Abstract

This study examines a sakinah family empowerment by optimizing the role of Badan Penasihat Pembinaan dan Pelestarian Perkawinan (Body for Marital Advisory Guidance and Maintenance (BMAGM)) and parents from a mental revolution perspective. There are three research questions: What is the so-called BMAGM? What and how is the correlation between the national revolution movement and sakinah family empowerment in Indonesia? What strategies are carried out in doing mental revolution in a family in order to have a sakinah family? This qualitative research collected both primary and secondary data. Three essential findings in this study are as follows. First, BMAGM is a legal social-religious organization whose particular duty is to cope with problems in a family. Second, there are three programs in the National Mental Revolution Movement (NMRM) as stated in the Presidential Instruction No. 12 of 2016 i.e. Indonesia in Order Movement (IOM) in point H/8; United Indonesia Movement (UIM) point J/10; Clean Indonesia Movement (CIM) point A/1. Third, in the perspective of the National Mental Revolution Movement (NMRM), parents’ role is essential. Therefore, parents are a strategic issue and should be prioritized in building sakinah family in Indonesia.

Abstract

Madurese’s resistance to the development of tourism facilities is based on the socio-cultural conditions of the community, which is less open to modernization. This research describes the form of resistance and reflects on its relation to Madurese society’s social and historical conditions. This research uses qualitative data with interview methods, collecting news on the internet, and literature studies. Data collection in this research begins with reading news on the internet on Madurese's resistance related to modern facilities and modern tourism, then conducting interviews with informants to confirm data from the news. Data analysis was carried out through three stages, namely describing data, classifying, and interpreting data thematically to reveal the meaning of the resistance by the Madurese community against the development of tourism facilities. The findings of this study highlight at least three main things, namely the forced closure of non-Muslim entertainment venues due to dissatisfaction with the resulting value shifts. Second, the presence of powerful actors triggers resistance from the community. Third, Madurese people tend to make tourism based on Islamic Sharia as they believe in their daily lives.

Abstract

For more than five decades (Since the implementation of Law Number 3 of 2006, which expanded the jurisdiction of religious courts to resolve Sharia economic disputes, there have been various debates regarding the effectiveness and implementation of this policy. Constitutional Court Decision Number 93/PUU-X/2012 clarified the legal position of religious courts, affirming their exclusive authority to adjudicate Sharia economic disputes. Therefore, this research provides an examination of the evolution of Religious Courts and their authority in resolving Sharia economic disputes following Constitutional Court Decision Number 93/PUU-X/2012, and the implications of implementing this decision. This study is normative research using historical, statutory, and conceptual approaches. The findings of this study indicate that the constitutional evolution of Religious Courts in resolving Sharia economic disputes in Indonesia has made significant progress. Their jurisdiction has been expanded by laws such as Number 3 of 2006 and Number 50 of 2009, which grant authority in Sharia economics and Sharia banking disputes. Constitutional Court Decision Number 93/PUU-X/2012 eliminated the legal dualism of the controversial provisions in Law Number 21 of 2008, ensuring legal clarity and consistency in upholding justice in Sharia economic cases. Following Constitutional Court Decision Number 93/PUU-X/2012, Religious Courts in Indonesia possess absolute authority in resolving Sharia economic disputes. The resolution of Sharia economic disputes by Religious Courts is expected to provide justice and welfare for the parties involved in the disputes.

Abstract

Posbakum is a place within the Religious Courts that provides free legal aid services to the poor. But in reality there are certain parties who need more services than Posbakum, for example the wife in fighting for her rights in divorce. Considering that wives in general have low levels of education, economy and access compared to their husbands. This study uses a qualitative approach that is directed at a sociological approach by using interview, observation and documentation data collection techniques. The results showed that the application of legal assistance for wives in divorce cases through Posbakum at the Sampang Religious Court was in accordance with applicable regulations, namely providing consultation and making claims (application for divorce) and providing information about advocate organizations that can provide legal assistance and among these services the dominant one is the making of divorce papers. The obstacles to the role of Posbakum in providing legal assistance to wives in divorce cases include the Posbakum rules which only provide services in the early stages of making a lawsuit (application for divorce), the wife's knowledge is minimal about the role and function of Posbakum, the Posbakum service room which is one with a court waiting room (without any partitions) and the lack of funds allocated by the state through the DIPA of the Sampang Religious Court. (Posbakum merupakan tempat yang berada di dalam Pengadilan Agama yang memberikan layanan bantuan hukum secara prodeo kepada masyarakat miskin. Namun dalam realita terdapat pihak tertentu yang membutuhkan pelayanan lebih dari Posbakum, misalnya pihak istri dalam memperjuangkan hak-haknya dalam perceraian. Mengingat istri pada umumnya memiliki tingkat pendidikan, ekonomi dan akses yang rendah dibandingkan dengan suami. Penelitian ini menggunakan pendekatan kualitatif yang diarahkan pada pendekatan sosiologis dengan menggunakan tehnik pengumpulan data wawancara, observasi dan dokumentasi. Hasil penelitian menunjukan bahwa penerapan bantuan hukum bagi istri dalam perkara perceraian melalui Posbakum di Pengadilan Agama Sampang telah sesuai dengan aturan yang berlaku yaitu pemberian konsultasi dan pembuatan gugatan (permohonan cerai gugat) serta pemberian informasi tentang organisasi advokat yang dapat memberikan bantuan hukum dan diantara layanan tersebut yang dominan adalah pembuatan surat gugat cerai. Adapun kendala atas peran Posbakum dalam memberikan bantuan hukum bagi istri dalam perkara perceraian antara lain aturan Posbakum yang hanya memberikan layanan pada tahap awal pembuatan gugatan (permohonan cerai gugat), pengetahuan pihak istri yang minim tentang peran dan fungsi Posbakum, ruang pelayanan Posbakum yang menjadi satu dengan ruang tunggu sidang (tanpa ada sekat) dan minimnya dana yang diperuntukan oleh negara melalui DIPA Pengadilan Agama Sampang.)
