Abstract

Freedom to gain knowledge, information and technology is very important by everyone including blind people which one realized the right of access to literary works through the Marrakesh Treaty 2013. Regulation about facilitating access to copyright of published works for blind people in Indonesia is still considered inadequate to give protection in the implementation of freedom to gain knowledge. This study applied normative juridical approach described descriptive-analytically. Accessibility to the scientific work of the blind people is a part of human rights which must be respected, protected and fulfilled by the State. The Government has an important role in the realization of the wider access of the disabled by formalizing the governmental regulation in accordance with the mandate of Article 44 paragraph (4) of the Copyright Act 2014 and the Government shall immediately establish The Disabilities National Commission granted the authority and responsibility to fulfill the facilitation of access for blind people and limited reading by guiding Marrakesh Treaty or by looking at other country's regulatory practices.

Abstract

The right to be elected is a right that applies to everyone, it means that both men, women and transgender people can use their right to be elected. Transgender basically have the same rights as any other normal human being, witch distinguishes only the will and desire of sexual orientation alone. However, in the implementation the right to be elected transgender often get discriminatory treatment. Based on these discussions. For answering those question, here used social legal approaching with research specification of analytic descriptive. Sort of data contain inside it consisted of primary data, secondary data and tertiary data, whereas the sampling is done through non random sampling method with purposive sampling. Bassed on discussion result that the right to be elected is part of the human rights of every citizen without any distinction between men, women and transgender. The right to be elected is include in derogable right to do that in the implementation of restriction by the state as a stakeholder in the fulfillment of human rights obligations of every citizen. The implementation of the right to be elected has been fulfilled by normative, but legal culture of Indonesian society still hasn’t allowed a transgender use their right to be elected in election to take a position either in public position nor non public position.

Abstract

Tujuan dari kegiatan pengabdian kepada masyarakat ini adalah untuk memberikan pandangan non-populer terhadap genosida yang terjadi di Palestina, serta memberikan sudut pandang berbeda dalam melihat permasalahan tersebut, yaitu menggunakan pendekatan Hak Asasi Manusia. Permasalahan dalam konflik tersebut adalah masyarakat masih memandang konflik Palestina dengan subjektifitas dan keberpihakan. Kegiatan ini menggunakan metode sosialisasi terbuka dan diskusi interaktif yang diikuti oleh 20 peserta dari masyarakat seni dan kedokteran di T-Space Bintaro. Kesimpulan dari pengabdian untuk para peserta adalah pentingnya menganalisa kasus internasional, menggunakan sudut pandang kemanusiaan dan universalisme dalam konsep Hak Asasi Manusia serta menggeser paradigma tersebut menjadi keberpihakan terhadap kehidupan dan keberlangsungan umat manusia

Abstract

Tujuan dari kegiatan pengabdian kepada masyarakat betapa pentingnya memberikan paradigma baru dalam memandang genosida yang terjadi bagi warga Palestina. Prinsip keadilan sejati nyatanya tidak berlaku bagi kasus-kasus kejahatan kemanusiaan yang terjadi di seluruh dunia, khususnya di Paliestina. Prinsip ini menjadikan keadilan berubah makna menjadi devil’s justice yang menggambarkan bagaimana kekuasaan dan hawa nafsu menuyelimuti jiwa manusia terhadap manusia lainnya. Keadilan model seperti ini tidak mencerminkan keadilan sejati bila dikaitkan dengan pendekatan keselamatan bagi manusia dalam bingkai Hak Asasi Manusia (HAM). Hasil dari pengabdian kepada masyarakat ini adalah memberikan pemahaman secara holistik terhadap kasus-kasus kemanusiaan yang terjadi dan bagaimana pemberian sudut pandang ini merubah paradigma bagi peserta yang hadir di T-Space, Bintaro, Tangerang Selatan dari keadilan dalam sebuah peperangan dan kejahatan manusia yang terjadi berubah menjadi tumbahnya rasa hormat kepada martabat manusia yang dikesampingkan dalam peristiwa kejahatan. Salin itu, dengan pengabdian kepada masyarakat ini turut memberikan pemahaman bagaimana kekerasan secara keilmuan bukan hanya kekerasan personal saja, lebih jauh dari itu kekerasan struktural melalui tatanan sosial, dan kekerasan kultural yang lebih kompleks telah terjadi, sehingga dalam menganalisa genosida yang terjadi di Palestina, seluruh peserta mendapatkan pandangan yang menyeluruh dan holistik tersebut.

Abstract

This research examines the influence of international law on the enforcement of state sovereignty over digital resources, focusing on a comparison of digital sovereignty policies in the European Union, the United States and China. With the rapid development of technology and the increasing reliance on digital infrastructure, many countries have sought to strengthen their digital sovereignty to protect data, privacy and national security. However, the absence of comprehensive international legal instruments poses challenges in the fair and uniform enforcement of digital sovereignty. This research uses a qualitative-descriptive approach with a multiple case study method, analyzing legal documents, national policies, and reports of relevant international organizations to identify the impact of international law on digital regulation. The results show that the European Union places privacy rights as a priority by implementing the General Data Protection Regu-lation (GDPR), while the United States tends to support market freedom and technological innovation, but with some exceptions related to national security. China, on the other hand, takes a protectionist and centralized approach with strict control over data and digital access in its territory. In conclusion, these different approaches result in fragmentation in the management of digital sovereignty, which could threaten global connectedness. This research recommends international cooperation to create a global digital legal framework that balances state sovereignty rights with the need for connectedness and equitable access to data around the world
