Abstract

The importance of labor protection is the main focus in an effort to ensure that every individual working in a company receives proper protection. In this context, the protection includes aspects of occupational health and safety, which aims to avoid the risk of accidents or injuries for workers. However, in reality, there are still violations of work protection provisions, such as the absence of personal protective equipment, which can threaten the safety of workers, especially at the Tanjung Morawa Rice Seed UPTD. In an effort to overcome these violations, this research carries out a descriptive method to describe the situation of legal protection against workers who experience accidents according to Law Number 13 of 2003 at the UPTD Induk Padi Tanjung Morawa. The results show that legal protection of workers is regulated in Article 6 of the Law, which contains the obligation of employers to provide rights and obligations to workers without discrimination. However, there are shortcomings in the details of the protection, especially regarding the protection of male workers. In addition, the protection of female workers is also stipulated in the Law, with a prohibition on female workers under the age of 18 to work during certain hours. Nevertheless, the implementation of legal protection of worker safety at the Tanjung Morawa Rice Seed UPTD still has challenges, where protection must include humanitarian and welfare aspects for workers.

Abstract

Seorang anak yang dianggap belum dewasa atau belum memenuhi kriteria batas usia yang sah, kemudian melakukan suatu perbuatan seperti mencuri, melakukan penganiayaan, dan sebagainya dipandang sebagai suatu pelanggaran hukum dan tidak dapat dianggap sebagai tindak pidana. Tidak adanya keseragaman batasan usia dewasa atau batasan usia anak dalam berbagai peraturan perundang-undangan di Indonesia seringkali menimbulkan pertanyaan mengenai batasan mana yang sebaiknya digunakan. Terlepas dari itu, penentuan batas usia minimal anak dapat melakukan perbuatan hukum harus memiliki kepastian dan jaminan hukum agar setiap perbuatan yang dilakukannya sah di mata hukum. Permasalahan yang dibahas adalah: Bagaimana pengaturan batas usia cakap hukum dalam perspektif hukum pidana di Indonesia dan bagaimana perbandingan batas usia cakap hukum dalam hukum pidana di Indonesia?

Abstract

One of the most scrutinized crimes in Indonesia is corruption. Corruption in the private sector is as severe as in the public sector, especially when business activities are linked to public sectors such as taxation, banking, and public services. The Nusantara Jawa Sumatera Association, known as "PENJARA," is an organization dedicated to preventing corruption in the regions of Java and Sumatra. This organization comprises committed members focused on the integrity of the Indonesian nation. The role of PENJARA in development activities, including efforts to prevent and eradicate corruption, is crucial as a social check to enhance public welfare and establish a professional, corruption-free bureaucracy. This study addresses the government's role in optimizing the prevention and eradication of corruption in Indonesia and how the youth organization PENJARA contributes to these efforts. The study reveals that government efforts in combating corruption face significant challenges, including synchronizing legislation, improving human resources, and digitization. PENJARA plays a vital role by conducting outreach, discussions, and dialogues with the public and government to prevent corruption and limit the opportunities for corrupt activities.

Abstract

Radikalisme merupakan benih awal dari terorisme berkembang melalui proses ideologisasi ekstrem, pada hakikatnya menolak tatanan sosial-politik sah dan berupaya menggantikannya dengan sistem kaku dan monolitik melalui kekerasan serta tindakan subversif. Anak-anak, sebagai subjek berada tahap perkembangan kognitif dan psikososial rentan, kerap menjadi sasaran indoktrinasi ideologi radikal—baik melalui keluarga, komunitas, maupun jaringan virtual—sehingga tidak jarang mereka terlibat tindakan dikualifikasikan sebagai tindak pidana terorisme. Fenomena ini menggambarkan adanya degradasi sistemik perlindungan sosial dan kegagalan institusional membentengi generasi muda dari paparan ideologi destruktif. kerangka hukum nasional, khususnya berdasarkan UU-PA dan UU-SPPA, negara berkewajiban memberikan perlindungan khusus terhadap anak-anak terpapar radikalisme dan menjadi korban jaringan terorisme, sebagaimana ditegaskan Pasal 59 ayat (2) huruf k UUPA dan Pasal 79 ayat (2) UUSPPA. penanggulangan fenomena ini menuntut dua prasyarat esensial: pertama, tersedianya instrumen yuridis komprehensif sebagai dasar legitimasi kebijakan perlindungan dan rehabilitasi anak; dan kedua, sinergi lintas sektoral kuat antara seluruh pemangku kepentingan, baik di tingkat negara maupun masyarakat sipil, membangun sistem responsif tidak hanya represif, tetapi preventif dan restoratif. Kajian ini menegaskan urgensi pendekatan holistik dan multidisipliner merumuskan strategi perlindungan anak dari radikalisme, demi menjamin keberlangsungan nilai-nilai kebangsaan, Pancasila, dan semangat kebinekaan.
