemerintah pusat, oleh karena itu pemerintahan desa harus melaksanakan penyelenggaraan pemerintahan secara baik sesuai dengan apa yang diatur didalam Undang-Undang Nomor 6 Tahun 2014 tentang desa, serta peraturan lain yakni Undang-Undang Nomor 30 Tahun 2014 Tentang Administrasi Pemerintahan. Desa merupakan kesatuan masyarakat hukum yeng memiliki kewenagan untuk mengurus urusan pemerintahan berdasarkan hak asal usul, dan hak tradisional yang diakui. Atas dasar tersebut menjadi keterkaitan bagi penulis untuk mengetahui bagaimana pelaksanaan prinsip good governance di desa warungasem kabupaten batang dan faktor apa saja yang mendukung dan menghambat pelaksanaan good governance di desa warungasem kabupaten batang. Dari hasil penelitian ditemukan bahwa Pelaksanaan Prinsip Good Governance di Desa Warungasem, Kabupaten Batang, belum dilaksanakan secara maksimal. Karena tidak seluruh asas-asas dalam penyelenggaraan pemerintahan yang baik dapat diimplementasikan. Selanjutnya faktor pendukung pelaksanaan prinsip good governance yaitu adanya partisipasi masyarakat, transparansi dalam penyelenggaraan pemerintahan desa dan kebijakan yang mensupport kegiatan di Desa. Sedangkan faktor penghambatnya yaitu adanya penyelewengan wewenang yang dilakukan oleh oknum perangkat desa serta ketidakdisiplinan dari perangkat desa. Dalam pandangan islam rasulullah SAW telah memberikan 5 prinsip yang harus dimiliki pemimpin yaitu sidig, amanah, tabligh, fathanah. Namun perangkat desa warungasem kabupaten batang belum bisa mewujudkan atau meneladani sifat sidig dan amanah yang sudah diajarkan rasulullah SAW. Kata kunci: Desa, Pemerintah, Good Governance

Abstract

Indonesian migrant workers (PMI) are an important part of contributing to the country's economic development. However, the constitutional rights of migrant workers are often neglected and adequate legal protection is often not met. Brebes Regency, as one of the areas that sends many migrant workers, requires strong guarantees to protect the constitutional rights of migrant workers. The research aims to determine the form of constitutional rights to legal protection in Brebes Regency and the Brebes Regency Government's efforts to provide constitutional rights in the form of legal protection to migrant workers. This research is empirical juridical research with a conceptual and statutory approach. The research results show that First ; There are four factors that cause why migrant workers have not maximally received their constitutional rights to legal protection in Brebes Regency, namely : There are no special regional regulations in Brebes Regency, there is no complete database of workers in Brebes Regency, lack of budget, there is no Unit Team. Duties (Task Force) in Brebes Regency. Second: There are various efforts made by the Brebes Regency Government to provide constitutional rights in the form of legal protection to migrant workers, such as: The Brebes Regency Government is trying as quickly as possible to create or ratify the latest Regional Regulations. Propose a budget to support legal protection. Immediately create a task force team to provide legal protection for Indonesian migrant workers in Brebes Regency, trying to improve services to increase legal protection in Brebes Regency.

Abstract

This study aims to analyze Government Regulation Number 39 of 2021 concerning implementing the Halal Product Assurance Sector with the principle of maslahah. With a normative legal research method through a statutory and conceptual approach. The results of the study show that the articles that have drawn criticism are in article 39. Halal Auditors are limited to being registered with only one Halal Inspection Institution. This shows that there is maslahah khassah, namely that Halal Auditors only provide specific benefits for one LPH or it can be said that there is still an element of harm because it still limits the profession of other Halal Auditors. Article 81, regarding free halal certification financing facilities for business actors, the policy of providing free certification facilities for business actors, makes BPJPH have a limited role in the halal certification process, because the halal certification process is required through a halal product companion. Article 150, regarding the imposition of sanctions that violate articles 93 and 94. Business actors who produce non-halal products are required to include a non-halal statement on their products. However, BPJPH is not given full authority to impose heavy administrative sanctions on business actors, which also has the potential to cause harm.

