Abstract

Perkembangan teknologi informasi telah membawa dampak signifikan terhadap praktik hubungan industrial, termasuk dalam proses pemutusan hubungan kerja (PHK) yang kini kerap dilakukan melalui media digital seperti WhatsApp. Penulisan ini bertujuan untuk menganalisis akibat hukum terhadap keabsahan PHK sepihak yang disampaikan secara digital dalam perspektif hukum ketenagakerjaan Indonesia. Metode yang digunakan adalah pendekatan yuridis normatif dengan studi kasus pada putusan Pengadilan Hubungan Industrial (PHI) dalam perkara PT Saraswanti Indoland (2017). Hasil analisis menunjukkan bahwa PHK yang tidak memenuhi prosedur formal, seperti pemberitahuan tertulis, perundingan bipartit, serta pemenuhan hak-hak pekerja, dianggap cacat hukum dan dapat dibatalkan. Media komunikasi digital dapat berfungsi sebagai alat bukti, tetapi tidak dapat menggantikan prosedur hukum yang sah. Oleh karena itu, dibutuhkan pembaruan hukum ketenagakerjaan yang adaptif terhadap perkembangan teknologi digital tanpa mengabaikan prinsip perlindungan pekerja. Kesimpulannya, PHK melalui WhatsApp tanpa mengikuti prosedur hukum ketenagakerjaan tidak memiliki kekuatan hukum yang sah, dan reformasi regulasi diperlukan untuk menjembatani kesenjangan antara praktik digital dan sistem hukum formal.

Abstract

The purpose of this study is to analyze the validity of power of attorney for concert ticket exchanges in accordance with Indonesian civil law provisions. This study fills a gap in legal research by focusing on the validity of power of attorney in the exchange of tickets for the Seventeen [Right Here] World Tour in Jakarta, as well as aspects of personal data protection involved therein. The study applies normative legal research methods. The results of this study reveal that the use of a power of attorney in the ticket exchange process, as utilized by ticket exchange services, falls under the category of a special power of attorney governed by Article 1975 of the Indonesian Civil Code. The format of the power of attorney from the promoter complies with the provisions of Article 1320 of the Civil Code. Conclusion of this study is that Mecimapro acts as the data controller responsible for the entire concert. Promoter is obligated to destroy power of attorney documents that have been used and are no longer relevant to the promoter company, as a form of personal data protection and document archive management. The provisions regarding the destruction process are regulated in Article 44 of the Personal Data Protection Law, whose regulations are further strengthened by Government Regulation No. 87 of 1999 on the Procedures for the Submission and Destruction of Company Documents.

Abstract

Termination of employment (PHK) is an event that has significant impacts on the welfare of workers, both economically, socially, and psychologically. In response to this challenge, the Indonesian government introduced the Job Loss Insurance (JKP) program through Law Number 6 of 2023 as a new social protection scheme for workers affected by termination. This study employs a normative legal method with statutory and conceptual approaches to analyze the effectiveness of JKP in providing post-termination protection. The results show that the JKP scheme offers more comprehensive protection compared to the previous provisions in Law Number 13 of 2003. In addition to financial benefits in the form of cash assistance for up to six months, JKP also provides access to job training and employment placement services. This program not only helps workers survive the transitional period but also enhances their employment opportunities and competitiveness in the labor market. The scheme is managed by the Workers Social Security Agency (BPJS Ketenagakerjaan) with funding support derived from the redistribution of contributions from the Work Accident Insurance (JKK) and Death Insurance (JKM) programs, along with subsidies from the state budget (APBN). The implementation of JKP encourages active participation from both workers and employers in the social security system, strengthens labor formalization, and improves corporate accountability. With its proactive and sustainable approach, JKP has the potential to become a strategic instrument in the reform of national labor protection and to reinforce the role of the state in realizing social welfare for all Indonesian workers.

Abstract

Population administration services constitute an essential part of public services as they are directly related to the fulfillment of citizens’ administrative rights and legal certainty. However, in practice, the provision of such services is often still confronted with maladministration issues. This study aims to analyze the forms of maladministration, their conformity with the principles of public service, as well as the efforts to prevent and address maladministration in population administration services at the Population and Civil Registration Office (Disdukcapil) of Semarang City. This research employs an empirical legal method (socio-legal approach) with a descriptive qualitative approach. Data were collected through in-depth interviews with Disdukcapil officials, operators of the Digital Population Identity (IKD) application, internship students, and service users, supported by observation and documentation studies. The results indicate that maladministration persists in the form of an inefficient queue system at certain times, the implementation of the IKD application that is not yet inclusive for vulnerable groups such as the elderly, and the placement of human resources lacking adequate competence in strategic service positions. These findings demonstrate that the principles of legal certainty, effectiveness, non-discrimination, professionalism, and accountability as stipulated in Law Number 25 of 2009 on Public Services have not been optimally implemented. This study concludes that improving the quality of population administration services requires not only digital innovation but also the strengthening of human resources, inclusive service delivery, and effective oversight mechanisms to prevent and address maladministration.

