Abstract

The examination of child victims of sexual violence in trials has not been effectively carried out in accordance with Law Number 11 of the Year, in trials of child victims of sexual violence the child victims must provide information again during the trial which has previously been explained during the inquiry and investigation process so that the child must remember again. incidents that make children afraid and traumatized, plus they have to meet the defendant or perpetrator who is someone who has caused trauma and damaged the child physically and psychologically, not to mention children who do not receive assistance and health and safety measures during the judicial process as in case number 117.Pid.Sus/PN LBo where the two child victims did not receive assistance from child protection agencies and from psychology for child safety and health efforts in accordance with Law Number 11 of the Year. This research uses an empirical juridical research method which is research and implementation in accordance with written legal provisions. Based on the results of the analysis of Law Number 11 of 2012, it provides protection and assistance to child victims, especially child victims of sexual violence, victims receive assistance treatment during the investigation and case investigation process until the completion of the case trial, but in fact in case 117.Pid.Sus/2022/ PN LBo, child victims experience deep trauma and even damage to the child's psychology, but there is no assistance from institutions that are experts in handling this case, such as women and children empowerment institutions, so that the examination of child victims of sexual violence in court has been effective but has not been carried out optimally.

Abstract

The research discusses the factors causing drug abuse cases and their countermeasures in Pohuwato Regency. The method used in the research is empirical with qualitative descriptive data analysis that describes and describes reality data in the field. Based on the results of the study, that the factors that cause drug abuse cases in Pohuwato Regency are internally derived from within a person. Where the inability to adjust and weak self-confidence so that the perpetrator is unable to control the desire to try and have experience with drugs that are expected to overcome the mental pressure he experiences. The pressure in question comes from family circumstances that are less supportive (not harmonious) and indifferent to one's self-development. In addition, there are external factors, namely the promiscuity of the perpetrator, social and work environment factors, economic problems and easy access for the perpetrator. Police Countermeasures against Drug Crimes in Pohuwato Regency are carried out by conducting Early Prevention or Pre-emtif efforts by conducting searches regarding the causes or drivers, to the opportunities for the use of these illegal drugs. Early prevention is carried out through education that aims to create awareness and vigilance, by distributing banners and advertising banners and invitations not to use drugs in agencies and public service places including in the school environment. Preventive efforts with socialization and counseling, supervision of narcotics trafficking traffic both at the port and land which is the entry point for migrants in Pohuwato district. In addition, this supervision is also carried out routinely in places where transactions are usually held, for example nightclubs and locations where teenagers usually gather, and conduct operations or patrols or raids. Repressive efforts as the last step to take firm action against the perpetrator by imposing sanctions, as well as the implementation of rehabilitation involving various elements.

Abstract

The purpose of this research is to determine the demands of prosecutors at the Bone Bolango district attorney's office regarding defamation on social media and to determine the factors that influence the disparity in prosecutors' demands at the Bone Bolango district attorney's office regarding criminal acts of defamation on social media. The research method used is a type of empirical research, namely a legal research method that functions to see the law in real terms and examine how the law works in society. The results of the research obtained regarding the prosecutor's demands at the Bone Bolango District Prosecutor's Office regarding defamation on social media, there is a disparity in the demands therein, where in the same case the level of material is the same, but the prosecution in both cases is too far apart, this is caused by several factors. These include social reasons, trial facts and statutory regulations. The conclusion that there is a disparity in sentences demanded by public prosecutors was never intended to eliminate the difference in the amount of punishment for criminals, but rather to reduce the range of differences in sentences imposed because this disparity which is too far is contrary to justice and law enforcement and has an impact on the wider community.

