Abstract

Penelitian ini dilatarbelakangi oleh pentingnya peran pengawas ad hoc dalam menjaga integritas pemilu, khususnya dalam konteks Pemilu 2024 yang semakin kompleks. Penelitian ini bertujuan untuk mengevaluasi efektivitas pengawasan pemilu oleh pengawas ad hoc dengan menyoroti keterkaitan antara proses rekrutmen, pembinaan, dan kinerja pengawasan di lapangan. Metode yang digunakan adalah pendekatan kualitatif deskriptif dengan teknik pengumpulan data melalui telaah dokumen dari berbagai elemen pengawasan pemilu. Hasil penelitian menunjukkan bahwa proses rekrutmen yang belum berbasis merit serta pelatihan yang tidak kontekstual menjadi kendala utama dalam menciptakan pengawas ad hoc yang profesional dan responsif. Di samping itu, terbatasnya dukungan teknologi dan regulasi perlindungan hukum turut memengaruhi efektivitas pengawasan. Penelitian ini menyimpulkan bahwa reformasi sistem pengawasan pemilu yang bersifat sistemik, berkelanjutan, dan adaptif sangat diperlukan, melalui penguatan aspek teknis, sumber daya manusia, regulasi, serta partisipasi publik.

Abstract

Pertumbuhan kawasan urban mendorong munculnya inovasi hunian, termasuk konsep hunian horizontal di atas bangunan komersial, seperti Cosmo Park Residence di Jakarta. Model ini menghadirkan tantangan hukum baru, khususnya terkait kepastian status hak atas tanah dan bangunan. Penelitian ini bertujuan untuk menganalisis kepastian hukum hunian horizontal di atas gedung komersial dengan menggunakan pendekatan yuridis normatif. Kajian difokuskan pada Undang-Undang Pokok Agraria Tahun 1960, Undang-Undang Nomor 20 Tahun 2011 tentang Rumah Susun, serta regulasi turunannya. Hasil penelitian menunjukkan bahwa model hunian ini dapat diakomodasi secara normatif melalui skema Hak Milik atas Satuan Rumah Susun (SHM Sarusun) atau Hak Guna Bangunan (HGB), meskipun belum terdapat pengaturan eksplisit yang secara spesifik mengatur bentuk hunian tersebut. Ketidakjelasan regulasi ini berpotensi menimbulkan ketidakpastian hukum bagi penghuni, pengembang, dan pengelola gedung. Penelitian ini menyimpulkan bahwa kekosongan pengaturan hukum terhadap bentuk hunian ini perlu segera ditangani untuk memberikan kepastian hukum dan mencegah potensi konflik hak atas tanah di kawasan campuran. Urgensi penataan hukum menjadi semakin mendesak seiring meningkatnya tren pembangunan hunian vertikal dan horizontal campuran di kota-kota besar.

Abstract

The growth of housing development in Sragen Regency, an agricultural region, has put pressure on the sustainability of agricultural land. This study aims to analyze housing growth and assess the role of local governments in controlling agricultural land conversion. The research method used is a juridical-empirical legal research with a qualitative approach. Data were obtained through interviews with relevant regional officials, legislation, and literature reviews. The results show that housing development reaches approximately 1,000 units per year, while the level of fulfillment of new housing needs is approximately 87% with a backlog of approximately 28,000 units. The local government has carried out a controlling role through spatial planning instruments, spatial utilization permits, the Suitability of Spatial Utilization Activities (KKPR), as well as coordination between regional officials and the provision of incentives to farmers. However, this role has not been optimal due to a disconnect between the role conception as formulated in spatial planning policies and regulations and the implementation of the local government's role in controlling agricultural land conversion in the field.

Abstract

The reality of employment relationships in Indonesia today far exceeds what is written in labor laws. The emergence of freelance and remote work trends due to digital technology has collided with laws that still rely on formal recognition. The research method used was normative legal research with a regulatory and comparative law approach. The results of the study point to the weak legal protection for freelance and remote workers, including wages, social security, occupational safety and health, and access to dispute resolution mechanisms. In comparison, German law has implemented an adaptive substantive approach. Employment status is assessed based on factual realities and economic dependence, even recognizing the category of quasi-independent workers (arbeitnehmerähnliche Personen) who receive legal protection. Through this comparison, a protection model based on the reality of employment relationships is more relevant to the current shifts in the world of work. On that basis, Indonesia needs to overhaul its labor law policies. By selectively absorbing German legal principles, Indonesia can build a stronger protective barrier for freelance and remote workers amid rapid digitalization.

Abstract

Infrastructure development is an effort to improve the quality of public services, particularly in regional development. One type of infrastructure that plays a crucial role in urban area management is the drainage system. The city of Semarang is an area with complex terrain, so the implementation of drainage projects must be optimized. In this context, the responsibility for implementing drainage projects lies with the Semarang City Public Works Department. However, various challenges are frequently encountered, and strict supervision is required during implementation. The objective of this study is to assess the effectiveness of drainage project supervision in Semarang City to determine the accountability of the involved agencies. The optimization of drainage project supervision at the Semarang City Public Works Department can be viewed through the lens of Muchsan’s supervision theory, which emphasizes both external and internal controls. This includes preventive measures, such as contracts designed to prevent deviations, and corrective actions to address obstacles, ensuring the project proceeds as planned and operates optimally. This supervision involves a complex network of supervisory actors, including the Public Procurement Agency, the Internal Government Supervisory Apparatus (APIP), the State Audit Board (BPK), and the Public Works Department. The effectiveness of drainage project supervision in Semarang City heavily depends on aligning field operations with Law No. 30 of 2014 to address legal obstacles related to jurisdictional authority, which frequently pose challenges. Supervision must encompass administrative compliance to ensure legal certainty. Thus, optimal public benefit can be achieved.

