Abstract

This research examines a case of marriage annulment filed at the Pekanbaru Religious Court, where the plaintiff, a Marriage Registrar, received a complaint from a legal wife who did not consent to her husband's marriage to another woman. The plaintiff questioned whether the annulment request had exceeded the expiration period. The study aims to (1) understand the legal consequences of filing for annulment after the legal deadline based on Marriage Law Number 1 of 1974 and Decision Number 1/Pdt.G/2021/PA.Pbr, and (2) explore the relevance of utility theory in the court’s reasoning. This is a sociological legal study using interviews and literature reviews, supported by primary, secondary, and tertiary data. The analysis uses a qualitative descriptive approach with deductive reasoning. The results show that the court granted the annulment despite the expiration, based on the discovery of an invalid guardian and procedural flaws. A verstek (default) decision was made as both defendants were absent at the first hearing. The court's decision reflects the balance of legal certainty, justice, and utility. The legal consequences include the termination of the marriage, the recognition of the child as legitimate, and the absence of shared property division.

Abstract

Humans in fulfilling their needs are inseparable from the assistance and cooperation carried out, often in which an agreement has been made. The Cooperation Agreement for the Sale of Land Lots between PT Kawasan Kurma Indonesia, which is engaged in property along with gardens, complete with a Sharia-based Muslim area with landowners, however, there are rights from landowners that are not paid. The formulation of the problem in this thesis is how efforts to resolve disputes in the land kaflingan sales cooperation agreement in Ranah Sungkai Village, XIII Koto Kampar District, Kampar Regency and what are the inhibiting factors in dispute resolution efforts in the land kaflingan sales cooperation agreement in Ranah Sungkai Village, XIII Koto Kampar District, Kampar Regency. This type of research is sociological research because with this research the author directly conducts research at the location or place under study, namely to provide a complete and clear picture, while the population and samples are the Head of Ranah Sungkai Village, the landowner community and the Manager of Corporate Aaffairs / Legal / HRIR PT Kawasan Kurma Indonesia. The purpose of this research is to find out the Dispute Resolution in the Cooperation Agreement for the Sale of Land Plots in Ranah Sungkai Village, XIII Koto Kampar District, Kampar Regency and the obstacles to Dispute Resolution in the Cooperation Agreement for the Sale of Land Plots in Ranah Sungkai Village, XIII Koto Kampar District, Kampar Regency.The results of this study are efforts to resolve disputes in the land kaflingan sales cooperation agreement in Ranah Sungkai Village, XIII Koto Kampar District, Kampar Regency have been carried out and the result is an agreement to disagree, because the mediation process does not get an agreement as well as the consensus deliberation process and inhibiting factors Both parties maintain their arguments and insist on their respective opinions There is no good faith from each party to the dispute. The parties do not understand the mediation process and the selfishness of the parties. The author's suggestion for the parties involved in resolving disputes in the land kaflingan sales cooperation agreement in Ranah Sungkai Village, XIII Koto Kampar District, Kampar Regency is to carry out a subpoena, if the subpoena has been taken also does not get results, proceed to the district court which is mutually agreed upon according to the agreement.

Abstract

In general, interfaith marriages have the potential to cause legal problems, both for the married couple and for third parties, including the inheritance rights of children born from interfaith marriages. As a village with the largest number of religious adherents in Tebing Tinggi Timur Sub-district, Kepau Baru Village is also a village that is very thick with its customary law, of course in terms of marriages of different religions it cannot be avoided so that the role of the local customary leader and customary rules is needed. Therefore, the purpose of this research is first, to find out the provisions of interfaith marriages according to the Customary Law of Kepau Baru Village. Secondly, to find out the consequences of interfaith marriage according to the Customary Law of Kepau Baru Village. The type of research used in this research is sociological. The approach used by researchers is the type of sociological research. The location of the research conducted by the author is in Kepau Baru Village, East Tebing Tinggi District, Meranti Islands Regency. The population and samples in this study were the tribal chief/datuk and the perpetrators of interfaith marriages. This research uses data in the form of primary data and secondary data and data collection techniques are carried out by interview. The results of this research have two main points that can be concluded. First, the customary provisions in Kepau Baru Village for interfaith marriages must go through several stages, namely choosing one of the religions to be embraced, having been approved by both parents and the customary leader. Interfaith marriage in Kepau Baru Village requires a long process. Nevertheless, in this case, interfaith marriage according to Kepau Baru's custom is contrary to freedom of religion. Secondly, there are no major consequences of interfaith marriages in Kepau Baru Village, either in marriage registration or population data. If there are household problems in Kepau Baru Village, they are resolved by going to the customary leader for advice.
