Abstract

The Bukit Tangkiling Conservation Area has great potential for natural resources, including clean water, honey bees, recreation services, and religious services. There is also potential for split stone, which had been mined by the people from the rock hills in the area. The potential utilization of these natural resources trigger conflicts between interests to maintain the function and existence of conservation areas with the interests of using split stone for the community in order to meet the development needs of the city of Palangka Raya and its surrounding regions, at the cost of damaging the existing area. As an input in managing the conservation area Bukit Tangkiling is well implemented, research is needed on the social and economic conditions of the community’s surrounding the area. The research used survey methods and respondents are determined by purposive sampling and simple random sampling, and data analysis was both qualitative and quantitative. The communities around the Bukit Tangkiling conservation area are dominated by productive age (18-56 years), Banturung Village 59.00% and Tangkiling Village 54.97%. The level of education is relatively low, Banturung Village 72.96% and Tangkiling Village 73.29%. Having low education, most of the people have difficulty in finding decent work. Aside from that, most people do not understand the function of the forest or the function of the conservation area and tend to be apathetic about the existence of the Bukit Tangkiling conservation area that must be preserved. For some of these poorly educated people, the work of mining rocks is the best alternative to meeting the economic needs of the household. Income obtained from mining rock ranges from 2-4 million IDR per month.

Abstract

Dilaksanakannya penelitian ini didasarkan pada asumsi bahwa dengan terjadinya konflik sosial antar etnis di Kalimantan Tengah, khususnya di Kabupaten Kotawaringin Timur pada tahun 2001 banyak menimbulkan berbagai dampak sosial, budaya, ekonomi, dan politik bagi asyarakat. Diantaranya adalah semakin menguatnya solidaritas etnis (identitas etnis) yang justru bisa pendorong semakin rapuhnya hubungan interaksi sosial antar etnis. Keadaan demikian, apabila tidak dikelola dengan baik, pada akhirnya bisa menyulut suatu konflik sosial yang tidak kita kehendaki di masa yang akan datang. Pendekatan penelitian ini adalah penelitian kualitatif dengan pengambilan data primer menggunakan teknik observasi dan wawancara mendalam. Di samping itu tim peneliti juga menelaah beberapa dokumen tertulis yang berkaitan dengan substansi penelitian. Tujuan penelitian adalah (1) untuk menemukenali berbagai faktor penyebab terjadinya konflik sosial antar etnis di Kabupaten Kotawaringin Timur pada tahun 2001, (2) Menemukenali berbagai dampak dari konflik sosial antar etnis tersebut terhadap pola interaksi sosial di Kota Sampit, (3) Merumuskan model pembinaan dan pengembangan masyarakat multikultur yang menghargai kebhinnekaan dan cinta damai. Sedangkan manfaat yang dapat diambil dari hasil penelitian ini adalah sebagai bahan masukan bagi pemerintah di Kabupaten Kotawaringin Timur untuk (1) menyusun rencana strategis pembangunan, khususnya yang berhubungan dengan pembangunan sosial, budaya, ekonomi, dan politik, dan (2) menyusun suatu sistem pembinaan dan pengembangan masyarakat yang multikultur agar masyarakat bisa memahami, menerima,menghormati, dan menghargai keanekaragaman/kebhinnekaan dalam masyarakat. Pembinaan dan pengembangaan seperti inilah yang diharapkan dapat menjamin tatanan kehidupan masyarakat yang cinta damai, bertoleransi, dan menjungjung tinggi nilai-nilai kesatuan dan persatuan negara Republik Indonesia.

Abstract

Suku Dayak sebagai penduduk asli Pulau Kalimantan, hingga saat ini masih menjadi bahan perbincangan banyak orang. Masih banyak stigma yang melekat pada kehidupan orang Dayak. Misalnya, orang Dayak kanibal, kafir, terbelakang, pemotong kepala, belum beradab, dll. Pandangan demikian oleh orang luar terhadap orang Dayak adalah hal yang wajar karena mereka belum mengenal kebudayaan orang Dayak secara menyeluruh dan komprehensif. Tulisan ini bertujuan untuk menyajikan secara umum tentang kebudayaan Dayak, khususnya kebudayaan Dayak Kalimantan Tengah. Dengan demikian diharapkan bahwa tulisan ini dapat memberi pemahaman yang ilmiah dan objektif tentang orang Dayak baik yang ada di Kalimantan Tengah maupun di seluruh wilayah pulau Kalimantan. Abstract

Turus Tajak is the ethnic term that describes the process of customary wedding ceremony among the Maanyaan Dayak of Central Kalimantan. The Maanyaan is one of Dayak ethnic groups of Central Kalimantan who occupy East Barito Regency. Historical of past experience of the Maanyan’s struggle and difficult lives has strengthened their solidarity and ethnic identity as one big extended family. These solidarity and ethnic identity are obviously seen and illustrated in their social lives wherever they live. One of their customary ceremonies that is still maintained until now is customary wedding ceremony named Turus Tajak. Semantically, Turus means a post or a pole, and Tajak means to set up a post or a pole in the water or on the ground. Symbolically Turus Tajak means to set up a strong basement for the new married couples to start and build their new household. There are two conditions described in Turus Tajak ceremony. The invited audiences alternately come forward in front of the couples and gives voluntary contribution(sum amount of money) and short advices on how to get together as new couples as well as how to build a new household. Turus Tajak ceremony, culturally binds all the Maanyan to be a big extended family.

