Abstract

This research aims to determine the process of canceling a land sale and purchase by the seller because the buyer defaulted, the legal consequences of canceling the land sale and purchase agreement by the seller because the buyer defaulted. The research method used in this research is descriptive analytical. The research results of the sale and purchase agreement process are valid and have binding force since an agreement is reached between the seller and the buyer. The sale and purchase agreement is based on the validity of the contract and other agreement principles. An agreement can be null and void (van rechtswege neiting) or can be canceled (vernietigbaar), if an agreement does not meet the requirements specified in accordance with Article 1320 of the Civil Code, namely if it does not fulfill subjective requirements (they agree to bind themselves, are competent to make an agreement) and objective conditions (a certain thing, a lawful cause). The legal consequences that arise for the buyer if they default, the buyer is required to pay compensation for losses suffered by the seller, pay court costs if sued in court, and fulfill the agreement if it continues.

Abstract

Defamation on social media, especially via the Facebook platform, has become an increasingly disturbing issue in society. This research aims to understand theeffectiveness of criminal law enforcement under the Information and Electronic Transactions Law (UU ITE) in cases of defamation on Facebook. Mixedqualitative and quantitative research methods were used, including literature studies, interviews, social media content analysis, surveys, and statistical analysis. The research results show that the phenomenon of defamation on Facebook faces challenges in law enforcement, including difficulties in identifying perpetrators, the length of the legal process, and public distrust of the effectiveness of law enforcement. Recommendations are given to increase cooperation between the police, legal institutions and social media platforms, as well as to increase public education about the dangers of defamation. In conclusion, criminallaw enforcement against defamation on Facebook requires a holistic approach involving various parties and ongoing efforts to create a safer and more ethicaldigital environment. Even though the Information and Electronic Transactions Law (UU ITE) provides a clear legal basis, law enforcement still faces variouschallenges, including difficulties in identifying perpetrators, the length of the legal process, and low public trust in the effectiveness of law enforcement. The proposed recommendations include increasing cooperation between the police, legal institutions and social media platforms, as well as intensifying publiceducation about the dangers of defamation. These steps are important for creating a safer and more ethical digital environment for all users. By understanding the challenges faced and through joint efforts across sectors, it is hoped that criminal law enforcement against defamation on Facebook and social media can beimproved, so that individual human rights can be better protected and the integrity of the digital environment can be maintained.

Abstract

Social media has become an integral part of everyday life, opening up unprecedented opportunities for communication, collaboration and information exchange. However, with the freedom offered by these platforms also comes the great responsibility to use them wisely and in accordance with applicableregulations. This research aims to explore wise practices in the use of social media and their impact on individuals and society. Through a qualitative approach, data was collected through in-depth interviews and observations of various social media users. The research results show that awareness of privacy, diversity ofopinions, control of posted information, and openness to other people's perspectives are important factors in using social media wisely. Apart from that, this researchalso identifies the challenges and obstacles faced in efforts to make social media a positive communication tool. These findings provide valuable insights forindividuals, institutions, and regulators to develop policies and practices that promote responsible and ethical use of social media. . From the research results, itappears that social media users have varying levels of awareness of the terms of use, but compliance with these rules can vary depending on factors such aspeer pressure, the complexity of the rules, and the influence of the social and cultural environment. Challenges in practicing wise use of social media are alsoapparent, ranging from the pressure to maintain a perfect image to the  difficulty in distinguishing between valid information and hoaxes. In addition, the positive impacts of social media, such as social connectivity and access to information, are also accompanied by negative risks, including the spread of hoaxes and mental stress. The influence of the social and cultural environment on social media usage practices reinforces the importance of taking into account an individual's social and cultural context in developing appropriate approaches to managing risks and maximizing the benefits of social media. In this context,awareness of the positive and negative impacts of social media is key to helping individuals and society develop more responsible and ethical practices in the use of these platforms. A holistic approach is needed that combines education, social support, and supportive policies to create a healthy and productive onlineenvironment for all users

Abstract

The aim of this research is to look at the transformation of the Corruption Eradication Commission Institution after the revision of the new Indonesian Corruption Eradication Commission (KPK) Law in supporting corruption prevention policies in Indonesia. This research was conducted using doctrinal legal research methods or normative legal research. In this research, the approaches used include: Statute Approach. Conceptual Approach, Historical Approach, Case Approach. The research results show that: 1) The authority of the Corruption Eradication Commission (KPK) after the promulgation of Law no. 19 of 2019 concerning the Second Amendment to Law no. 30 of 2002 concerning the Corruption Eradication Commission, with the addition of the Supervisory Board within the Corruption Eradication Commission (KPK)  Institution which has quite large authority, namely not only supervision but also the implementation of the authority of the Corruption Eradication Committee, namely that it must first obtain permission from the Supervisory Board before carrying out wiretapping, searches and/ or the confiscation is carried out by the Corruption Eradication Commission, this can hinder law enforcement in eradicating criminal acts of corruption and can also affect the independence of the Eradication of Corruption Crimes within the Corruption Eradication Commission Institution.

