Abstract

Aviation safety law regulates the interaction between commercial aircraft and state aircraft, particularly in relation to airspace management and conflict avoidance at airports. The case studies of the JAL516 and JA7222A Accidents at Haneda Airport, Tokyo, Japan illustrate how regulatory violations and lack of coordination between civil and military authorities can pose serious safety risks. In both incidents, commercial aircraft were involved in events that threatened the safety of passengers and crew due to the lack of data transparency and communication between the civil and military sectors. These cases demonstrate the need for the implementation of Flexible Use of Airspace (FUA) to efficiently divide airspace, as well as the use of Collaborative Decision Making (CDM) to ensure effective coordination between stakeholders. The adoption of modern technologies, such as artificial intelligence (AI)-based air traffic management systems, can help identify potential conflicts earlier and provide solutions in real time. In this context, air law must continue to adapt to ensure the protection of civil aviation, prioritizing transparency, increasing international cooperation, and implementing stronger regulations to prevent similar accidents in the future.

Abstract

Ticketing for traffic violations on the highway using the Electronic Traffic Law Enforcement (ETLE) system. The existence of the E-ticket system makes it easier for people to pay fines through the bank. The implementation of ETLE is an effort to utilize Information Technology and Communication to support the process of road traffic law enforcement. For this reason, it will be further studied how effective electronic ticketing or electronic traffic law enforcement (ETLE) is in improving traffic discipline in Jakarta and how the factors that hinder the effectiveness of electronic ticketing or electronic traffic law enforcement (ETLE) in improving traffic discipline in Jakarta. The research method used in this study is the normative legal research method. From the results of the study, it was found that electronic ticketing or electronic traffic law enforcement (ETLE) is effective in improving traffic discipline in Jakarta, if law enforcement officers, in this case the Traffic Police, act as deterrents and enforcers for traffic violations that occur. The initiation of the application of the ETLE concept is actually in line with the direction of national legal development, especially in the direction of national legal development that focuses on efforts to eliminate and discipline traffic violations. There is no specific regulation that specifically regulates ETLE and the factors that hinder the effectiveness of electronic ticketing or electronic traffic law enforcement (ETLE) in improving traffic discipline in Jakarta is the regulation of the implementation of ETLE in PP 80/2012 has the potential to cause fundamental problems regarding the legal accountability of ETLE. PP 80/2012. The working mechanism of ETLE raises the possibility that traffic violators are not motor vehicle owners, while the Traffic Ticket will be sent with a database of motor vehicle owners in the motor vehicle registration and identification database. From the results of the study for improvement, it is expected that in terms of limited facilities and infrastructure that require a large budget, the Police can work together with local governments to provide facilities and infrastructure in enforcing ETLE and the government must form legislation, government regulations, and police chief regulations to provide justice, certainty and benefits for all parties related to the effectiveness of electronic traffic law enforcement (ETLE).

Abstract

Penelitian ini adalah penelitian hukum normatif-empiris yang dilakukan dengan cara mengkaji berbagai aturan hukum yang bersifat formal seperti Konstitusi, undang-undang, peraturan-peraturan serta literatur yang berisi konsep-konsep teoritis yang kemudian dihubungkan dengan fokus penelitian tesis ini. Pendekatan penilitian ini menggunakan beberapa jenis pendekatan yaitu Pendekatan perundang-undangan; Pendekatan konseptual, Pendekatan analitis, Pendekatan perbandingan, Pendekatan historis, Pendekatan filsafat, Pendekatan kasus. Latar belakang dari penulisan tesis ini adalah adanya stigma konstitusional dan empiris bahwa Presiden adalah Panglima Tertinggi TNI. Kenyataannya klausul tersebut hanya pernah tertulis sekali dalam UUD RIS 1949 dan UU Nomor 54 Tahun 1954 tentang Pertahanan Negara. Dalam UUDS 1950 tidak tercantum klausul Presiden selaku Panglima Tertinggi Angkatan Perang. Setelah Dekrit Presiden 5 Juli 1959 UUDS 1950 dinyatakan tidak berlaku lagi dan negara Indonesia kembali menggunakan UUD 18 Agustus 1945. Pada UU Nomor 29 Tahun 1954 klausul tersebut masih digunakan bahkan juga dalam Supersemar tahun 1966. Hingga kini stigma Presiden selaku Panglima Tertinggi tentara masih selalu terucap oleh masyarakat bahkan oleh kalangan TNI sendiri walaupun sebutan tersebut adalah Inkonstitusional. Dari hasil wawancara online dengan informan purnawirawan perwira Tinggi TNI yang pernah menduduki jabatan struktural strategis bahwa dalam menentukan suatu jabatan TNI yang strategis khususnya jabatan Panglima TNI dan Kepala Staf Angkatanselalu ada intervensi dari kekuasaan politik. Kesimpulan dari penelitian ini adalah bahwa presiden bukan Panglima Tertinggi TNI, melainkan berdasarkan Pasal 10 UUD 1945 Presiden memegang kekuasaan Tertinggi atas tentara, dan Pasal 10 tersebut dibatasi atau dijelaskan oleh Pasal 11 dan Pasal 12 UUD 1945 yakni kekuasaan Presiden bersifat kontekstual yakni saat negara dalam masa perang dan keadaan darurat atau bahayaanaman harus mengutamakan pendekatan Keadilan Restoratif dan Upaya Diversi