Abstract

Kota Gorontalo memiliki situs bawah air Leato, yang dikenal juga dengan sebutan situs kapal tenggelam Japanese Cargo Wreck. Namun realitasnya, belum ada produk hukum yang menata prosedur penyelaman di lokasi situs bawah air Leato / Japanese Cargo Wreck. Rumusan masalah dalam penelitian ini, bagaimana model regulasi wisata minat khusus scuba diving kaitannya dengan optimalisasi perlindungan hukum situs bawah air Leato / Japanese Cargo Wreck? Metode penelitian yang digunakan metode penelitian normatif. Tujuan penelitian yaitu mengkaji urgensi optimalisasi perlindungan hukum situs bawah air Leato / Japanese Cargo Wreck melalui pembuatan regulasi hukum dan mendeskripsikan model regulasi wisata minat khusus scuba diving kaitannya dengan optimalisasi perlindungan hukum situs bawah air Leato / Japanese Cargo Wreck. Kegunaan penelitian memberikan kepastian hukum. Hasil kajian, realitasnya melalui langkah hukum yang progresif yakni menghadirkan regulasi hukum prosedur penyelaman rekreasi di lokasi situs bawah air Leato / Japanese Cargo Wreck dalam rangka menyikapi pesatnya pertumbuhan industri selam beserta potensinya. Model regulasi hukum prosedur penyelaman rekreasi di lokasi situs bawah air Leato / Japanese Cargo Wreck sebagai sebuah proses pembangunan hukum yang ditujukan untuk menata aktivitas hukum ke arah yang lebih baik dan kontributif khususnya terkait kesinambungan pemanfaatan situs bawah air Leato / Japanese Cargo Wreck dibidang wisata bahari minat khusus Scuba Diving tanpa mengenyampingkan pelestariannya dan juga status hukumnya sebagai kawasan konservasi maritim. Terdapat kebijakan-kebijakan hukum baik internasional maupun nasional yang dapat dijadikan landasan formulasi regulasi dan salah satunya yakni regulasi jalur penyelaman di U.S.A.T. Liberty di Tulamben, Provinsi Bali. Kesimpulan, memiliki Regulasi hukum guna optimalisasi perlindungan hukum situs bawah air Leato / Japanese Cargo Wreck sekaligus memaksimalkan potensinya pariwisatanya. Model regulasi dapat menjadikan menjadikan U.S.A.T Liberty di Tulamben, Bali sebagai percontohan penerapan regulasi prosedur menyelam pada situs bawah air. Sekaligus pengelolaannya dibidang pariwisata.

Abstract

This article applies the theory of restorative justice to the analysis of state losses resulting from corrupt activities. This study employs socio-legal research, which is a type of normative legal research that is dependent on values and facts. The study's findings revealed that two (2) points of view are based on the fundamental notion that restorative justice can compensate the state for damages incurred through acts of corruption. First, in order to make up for the losses sustained by the state as a result of corrupt criminal acts, law enforcement must be centered around the idea of restorative justice. Secondly, the fact that the Constitutional Court's ruling Number 25-PUU-XIV-2016 eliminated the word "may" from Article 2 paragraph (1) and Article 3 of Law Number 20 Year 2001 in combination with Law Number 31 Year 1999 for the Eradication of Corruption remains a reality. In order to ensure that substantive justice in the application of restorative justice does not clash with current laws and regulations and is administered with chosen criteria, the A quo ruling nullifies Article 4 of the Corruption Crime Eradication Law.

Abstract

Indonesian criminal law adheres to various principles that form the basis for solving problems, especially in problems related to two or more countries. One of the principles recognized and in line with the research, in this case, is the territorial principle, which is a useful principle in determining the limits of validity of criminal law provisions based on place or location. This study aims to analyze the application of the territorial principle to perpetrators of pedophilia crimes committed by foreign nationals. The method used in this study is a normative type of research that uses the law approach and case studies. The results of this study indicate that should be based on the principle of criminal law, namely the territorial principle, Indonesian law will be applied to anyone who commits a crime in Indonesia, including in this case foreign citizens who commit pedophilia crimes, especially a sovereign state has exclusive jurisdiction in the environment. the territory itself is called territorial sovereignty so that the state has full jurisdiction to punish people who commit crimes against the law in the territory of the country. In reality, this territorial principle cannot be applied to this case because the suspect is still in the process of waiting for the results of approval or rejection of extradition by the Ministry of Law and Human Rights of the Republic of Indonesia, considering that the suspect is a foreign citizen and is also a fugitive in his home country, namely the United States of America. so that the country of origin sends a letter of request for extradition and this extradition request is still in the process of being followed up.

Abstract

The use of electric bicycles is currently becoming a primadonna among the community. The combination of transportation and technology makes it a creative and revolutionary innovation. High public interest and also based on the thought of the movement to save the Earth from carbon emissions has increasingly popularized the use of electric bicycles.  The purpose of this study was to determine and analyze the urgency of regulating electric bicycles in Gorontalo City in a progressive legal perspective.  The research method used is statute approach and conceptual approach.  Electric bicycles have begun to be traded in the Gorontalo Province. Of course, this indicates that Gorontalo Province has good market potential. Nationally, the rules for the use of electric bicycles have indeed been accommodated in the Minister of Transportation Regulation, but their embodiment in regional regulations is still needed considering that Gorontalo Province in general and Gorontalo City in particular certainly have special conditions. which must also be accommodated in a regulation because the facilities and infrastructure as well as local wisdom that live in the community are certainly not at the same level nationally. It is appropriate that the use of electric bicycles as a means of transportation is made a legal umbrella in the regions. Law through the lens of progressiveness must move faster than society itself considering that law is rigid while society is dynamic

