Abstract

The defendant committed crime on February 15th, 2021 when he returned home because a headache. Arriving at the house he intended to commit suicide by setting himself on fire, but when he started the fire, he felt pain from the fire and he came out from the burning house. Remembering his mother was in the house, the defendant return, but fire had burned the house and caused his mother to burn and died. The Judges in Decision Number 76/Pid.B/2021/PN Bbs, sentenced the Defendant with criminal sentence because it was legally proven he have violated Article 359 of Criminal Code. Whether the defendant fulfilled the elements of Article 359 of Criminal Code and what types of offenses can be imposed on the defendant are the main problems. This research uses prescriptive law type, namely descriptive analytical legal research, using secondary data obtain through library research. analyzed qualitatively and conclusions drawn using deductive understanding. The conclusions: decision from the judges which found the defendant guilty of violating Article 359 of Criminal Code was inappropriate, they should be applying Article 187 paragraph (3) and (2); The defendant’s offenses including: criminal, material, commission, concrete, general, offenses causing danger, completed, single, ordinary and simple offenses.

Abstract

one of the causes of criminal acts of fraud is that the perpetrator can convince the victim with his deceit and false prestige. the defendant deceived the victim by pretending to be a State Civil Apparatus (ASN) and used the victim to commit his crime by committing fraud and embezzlement. This is in line with the beginning of the case which is the object of this research. The research method used in writing this thesis is a normative legal research method. This research is analytical descriptive in nature, using secondary legal data and primary, secondary and tertiary legal materials, collected from the results of library research, then processed qualitatively. The results of data processing from research results are concluded with the deductive method. Based on the research that has been done, it can be concluded that the criminal responsibility applied by the Panel of Judges is not quite right, the perpetrators should have applied criminal responsibility using two articles, namely the crime of fraud and embezzlement. The Panel of Judges when examining and deciding cases is more careful based on the facts of the trial, the evidence is available so that there is no mistake in deciding a criminal case.

Abstract

This study examines the protection of Domestic Violence (KDRT) victims perpetrated by military personnel in Indonesia. Domestic violence cases involving military members are complex issues requiring serious attention, as they encompass aspects of general criminal law and military disciplinary law. Based on Law No. 23 of 2004 on the Elimination of Domestic Violence and Law No. 25 of 2014 on Military Discipline, military personnel who commit domestic violence can be subjected to both criminal and disciplinary sanctions. The legal process for military domestic violence cases involves two pathways: the criminal pathway, managed by the police and prosecution, and the military disciplinary pathway, handled by the authorized superior. Besides law enforcement, this study highlights the importance of protecting victims’ rights, such as security, physical and psychological recovery, and legal support. However, there are several obstacles to victim protection, including the strong patriarchal culture, lack of understanding about domestic violence within the military, and the complexity of the legal enforcement process. This study recommends increasing awareness of domestic violence, strengthening support for victims, and improving legal procedures to make the protection of domestic violence victims more effective.

Abstract

Dispute can occur in medical practice if patient(s) feel their interests are being damaged or they received results not as expected. This study is a normative, qualitative research using secondary data on dispute resolution in accordance to Act Number 17 Year 2023 on Health, compared to before the Law was enacted. According to the Act, patients or their representatives who felt aggrieved can report the doctor(s) to Professional Disciplinary Council, to the authorities for suspected criminal act, and/or to the court for civil act violation. The Council’s recommendation that states there is a violation on current standards is required for criminal investigation to proceed, and for civil lawsuit to go to court. Such requirement is nonexistent in Act Number 29 Year 2004 on Medical Practice. This could be observed in the case of dr. Dewa Ayu Sasiary Prawan, et al in 2010 where patient Mrs. Julia Fransiska Makatey that they treated was deceased. They were found not guilty in district court, sentenced to imprisonment in Supreme Court cassation, and finally ruled not guilty in Supreme Court judicial review verdict because no proven standard violations. Learning from this, such Council that has utmost integrity and works profesionally is needed for a fair dispute resolution.

Abstract

Domestic violence (KDRT) is a serious social issue, including within the Indonesian military. Cases of domestic violence committed by military personnel not only affect the victims but also impact the overall reputation of the military institution. This study aims to analyze the handling of domestic violence cases by military personnel and to explore the process of imposing additional criminal penalties in the form of dismissal for offenders within the military environment. Using a normative juridical research method, this study focuses on the application of laws in Indonesia, particularly Law Number 23 of 2004 on the Elimination of Domestic Violence and Law Number 25 of 2014 on Military Discipline.The research findings indicate that handling domestic violence cases in the military poses unique challenges due to the duality of legal systems between general criminal law and military discipline law. In addition, there are social barriers such as stigma against victims and fear that hinder case disclosure. The imposition of additional criminal penalties, such as dismissal, serves as a key sanction to maintain military integrity and discipline, where the dismissal is aimed at creating a deterrent effect and protecting the victim. The dismissal process not only encompasses aspects of criminal law but also involves formal and hierarchical internal military mechanisms.This study highlights the need for reform in the military justice system, particularly in addressing domestic violence cases, and emphasizes the importance of raising awareness and providing support to victims of domestic violence within military families. Strengthening legal protection and applying strict sanctions are expected to reduce the incidence of domestic violence in the military environment and improve justice for victims.