Abstract

The implementation of the guarantee of products that have been halal certified is a mandate from the Halal Product Guarantee Law. However, in reality, the technical implementation of periodic supervision of products that have been halal certified has not been specifically regulated in laws and regulations. Therefore, the principle of legal certainty that should be reflected in every regulation is suspected of not being optimally implemented in regulations that guarantee the halalness of halal certified products. This study aims to analyze legal instruments related to halal product guarantees in Indonesia, as well as to examine the legal implications that arise due to legal uncertainty in the technical regulation of supervision of halal certified products. The type of normative legal research with a statutory approach and a conceptual approach. The legal material analysis technique is carried out qualitatively by examining and interpreting laws and regulations, legal doctrines, and the results of theoretical studies to obtain systematic and logical legal arguments related to the regulation of guarantees and supervision of halal products in Indonesia. The results of the study show that halal product guarantee regulations in Indonesia still do not fully reflect the principle of legal certainty, especially regarding post-certification supervision mechanisms. The absence of technical regulations governing the implementation of such supervision has the potential to create legal loopholes and uncertainty in consumer protection and strengthening the halal product guarantee system.

Abstract

The COVID-19 pandemic has exerted profound effects on the socio-economic landscape of the Indonesian populace, giving rise to vulnerable social segments. Throughout this period, BAZNAS, LAZISNU, and LAZISMU have overseen and allocated philanthropic resources from the Indonesian Muslim community for the mitigation of COVID-19-related challenges. The objective of this study is to address the inquiry regarding the allocation of funds for managing COVID-19 through a maṣlaḥah perspective, utilizing data sourced from documents of the three Amil institutions and insights gathered from interviews. The investigation reveals a congruence between BAZNAS and LAZISNU in their fund distribution practices, both demonstrating a concerted endeavor to leverage Islamic philanthropy for the establishment of social networks. Conversely, LAZISMU places greater emphasis on establishing a social health system amidst the pandemic, as evidenced by health programs being accorded second priority after social humanitarian initiatives. Nevertheless, a comprehensive conclusion may be drawn that all three institutions prioritize health and humanitarian concerns as focal points in the distribution of zakat, infaq, and alms within the context of the pandemic. From the standpoint of the maṣlaḥah theory, the prioritization rationale indicates that the allocation of Zakat, Infaq, and Alms funds is predominantly rooted in maṣlaḥah 'urfiyyah (or maṣlaḥah mulghah ghair mu'tabarah) rather than maṣlaḥah syar'iyyah.

Abstract

Penelitian ini bertujuan untuk menjelaskan konflik norma dalam kedua dasar hukum tersebut, khususnya dalam ketentuan akad ijarah, dalam hal penetapan biaya pemeliharaan ma’jur dan apa akibat hukum dari terjadinya konflik norma tersebut. Jenis penelitian ini adalah penelitian hukum normatif dengan menggunakan pendekatan konseptual dan analitis yang menggunakan bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa terjadi konflik norma dalam penetapan biaya pemeliharaan ma’jur pada akad ijarah, dimana dalam KHES mengatur bahwa pemeliharaan ma’jur (objek ijarah) menjadi tanggung jawab dari musta’jir (penyewa), sedangkan di dalam Fatwa DSN-MUI menetapkan sebaliknya bahwa Lembaga Keuangan Syariah yang wajib menanggung biaya pemeliharaan objek ijarah. Adapun akibat hukum adanya konflik norma tersebut yaitu menjadikan ketidakkepastian hukum dalam hal penetapan biaya pemeliharaan ma’jur yang dapat berakibat menambah potensi terjadinya sengketa di Lembaga Keuangan Syariah. Kontribusi keilmuan dari penelitian ini adalah memberikan pemahaman kritis terhadap konflik norma dalam hukum ekonomi syariah di Indonesia serta urgensi harmonisasi antara KHES dan Fatwa DSN-MUI untuk mewujudkan kepastian hukum dalam praktik akad ijarah.