Abstract

Instant profit-making patterns have been established by the current online purchasing and selling practices. For example, brushing is the activity of internet retailers or merchants fabricating favorable reviews or fraudulent endorsements to boost the reputation of their goods or services. When a customer receives a product or service that falls short of their expectations, brushing can be harmful. This study aims to investigate the legality of online buying and selling in Indonesia, specifically the practice of "brushing," or using fictitious orders, reviews, and buyers.  The methods used are Statute Approach, Case Approach, Conceptual Approach, Analytical Approach, Theoretical Approach.   The findings indicated that, from the standpoint of Indonesian telematics and consumer protection legislation, brushing activities frequently contravene a number of relevant rules and laws. As a result, brushing may be deemed unlawful in Indonesia and subject to penalties based on relevant legislation. In order to prevent brushing activities, it is critical that the government and regulatory agencies bolster law enforcement, protect consumers from brushing practices, and inform consumers of their rights in this regard. Enforcing stringent regulations and ensuring their efficient implementation are crucial for safeguarding consumers and upholding the integrity of Indonesia's online ecosystem.

Abstract

Pedulilindungi adalah aplikasi yang dikembangkan untuk membantu instansi pemerintah terkait dalam melakukan pelacakan untuk menghentikan penyebaran Coronavirus Disease (covid-19). Aplikasi ini mengandalkan partisipasi masyarakat untuk saling membagikan data lokasinya saat bepergian agar penelusuran riwayat kontak dengan penderita covid-19 dapat dilakukan. Pengguna aplikasi ini juga akan mendapatkan notifikasi jika berada di keramaian atau berada di zona merah, yaitu area atau kelurahan yang sudah terdata bahwa ada orang yang terinfeksi covid-19 positif atau ada Pasien Dalam Pengawas. Disebutkan dalam ketentuan aplikasi pedulilindungi, bahwa segala hal terkait pengaksesan dan penggunaan pedulilindungi dilakukan atas tanggung jawab pengguna dan/atau pelanggan, sehingga semua risiko untuk penggunaan pedulilindungi ditanggung oleh pengguna dan/atau pelanggan. menanggapi pembatasan tanggung jawab tersebut, yaitu tidak bertanggung jawab atas setiao kerugian yang diakibatkan karena adanya pelanggaran atau akses tidak sah terhadap PeduliLindungi, termasuk namun tidak terbatas pada hal-hal ataupun fitur yang terdapat dalam PeduliLindungi yang dilakukan oleh pengguna dengan cara bertentangan dengan ketentuan hukum yang berlaku.

Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana tugas dan kewenangan pegawai negeri sipil (PPNS) dalam menangani tindak pidana bea cukai dan untuk menganalisis bentuk koordinasi yang dilakukan oleh PPNS Bea Cukai dan Penyidik Kepolisian dalam penyidikan tindak pidana di bidang kepabeanan. Metode penelitian yang digunakan adalah yuridis-normatif yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa tugas-tugas dari Direktorat Penindakan dan Penyidikan meliputi usaha preventif, yaitu usaha untuk mencegah terjadinya tindak pidana penyelundupan dengan meniadakan sebab terjadinya. Undang-Undang No. 10 Tahun 1995 Tentang Kepabeanan, Pejabat PPNS di lingkungan Direktorat Jenderal Bea dan Cukai diberi wewenang untuk melakukan penyidikan tindak pidana di bidang Kepabeanan. Tindak pidana di bidang Kepabeanan adalah tindak pidana fiskal. PPNS di lingkungan Direktorat Jenderal Bea dan Cukai diberikan kewenangan untuk melakukan penyidikan tindak pidana di bidang Kepabeanan salah satunya adalah tindak pidana penyelundupan dan bentuk koordinasi yang dilakukan oleh PPNS Bea Cukai dan penyidik Polri dalam penyidikan tindak pidana di bidang Kepabeanan adalah pemberitahuan dimulainya penyidikan (SPDP) dan penyampaian hasil penyidikan dari PPNS ke penyidik Polri baik secara lisan maupun tertulis. Sementara pelaksanaan pengawasan penyidikan dapat dilakukan dalam bentuk bantuan penyidikan yang berupa bantuan taktis berupa personil maupun peralatan penyidikan, bantuan teknis penyidikan, bantuan pemeriksaan ahli dalam rangka pembuktian secara ilmiah, dan bantuan upaya paksa