Abstract

Penelitian ini memiliki tujuan untuk mengeksplorasi, menemukan, dan menganalisis dasar pemikiran penyelesaian perkara tindak pidana kekerasan dalam rumah tangga yang pelakunya militer melalui keadilan restoratif dan untuk menentukan parameter tindak pidana kekerasan dalam rumah tangga yang dapat diselesaikan melalui keadilan restoratif. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan data Sekunder meliputi bahan-bahan hukum primer, sekunder serta tersier yang digunakan sebagai bahan pendekatan dalam penelitian. Data penelitian dianalisis secara kualitatif dan dijabarkan secara deskriptif preskriptif. Hasil yang ditemukan dalam penelitian ini didapati dua kesimpulan. Pertama, dasar pemikiran penyelesaian tindak pidana kekerasan dalam rumah tangga yang pelakunya militer sebaiknya diselesaikan melalui mekanime keadilan restoratif karena telah mempunyai landasan filosofis berdasarkan sila ke-4 Pancasila dan landasan yuridis yaitu Pasal 71 ayat (1) huruf i UU No 31 Tahun 1997 tentang Peradilan Militer, Pasal 5 Undang-Undang Nomor 48 Tahun 2009 tentang Kekuasaan Kehakiman dan Peraturan Mahkamah Agung Nomor 1 tahun 2024 tentang pedoman mengadili perkara pidana berdasarkan keadilan restoratif serta Surat edaran Mahkamah Agung Nomor 2 Tahun 2024 Huruf d angka 2 tentang Penerapan keadilan restoratif (Resoratve Justitice) terhadap prajurit TNI yang melakukan tindak pidana kekerasan dalam rumah tangga. Kedua, Parameter tindak pidana kekerasan dalam rumah tangga dilakukan oleh militer yang dapat diselesaikan melalui keadilan restorative adalah apabila merupakan delik aduan delik aduan korban mencabut aduannya, terdapat persetujuan antara korban dengan terdakwa, dalam hal korban adalah suami/istri sudah hidup rukun kembali dan korban baru pertama kali melakukan tindak pidana ini.

Abstract

Penyalahgunaan narkotika di kalangan militer menjadi persoalan serius karena berdampak langsung terhadap integritas, disiplin, dan daya tempur prajurit. Penelitian ini bertujuan untuk menganalisis urgensi pembentukan satuan unit kerja rehabilitasi bagi militer penyalah guna narkotika dan meninjau aspek yuridis dari kebijakan pemidanaan tambahan berupa pemberhentian tidak dengan hormat (PTDH). Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan deskriptif-analitis, menggunakan data primer hasil wawancara dengan Babinkum TNI dan Deputi Rehabilitasi BNN, serta data sekunder berupa peraturan perundang-undangan dan dokumen kebijakan. Hasil penelitian menunjukkan bahwa terdapat kesenjangan perlakuan hukum antara sistem peradilan umum dan peradilan militer dalam penanganan kasus penyalahgunaan narkotika. Ketiadaan kebijakan rehabilitasi dalam yurisdiksi militer berpotensi mengabaikan asas kesetaraan di hadapan hukum dan menghambat pemulihan prajurit. Oleh karena itu, diperlukan regulasi khusus berupa Peraturan Panglima TNI yang mengatur mekanisme rehabilitasi di lingkungan TNI. Implikasi dari studi ini diharapkan mendorong reformasi hukum militer yang lebih adil, manusiawi, dan responsif terhadap kebutuhan pemulihan individu serta ketahanan institusional.

Abstract

The criminal act of insubordination within the military is a serious offense that disrupts the hierarchical structure and discipline among soldiers. This study examines the compatibility between the elements of insubordination as defined in Article 106 of the Military Criminal Code (KUHPM) and the defendant’s actions in Decision Number: 134-K/PMT-II/BDG/AL/IX/2022. The problems discussed include the elements of the military crime involving a subordinate attacking a superior, and whether the defendant’s actions, based on the legal facts in the aforementioned ruling, align with the elements of insubordination as applied by the judges. This research adopts a normative legal approach and employs qualitative analysis. The findings reveal that not all elements in Article 106 KUHPM were fulfilled, particularly the absence of physical violence, making Article 105 KUHPM more appropriate for prosecution. The study concludes that misclassification of the article led to inaccurate judicial considerations. The recommendation emphasizes the need for greater judicial precision in assessing criminal elements to ensure the achievement of substantive justice.

Abstract

The management of narcotics, psychotropics, and precursor drugs in healthcare facilities is a highly sensitive area prone to abuse. Pharmacists, as healthcare professionals responsible for managing these medications, play a crucial role in ensuring the availability, safety, and appropriate use of drugs for patients. However, in carrying out their duties, pharmacists often face various ethical and legal dilemmas and challenges. On the one hand, pharmacists must ensure that patients receive the right medication according to their medical needs. On the other hand, they must also comply with applicable laws and regulations, which are stringent and complex, regarding the handling of narcotics, psychotropics, and precursors. In some cases, pharmacists may even become entangled in legal issues due to actions taken in the course of their professional duties. Therefore, legal protection for pharmacists in performing pharmaceutical work, especially in managing drugs containing narcotics, psychotropics, and precursors, is crucial. With adequate legal protection, pharmacists can carry out their professional duties more professionally, responsibly, and without fear of legal repercussions. Ultimately, this will positively impact the improvement of healthcare quality for the public
