Abstract

Stunting merupakan masalah kesehatan darurat yang memengaruhi perkembangan fisik dan kognitif anak. Di Desa Butuh Kecamatan Kalikajar Kabupaten Wonosobo, tingginya prevalensi stunting menyoroti perlunya intervensi kebijakan yang terstruktur dan kontekstual. Kegiatan Pengabdian kepada Masyarakat ini bertujuan untuk menyusun policy brief yang merekomendasikan kebijakan pencegahan stunting pada tingkat desa, berdasarkan data dan kebutuhan berbasis kearifan lokal. Metode implementasi meliputi pengumpulan data tentang prevalensi stunting, lokakarya, Focus Group Discussion (FGD), penyusunan ringkasan kebijakan, dan penyuluhan bagi masyarakat. Melalui pendekatan transendental yang berakar pada kearifan lokal, pemerintah desa diharapkan dapat merumuskan kebijakan yang lebih tepat sasaran dan efektif dengan melibatkan akademisi, kader kesehatan, organisasi, dan tokoh masyarakat sebagai pemangku kepentingan. Pemanfaatan data observasi kuantitatif berfungsi sebagai dasar untuk ringkasan kebijakan, memastikan keselarasan dengan kondisi desa yang sebenarnya. Kegiatan ini menghasilkan ringkasan kebijakan yang menguraikan rencana strategis dan prioritas, yang mengarah pada pembentukan Tim Percepatan Penurunan Stunting dan Naskah Akademik Rancangan Peraturan Desa tentang Strategi Penurunan Stunting di Desa Butuh.

Abstract

Legislation of the presidential institution has been proposed since 2001 through the draft of the Presidential Institution Law. The problem is that presidential impeachment as a mechanism for limiting presidential power is not regulated. This study aims to: First, compare the regulations on presidential impeachment and impeachment in countries. Second, examine the existence of regulations on presidential impeachment and impeachment that currently exist in Indonesia. Third, measure the urgency of carrying out legislation on presidential impeachment in the Presidential Institution Law. This study is a doctrinal legal study that conducts a literature study with a comparative, conceptual, and legislative approach. The results of this study indicate that based on the comparison there are variations in the regulation of presidential impeachment in countries. Still, starting from the important situation of regulating this in both the constitution and legislative products, the regulation of impeachment in Indonesia itself is spread among many laws and regulations which in some cases causes technical problems in resolving the impeachment mechanism. Therefore, it is necessary to codify impeachment in one Presidential Institution Law.

Abstract

ABSTRAK Terdapat dua persoalan yang mendasari penelitian ini. Pertama, Pasal 13 UU Nomor 3 Tahun 2022 tentang Ibu Kota Negara (IKN) menyatakan di IKN Nusantara hanya akan dilaksanakan Pemilu pada tingkat Nasional, namun dalam PERPPU No. 1 Tahun 2022 tentang Pemilu tidak mengatur dapil khusus untuk itu. Kedua, terdapat pertanyaan konseptual untuk Pemilu DPD sebab susunan Pemda IKN yang hanya setingkat provinsi. Persoalan tersebut akan dikaji berdasarkan problematika konseptual, urgensi hadirnya DPD, serta pelaksanaan Pemilu DPD di IKN Nusantara. Penelitian ini adalah penelitian yuridis normatif. Bahan hukum dari sumber kepustakaan selanjutnya akan ditelaah secara kualitatif. Kesimpulan penelitian ini, terdapat disparitas konseptual keberadaan DPD di IKN, pada satu sisi strukturnya yang setingkat provinsi tidak bisa dikategorikan sebagai provinsi sebab bukan merupakan daerah otonom. Pada sisi lain, DPD sebagai representasi regional memiliki kinerja untuk mewakili seluruh daerah dalam wilayah Indonesia. Terlepas dari itu, keberadaan DPD untuk dapil IKN memiliki urgensitas, secara umum untuk mewujudkan aspirasi kedaerahan serta secara khusus untuk melakukan kontrol terhadap kinerja Badan Otorita IKN dan Presiden dalam wilayah IKN. Terakhir, sampai diadakan Pemilu DPD di IKN, fungsi aspirasi kedaerahan dilaksanakan oleh Badan Otorita.

