Abstract

Rape is a form of sexual violence that not only violates human rights, but also causes deep physical and psychological trauma to the victim. In this context, victims with mental retardation are in a very vulnerable position and are often unable to defend themselves or give legitimate consent. This condition makes them a group that needs special protection under the law. This study aims to analyze the legal protection of rape victims who experience mental retardation as a state of helplessness based on the applicable laws in Indonesia. Rape is a form of sexual violence that violates human rights and results in deep physical and psychological trauma for the victim. Victims with mental retardation have a higher vulnerability and require special protection. The approach used in this study is normative juridical, by analyzing related laws and regulations, including the Criminal Code (KUHP), Law Number 23 of 2004 concerning the Elimination of Domestic Violence, and Law Number 8 of 2016 concerning Persons with Disabilities. The results of the study show that although there are regulations that provide legal protection for rape victims, the implementation and enforcement of the law still face various obstacles. Factors such as social stigma, a lack of understanding of mental retardation, and limited resources in the justice system often hinder effective protection for victims. This study recommends increased socialization and training for law enforcement officials, as well as the provision of better support services for victims with mental retardation.

Abstract

Program Jaminan Kesehatan Nasional (JKN) yang diselenggarakan oleh BPJS Kesehatan merupakan wujud pelaksanaan hak konstitusional atas pelayanan kesehatan. Namun, dalam implementasinya, muncul berbagai persoalan hukum, khususnya terkait tuduhan fraud (kecurangan) yang dialamatkan kepada rumah sakit mitra. Tuduhan ini seringkali disampaikan tanpa prosedur pembuktian yang jelas, serta tidak diiringi dengan perlindungan hukum yang memadai, sehingga menimbulkan ketidakpastian hukum dan ketimpangan relasi antara BPJS dan rumah sakit. Penelitian ini bertujuan untuk menganalisis pengaturan hukum mengenai pembuktian fraud dalam program JKN, mengevaluasi tanggung jawab hukum atas tuduhan yang tidak berbasis fakta, serta menilai penerapan prinsip keadilan dalam proses penegakan hukum administratif oleh BPJS. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil penelitian menunjukkan bahwa terdapat kekosongan hukum (legal vacuum) dalam mekanisme pembuktian tuduhan fraud oleh BPJS, yang membuka ruang bagi penyalahgunaan kewenangan dan potensi pelanggaran asas praduga tak bersalah serta keadilan substantif. Oleh karena itu, diperlukan penguatan regulasi yang lebih akuntabel dan berkeadilan untuk menjamin perlindungan hukum bagi rumah sakit sebagai mitra strategis dalam pelayanan kesehatan nasional.

Abstract

Penelitian ini bertujuan untuk mengevaluasi kelemahan perlindungan hukum terhadap anak korban perdagangan manusia di Indonesia dalam perspektif Hak Asasi Manusia (HAM), serta menawarkan arah reformulasi regulasi yang lebih komprehensif dan berorientasi pada kepentingan terbaik anak. Meskipun Indonesia telah meratifikasi Konvensi Hak Anak (CRC) dan mengadopsi berbagai regulasi seperti UU No. 21 Tahun 2007, UU No. 35 Tahun 2014, dan PP No. 44 Tahun 2008, pendekatan hukum yang dominan masih bersifat represif dan belum menempatkan pemulihan korban sebagai pusat kebijakan. Penelitian ini mengungkap bahwa ketidaksinkronan antarregulasi, lemahnya koordinasi kelembagaan, minimnya pelatihan sumber daya manusia, serta ketiadaan sistem informasi terpadu menjadi faktor utama kegagalan sistem perlindungan. Metode penelitian hukum normatif digunakan dengan pendekatan konseptual, perundang-undangan, dan komparatif. Hasilnya menunjukkan urgensi reformulasi hukum yang mencakup revisi pasal-pasal kunci dalam UU PTPPO, penetapan standar intervensi terapeutik nasional, pengaturan pendampingan anak korban secara teknis-yuridis, dan penyusunan peraturan pelaksana di tingkat daerah. Penelitian ini menegaskan bahwa tanpa sistem hukum yang memulihkan dan melindungi secara utuh, negara belum memenuhi amanat konstitusional dalam menjamin hak anak sebagai bagian dari kelompok rentan.