Abstract

This writing discusses the concept of Mengalah among the Dayak of Central Kalimantan in its relation with conflict. Mengalah is not coward, but the Dayak’s glorious nature to avoid any conflicts. Mengalah is the form and expressions of cultural values inherited from their ancestors. The concept of belief system of the Dayak contains two principles: belief in the One God and ancestor’s spirit that has directed them to keep the harmony of Cosmos in order that the Dayak’s live is prosperous and peaceful. In regarding with this belief system, the essential meaning of live of the Dayak lies on the harmony of Cosmos, it does not lie on prosperity and reality or objectivity understood by modern or scientific ideas. Maintaining the harmony of Cosmos, human being according to the Dayak, have to adhere to customs that has directed human being to keep harmony relation with the One God, with ancestor spirits, with other human beings and with the surrounding nature.

Abstract

The complex interaction between formal legal systems and indigenous local wisdom in managing forest and land fires in Central Kalimantan highlights the need for a nuanced regulatory approach. This study aims to explore how local wisdom is integrated into the formal legal framework governing forest and land fires by indigenous communities in the region. Conducted from September 2023 to April 2024, the research employed qualitative methods, including purposive sampling through interviews, observations, and field studies on local wisdom, focusing on community members and government agencies in Gunung Mas and Murung Raya regencies. The findings reveal that legal decisions concerning forest and land fires must incorporate the deep-rooted traditions and practices of indigenous communities, particularly those of the Dayak people. Their traditional agricultural practices and rituals, including pre-land use ceremonies, are integral to land management and fire prevention. This study concludes that aligning legal frameworks with local wisdom not only respects cultural heritage but also enhances the effectiveness of fire management policies. The implications suggest that policies should integrate traditional practices to create a more adaptive and sustainable legal system

Abstract

The occurrence of various social conflicts and environmental damage in Indonesia, especially in Central Kalimantan, is assumed to be due to the neglect of cultural values ​​and norms which should be a reference in all development planning and implementation. Management of development by referring to cultural values ​​and norms is in accordance with the mandate of the 1945 Constitution, Regional Autonomy, and the Concept of Dayak Traditional Law and Customs in Central Kalimantan. Objectively, implementing various development programs in community life requires first getting to know the community, especially traditional communities in remote rural areas in Indonesia. The reason is because each community group has its own potential for self-sufficiency which is based on its unique and special socio-cultural background. Therefore, the development programs introduced should be adapted to the needs and potential of each community.

Abstract

Kebakaran hutan dan lahan (Karhutla) merupakan salah satu permasalahan hukum terkait pemanfaatan sumberdaya alam yang melibatkan Masyarakat Adat kearifan lokal dalam mengelolah lahan untuk pertanian dan kasus pembakaran hutan dapat dilihat dari tradisi masyarakat yang masih dipertahankan dan diwariskan dari leluhur mereka, seperti Tokoh adat sangat berperan penting dalam proses hingga tahapan-tahapan pengelolaan lahan dimana tokoh adat akan melakukan ritual terlebih dahulu sebelum melakukan proses pembukaan lahan kemudian membaca mantra-mantra khusus setelah itu melakukan pembukaan lahan. Sehingga pada proses ini masyarakat masih mengacu pada tradisi yang telah menjadi pengontrol pada setiap aktivitas pembukaan dan pengelolaan lahan untuk pertanian masyarakat, serta tindakan dan aturan hukum masyarakat adat juga masih digunakan dalam hal kasus pembakaran lahan. Hal ini yang melatarbelakangi peneliti tentang implementasi kearifan lokal dalam penegakan hukum positif Indonesia terhadap Pembakaran hutan dan lahan di Kalimantan Tengah. Data survei yang berasal dari penelitian ini akan berkontribusi pada peraturan-peraturan pemerintah di Kalimantan Tengah. Tujuan dari penelitian ini yaitu Mengidentifikasi kategori pembakaran hutan dan lahan yang diakui oleh hukum adat berdasarkan kearifan lokal di Kalimantan Tengah.

Abstract

Berlakunya Undang-Undang Undang Undang (UU) Nomor (No) 6 Tahun 2014 tentang Desa memberikan otoritas pada desa untuk menyelenggarakan berbagai aspek pemerintahan dan pembangunan desa mulai dari Sosial, Ekonomi, Kesehatan, Pendidikan maupun Politik. Tulisan ini bermaksud mengkaji kondisi sosial ekonomi masyarakat di Desa Bahu Palawa. Desa Bahu Palawa termasuk dalam kategori desa berkembang, perekonomian masyarakat Desa Bahu Palawa bergantung pada sumber daya alam sebagai sumber penghidupan utama. Desa Palawa memiliki beragam sumber daya lokal yang masih belum dikembangkan secara optimal untuk meningkatkan perekonomian masyarakatnya. Desa ini memiliki hutan desa yang luasnya sekitar 397 ha dan telah memiliki SK dari kementerian Kehutanan, lalu terdapat kurang lebih 755 ha area hutan yang diusulkan untuk hutan adat serta masih terdapat 1.473 ha hutan tanpa status. Bagi masyarakat desa Palawa Hutan cukup berperan penting sebagai sumber daya lokal. Sumber daya lokal tersebut dimanfaatkan untuk penghidupan keluarga
