Abstract

This writing journal aims to study and find out the legal protection obtained by third parties as owners of land ownership certificates as replacement collateral for debtors at the bank. The problem taken in this journal is: How is Legal Protection for Mortgage Owners as Replacement Collateral by Debtors in Banks. This journal research uses a normative juridical approach method with the writing reference being positive legal rules in Indonesia. After that, carry out a normative analysis and use legal materials such as the 1945 Constitution, the Civil Code, statutory regulations, mortgage rights, legal expert opinions, and related concepts. This research is expected to focus on legal protection for third parties as owners of collateral/replacement collateral guaranteed by debtors, as positive legal provisions and debtor settlements harm third parties as owners of replacement objects. So it can be concluded in this paper that there are no provisions that prohibit other parties or third parties (other than creditors and debtors) from pledging their objects, but the owner of the collateral object is prone to being harmed. If another party as the owner of the collateral object feels that their rights have been violated, they will receive legal protection, both criminal and civil, and can be pursued through litigation or non-litigation.

Abstract

Perlindungan hukum bagi pasien peserta BPJS Kesehatan dalam pelayanan fasilitas kesehatan tingkat pertama merupakan isu penting dalam sistem kesehatan di Indonesia. Permasalahan yang selama ini selalu dikeluhkan oleh peserta BPJS adalah pelayanan dari mitra BPJS. Tidak maksimalnya layanan kesehatan mitra kerja menjadi salah satu prioritas persoalan yang dicarikan solusi. keluhan pasien ini terjadi pada faskes tingkat pertama. Masalah yang sering terjadi seperti, dokter keluarga yang tidak melayani dengan dalih antrean penuh, keluhan terkait ditolaknya pasien dengan dalih ruang pelayanan penuh hingga perbedaan perlakuan antara peserta BPJS dengan pasien umum. Buruknya pelayanan dari mitra BPJS tersebut sangat merugikan pasien BPJS yang telah melaksanakan kewajibannya sebagai peserta BPJS Kesehatan. Tujuan dari penelitian ini adalah untuk menganalisis mengenai perlindungan terhadap hak-hak peserta BPJS Kesehatan yang yang belum dipenuhi kepada pasien peserta BPJS Kesehatan. Dalam penelitian ini, digunakan pendekatan yuridis normatif khususnya pada pendekatan perundang-undangan. Kesimpulan dari permasalahan ini adalah perlindungan hukum terhadap hak-hak pasien peserta BPJS Kesehatan di fasilitas kesehatan tingkat pertama masih belum optimal terkait buruknya pelayanan. Oleh karena itu, diperlukan perbaikan dalam sistem pelayanan dan penegakan hak-hak peserta BPJS untuk memastikan layanan kesehatan yang adil dan berkualitas.

Abstract

Perkembangan pesat tindak pidana kekerasan seksual kini turut memengaruhi masyarakat dalam memanfaatkan media sosial. Tidak hanya sebagai ruang interaksi, media sosial juga sering kali disalahgunakan sebagai medium untuk melakukan kejahatan dan menjadikan penggunanya sebagai korban. Para pelaku kerap menjebak, memeras, hingga mencemarkan nama baik korban dengan menyebarkan konten pornografi melalui platform digital. Ironisnya, perlindungan atas data pribadi dan kerahasiaan pengguna teknologi sering kali terabaikan, padahal hal tersebut seharusnya menjadi prioritas utama. Oleh karena itu, urgensi penelitian ini terletak pada upaya untuk menganalisis regulasi mengenai tindak pidana pornografi serta meninjau perlindungan hukum bagi para korban. Penelitian ini termasuk dalam jenis penelitian hukum normatif, yang dilaksanakan melalui pendekatan studi pustaka. Fokus utama dari penelitian ini adalah untuk memahami kerangka hukum yang mengatur tindak pidana pornografi serta mekanisme perlindungan hukum yang dapat diakses oleh korban kejahatan tersebut. Berdasarkan hasil penelitian, regulasi terkait tindak pidana pornografi tercantum dalam beberapa peraturan perundang-undangan, termasuk KUHP, Undang-Undang Pornografi, serta Undang-Undang Informasi dan Transaksi Elektronik. Selain itu, perlindungan hukum bagi korban tindak pidana pornografi melalui media sosial meliputi pemberian bantuan medis hingga rehabilitasi psiko-sosial. Pengajuan bantuan ini dilakukan secara tertulis dan ditujukan untuk memastikan pemulihan kondisi korban serta memberikan keadilan hukum yang memadai.