Abstract

Perkembangan teknologi informasi yang pesat telah membawa perubahan signifikan dalam berbagai aspek kehidupan, termasuk bidang pertahanan dan keamanan negara. Transformasi digital tidak hanya menciptakan peluang baru dalam sistem pertahanan siber, tetapi juga menimbulkan tantangan serius berupa penyalahgunaan teknologi oleh aparat pertahanan. Salah satu fenomena yang mengemuka adalah keterlibatan prajurit Tentara Nasional Indonesia (TNI) dalam praktik judi online yang melanggar hukum pidana umum dan hukum militer sekaligus. Penelitian ini bertujuan untuk menganalisis urgensi hukum siber dalam lingkungan militer serta efektivitas penegakannya terhadap pelanggaran yang dilakukan oleh anggota TNI. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan studi kasus, menggunakan bahan hukum primer, sekunder, dan tersier. Hasil penelitian menunjukkan bahwa penegakan hukum siber dalam tubuh TNI masih menghadapi kendala struktural dan normatif, seperti dualisme yurisdiksi, keterbatasan kapasitas forensik digital, dan lemahnya literasi digital di kalangan prajurit. Oleh karena itu, strategi penguatan penegakan hukum siber harus dilakukan melalui pendekatan regulatif, struktural, kultural, dan preventif secara terpadu. Integrasi antara Undang-Undang Informasi dan Transaksi Elektronik (UU ITE), Kitab Undang-Undang Hukum Pidana Militer (KUHPM), dan Undang-Undang Disiplin Militer menjadi fondasi utama dalam membangun sistem hukum militer yang adaptif, profesional, dan berintegritas di era digital.

Abstract

Hospital service standards are closely linked to a hospital’s ability to provide healthcare services following its qualifications. This study aims to demonstrate how declining public trust in doctors has led to rising lawsuits, often associated with perceived failures in medical treatment. This qualitative research employs a descriptive approach to systematically and factually collect data promptly based on the conditions during the study. The findings indicate that doctors who commit medical negligence can be held legally accountable through both professional and non-professional institutions. Furthermore, non-professional dispute resolution can occur outside the court (non-litigation) or within the court system (litigation).

Abstract

This study explores customary law’s role in managing natural resources in rural areas of Indonesia, focusing on its contribution to national defence and the preservation of national sovereignty. Adopting a qualitative approach based on a literature review, this research examines the interactions between customary law, state law, and local practices within the resource management framework. The findings reveal that customary law remains a vital institution in regulating access to and utilization of natural resources despite the challenges posed by modern development policies and globalization. The study identifies various adaptive mechanisms within customary law that allow it to evolve in response to socio-ecological changes, thus supporting sustainable resource management. Furthermore, the research highlights the importance of incorporating customary law into formal policy frameworks to enhance the effectiveness of natural resource management at local and national levels.

Abstract

Dalam menjaga kedaulatan wilayah udaranya, Pemerintah Indonesia memiliki wewenang dan tanggung jawab untuk melaksanakan pengaturan ruang udara nasional termasuk dalam bidang pertahanan dan keamanan Negara. Undang-Undang Nomor 34 Tahun 2004 tentang Tentara Nasional Indonesia. Permasalahan dalam penelitian ini yaitu 1) Bagaimana kewenangan TNI Angkatan Udara dalam penegakan hukum dan kedaulatan di wilayah udara Indonesia terhadap pelanggaran wilayah oleh pesawat udara asing ? 2) Apakah kewenangan TNI Angkatan Udara sudah memadai dalam penegakan hukum dan kedaulatan di wilayah udara Indonesia terhadap pelanggaran wilayah oleh pesawat udara asing ?. Jenis penelitian yang akan digunakan dalam penelitian ini yaitu jenis penelitian yuridis normatif. Penelitian yuridis normatif meneliti hukum dari perspektif internal dengan objek penelitiannya adalah norma hukum. Hasil penelitian ini menunjukan bahwa kewenangan TNI Angkatan Udara dalam penegakan hukum dan kedaulatan di wilayah udara Indonesia terhadap pelanggaran wilayah oleh pesawat udara asing sebagai penyelidik melakukan Operasi Pertahanan Udara Aktif antara lain Deteksi, Identifikasi, dan Penindakan berupa membayang-bayangi (shadowing), penghalauan (intervention), pemaksaan mendarat (force down) dan penghancuran (destruction). TNI AU hanya memiliki kewenangan penuh untuk melakukan intercept, identifikasi, pengusiran, dan penegakan hukum terhadap pesawat asing yang melanggar wilayah udara Indonesia. TNI AU memungkinkan menjadi penyidik atas pelanggaran wilayah udara, asalkan memiliki PPNS. PPNS dari Kementerian Perhubungan adalah sebagai penyidik dalam pelanggaran Wilayah Udara Indonesia. Namun demikian semua kasus tidak pernah sampai pada proses peradilan hanya penerbitan diplomatic complain kepada negara asal pelanggar