Abstract

Gender quota policies for women in parliament or politics worldwide have developed since the 1990s. Indonesia applies this policy to the House of Representatives (DPR) as a political representation with a 30 (thirty) percent quota. As a fellow national parliamentary institution that is part of the People's Consultative Assembly (MPR), it turns out that there is a policy vacuum for DPD institutions. The vacuum, in addition to illustrating discriminatory practices, can potentially result in a very minimal representation of women in the institution. This study aims to assess the probability of implementing a similar policy for DPD institutions or provide other recommendations that are more appropriate. This research used normative legal research that uses the statute approach, conceptual approach, and comparative approach. Our data is obtained from a literature study and will be analyzed qualitatively. The results of this study, based on the consideration of nomination inequality and patriarchal culture, comparison of other countries, DPD as part of the MPR, Indonesia's bicameral system, and the correlation of Regional Representation and Women's Issues in Indonesia; DPD has several important and relevant arguments for implementing affirmative gender quota policy. However, against these considerations, there are also arguments that are not important and irrelevant, have no significant impact, or are impossible to apply, which is a challenge to implement affirmative policies such as DPR. Therefore, the most appropriate recommendation for DPD is simply through more massive socialization of candidacy by the General Election Commission (KPU) so that the legal culture in the form of awareness of the existence of female DPD members will grow and concerns about the lack of female DPD members can be prevented.

Abstract

Regulatory dynamics in Indonesia are facing over-regulation or over-lapping caused by irregularities in the legislative institutions organization and harmonization of regulations. This is also inseparable from the sectoral ego of each institution. The presence of the Job Creation Law through the omnibus law method is considered a solution to overcome the problem of national regulations, but the existence of this law presents a new problem, namely the increasing number of derivative regulations that must be issued. This research focuses on two main issues: first, the legal and political capability of harmonizing regulations under the law through the Job Creation Law. Second, the urgency of establishing a National Legislation Center to overcome over-regulated and over-lapping regulations under the law This study uses a normative juridical type with literature studies. Data obtained from primary and secondary sources and analyzed qualitatively. The results of this study indicate that the legal politics of harmonization of the Job Creation Law does not have the capability to overcome the problems of laws and regulations under overlapping laws. Next, it is necessary to establish the Central National Legislative Body as a state institution under the President at the Ministry level with the function of controlling statutory regulations under the law so that they are not over-regulated or over-lapping.Keywords: Central Agency for National Legislation, Job Creation Law, Politics of Law AbstrakDinamika regulasi di Indonesia menghadapi situasi over-regulated atau over-lapping yang disebabkan oleh ketidakteraturan lembaga legislasi dalam menata dan mengharmonisasikan regulasi. Hal ini juga tidak terlepas dari ego sektoral masing-masing lembaga. Kehadiran Undang-Undang Cipta Kerja melalui metode omnibus law dianggap sebagai solusi untuk mengatasi persoalan regulasi nasional tersebut, akan tetapi keberadaan undang-undang tersebut menghadirkan persoalan baru, yakni makin banyaknya regulasi turunan yang harus diterbitkan. Penelitian ini menitikberatkan pada dua masalah utama. Pertama, kapabilitas politik hukum harmonisasi peraturan di bawah undang-undang melalui UU Cipta Kerja. Kedua, urgensi pembentukan Badan Pusat Legislasi Nasional untuk mengatasi over-regulated dan over-lapping peraturan di bawah undang-undang. Penelitian ini menggunakan metode yuridis normatif dengan studi kepustakaan. Data yang diperoleh dari sumber-sumber primer maupun sekunder dan ditelaah secara kualitatif. Hasil penelitian ini menunjukan bahwa politik hukum harmonisasi UU Cipta Kerja tidak memiliki kapabilitas untuk mengatasi problematika peraturan perundang-undangan di bawah undang-undang yang tumpang tindih. Berikutnya, perlu untuk dibentuk Badan Pusat Legislasi Nasional sebagai lembaga negara di bawah Presiden setingkat Kementerian dengan fungsi mengontrol peraturan perundang-undangan di bawah undang-undang agar tidak over-regulated maupun over-lapping.Kata Kunci: Badan Pusat Legislasi Nasional, Politik Hukum, UU Cipta Kerja

Abstract

In the beginning, traditional beliefs in Indonesia were always rejected. Even RI Presidential Decree No. 1/PNPS 1965 provides criminal sanctions against individuals who adhere to traditional beliefs that defame religion. Even though Constitutional Court Decision No. 97/PUU/VIX/2016 was later acknowledged, its conception remains questionable. Moreover, with the characteristics of the 1945 Constitution of the Republic of Indonesia which is a constitutional constitution based on God; there is a gray area regarding the relevance of traditional beliefs to the identity of such a constitution. The method used is socio-legal with a legal approach in the form of a statutory approach, a conceptual approach, and a religious studies approach. Data was obtained from the literature and analyzed qualitatively. This research concludes that the concept of constitutional identity is part of the constitutional identity that is accommodated in Indonesia. Beliefs that have the dimension of trust in an entity that has power can be analyzed using this concept to examine the suitability and explore the philosophical basis in the Indonesian legal system. Finally, the acceptance of traditional beliefs in Indonesia is due to two philosophical legitimations, namely a godly constitution (slightly) due to its characteristics in traditional beliefs, and a cultural constitution that respects the existence of traditional beliefs as cultural identities and traditional rights.