Abstract

ABSTRAKSurat Pernyataan hibah ditulis dibawah tangan dianggap belum memenuhiunsur pembuktian dari perbuatan hukum hibah kepada penerima hibah. PeraturanPerundang-undangan No. 24 Tahun 1997 tentang pendaftaran tanah berlaku, tiappemberian hibah tanah dan bangunan harus dilakukan dengan akta Pejabat PembuatAkta Tanah (PPAT). Banyak permasalahan hukum yang muncul di masyarakat,terutama yang berkaitan dengan kepemilikan tanah, khususnya dalam kontekshibah Tanah. Hubungan hukum antara pihak yang memberikan hibah dan pihakyang menerima hibah didasarkan pada perjanjian, di mana pemberi hibah bertindaksebagai debitor dan penerima hibah sebagai kreditor. Hibah merupakan bentukhubungan hukum yang bersifat sepihak. Ini berarti bahwa pemberian hibahdilakukan secara sukarela oleh pemberi hibah kepada penerima tanpa menuntutadanya balasan atau imbalan apapun dari pihak penerima hibah.Penelitian inimembahas analisis putusan dari surat pernyataan hibah kepada penerima hibah danimplikasinya terhadap pihak urutan ketiga serta ahli waris yang diatur dalamundang undang. Hibah, sebagai perjanjian sepihak, diatur dalam KUH Perdata Pasal1666-1693, yang menyatakan bahwa hibah merupakan sebuah pemberian yangtidak dapat ditarik Kembali seperti semula. Namun, pelanggaran terhadap ketentuanlegitieme portie bagian minimal yang harus diterima oleh ahli waris—dapatmenimbulkan konsekuensi hukum yang signifikan.Penelitian ini menjelaskan jenispenelitian yuridis normatif, yang dikaji melalui pendekatan perundang-undangan.Data yang digunakan berasal dari studi putusan dan dokumen. Ketentuan pemberianhibah telah diatur bahwa hibah harus dilakukan di hadapan pejabat yang berwenangdengan akta autentik. Dalam kasus putusan perkara Nomor1050/Pdt.G/2018/Pengadilan Agama Selong,surat hibah dibuat secara sepihak dantanpa akta notaris bertentangan dengan Pasal 1682 KUH Perdata..Kata Kunci: Surat pernyataan hibah,Akta otentik,Tanah.

Abstract

The urgency of interest rate transparency in information technology-based lending services is crucial to protect the legal rights of borrowers. Based on POJK 10/05/2022, transparency is an obligation for fintech organizers, but many parties do not comply with the standards set by AFPI. As a result, borrowers are vulnerable to interest rate abuse. Insufficiently strict regulations and weak supervision and enforcement of sanctions from OJK create legal loopholes that can be exploited by fintech organizers. This study emphasizes the importance of OJK's role in strengthening policies and supervision, as well as enforcing sanctions to ensure compliance with the principle of transparency. This is expected to create a fairer financial services ecosystem, protect consumers, and support sustainable digital economic growth in Indonesia.

Abstract

Pengalihan piutang (cessie) sering kali menimbulkan potensi masalah terutama apabila cessie dilakukan tanpa adanya pemberitahuan kepada pihak debitur (cessus). KUHPerdata mengatur bahwa tindakan pengalihan piutang (cessie) harus dituangkan dalam suatu bentuk akta yang disebut dengan akta cessie. Keabsahan dari akta cessie berperan krusial dalam memberikan kepastian hukum serta memberi perlindungan pada kepentingan semua pihak yang terlibat. Penelitian ini menggunakan metode hukum normatif (normative legal research), sehingga pendekatannya meliputi pendekatan terhadap undang-undang, pendekatan konseptual, serta pendekatan berbasis kasus. Penelitian ini menggunakan bahan hukum primer dan bahan hukum sekunder dengan teknik analisis bahan hukum yang bersifat preskriptif dan menggunakan logika deduksi. Pemberitahuan dan persetujuan debitur adalah faktor penting dalam menjaga keabsahan akta cessie, apabila diabaikan dapat membuat cessie tidak berdampak hukum bagi debitur atau bahkan batal demi hukum.

