Abstract

The regulaion of traditional markets and modern stores stated in Regional Regulation Number 11 in 2011 section 19 points 1, explains that the mini market is at least 1 km from the traditional market. This research aims to find out and to analyze: 1) Polecy Regulation about establishment of traditional markets and Modern Stores; 2) the implementation of Policy about the establishment of traditional markets and Modern Stores in Kramatmulya District. The writer makes thi study using descriptive analytical research i.e. describing a case based on the rules and regulation relating to positive law that has close relation with the problem of this research. In this study the method used are empirical juridical method, i.e., the method using data from books or literature or regulations regarding with the problem observed as the results of the interview or observation to a place of research. To collect data in this study uses observation and interview. The research location is in Kramatmulya District. The results showed: 1) Responses regarding establishment permit BPPT modern stores beginning with the meeting of the study after getting pleas from the community. 2) response of the Government and businessmen regarding the rules of modern stores Setup significantly influential to the existence of traditional market in district Kramatmulya. Regulations concerning modern store setup is currently regulated in the regulations of Kuningan Regency number 11 in 2011. The society gave a positive response towards the regulation of modern stores setup in Kramatmulya District . Keywords: Modern Store Setup, the presence of traditional markets   Abstrak Ketentuan mengenai pasar tradisional dan toko modern di dalam Peraturan Daerah Nomor 11 Tahun 2011 menurut Pasal 19 Angka 1, dijelaskan bahwa minimarket berjarak minimal 1 km dari pasar tradisional. Tujuan dari penelitian ini adalah untuk mengetahui dan menganalisa : 1) Regulasi Kebijakan Pendirian Toko Modern dan Pasar Tradisional, dan 2) Implementasi Kebijakan Pendirian Toko Modern dan Pasar Tradisional di Kecamatan Kramatmulya. Penulis melakukan penelitian, menggunakan spesifikasi penelitian deskriptif analisis, yaitu menggambarkan sesuatu hal upaya yang jelas dan melalui peraturan-peraturan dan peraturan perundang-undangan yang berlaku berkaitan dengan hukum positif yang ada kaitannya dengan masalah ini. Adapun metodenya adalah yuridis empiris yaitu metode yang bersifat mendapatkan data dari buku-buku atau literatur ataupun peraturan perundang-undangan mengenai apa yang diteliti hasil wawancara maupun observasi ke tempat penelitian. Lokasi penelitian di Kecamatan Kramatmulya. Hasil penelitian menunjukkan : 1) Tanggapan BPPT mengenai ijin pendirian toko modern diawali dengan rapat kajian setelah mendapatkan permohonan dari masyarakat. 2) Tanggapan pemerintahan desa dan pelaku usaha mengenai peraturan tentang penataan toko modern berpengaruh secara signifikan terhadap keberadaan pasar tradisional di Kecamatan Kramatmulya. Peraturan tentang penataan toko modern saat ini diatur dalam Peraturan Daerah Kabupaten Kuningan Nomor 11 Tahun 2011. Masyarakat memberikan tanggapan yang positif terhadap peraturan tentang penataan toko modern di Kecamatan Kramatmulya.

Abstract

Penelitian ini bertujuan untuk menganalisis bentuk disharmoni konstitusional antara norma dasar Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 dengan praktik penegakan hukum dan perlindungan hak asasi manusia (HAM) dalam konteks konflik bersenjata di Papua. Urgensi penelitian ini terletak pada kebutuhan untuk menilai ulang efektivitas kerangka hukum nasional dalam menjamin supremasi konstitusi di wilayah konflik. Permasalahan utama yang dikaji mencakup dua hal: (1) deviasi konstitusional antara norma dasar UUD 1945 dan praktik penegakan hukum di Papua, dan (2) rekonstruksi politik hukum konstitusional untuk memulihkan supremasi konstitusi dan perlindungan HAM. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan konseptual dan perundang-undangan, serta analisis terhadap dokumen hukum, putusan yudisial, dan hasil kajian lembaga independen. Hasil penelitian menunjukkan bahwa terjadi penyimpangan prinsip constitutional supremacy akibat pendekatan keamanan yang dominan, lemahnya mekanisme akuntabilitas, serta terbatasnya akses keadilan bagi warga sipil. Untuk itu, penelitian ini menawarkan model rekonstruksi politik hukum konstitusional berbasis constitutional ex-ante review, penguatan lembaga pengawas independen, dan partisipasi publik dalam formulasi kebijakan hukum. Penelitian ini berkontribusi pada pengembangan wacana hukum konstitusional kritis (Critical Constitutional Discourse) yang menempatkan hukum sebagai instrumen emansipatoris dalam pemulihan keadilan substantif di Papua.

Abstract

Background: Democratic governance is fundamentally supported by the rule of law, which ensures transparency, accountability, and meaningful citizen participation in political processes. Nevertheless, in many jurisdictions, democratic institutions are weakened by fragile legal frameworks, judicial inefficiencies, and political interference, creating conditions that facilitate corruption and democratic backsliding. Objective: This study aims to analyze the role of law in strengthening democratic governance by examining how legal principles, institutional mechanisms, and constitutional safeguards contribute to the stability and effectiveness of democratic systems across different countries. Methods: The research adopts a qualitative approach using doctrinal legal analysis and comparative case studies. Legal documents, constitutional provisions, judicial decisions, and governance reports from various democratic nations are systematically examined to assess the relationship between legal frameworks and democratic governance. Results: The findings indicate that robust legal systems, independent judiciaries, and strong constitutional safeguards play a pivotal role in promoting democratic governance. Countries that provide effective legal protection for civil liberties and enforce checks and balances on executive power tend to demonstrate higher political stability, stronger public trust, and more resilient democratic institutions. Conversely, weak legal frameworks are closely associated with corruption, electoral manipulation, and the erosion of democratic norms. Conclusion: The study concludes that strengthening the rule of law is essential for sustaining democratic governance. A well-functioning legal system not only protects human rights and ensures governmental accountability but also enhances citizen participation. This research contributes to legal and political scholarship by offering an analytical framework to evaluate the effectiveness of legal systems in democratic governance and provides practical insights for policymakers and legal scholars seeking to strengthen democratic institutions globally.
