Abstract

Political participation of persons with disabilities in electoral processes remains constrained by structural barriers despite constitutional guarantees and international human rights commitments. This study examines the need for electoral accessibility reform by employing the concepts of accessibility and reasonable accommodation as normative and philosophical foundations. The research adopts a normative legal method with conceptual and statutory approaches. The findings indicate that while Indonesia’s legal framework formally recognizes accessibility and reasonable accommodation, implementation gaps persist, particularly in relation to physical infrastructure, electoral information, and socio-cultural practices. Drawing on distributive justice and principles protecting vulnerable groups, the study argues that accessibility should be understood as a substantive equality requirement rather than merely a technical administrative measure. It concludes that electoral reform should prioritize universal accessibility standards and proportionate accommodation mechanisms to ensure equal political participation of persons with disabilities within Indonesia’s democratic framework.

Abstract

The open proportional system implemented in Indonesia since the 2009 elections was designed to enhance democratic participation and strengthen legislative accountability. Nevertheless, in practice, this electoral model has produced structural problems that have significantly undermined the quality of representative democracy. This study seeks to address a critical question: to what extent does the open proportional system generate structural imbalances in the distribution of political power within Indonesia’s democratic framework? A normative legal method is employed, utilizing the Structural Approach to Election Law developed by Samuel Issacharoff and refined by Nicholas Stephanopoulos and Yasmin Dawood. The research is based on doctrinal analysis of election laws, Constitutional Court decisions, relevant legal literature, and democratic theory. The findings indicate that the system reinforces the dominance of wealthy candidates, erodes the ideological foundations of political parties, and perpetuates structural exclusion of marginalized social groups. Furthermore, it demonstrates that election law, as an institutional structure, is not ideologically neutral and may be exploited to preserve unequal power relations. The study concludes that electoral reform is necessary to achieve structural justice, particularly through the reconstruction of electoral districts, revision of the parliamentary threshold, implementation of transparent campaign finance regulations, and revitalization of political parties as ideological entities. The structural approach offers a critical and holistic analytical framework for building a more just, inclusive, and substantively democratic electoral system in Indonesia.

Abstract

Tujuan penelitian ini adalah menemukan model maupun konsep terkait legalisasi pembentukan peraturan daerah bernuansa agama yang selama ini masih menjadi polemik antara kewenangan pusat dan daerah. Adapun metode yang digunakan dalam penelitian ini ialah normative, dengan menelaah kajian pustaka dalam hal ini peraturan perundang-undangan yang relevan dan dianalisis secara deskriptif kualitatif. Hasil penelitian terkait model pelegalan pembentukan peraturan daerah bernuansa agama yaitu; melakukan amandemen konstitusi dan mempertegas pasal mengenai urusan agama yang menjadi ranah kewenangan pusat dan daerah; Penambahan uraian dalam klausul “Penjelasan” UU Pemerintahan Daerah tentang batasan pengaturan agama oleh pemerintah pusat. Tolok ukur pengaturan masalah hubungan sosial keagamaan dalam undang-undang ini dapat memberikan kepastian hukum dan pelegalan keberadaan perda benuansa agama agar tidak lagi menjadi polemik; dan Pembentukan perda bernuansa agama melibatkan tokoh agama dan Forum Kerukunan Umat Beragama. Oleh karena itu, pemerintah pusat perlu membuat barometer sebagai ukuran sekaligus penegasan terhadap batasan masalah agama yang diatur pemerintah pusat secara nasional dan menyeluruh, dengan urusan publik dalam aspek mua’mallah (sosial kemasyarakatan). Penegasan ini mengingat ada aspek hubungan sosial keagamaan yang juga berkaitan dengan bidang pendidikan, ekonomi, budaya dan lingkungan yang merupakan tanggung jawab bersama dan menjadi urusan wajib pemerintah daerah. Batasan tersebut dapat dilakukan melalui revisi Undang-undang Pemerintahan Daerah maupun menambahkan dalam bagian “Penjelasan” UU dimaksud.

Abstract

Community service (PkM) in the form of educational assistance and legal consultation in Bulili Village, Duhiadaa Subdistrict, was carried out with the aim of improving legal understanding and assisting the community in resolving legal issues they face. This educational support and legal consultation activity was based on two crucial issues: the community's lack of understanding of marriage and inheritance laws, and their low participation in the village regulation formation process. These two issues were chosen because they significantly affect the realization of a safe, orderly, and prosperous village. The methods used in this community service program include interactive outreach and participatory-based direct consultation, combining educational and legal empowerment approaches for village residents. The results of the program indicate an increase in community legal awareness regarding rights and obligations within the family context, as well as the importance of active community involvement in the formulation of village regulations. It is hoped that this activity can strengthen the legal culture at the local level and serve as a foundation for the development of a just, inclusive, and sustainable village.

Abstract

This study aims to reconstruct the implementation of Article 33 of the 1945 Constitution through the framework of Ordnungspolitik developed by Franz Böhm and Walter Eucken. The study is grounded in the existence of imbalances in the normative, institutional, and functional dimensions of Indonesia’s economic system, which hinder the realization of the principles of solidarity and social justice. This study uses a normative legal methodology with a conceptual and comparative approach to legal thought. The analysis examines the comprehensive text of the amendments to the 1945 Constitution, sectoral regulations (such as the Job Creation Law and the Mining and Energy Law), as well as Constitutional Court rulings related to the economy. Data is analyzed qualitatively to align the principles of the German economic order (Ordoliberalism) with the values of the Indonesian Constitution. The novelty of this study lies in offering a new interpretive model for Article 33 of the 1945 Constitution by positioning the state as the architect of the market order (rather than merely a passive actor or regulator). Its innovation lies in integrating the substantive rule of law of Ordnungspolitik to limit the concentration of private economic power, which often distorts the constitutional mandate. The results show that Ordnungspolitik provides operational instruments for Indonesia to achieve distributive justice through two main channels: (1) strengthening the independence of competition oversight agencies to the level of constitutional institutions, and (2) codifying economic laws that guarantee market access rights for small businesses. This interpretation shifts the paradigm of Article 33 from mere symbolism regarding “cooperatives” to a binding norm that obligates the state to undertake structural interventions to maintain market integrity. The conclusion is that integrating the principles of Ordnungspolitik into the national legal system can serve as a solution to Indonesia’s economic institutional failures. This study recommends restructuring economic public policy to prioritize healthy competition and the protection of social rights as an inseparable legal order.