Abstract

Tax evasion offenses involving amounts under IDR 500 million often present a dilemma between criminal law enforcement and the efficiency of recovering state losses. The conventional retributive justice system frequently fails to provide optimal outcomes in terms of legal certainty and financial recovery. This study aims to explore the potential implementation of restorative justice as an alternative approach for resolving minor tax evasion cases and to evaluate how well this approach aligns with the principles of substantive justice. The research employs a normative and empirical legal method, analyzing existing regulations and drawing comparisons with practices in other jurisdictions. The findings indicate that restorative justice offers a more equitable and efficient solution, provided that strict case selection criteria are applied, offenders are willing to take responsibility, and a transparent oversight mechanism is in place. It concludes that adopting restorative justice in low-scale tax evasion cases may help restore state losses without compromising the values of justice and legal certainty.

Abstract

A transfer deed made before a notary is a guarantee of rights to shares. There are still many problems with transfer deeds being submitted to the court by the heirs of the share giver when the transfer is carried out without the knowledge of the other heirs. This is detrimental to the rights the heirs should receive. The validity of a conservation deed that is not guided by applicable regulations can result in the conservation deed becoming invalid. This research method is normative using a statutory and regulatory approach and a contextual approach. The results of the research in this study are that a transition is an agreement that must be guided by Article 1320 of the Civil Code regarding the conditions for the validity of an agreement, a transition in the case of not fulfilling all the elements of the agreement including agreement, skills, a certain thing and a lawful cause. This results in the deed of transfer being invalid. People who are no longer competent to carry out legal actions need forgiveness from their biological children and the purpose of all heirs because biological children also have rights to the object of preserving shares. The notary who makes the deed of transfer can be held responsible for his negligence which results in losses for heirs based on Article 1365 of the Civil Code. Responsibilities imposed on maintenance include professional responsibility, civil responsibility and administrative responsibility.

Abstract

Illegal transfer of land rights is a developing and serious problem in Indonesia's land management system. This problem often involves fraud, document forgery, misuse of authority, and even complicity with corrupt officials, leading in the loss of land rights rightfully owned by citizens. In addition to causing the victims to suffer actual and intangible damages, these transgressions also compromise core legal precepts such as justice, legal certainty, and the defense of fundamental rights protected by the Constitution. The purpose of this study is to thoroughly investigate the types of legal protection that victims can obtain through non-litigation processes like mediation, administrative complaints, and legal aid, as well as through litigation channels including civil lawsuits, criminal reports, and administrative disputes.  By analyzing court decisions, this study uses a legislative, intellectual, and case-based approach to the normative legal method. The study's findings demonstrate that even though the Indonesian legal system has offered a variety of safeguards, victims continue to encounter a number of challenges, including convoluted processes, restricted access to legal aid, and widespread maladministration.  Therefore, to ensure that the preservation of land rights is not only normative but can be actually implemented in tangible terms in social life, it is imperative to promote public legal literacy, reform the land bureaucracy, provide access to legal assistance, and fortify law enforcement authorities.

Abstract

This article discusses the legal protection for lands right holder designated as abandoned lands. Abandoned land in Indonesia poses serious challenges, not only for the rights holders but also for the development of society and the states. This research employs a normative legal research method to analyzes applicable legal provision and implications of the regulations of abandoned land on rights holders and the wider community. The findings indicate that land rights holders have an obligation to manage and utilize their land in accordance with the prevailing regulations. Failure to do so may result in the designation of their land as abandoned, subsequently transferring its status to that controlled by the state. Additionally, this article recommends measures to enhance legal protection for rights holders, including the application of good governance principles in addressing abandoned land issues. These findings provide important insights into the need for more effective regulations and actions in managing abandoned land for the welfare of the communition and the states.
