Abstract

Abstract

The aim of this activity is to find out the resolution of juvenile crimes using a restorative justice approach according to Law Number 1 of 2012 concerning the Juvenile Criminal Justice System. Preparation for activities starts from determining the location to identifying legal problems in the community and then preparing outreach materials. The activity was carried out using a lecture method to the participants which was then followed by questions and answers. The activity was carried out by a community service team from the university involving students. The results of the activity were that the principles of restorative justice in the Juvenile Criminal Justice System (UU Number 11 of 2012) were strictly regulated. One form of restorative is diversion. For children who have problems with the law, the nature of punishment with criminal sanctions is as an Ultimum Remedium or as a last resort. The main means are the principles of restorative justice and/or diversion, where for children as perpetrators of criminal acts, the resolution process is carried out using restorative/diversion both within the Juvenile Criminal Justice System (Children's SPP) and outside of the Juvenile SPP. The restorative/diversion process in Children's SPP can be carried out at the investigation, prosecution, or trial stages in court provided that there must be a voluntary agreement between the victim, the perpetrator, the victim's/perpetrator's family and related parties, with the aim of jointly finding a solution that is acceptable. fair by emphasizing restoration to the original state, and not retaliation. Meanwhile, outside the Children's SPP, restorative/diversion can be carried out at any time with the same conditions as the settlement in the Children's SPP. The settlement process using the principles of restorative justice is actually the same as resolving customary crimes.

Abstract

The outreach activity aims to ensure that the public understands the urgency and process of land registration so that it can raise public legal awareness in registering their land, especially through the Complete Systematic Land Registration (PTSL) program. Preparation for socialization activities is carried out starting from determining the location to identifying legal problems in the community, then preparing socialization materials. The activity was carried out using the method of delivering socialization material to participants which was then followed by questions and answers. The activity was carried out by the community service team from the university involving students. The results of the activity were that one of the things that reduced people's interest in certifying their land was the registration procedure which felt complicated and land registration fees which were felt to be still expensive, especially if registration was carried out sporadically. The PTSL program is considered to really help the community to be able to certify their land because the government plays an active role in carrying out data collection activities on community land that has not been certified so that mass land registration can then be carried out in a village/sub-district area and the government, especially the regional government, can also help in financing the certificate processing.

Abstract

Background: This study examines the role and legal authority of the village head in resolving child custody disputes through non-litigious mediation in Sambahule Village, Baito Sub-district, South Konawe Regency, Southeast Sulawesi Province, Indonesia. Objectives: The objectives of this study are to analyse the authority of village heads in determining child custody rights, explain the mechanism for resolving child custody disputes, and assess the social and legal implications of village head decisions. Method: Employing a normative-empirical legal research design with a qualitative descriptive approach, data were gathered through in-depth interviews, field observation, and documentary analysis. Results: The findings reveal two principal conclusions: first, the village head possesses no direct statutory authority to formally adjudicate child custody, as such jurisdiction is vested exclusively in the Religious Court (for Muslim parties) or the District Court (for non-Muslim parties) under Law No. 1 of 1974 on Marriage as amended by Law No. 16 of 2019, and the Compilation of Islamic Law (KHI) Article 105; second, notwithstanding this limitation, the village head's role as a community mediator grounded in Law Number 6 of 2014 on Villages, Article 26(4)(k) proved socially effective in the case under study, producing a consensual, peace-based resolution within two mediation sessions held in January 2021. Conclusion: The study further reveals that village-level decisions carry no binding legal force and remain subject to formal judicial challenge. The paper recommends clearer regulatory delineation of the village head's dispute-resolution authority, mandatory mediator certification, and post-mediation court ratification to secure the legal protection of the child's best interests.
