Abstract

The phenomenon of LGBT groups is not only endemic in society within the TNI has also been some who joined the LGBT group where this group has damaged the identity of a firm attitude, discipline and soul sapta marga a faded due to LGBT groups. How is the regulation of same-sex immoral crimes (homosexual) in Indonesian criminal law? And How is the application of additional punishment of dismissal from military service against TNI Soldiers who are proven to have committed same-sex immoral crimes (homosexual) based on the legal considerations of the Judges in the Military Court Decision III-12 Surabaya Number 24-K / PM.III-12 / AD / II / 2020? The Regulation of Same-Sex Indecent Crimes (Homosexual) in Indonesian Criminal Law, there are differences in the regulation of same-sex indecent crimes between the old Criminal Code and the new Criminal Code. Where in the old Criminal Code, there was a disparity related to the age of the perpetrators of same-sex immoral crimes. Whereas in the new Criminal Code it is no longer regulated related to age. The application of additional punishment of dismissal from military service against TNI Soldiers who are proven to have committed same-sex immoral crimes (homosexual) is in accordance with applicable law. Because same-sex immoral acts are serious crimes, the defendant is given an additional sanction in the form of dismissal. This research uses the research method of Normative Juridical research method with secondary data consisting of premier, secondary and tertiary legal materials. Arrangement of Same-Sex Indecent Crimes (Homosexual) in Indonesian Criminal Law, there is no explicit prohibition in the Criminal Code related to indecent acts (homosexual) and not in accordance with the norms of decency, because same-sex indecent crimes are not prosecuted except on complaints, even though homosexual crimes have violated the norms of decency, and arrangements should be made related to the prohibition of homosexuality in the law. The application of additional punishment of dismissal from military service against TNI soldiers who are proven to have committed same-sex immoral crimes (homosexual) needs to be socialized so that soldiers are careful in maintaining their actions so that the honor of TNI soldiers is maintained.

Abstract

Insubordination is a purely military crime where the perpetrator is a military person. The purpose of the crime of insubordination is that a subordinate with real actions threatens with violence aimed at his superior or his Commander. How is the regulation of insubordination criminal offense with real action in Indonesian military criminal law? How is the criminal liability of TNI members as perpetrators of the crime of insubordination with real actions based on the decision of Military Court III-19 Jayapura number 236-K/PM.III-19/AD/XI/2021. Regulation of the Crime of Insubordination by Actual Action in Indonesian Military Criminal Law. In cases of insubordination, Military Courts and General Courts differ in the stages of resolution and the rules used tend to be different even though they both regulate insubordination. In the Criminal Code, insubordination is regulated in Articles 459-461, while the specific regulation is regulated in Articles 106-109 of the KUHPM. the decision given by the judge is relatively light, because if you refer to the provisions governing the crime of insubordination, namely in the Military Criminal Code (KUHPM) insubordination is classified into the category of serious crimes because the penalty is above 5 (five) years in prison. This research uses the Normative Juridical research method with secondary data consisting of primary, secondary and tertiary legal materials. The regulation of the Crime of Insubordination with Real Actions in Indonesian Military Criminal Law should be regulated by KUHPM because the Crime of Insubordination is a special crime so that the regulation must also be made special. Criminal Liability of TNI Members as Perpetrators of Criminal Acts of Insubordination by Real Judges in deciding cases of Criminal Acts of Insubordination should provide heavy verdicts in accordance with the Articles contained in the KUHPM in order to create loyalty to superiors by adhering to the joints that have been contained in the Sapta Marga and the oath of the soldier.

Abstract

The affirmation of the constitution means that to take all actions in the realm of industrial relations must be based on the law or the provisions of the applicable labor legislation to provide protection for workers/laborers as also regulated in the Human Rights Act. Therefore, it is interesting to examine how the Pancasila Industrial Relations Norms in Indonesian Labor Legislation and How the Implementation of Pancasila Industrial Relations in Making Company Regulations and Collective Labor Agreements in a Company. To answer these problems, normative legal research methods are used (juridical normative) with a statutory approach, conceptual approach, and comparative approach, using secondary data obtained from primary, secondary and tertiary legal sources. The research found that Pancasila industrial relations norms originated from Pancasila which is a tangle of main basic values is a crystallization of various values that live in society as the soul of the nation (volskgeist) and guiding star (leidstar) in social life, because the main basic value is still very abstract and cannot be legally enforced, or cannot be sanctioned if violated, then as a concretization of these basic values must be outlined in legislation so that it can be enforced and sanctioned if violated and the Implementation of Pancasila Industrial Relations in Making Company Regulations and Collective Labor Agreements in a Company, should involve and accommodate the aspirations of workers through trade unions / workers' representatives in making Company Regulation policies (PP) and Collective Labor Agreements (PKB). Pancasila Industrial Relations is part of contractual relations as a mutual agreement between employers and workers, the achievements and implementation of the agreement should not conflict with Pancasila Industrial Relations and justice.