Abstract

Criminal threats for people who do not obey the orders of officials, as stipulated in Article 216 paragraph (1) of the Criminal Code which stipulates that anyone who intentionally does not obey orders or requests made according to the law by an official whose duty is to supervise something, or by an official based on his duties, as well as those who are given the authority to investigate or examine criminal acts; Likewise, anyone who intentionally prevents, obstructs or thwarts an action to carry out the provisions of the law carried out by one of the officials, is threatened with criminal penalties. So, Article 51 paragraph (2) is intended to protect the perpetrator of an order because there is an official order where the protection is something that can be considered reasonable. The research method used is normative juridical. The results of the research are Legal regulations against people who obstruct investigations in the perspective of the Criminal Code that the term obstruction of justice in the Criminal Code. However, several criteria that refer to this problem can be found in several articles in the Criminal Code, including; Article 221 paragraph (1), Article 231 and Article 233. The substance of obstruction of justice is regulated in Articles 21 to 24 of Law No. 31 of 1999 in conjunction with Law No. 20 of 2001 concerning Amendments to Law No. 31 of 1999 concerning the Eradication of Criminal Acts of Corruption. Obstruction of Justice in criminal cases related to Article 51 paragraph (2) of the Criminal Code that provides restrictions on the implementation of illegal office orders. This provision aims to ensure that unlawful superior orders cannot be used as justification to free subordinates from criminal responsibility.

Abstract

As a legal state, one of the transportation activities is air transportation. Air transportation is normatively subject to the provisions in Law Number 1 of 2009 concerning Aviation. Based on Article 1 number (1) of the a quo Law, it is known that aviation is a unified system consisting of the use of airspace, aircraft, airports, air transportation, flight navigation, safety and security, the environment, as well as supporting facilities and infrastructure. other general. The research method is normative juridical. The results of the research are: Responsibility for sanctions for perpetrators of criminal acts conveying false information that endangers aviation safety, that liability (criminal) leads to the criminal's conviction, if they have committed a criminal act and fulfill the elements specified in the law. In the researcher's view, there needs to be criminal sanctions in the form of fines or compensation for people on board airplane flights resulting from false information that threatens flight safety. This right can provide a deterrent effect for perpetrators so that they do not harm many people. The judge's legal considerations in Decision Number 43/Pid.B/2018/PN Lbj state that the legal considerations by the Panel of Judges have not provided a deterrent effect, there is a need for sanctions in the form of fines or compensation, so that legal certainty is achieved, because currently there is no legal certainty.

Abstract

Law enforcement of election crimes is a critical aspect to ensure the creation of a fair, honest, and transparent democratic process. This research discusses the role of the Integrated Law Enforcement Centre (Gakkumdu) under Bawaslu East Jakarta in handling and resolving cases related to election crimes. Gakkumdu Bawaslu East Jakarta is mandated to address various violations, including administrative breaches, code of ethics violations, and criminal acts within the electoral process. This study aims to identify how Gakkumdu East Jakarta carries out its preventive and enforcement functions, as well as to analyse the challenges encountered in implementing these tasks. The research adopts a qualitative method with a literature and legal approach, utilising secondary data sources such as official documents, reports, regulations, and interviews with related stakeholders. The findings reveal that Gakkumdu East Jakarta plays a pivotal role in maintaining electoral integrity by actively monitoring, investigating, and processing election violations. However, several obstacles persist, notably limited human and financial resources, the complexity of legal procedures, and challenges in inter-institutional coordination between Bawaslu, the police, and the prosecutor’s office. This research emphasizes the need for improved institutional synergy, capacity building, and clearer regulatory frameworks to enhance the effectiveness of Gakkumdu’s performance in future elections. Strengthening these aspects is vital to upholding democratic values and ensuring that elections run according to the principles of fairness and justice.

