Abstract

This research is intended to: (1) find out how effective the implementation of Electronic Traffic Law Enforcement (ETLE) is for traffic violations based on Law no. 22 of 2009 concerning Traffic in Gorontalo City. The research results show, first, the implementation of the ETLE system for traffic violations based on the LLAJ Law in Gorontalo City is to modernize the system for handling traffic violations, enforce traffic laws, and in order to instill a culture of compliance in traffic. Apart from that, the implementation of the ETLE system in Gorontalo City is quite effective and better than conventional systems because the ETLE system can produce more violation data, is efficient in terms of time, and does not require deploying officers in the field directly. Second, the factors that hinder the implementation of the ETLE system in Gorontalo City are the lack of a culture of traffic compliance by the community, a mismatch between the data held by officers and the data recorded by the ETLE system, and the ETLE system not being able to detect certain types of violations.

For this reason, this study aims to determine the opportunities for the existence of Gorontalo customary law through the prerequisites contained in the Explanation of Article 2 paragraph (1) of the National Criminal Code. This research uses normative legal research methods with a statutory approach and conceptual approach and uses primary, secondary and tertiary legal materials. The legal material is then analyzed qualitatively using grammatical, systematic, and historical interpretations. The results showed that Gorontalo customary law exists through the presence of several regional regulations, including (1) Gorontalo Provincial Regulation Number 2 of 2016 concerning the Implementation of Customary Institutions; (2) Gorontalo Mayor Regulation Number 10 of 2020 concerning the Implementation of the Dulohupa Customary Institution of Gorontalo City; and (3) Regional Regulation of Bone Bolango Regency Number 8 of 2020 concerning the Implementation of Customary Institutions. Furthermore, through regulations at the regional level, Gorontalo customary law is also present through concrete events such as the management of customary institutions carried out periodically. Based on this, the regulation of concrete norms related to acts prohibited under living law in regional regulations as required by the Explanation to Article 2 paragraph (1) of the National Criminal Code will have a very large opportunity.

Abstract

This research aims to analyze the judge's decision regarding environmental crimes committed by corporations through Decision Number 190/Pid.B/LH/2020/PN Plw. This research uses a type of normative research with three approaches for the purposes of legal analysis and explanation, namely the case approach, statutory approach and conceptual approach. In contrast to previous research, this research specifically describes how judges interpret judges' interpretations in deciding cases of environmental crimes committed by corporations in more detail, not only from a criminal law perspective but also from the perspective of environmental law itself. The results of this research show that the Defendant in the "a quo" case is not a human being/person who can physically act and speak in front of the court, but rather a corporation with a legal entity, so in this case the Defendant PT. APAI must be represented by its administrator, namely Mr. GKE who is the Director of PT. WHAT. The defendant's actions were categorized as gross negligence because they reflected very serious negligence because they had a significant impact and were detrimental to the wider community. The defendant was not sentenced to prison but was only sentenced to a minimum fine in accordance with the provisions of Article 99 Paragraph (1). The defendant was also sentenced to additional punishment or disciplinary action in the form of reparation for the consequences of the criminal act even though this article was not included in the prosecutor's indictment. The additional punishment imposed is in the form of the amount of costs required to improve the environment in the amount of land that has been determined by taking into account the polluter pays principle and the precautionary principle. For this reason, the imposition of additional criminal sanctions should be decided by considering the concept of sustainable and environmentally sound development by taking into account various aspects including social, economic and environmental.