Abstract

This article delves into the crucial aspects of the Constitutional Court of the Republic of Indonesia's decision, focusing on the emergency state of administrative law concerning open legal policy decisions referred back to legislators, particularly regarding the tenure of village heads. The study employs a conceptual and legal approach, centering on the Constitutional Court Decision No.15/PUU-XI/2023 concerning the village head's position. This represents an open legal policy for law framers, paving the way for the political prevention of Pilkades (village head elections) money politics. Law No. 6 of 2014, which is under consideration for revision, lacks explicit measures against money politics. The methodology adopted is normative legal research that integrates legal theory with legislation. The findings indicate that open legal policy rulings necessitate immediate action by law framers, signaling administrative law urgency. The rationale is that law framers must react to that decision, and revising the law does not necessarily require inclusion in the National Legislation Program (Prolegnas). Decision on open legal policies must be administratively executed by law framers, including the issuance of Government Regulation in Lieu of Law (Perpu), which subsequently require legislative approval to become law. In essence, the decision of the Constitutional Court carries a moral and ethical coercive force, achieved by transforming ius constitutum into ius constituendum.

Abstract

Penelitian ini mengkaji penerapan konsep Restorative Justice dalam sistem peradilan pidana di Indonesia, yang merupakan pergeseran dalam sistem tersebut yang berfokus pada perbaikan kerusakan dan pemulihan hubungan daripada semata-mata menjatuhkan hukuman. Studi ini menunjukkan bahwa restorative justice menawarkan opsi yang menjanjikan untuk pendekatan hukuman tradisional. Namun, keberhasilannya di Indonesia bergantung pada evaluasi, pelatihan, dan perubahan terus-menerus kerangka hukum untuk memastikan bahwa itu sesuai dengan tujuan reformasi hukum di Indonesia. Studi ini mencapai kesimpulan dengan menyarankan tindakan strategis yang dapat meningkatkan kinerja restorative justice di Indonesia. Salah satu langkah yang disarankan adalah agar restorative justice dimasukkan ke dalam undang-undang yang berdiri sendiri, yang dapat memperkuat peranannya dalam mencapai sistem peradilan yang lebih seimbang dan rehabilitatif.

Abstract

A connectivity court is a court that functions to try criminal offenses committed jointly by civilians and members of the military (TNI), both general and special crimes, such as corruption. Provisions regarding koneksitas courts are regulated in detail in the Criminal Procedure Code, specifically in CHAPTER XI Article 89 to Article 94, as well as Article 198 to Article 203 in Law Number 31 of 1997 concerning Military Courts. However, in practice, when there is a criminal offense involving members of the TNI and civilians, the case should be resolved through a koneksitas mechanism. In reality, perpetrators are often tried in different courts, with TNI members being tried in military courts and civilian perpetrators in general courts. This creates disparity and ignores the principle of equality before the law, which in turn creates injustice. Law enforcers focus more on procedural justice than on achieving substantial justice.

Abstract

Paradigma hukum progresif di Indonesia, saat ini masih dianggap hal yang tabu karena dari sekian lama, mahasiswa-mahasiswa hukum, para penegak hukum, hanya diberikan bekal pelajaran hukum di sekolah-sekolah hukum yang berbau positivistik belaka sehingga dengan adanya paradigma hukum progresif ini, kita semua para penegak hukum (terutama hakim) dituntut untuk merubah cara berpikirnya “yang lama” yang selama ini selalu penuh dengan aroma paradigma positivistik. Karena salah satu sumber yang menyebabkan tidak bekerjanya hukum sebagaimana mestinya. Sehingga saat ini sudah saatnya para penegak hukum yang betul-betul ingin melihat hukum beridiri di atas sendi-sendi kebenaran untuk berani memulai dengan paradigma hukum progresif. Berdasarkan uraian tersebut, Penulis merumuskan masalah sebagai berikut; 1) Bagaimana pertimbangan hukum hakim dalam implementasi prinsip hukum progresif sebagai paradigma pembaharuan sistem peradilan di Indonesia? Dan 2) Apa kendala pertimbangan hukum hakim dalam implementasi prinsip hukum progresif sebagai paradigma pembaharuan sistem peradilan di Indonesia?. Penelitian menggunakan metode pendekatan peraturan perundang-undangan (statute approach), dan pendekatan konseptual (conseptual approach). Pendekatan peraturan perundang-undangan untuk menelaah Undang-Undang Dasar, undang-undang, dan peraturan pelaksanaan lainnya yang berkaitan dengan isu hukum yang diteliti.hasil penelitian ini ialah Penerapan Pemikiran Hukum Progresif oleh Hakim di Indonesia Pembentukan hukum yang dinamis, baik dalam arti horizontal maupun vertical tidak mungkin tanpa konstansi dan dinamik relatif dari asas-asas hukum materiil. Asas-asas hukum materiil yang bersifat konstitutif dan regulatif yang mendorong terus proses pembentukan hukum, sedangkan sebaliknya asas-asas ini akan mengembangkan arti yuridis dalam pembentukan hukum yang dinamis.

