Abstract

Penelitian ini mengkaji hak waris dalam hukum perdata Indonesia dengan fokus pada sistem pembagian warisan. Menggunakan metode penelitian hukum normatif dengan pendekatan studi pustaka, penelitian ini menganalisis ketentuan-ketentuan dalam Kitab Undang-Undang Hukum Perdata (KUHPerdata) terkait pewarisan. Hasil penelitian menunjukkan bahwa hukum waris perdata Indonesia menganut sistem individual, membagi ahli waris menjadi empat golongan, dan menerapkan konsep legitime portie. Prinsip kesetaraan gender ditegakkan dalam pembagian warisan, tanpa membedakan bagian antara ahli waris laki-laki dan perempuan. Namun, penerapannya menghadapi tantangan akibat pluralisme hukum di Indonesia. Penelitian ini juga mengidentifikasi upaya pencegahan konflik waris melalui edukasi hukum, peran notaris, dan mediasi keluarga. Kesimpulannya, diperlukan harmonisasi antara hukum waris perdata dengan sistem hukum waris lainnya untuk mengakomodasi keberagaman budaya dan agama di Indonesia.

Abstract

This study examines the legal aspects of Civil Service Neutrality in Indonesian general elections. Civil service neutrality represents a fundamental principle in democratic governance with integrity. Through a normative juridical approach, this research analyzes the regulatory framework governing civil servant neutrality, common forms of violations, and the effectiveness of existing supervision mechanisms and sanctions. The findings indicate that despite Indonesia having comprehensive legislation regarding civil service neutrality, its implementation still faces various challenges, including diverse interpretations of the boundaries of civil servants' political activities, weak law enforcement, and lack of awareness and understanding among civil servants themselves. This research recommends strengthening collaborative oversight mechanisms between institutions, clarifying the boundaries and definitions of civil servants' political activities, and enhancing education and socialization regarding civil service ethics in the context of electoral democracy.

Abstract

This article analyzes the implementation of advocate obligations under Law Number 18 of 2003 and its impact on the validity of the suspect examination process during the investigation stage. This normative legal research reveals that the obligation of advocate accompaniment is a crucial element of the principles of due process of law and fair trial. The effective presence of an advocate functions as a control against the potential abuse of power by investigators and ensures the fulfillment of the suspect's constitutional rights. Conversely, the ineffectiveness of the advocate's role such as merely formalistic accompaniment directly impacts the weakening of the suspect's rights protection, the fragility of the evidence construction, and potentially creates legal defects in the Investigation Report (BAP). This article concludes that the optimal enforcement of advocate obligations is an absolute prerequisite for realizing a valid, fair, and integral investigation process.

Abstract

The purpose of this study is to examine and analyze the implementation of the One-Stop Integrated Service (PTSP) in realizing the principles of fast, simple, and low-cost justice at the Religious Court of Arga Makmur. This research focuses on how PTSP operates as a front-line service in handling administrative processes and public requests related to court cases. The study uses a juridical empirical method with a descriptive analytical approach. Primary data were obtained through interviews and observations during internship activities at the Religious Court of Arga Makmur, while secondary data were collected from legislation, court regulations, and relevant literature. The results show that the implementation of PTSP has improved service quality by simplifying procedures, shortening processing times, and increasing transparency and accountability. However, several obstacles remain, such as limited human resources, inadequate digital infrastructure, and low public legal awareness. These findings indicate that continuous improvement in human resource capacity and technology utilization is essential to fully realize the principles of fast, simple, and low-cost justice.