Abstract

The rising prevalence of diabetes mellitus in Indonesia represents a significant public health concern, particularly in relation to excessive sugar intake. This normative legal research seeks to examine the urgency of establishing excise regulation on sugar-sweetened beverages (SSBs) as a strategic policy instrument for diabetes prevention and control. Using statutory and conceptual approaches, the study finds that although the SSB tax policy has not yet been enforced, it is supported by a solid legal foundation and strong policy justification. Such regulation has the potential to contribute to reducing sugar consumption while also strengthening health financing mechanisms. Accordingly, this research highlights the need to expedite the development and implementation of an SSB excise policy as part of a sustainable national health strategy.

Abstract

Cannabis is a plant that has medicinal benefits. However, the use of cannabis is prohibited by Indonesian Law Number 35 of 2009 concerning Narcotics, which states that cannabis is a Class I narcotic and cannot be used for medical purposes. This is contrary to the right to obtain health services and the state is obliged to provide them. A number of studies on the medicinal benefits of cannabis plants have created a new debate in Indonesia regarding the relative benefits of constitutional regulation and medical treatment. In other state policies, Thailand has updated its cannabis legalization arrangements, which have had a good impact on several sectors. This paper aims to analyze the regulation of cannabis in Indonesia and in Thailand comparatively, as well as examine the impact of the regulation of cannabis legalization in Indonesia and in Thailand.

Abstract

This study examines the implementation of local retribution collection at the Sport Center Manunggal Jati in Semarang City from the perspective of positive law and the principles of good governance. The main issue addressed is the extent to which the regulation and implementation of user service retribution in this sector align with the general principles of good administration. The research adopts a normative juridical method with a descriptive-analytical approach. Data were obtained through literature studies on statutory regulations, local government documents, and previous research findings. The results reveal that the legal framework for retribution collection is well-established, both at the national and regional levels, including Law Number 1 of 2022, Government Regulation Number 35 of 2023, Semarang Regional Regulation Number 7 of 2018, and Mayor Regulation Number 6 of 2020. However, implementation still faces challenges such as limited public outreach, suboptimal administrative systems, and insufficient supervision. Nevertheless, the retribution collection at Sport Center Manunggal Jati reflects the principles of legal certainty, utility, impartiality, non-abuse of power, and public interest. The study concludes that strengthening management systems, conducting regular regulatory evaluations, and applying digital technology are essential to improve the efficiency and accountability of retribution administration.

Abstract

Program Kota Layak Anak merupakan kebijakan publik yang bertujuan untuk menjamin pemenuhan hak-hak anak melalui pembangunan yang terencana, menyeluruh, dan berkelanjutan di tingkat daerah. Di Kota Semarang, pelaksanaan program Kota Layak Anak melibatkan berbagai pemangku kepentingan, dengan Dinas Pemberdayaan Perempuan dan Perlindungan Anak (DP3A) sebagai instansi yang memiliki peran strategis. Penelitian ini bertujuan untuk menganalisis tanggung jawab DP3A terhadap kebijakan penyelenggaraan Program Kota Layak Anak di Kota Semarang. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan deskriptif-analitis, yang bersumber pada data sekunder berupa peraturan perundang-undangan, dokumen kebijakan, serta literatur yang relevan. Hasil penelitian menunjukkan bahwa DP3A memiliki tanggung jawab dalam perumusan kebijakan, koordinasi lintas sektor, fasilitasi pelaksanaan program, serta monitoring dan evaluasi pemenuhan hak anak. Namun, pelaksanaan tanggung jawab tersebut masih menghadapi berbagai tantangan, seperti keterbatasan sumber daya, koordinasi antarinstansi, dan partisipasi masyarakat. Oleh karena itu, diperlukan penguatan sinergi antar pemangku kepentingan serta optimalisasi implementasi kebijakan guna mewujudkan Kota Semarang sebagai Kota Layak Anak.

Abstract

Home-based workers constitute a segment of the labor force who carry out their work from their residences, typically under informal employment arrangements, which often results in their exclusion from adequate legal protections. The definitional distinctions between home- based workers and other categories of workers, coupled with their significant numbers, underscore the urgency of recognizing and ensuring legal protections for this group. This study aims to examine the risks and challenges faced by home-based workers within industrial contexts and to enhance understanding of the labor rights that are often denied to them. This study uses a normative juridical method, with statutory and conceptual approach, based on a literature review of primary, secondary, and tertiary legal materials. The findings reveal that home-based workers encounter a range of issues, including the absence of written employment contracts, substandard wages, excessive working hours, lack of social security coverage, and constraints on forming labor unions. Additionally, exploitative practices such as the involvement of child labor and the imposition of production costs on workers are prevalent. Addressing these challenges requires strengthening legal awareness and ensuring that home-based workers are afforded the rights and protections to which they are entitled.