Abstract

Prevention & eradication of criminal acts of corruption in Indonesia has been very intensively implemented because corruption in Indonesia is now so rampant, acute, and systemic. The existence of firm and harsh criminal sanctions has a very important role in the process of eradicating corruption. In Law Number 31 of 1999 in conjunction with Law Number 20 of 2001 concerning the Eradication of Corruption Crimes or what is called the PTPK Law, there is a juridical space that can be used to impose death penalty sanctions on perpetrators of criminal acts of corruption, namely in Article 2 paragraph (2) The PTPK Law stipulates that if the criminal act of corruption as intended in paragraph (1) is committed under certain circumstances, the death penalty can be imposed." However, until now in its implementation, there has never been a single court decision in Indonesia that dared to use this article. Apart from that, imposing the death penalty sanction is not easy because there is still debate because not all people agree with this heaviest sanction, they argue that imposing the death penalty sanction is considered to violate human rights. The issue of protecting human rights, especially the right to life, has so far been the main reason for imposing the death penalty for perpetrators of criminal acts of corruption. Furthermore, those who oppose the imposition of death penalty sanctions feel that the right to life is an absolute right that cannot be revoked by anyone except God, and this right is protected by the 1945 Constitution, Article 28 I paragraph (1). Given this, the enforcement of death penalty sanctions against perpetrators of criminal acts of corruption will of course become an obstacle in its enforcement in the future

Abstract

Militer atau Tentara Nasional Indonesia (TNI) merupakan lembaga yang memiliki peran penting dalam menjaga keamanan negara dan kepercayaan publik. Namun, ketika ada anggota TNI terlibat dalam kasus tindak pidana misalnya penipuan, hal itu dapat merusak kepercayaan masyarakat terhadap institusi militer. Penelitian ini adalah Pertanggungjawaban Pidana Penipuan Yang Dilakukan Oleh Anggota Militer (Analisis Putusan Hakim Pengadilan Militer I-02 Medan Nomor. 11-K/PM-I-02I/AD/2/2023) Rumusan Masalah Bagaimana Pertanggungjawaban Hukum Tindak Pidana Penipuan Yang Dilakukan Oleh Militer dalam hukum Pidana Indonesia? Metode Penelitian Apakah putusan hakim Putusan Hakim Pengadilan Militer I-02 Medan No. 11-K/PM-I-02I/AD/2/2023 telah sesuai atau bertentangan dengan perundang-undangan yang berlaku? Penelitian ini menggunakan jenis penelitian Yuridis-Normatif dengan melakukan pendekatan peraturan perundang- undangan (statute approach) dan pendekatan konseptual (conseptual approach). Pengumpulan data dari bahan sekunder dilakukan dengan metode kepustakaan dan dianalisa menggunakan metode kualitatif. Hasil penelitian ini adalah 1. Pertanggungjawaban Hukum Tindak Pidana Penipuan Yang Dilakukan Oleh Anggota Militer dalam hukum Pidana Indonesia Pertanggungjawaban tidakberbeda dengan masyarakat sipil, hanya bedanya adalah oknum anggota tentara Militer terhadap tindak pidana penipuan tetap dikenakan sanksi pidana sesuai dengan Pasal 378 KUHP. Tindak pidana yang terjadi dalam kalangan militer sama dengan tindak pidana pada umumnya yang membedakan hanya subjeknya dimana subjeknya dalam penelitian ini yaitu militer. 2. Putusan hakim Putusan Hakim Pengadilan Militer I-02 Medan No. 11-K/PM-I-02I/AD/2/2023 telah sesuai atau bertentangan dengan perundang-undangan yang berlaku. Dalam penelitian ini Penerapan hukum terhadap tindak pidana penipuan yang diIakukan oIeh oknum Militer, sudah tepat, dengan menyatakan terdakwa terbukti secara sah dan meyakinkan bersaIah yang sebagaimana daIam dakwaan tunggal yakni PasaI 378 KUHPidana
