Abstract

Anak merupakan bagian keberlangsungan hidup bangsa dan negara Indonesia yang menjaga persatuan berdasarkan Pancasila dan Undang-Undang Dasar Republik Indonesia 1945. Menangani kejahatan yang melibatkan anak tidak mudah. Komisi Nasional Perlindungan Anak mendata kasus kekerasan pada anak pada tahun 2023 sebanyak 3.547 kasus, kasus perundungan merupakan kasus yang sering terjadi di Sekolah Menengah Atas (SMA). Kebijakan dalam penanganan kasus perundungan terhadap anak sangat penting dan memerlukan penanganan yang serius dalam merespon peningkatan kasus kekerasan di sekolah. Implementasi kebijakan pencegahan dan perundungan di Sekolah Menengah Atas memerlukan perhatian serius. Pemerintah Aceh telah membentuk tim untuk mengatasi kekerasan di sekolah. Hambatan dalam pencegahan dan penanganan perundungan di sekolah meliputi tidak ada laman pelaporan online, kesadaran dan pemahaman perundungan pada siswa yang minim, sumber daya dan fasilitas untuk korban terbatas, evaluasi dan pengawasan belum efektif karena tidak adanya pengawas sekolah di bidang bimbingan konseling, upaya pencegahan dilakukan melalui pelatihan guru, kampanye kesadaran anti perundungan, sosialisasi, dan koordinasi antara sekolah, guru, siswa, dan orang tua, serta memastikan perlindungan korban dan mencegah tindakan perundungan terjadi kembali.

Abstract

Scientific writing, which includes journal articles, has a role that has a positive impact on career development in a profession as well as the development of knowledge. Scientific work is also one of the important things for students, teachers and lecturers, both for obtaining graduation from one level of education and for the benefit of a work portfolio. Even so, there are still many who do not understand the preparation of scientific articles and the publication process. Therefore, the results obtained through this activity are increasing the knowledge of workshop participants consisting of students, general academics, and lecturers within the Malikussaleh University campus environment regarding scientific article writing and the publication process. This dedication is also very important to carry out, considering that there are still many parties who do not understand scientific articles in particular. What's more, with this workshop, of course, it is very helpful to motivate many parties to try to write and seek many ways of solving problems related to issues in society. As is commonly known, that the purpose of knowledge is to provide solutions to every problem that exists in society, and this can be obtained through research which can then be reported through scientific writing.

Abstract

Permasalahan utama dalam penelitian ini adalah adanya ketidaksesuaian antara norma hukum yang berlaku dengan realitas di lapangan, meskipun qanun telah mengatur sanksi tegas terhadap perbuatan ikhtilath, praktiknya masih banyak pelanggaran yang tidak ditindak oleh wilayatul hisbah, di mana pelanggaran ikhtilath oleh wisatawan asing sering terjadi secara terbuka tanpa adanya tindakan hukum yang tegas dari aparat penegak syari'at. Studi ini bertujuan untuk menganalisis penegakan Qanun Nomor 6 Tahun 2014 tentang Hukum Jinayah terhadap pelanggaran ikhtilath yang dilakukan oleh wisatawan asing di Kota Sabang, serta mengevaluasi sejauh mana peran wilayatul hisbah dalam menangani pelanggaran tersebut. Penelitian ini menggunakan pendekatan yuridis empiris dengan metode penelitian kualitatif. Objek formal penelitian meliputi pendekatan perundang-undangan, pendekatan kasus, dan pendekatan komparatif. Data diperoleh melalui observasi langsung dan wawancara dengan petugas wilayatul hisbah, geuchik gampong, tokoh agama, masyarakat setempat, dan wisatawan asing. Hasil penelitian menunjukkan bahwa penegakan qanun terhadap wisatawan asing belum berjalan efektif. Wilayatul hisbah tidak melakukan tindakan tegas meskipun pelanggaran terjadi secara nyata. Hambatan utama yang dihadapi meliputi keterbatasan sumber daya, tidak adanya kebijakan teknis, kendala bahasa, minimnya sosialisasi syariat, dan kekhawatiran merusak citra pariwisata. Solusi yang ditawarkan antara lain adalah penyusunan kebijakan teknis khusus, pelatihan petugas dalam komunikasi lintas budaya, serta peningkatan sosialisasi syari'at melalui media informasi di kawasan wisata. Dengan demikian, diharapkan wisatawan dapat memahami dan menghormati hukum yang berlaku di Aceh, khususnya di Kota Sabang.

Abstract

A total of 50 beggars and homeless people have been recorded in Lhokseumawe City. This number has increased compared to the previous year, which recorded 37 beggars and homeless people. Article 34 paragraph (1) of the 1945 Constitution of the Republic of Indonesia affirms that the poor and neglected children shall be cared for by the state. In general, under Indonesia’s positive law, the activities of begging and vagrancy are classified as criminal acts. Substantively, criminal law provisions for beggars and homeless people remain necessary to address these issues in Lhokseumawe City. Based on this, the main problems are how criminal law policy regulates the handling of beggars and homeless people in Lhokseumawe City and how the implementation of criminal law enforcement is carried out against them. This research employs an empirical juridical method. The data sources consist of primary and secondary data, collected through interviews, observation, and document study, then analyzed qualitatively. The results show that there is no specific qanun (regional regulation) regarding beggars and homeless people. The existing criminal law policy still provides a legal basis for law enforcement against them. Efforts to address this issue include law enforcement, social rehabilitation, and social empowerment in accordance with Law Number 11 of 2009 and Government Regulation Number 31 of 1980. Therefore, handling beggars and homeless people can utilize provisions in the Indonesian Penal Code (KUHP), particularly Articles 504 and 505, which regulate begging and vagrancy in public places. The implementation of criminal law enforcement against beggars and homeless people in Lhokseumawe City still faces various obstacles in terms of legal structure, legal substance, and legal culture. Overall, law enforcement in this context requires regulatory reform, capacity building of law enforcement officers, and changes in the mindset of society and law enforcers to provide more effective and comprehensive solutions in addressing this issue.

Abstract

This study employs a qualitative socio-legal approach to examine the role of customary law in addressing climate change and ecological challenges in the Paya Nie wetland ecosystem. Customary law is understood not only as written norms but also as living practices embedded in community life. Thus, the ecological crisis in Paya Nie marked by recurrent drought, flooding, and ecosystem degradation cannot be analyzed solely through normative legal perspectives but requires a broader socio-ecological framework. Research data were obtained from two main sources. Secondary data came from academic journals, legal documents, government reports, and research publications, providing the conceptual foundation to situate customary law within environmental governance. Primary data were collected through participatory observation and in-depth interviews with customary leaders, local stakeholders, and surrounding communities to capture social dynamics, communal solidarity, and unwritten customary mechanisms that remain influential in daily practice. Data were analyzed using a descriptive-analytical method. The analysis first mapped ecological problems in Paya Nie, then linked them to customary and formal legal instruments, including qonun gampong. Finally, the findings were interpreted through the lens of socio-ecological resilience theory to reveal how communities adapt, transform, and innovate in response to climate change. The study shows that customary law in Paya Nie functions not only as a set of traditional rules but also as an adaptive mechanism that strengthens community resilience. It plays a critical role in regulating land use, fostering solidarity, and sustaining ecological balance. These findings contribute to the broader discourse on how living customary law can serve as a local strategy for ecological resilience in the face of global environmental change.
