Abstract

Penerapan hukum adat dalam pengelolaan sumber daya alam telah menjadi subjek penting dalam upaya pembangunan berkelanjutan. Peluang yang kiranya sangat berkaitan dengan penerapan hukum adat mencakup peningkatan pelestarian lingkungan, pemeliharaan keanekaragaman hayati, dan pemberdayaan masyarakat lokal. Hukum adat juga memberikan landasan bagi praktik-praktik pengelolaan yang berkelanjutan, memungkinkan adaptasi terhadap perubahan lingkungan, dan mempromosikan ketahanan lokal. Namun, penerapan hukum adat juga dihadapkan pada sejumlah tantangan. Sehingga penelitian ini bertujuan untuk mengetahui bagaimana seharusnya masyarakat adat mendapatkan perlindungan hak terhadap tantangan utama sulitnya mendapatkan pengakuan dan perlindungan hukum terhadap Hutan Adat sebagai sumber daya alam di Kalimantan Tengah menurut perspektif hukum adat. Menurut hasil penelitian, konflik kepentingan antara masyarakat adat dan pihak-pihak lainnya seperti pemerintah, serta ketidaksesuaian dengan kerangka hukum nasional menjadi pemicu permasalahan antara Masyarakat adat dan pemerintah. Dalam konteks pembangunan berkelanjutan, pemerintah seharusnya memegang kepentingan untuk memperkuat pengakuan dan perlindungan hukum terhadap hukum adat, serta memperkuat keterkaitan antara hukum adat dan hukum formal. Langkah-langkah tersebut dapat menciptakan kerangka kerja yang inklusif dan berkelanjutan bagi pengelolaan sumber daya alam, yang menghargai pengetahuan lokal, mendorong partisipasi masyarakat, dan memperkuat resiliensi ekosistem dalam rangka pengelolaan dan pemanfaatn hutan adat sebagai Upaya Pembangunan Berkelanjutan.

Abstract

Artikel ini mengkaji peran kearifan lokal dalam pembentukan Peraturan Daerah (Perda) melalui perspektif Sociological Jurisprudence dengan berfokus pada pemikiran Roscoe Pound, khususnya konsep law as a tool of social engineering. Dengan menggunakan pendekatan konseptual, penelitian ini menelaah doktrin, asas, dan konsep hukum yang relevan untuk menjelaskan bagaimana nilai lokal berfungsi sebagai landasan sosial dalam proses legislasi daerah. Melalui pendekatan ini, analisis diarahkan pada pemahaman bahwa hukum tidak hanya merupakan seperangkat aturan formal, tetapi instrumen rekayasa sosial yang harus selaras dengan kebutuhan serta nilai masyarakat. Hasil kajian menunjukkan bahwa Perda yang mengabaikan kearifan lokal cenderung menghadapi resistensi sosial, ketidakefektifan implementasi, serta keterputusan antara norma hukum dan realitas masyarakat. Sebaliknya, pengintegrasian nilai lokal dalam proses legislasi memperkuat legitimasi, efektivitas, dan daya rekayasa sosial hukum daerah. Artikel ini menegaskan pentingnya pembentukan Perda yang responsif dengan menjadikan kearifan lokal sebagai fondasi normatif dan sosial dalam kerangka rekayasa sosial yang berkeadilan.

Abstract

In the results of this research, statistically the coefficient states that partially the contribution of transformational leadership has a positive but not significant influence on employee performance, while organizational commitment has a positive and significant influence on employee performance. However, if both simultaneously have a significant influence on employee performance. Furthermore, the contribution of organizational commitment and transformational leadership to employee performance both have a positive and significant influence, both partially and simultaneously. The contribution of job satisfaction to employee performance has a positive and significant influence. Furthermore, in the analysis of organizational commitment and transformational leadership on employee performance through job satisfaction, it was found that there was no mediating effect of job satisfaction in the relationship between organizational commitment and employee performance, but a mediating effect of job satisfaction was found in the relationship between transformational leadership and employee performance.

Abstract

The advancement of information and communication technology has created a new sphere of interaction known as cyberspace, where information can be disseminated without geographical boundaries. This condition not only facilitates the exchange of information but also gives rise to complex legal challenges, particularly concerning hate speech offenses. In Indonesia, the regulation of online hate speech is stipulated in Law Number 11 of 2008 concerning Electronic Information and Transactions (ITE Law) as amended by Law Number 19 of 2016. The problem arises when perpetrators of hate speech reside outside Indonesia, yet their actions have legal impacts within the country. This situation relates to the application of the principle of extraterritoriality as regulated in Article 2 of the ITE Law, which extends Indonesia’s jurisdiction to acts committed abroad that have legal consequences domestically. However, the application of this principle raises debate due to its potential conflict with the principle of territoriality in Indonesian criminal law as regulated in the Criminal Code (KUHP). This study aims to analyze the criminal law regulation of extraterritoriality within the ITE Law regarding hate speech in cyberspace and to examine the limits of Indonesia’s jurisdiction in enforcing the law against cross-border cyber offenses. The research employs a normative legal method with statutory and conceptual approaches. The findings are expected to provide insight into the extent to which the principle of extraterritoriality in the ITE Law can be effectively applied in harmony with the general principles of Indonesian criminal law.