Abstract

Bullying di lingkungan sekolah merupakan salah satu bentuk kekerasan terhadap anak yang dapat berdampak negatif terhadap perkembangan fisik, psikologis, dan sosial anak. Anak sebagai subjek hukum memiliki hak untuk memperoleh perlindungan dari segala bentuk kekerasan, termasuk perundungan. Namun, penanganan kasus perundungan belum optimal mengikuti kaidah hukum kebijakan anti perundungan. Oleh karena itu, pendekatan non-litigasi menjadi alternatif yang lebih ramah anak dan berorientasi pada pemulihan. Artikel ini bertujuan untuk menganalisis perlindungan hukum terhadap anak korban bullying melalui pendekatan non-litigasi berbasis kebijakan anti perundungan di sekolah. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa pendekatan non-litigasi, seperti mediasi, konseling, dan restorative justice, dapat memberikan perlindungan hukum yang lebih efektif bagi anak korban bullying. Selain itu, implementasi kebijakan anti perundungan di sekolah berperan penting sebagai instrumen pencegahan dan penanganan bullying, meskipun masih menghadapi berbagai kendala dalam pelaksanaannya. Dengan demikian, diperlukan penguatan kebijakan dan komitmen semua pihak untuk mewujudkan lingkungan sekolah yang aman dan ramah anak.

Abstract

Penutupan sepihak pusat kebugaran oleh pelaku usaha menimbulkan persoalan hukum yang serius terhadap perlindungan hak-hak konsumen, khususnya bagi anggota yang telah melakukan pembayaran keanggotaan dalam jangka waktu tertentu. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum bagi konsumen serta tanggung jawab hukum pelaku usaha terhadap kerugian yang timbul akibat penutupan sepihak pusat kebugaran. Metode penelitian yang digunakan adalah penelitian normatif dengan pendekatan perundang-undangan dan pendekatan kasus, yang dianalisis menggunakan bahan hukum primer berupa peraturan perundang-undangan serta bahan hukum sekunder berupa literatur dan hasil penelitian terdahulu. Hasil penelitian menunjukkan bahwa tindakan penutupan sepihak pusat kebugaran berpotensi melanggar ketentuan dalam UUPK, khususnya terkait hak konsumen atas informasi, kenyamanan, dan kompensasi atas kerugian yang dialami. Selain itu, pelaku usaha memiliki kewajiban untuk memberikan ganti rugi kepada konsumen berdasarkan prinsip tanggung jawab mutlak (strict liability) sebagaimana diatur dalam Pasal 19 UUPK. Namun demikian, implementasi ketentuan tersebut dalam praktik masih menghadapi kendala struktural, terutama ketika pelaku usaha tidak lagi memiliki kemampuan finansial untuk memenuhi kewajiban ganti rugi. Oleh karena itu, penelitian ini merekomendasikan revisi UUPK untuk membentuk mekanisme Dana Jaminan Konsumen (Consumer Security Bond) sebagai instrumen preventif yang mewajibkan pelaku usaha menyisihkan sebagian dana keanggotaan ke dalam rekening jaminan guna memastikan tersedianya dana kompensasi apabila terjadi penutupan usaha. Mekanisme ini diharapkan dapat memperkuat efektivitas sistem perlindungan konsumen dan memberikan kepastian hukum bagi masyarakat.

Abstract

Tax avoidance is one of the main challenges in Indonesia's tax system, especially since this practice is formally legal but contrary to the spirit of fiscal justice. This study analyzes the legal arrangements regarding tax avoidance in Law Number 6 Year 1983 on General Provisions and Tax Procedures (KUP Law), which has been updated through Law Number 7 Year 2021 on Harmonization of Tax Regulations (HPP Law), as well as its implementing regulations. Although not explicitly categorized as a criminal offense, the authority of the Directorate General of Taxes (DGT) in correcting transactions based on the principle of substance over form and the use of schemes such as transfer pricing, special audit, and advanced pricing agreement are concrete steps in tackling tax avoidance. This study also highlights the obstacles faced by tax law enforcement officers, including: (1) substantive legal lacunae related to the definition and sanctions on tax avoidance; (2) limited access to cross-jurisdictional information despite AEOI; (3) lack of human resource capacity and technology in analyzing complex avoidance schemes; and (4) weak coordination between law enforcement agencies. This study recommends strengthening the General Anti-Avoidance Rule (GAAR) and developing the Specific Anti-Avoidance Rule (SAAR), as well as increasing the competence and analytical tools of tax officials.
