Abstract

People do various ways to survive, they make every effort whether they are farmers, traders, employees or other professions. Likewise, some people in the village of Tanjung Sari, Jenangan, Ponorogo, chose to become bricks managers and entrepreneurs at the brick making center in the local village. The pattern of brick- making cooperation in Tanjung Sari village, Jenangan Ponorogo sub-district has fulfilled the terms and conditions of the agreement but in terms of profit sharing there is uncertainty because the capital owner has determined the price at the beginning, deducted the amount of the manager's loan but in this case found no elements that lead to fraud and compulsion, this is in accordance with Islamic ethical ethics. Whereas the cooperation agreement between the entrepreneur (owner of capital) and the manager of the brick is classified as mud syirkah mudh{a>rabah but in practice there is an element of non-compliance with syirkah muda>rabah condition in terms of determining the benchmark price at the beginning when the manager borrows money to the capital owner whereas capital owners can sell middlemen with a nominal that is much higher than the price of the manager. The contract lends a certain amount of money to the brick manager, which is classified as a qardlu contract which is lively (there is an excess of benefits. Beragam cara dilakukan orang untuk bisa berhahan hidup, mereka melakukan segala upaya baik menjadi petani, pedagang, pegawai maupun profesi-profesi lainnya. Demikian juga sebagian masyarakat di desa Tanjung Sari kecamatan Jenangan kabupaten Ponorogo yang memilih menjadi pengelola dan pengusaha batu bata di sentra pembuatan batu bata di desa setempat. Pola kerjasama pembuatan batu bata di desa Tanjung Sari Kecamatan Jenangan Ponorogo telah memenuhi syarat dan rukun akad tetapi dalam hal pembagian keuntungan terdapat ketidakjelasan karena pemilik modal sudah menentukan harga di awal, dipotong besarnya pinjaman pengelola tetapi dalam hal ini tidak ditemukan unsur-unsur yang mengarah pada penipuan maupun keterpaksaan, ini sesuai dengan etika Islami keridha>an. Sedangkan Akad kerjasama antara pengusaha (pemilik modal) dan pengelola batu batu bata digolongkan sebagai syirkah mud{a>rabah tetapi pada prakteknya ada unsur ketidak sesuaian syarat syirkah mud{a>rabah dalam hal penentuan patokan harga di awal ketika pengelola meminjam uang kepada pemilik modal sedangkan pemilik modal bisa menjual batu bata ketengkulak dengan nominal yang jauh lebih tinggi dibanding dengan harga dari pengelola. Akad meminjamkan sejumlah uang kepada pengelola batu bata tergolong dalam akad qardlu yang jarra naf’an (adanya kelebihan manfaat).

Abstract

Mu'amalah fiqh there are several types and types of contracts, one of which is the musaqoh (watering) contract. Likewise, the implementation of the contract in the tasen system between the land management community and Perhutani as the land owner in Hamlet Wonojati, Suren Village, Mlarak District, Ponorogo Regency. From the results of the study it was found that the implementation of the tasen system still uses manual intercropping farming techniques, in which the existence of the tasen system was responded to well by all members of the community. The implementation of the musaqoh contract in the management of Perhutani's land was in accordance with its terms and conditions and was shown from the Islamic attitudes and actions of both parties. Although there are some things that are not appropriate, this is done because of a compulsion. Dalam fiqih mu’amalahada beberapa macam dan jenis akad, salah satunya akad musaqoh (penyiraman). Begitu juga pelaksaaan akad dalam sistem tasen antara masyarakat pengelola lahan dan Perhutani sebagai pemilik lahan di Dukuh Wonojati Desa Suren Kecamatan Mlarak Kabupaten Ponorogo. Dari hasil penelitian didapatkan bahwa pelaksanaan sistem tasen masih menggunkan teknik pertanian tumpang sari manual, yang mana keberadaan sistem tasen ini ditanggapi baik oleh seluruh warga masyarakat. Implementasi akad musaqoh pada kerjasama pengelolaan tanah milik Perhutani telah sesuai dengan syarat dan rukunnya serta ditunjukkan dari sikap dan tindakan Islami dari kedua belah pihak. Meskipun ada beberapa yang kurang sesuai hal tersebut dilakukan karena sebab keterpaksaan.

Abstract

Maximizing “cuan or profit” in a business is a necessity. Traders often memorize all means in marketing their merchandise. Likewise, coffee sellers on Suromenggolo street or new road in Ponorogo Regency. In attracting customers they deliberately involve "sexy" women to sell their trade. This is a field of research, researchers go directly to the field to examine gaps that occur, data collection techniques using interviews, observation and data analysis. Various reasons for women to become coffee shop servants on Suromenggolo street, starting from the low level of education to being pushed aside, the difficulty of meeting family needs is a major factor. While in terms of the analysis the sociology of Islamic law, it was found that injustice in the process of cooperative interaction between coffee shop business owners and the female servants. Even though they are aware of the injustices and dishonesty that occur in reality they cannot fight the consequences of the agreed standard rules at the beginning. Memaksimalkan cuan dalam sebuah bisnis maupun usaha merupakan keniscahyaan. Pedagang seringkali menghalkan segala cara dalam mamasarkan dagangannya. Begitu juga para penjual kopi di jalan Suromenggolo atau jalan baru Kabupaten Ponorogo. Dalam menarik pelanggan mereka sengaja melibatkan perempuan “seksi” untuk menjajalkan dagangnnya. Ini merupakan field research, yaitu peneliti terjun langsung ke lapangan untuk meneliti kesenjangan yang terjadi, teknik pengumpulan data menggunakan interview, observasi dan analisi data. Berbagai alasan para perempuan menjadi pelayan warung kopi di Jalan Suromenggolo mulai dari rendahnya tingkat pendidikan sampai terdesak akan sulitnya memenuhi kebutuhan ekonomi keluarga menjadi faktor utamanya. Sedangkan dari segi analisis sosiologi hukum Islam di temukan ketidakadilan dalam proses interaksi kerjasama antara pemilik usaha warung kopi dengan para pelayan perempuan tersebut. Meskipun mereka mengetahui atas ketidakadilan dan ketidakjujuran yang terjadi kenyataannya mereka tidak bisa melawan akhibat aturan baku yang sudah disepakati diawal.

Abstract

The background to this research is that Ijarah is an agreement to transfer the right to use a good or service for a certain time through rental payments without being followed by a transfer of ownership of the right. J&T Express goods delivery service Sumoroto branch, where the admin is less transparent in providing information regarding rounding of scales, resulting in some consumers not knowing about this. This problem causes losses for consumers because the rounding carried out tends towards the top, and this final assignment contains the problem formulation (1) what is the practice of rounding the scales carried out at the Sumoroto branch of the J&T Express goods delivery service? , (2) how Islamic law reviews the practice of rounding scales at the J&T Express goods delivery service at the Sumoroto branch. This research uses a qualitative approach and uses observation, interview and documentation procedures. The conclusions are (1) the rounding method used by J&T Express Sumoroto branch is carried out by: Calculating actual weight scales (kilograms) with a weighing tolerance limit of 1.3 kg and scales based on the volume of goods (volumetric), (2) J&T Sumoroto Express Branch rounding practices are carried out with the ijarah system and is said to be valid because it fulfills the requirements and pillars of ijarah, including: aqid, Sighat, ujrah, and benefits. However, in the transactions carried out, the rounding system is not valid in Q.S Hud verse 85 because there is an element of rounding off the scales.