Abstract

Law enforcement of election crimes is a critical aspect to ensure the creation of a fair and transparent democratic process. This research discusses the role of Gakkumdu Bawaslu East Jakarta in enforcing the law on election crimes. Gakkumdu Bawaslu East Jakarta is responsible for handling and resolving cases of election law violations, which include administrative violations, code of ethics violations, and election crimes. This research identifies how the East Jakarta Bawaslu Gakkumdu functions in preventing and enforcing the law against election violations and the challenges faced in carrying out this task. The methodology used involves qualitative secondary data analysis, including documents, reports and interviews with related parties. The research results show that the East Jakarta Gakkumdu Bawaslu plays a crucial role in enforcing compliance with election regulations, despite several obstacles in carrying out its duties, such as limited resources and coordination between institutions. This research suggests several corrective steps to increase the effectiveness of Gakkumdu in enforcing election law in the future.

Abstract

Penelitian ini dilaksanakan guna mengetahui bentuk pertanggungjawaban hukum pelaku tindak pidana penyalahgunaan narkotika berulang (residivis) dalam kaitannya dengan Kesehatan mental. Penelitian ini dilakukan menggunakan jenis penelitian hukum yuridis normatif. Yang dimaksud penelitian yuridis adalah dengan melihat aspek-aspek hukum yang berdasarkan pada peraturan perundang-undangan, sedangkan penelitian normatif adalah suatu penelitian di bidang hukum untuk menemukan aturan-aturan hukum, serta doktrin-doktrin hukum guna menjawab isu hukum yang ada. Berdasarkan penelitian yang telah dilaksanakan dan setelah dilakukannya analisis perspektif yaitu 1) Narkotika adalah sah. Karena undang-undang Narkotika hanya melarang penggunaan narkotika yang tidak sesuai dengan ketentuan Undang-Undang. 2) Salah satu faktor yang mempengaruhi seseorang dapat menggunakan narkoba bahkan sampai residivis yaitu salah satunya lingkungan pergaulan yang buruk mengacu pada suatu konteks sosial di mana individu berinteraksi sehari- hari. 3) sesuai dengan Pasal 44 Ayat 1 Kitab Undang-Undang Hukum Pidana, Pasal tersebut mempertegas pengecualian dalam hal pertanggungjawaban pidana yang tidak dapat dibebankan kepada orang yang mengalami gangguan kejiwaan.

Abstract

This article discussesnganalyze the legal violations that occurred in the case of the construction of a sea fence as part of the Pantai Indah Kapuk (PIK) reclamation project in Tangerang as well as the Issuance of Building Use Rights (HGB) and Ownership Certificates (SHM) in the sea area which is a complex and controversial issue in Indonesia. The purpose of this study is to determine the legality of the issuance of HGB and SHM in the sea area reviewed from the Basic Agrarian Law (UUPA) and other related laws and regulations and to analyze how the Sea Fence case is resolved. The methodology used in this analysis includes a literature review of various related laws and regulations, a study of project planning documentation, and interviews with environmental and spatial law experts. The analytical approach used focuses on the normative legal aspects by considering the empirical facts that occur in the field. This study also considers the jurisprudence of similar cases that have occurred previously in Indonesia. The results of this study found that it was concluded that the legality of issuing HGB and SHM in the sea area is a complex issue and contradicts the provisions of Article 27 of Law Number 1 of 2014 concerning Management of Coastal Areas and Small Islands. (Law No. 1/2014). The issuance of land rights in the sea area must be carried out very carefully and considering all legal implications as regulated in Presidential Regulation Number 122 of 2012 concerning Reclamation in Coastal Areas and Small Islands. (Presidential Regulation No. 122/2012). This study also revealed complex and multidimensional legal violations in the case of the Pantai Indah Kapuk Tangerang Reclamation Project sea fence. The developer of the PIK 2 area needs to carry out criminal and civil liability based on Law No. 32/2009 and the Criminal Code, through the settlement of applicable laws.