Abstract

The Indonesian Constitution recognizes indigenous legal communities as part of the wealth of the Unitary State of the Republic of Indonesia whose existence and rights are guaranteed. One such group is the Minangkabau community, which is often involved in customary land ownership disputes. Internal and external conflicts in society. Many things cause these conflicts: non-transparent deliberation processes, lack of openness in the termination of customary land, inadequate compensation, and lack of guarantees from private companies. This study uses a descriptive empirical legal approach with primary data sourced from the field. Disputes are resolved through customary procedures, which usually involve the implementation of customary systems, deliberation, consensus through negotiation or mediation between local customs and companies (or representing companies) → Formulation of customary land disputes. Then the decision is formalized by registering the agreement with a notary or court so that it can be [legally] enforced. However, dispute resolution can be facilitated by a third party, for example, the territorial government approach that provides support in negotiations or finding agreements

Abstract

Marriage legalization (iṣbat nikah) is a legal mechanism submitted to the Religious Court to obtain official recognition of a marriage conducted according to Islamic law but not yet officially recorded in state administration. This study aims to examine the juridical basis, implementation procedures, and obstacles in submitting an iṣbat nikah application at the Karanganyar Regency Religious Court. The method used is normative juridical research with a statutory and case study approach. The study results indicate that the legal basis for iṣbat nikah is regulated in Article 7, paragraph (3) of the Compilation of Islamic Law (KHI), Law Number 1 of 1974 concerning Marriage, and Law Number 50 of 2009 concerning the Second Amendment to Law Number 7 of 1989 on Religious Courts. The practice at the Karanganyar Religious Court shows an increase in the number of applications, especially from couples in unregistered marriages (nikah siri). The main obstacles in the implementation are the lack of public legal awareness and limitations in evidence.This research concludes the need to improve public legal literacy as well as the active role of village government officials in encouraging early marriage registration.

Abstract

Government strategy in sports development is a critical foundation for preserving public health and fitness, which in turn boosts human resource production. This process begins with culturalization through the introduction of movement from an early age, mass promotion by making sports a lifestyle, looking for superior seeds through talent scouting and strengthening sports centers through a competition system, and improving performance through coaching nationally superior sports branches so that athletes can achieve the highest achievements. Sports serve as a vehicle for physical development, but they also serve to mold the nation's identity and character by instilling qualities such as discipline, sportsmanship, dynamism, and a strong work ethic. A nation's cohesiveness, integrity, and resilience are all strengthened by sports success, which also raises the nation's prestige and dignity internationally. The concepts of efficacy and fairness are not entirely reflected in the allocation of monies. In reality, certain sports organizations with a large following and a track record of success are given fewer budgetary allotments than other organizations with less substantial contributions. In addition, excessive budget plans and insufficient organizational governance were observed in some sports that received support. These findings have strategic significance for national sports management, notably in the establishment of a performance-based funding model that can be implemented by KONI at various regional levels. This study adds to the sports management literature by presenting a complete financial evaluation framework that can be used as a resource for national sports policy reform. To ensure that available finances can support the long-term enhancement of athlete performance, financing policies must be reformulated based on performance, real needs, and institutional responsibility.

Abstract

The purpose of this study is to examine the role of customary justice in Pancasila and the 1945 Constitution. The normative legal technique was employed in the research, which included numerous primary and secondary data sources such as the 1945 Constitution, regulations, legislation, court decisions, legal theories, and even scholarly opinions. The study's findings imply that Pancasila is necessary or coercive in nature. This means that anyone who is within the scope of the Unitary State of the Republic of Indonesia must respect Pancasila as a national outlook, including the State and the law itself. This means that the points of "Just and Civilized Humanity" and "social justice for all Indonesian people" which adhere to the principle of equal rights and justice must always be obeyed by all elements in the Republic of Indonesia. Pancasila is also a juridical-sociological basis, or in other words, it is the basis of norms and laws that live in society, and thus Pancasila has fulfilled the principles and basic values ​​according to the development and needs of society and the State.

Abstract

Kegiatan usaha penyewaan kamar kos di sekitar lingkungan kampus merupakan salah satu sektor ekonomi produktif yang berkembang pesat. Namun, masih banyak pemilik kos yang belum memahami pentingnya legalitas usaha melalui perizinan berusaha berbasis sistem Online Single Submission (OSS). Artikel ini bertujuan untuk mendeskripsikan kegiatan pelatihan perizinan berusaha bagi pemilik kos di sekitar Kampus Universitas Negeri Surabaya (UNESA) 5 sebagai upaya meningkatkan kesadaran hukum dan tata kelola properti yang legal. Metode pelaksanaan dilakukan melalui pendekatan pelatihan partisipatif, pendampingan administrasi OSS, serta evaluasi pemahaman peserta. Hasil kegiatan menunjukkan adanya peningkatan pengetahuan dan kesadaran hukum pemilik kos terhadap pentingnya perizinan usaha. Pelatihan ini diharapkan menjadi model pemberdayaan masyarakat berbasis kampus dalam mewujudkan lingkungan usaha yang tertib, aman, dan legal.