Abstract

Connectivity justice is designed as an integrative mechanism for adjudicating criminal offences jointly committed by legal subjects falling under both general and military jurisdictions. In practice, however, the splitting of case files, or splitsing, in civilian-military mixed cases may transform connectivity from a unifying procedural forum into a merely declaratory norm with limited operational force. This article examines why splitsing may negate the ratio legis of connectivity justice, particularly in relation to equality before the law, due process of law, and the unity of criminal liability. The research applies a normative juridical method with descriptive-prescriptive analytical characteristics, using statutory, conceptual, and case approaches. Legal materials are collected through library research covering legislation, court decisions, doctrine, journal articles, books, and contemporary case materials. The article argues that splitsing in mixed civilian-military cases cannot be treated as a purely technical prosecutorial instrument because it affects forum allocation, evidentiary coherence, public access, and the construction of criminal responsibility. The novelty of this article lies in proposing a “limited-priority connectivity model”, which requires a connectivity trigger test, a dominant-interest test, joint case assessment, and written reasoned justification before any case splitting may be undertaken. This model is necessary to prevent splitsing from becoming an instrument of jurisdictional fragmentation.

Abstract

The enactment of Law Number 20 of 2025 on the Indonesian Criminal Procedure Code marks a substantial transformation of investigation and coercive measures. On the one hand, the new Code strengthens suspects’ rights, broadens pretrial review, requires at least two pieces of evidence for suspect designation and several restrictions on liberty, and provides more explicit safeguards for vulnerable groups. On the other hand, the catalogue of coercive measures is expanded to include suspect designation, arrest, detention, search, seizure, interception, examination of correspondence, blocking orders, and travel bans, thus preserving a broad space for state intervention into individual liberty. This article applies normative legal research with a descriptive-prescriptive analytical character, relying on secondary legal materials through library research and employing statutory and conceptual approaches. It argues that the central problem of the new Code does not merely concern the existence of rights-protective norms, but the consistency of judicial oversight over investigative discretion. By examining Constitutional Court Decision No. 21/PUU-XII/2014, contemporary pretrial practice on suspect designation, and the oversight architecture of the new Criminal Procedure Code, this article proposes an integrated judicial oversight model based on legality, necessity, proportionality, written reasons, judicial authorization, post factum review, exclusionary rules, and effective remedies. The model is necessary to ensure that the expansion of coercive powers does not reproduce crime-control dominance, but moves toward substantive due process of law.

Abstract

Purpose: This study examines the legal implications of the dismissal of Indonesian National Armed Forces (TNI) soldiers, particularly when a Military Court's review decision revokes the dismissal penalty. It explores whether soldiers, once dismissed for legal violations, should be entitled to reinstatement if the dismissal penalty is nullified. Research Methodology: The research uses a qualitative approach with document studies and interviews. Document studies analyze legal documents, court rulings, and administrative regulations, while interviews involve legal experts, TNI personnel, and stakeholders in military law. Results: The findings suggest that the revocation of the dismissal penalty in a review decision can be considered a novum (new legal fact), nullifying the legal basis for the dismissal. As a result, the dismissal becomes invalid, and the soldier may be entitled to apply for reinstatement in the military. Conclusions: The study concludes that soldiers whose dismissals are revoked in a review decision should have the right to seek reinstatement. However, current regulations do not provide for such a provision, highlighting the need for regulatory changes to accommodate this right. Limitations: The study is limited by the availability of relevant legal cases and the absence of administrative regulations on reinstating dismissed soldiers. Further research may be needed to explore broader implications for TNI personnel. Contributions: This research contributes to the understanding of legal processes regarding military personnel, offering recommendations for policy reforms in military justice and personnel management.
