Abstract

This study examines the influence of Environmental, Social, and Governance (ESG) regulations on corporate legal liability within the evolving framework of modern business law. As global business practices shift toward sustainability and accountability, ESG has transformed from a voluntary guideline into a mandatory regulatory standard that shapes corporate behavior. This research employs a qualitative and normative approach by analyzing relevant legal frameworks, scholarly literature, and case studies to explore how ESG regulations affect corporate responsibility. The findings indicate that ESG regulations significantly expand the scope of corporate legal liability beyond traditional financial obligations to include environmental protection, social responsibility, and governance transparency. Companies are increasingly held accountable through civil, criminal, and administrative sanctions for non-compliance with ESG-related standards. The study also highlights that effective ESG implementation can serve as a preventive mechanism, reducing legal risks and enhancing corporate governance. However, challenges remain, particularly in terms of regulatory harmonization, enforcement mechanisms, and varying levels of compliance across jurisdictions. This research concludes that ESG regulations play a critical role in strengthening corporate accountability and promoting sustainable business practices. Integrating ESG into corporate legal frameworks is essential for balancing economic objectives with social and environmental responsibilities in the long term.

Abstract

Pesatnya pertumbuhan e-commerce di Indonesia membawa tantangan serius bagi perlindungan konsumen, khususnya terkait peredaran produk kosmetik ilegal yang mengandung bahan berbahaya atau tanpa izin edar Badan Pengawas Obat dan Makanan (BPOM). Penelitian ini bertujuan untuk menganalisis batasan tanggung jawab hukum platform marketplace terhadap peredaran produk kosmetik ilegal di ekosistem digital Indonesia serta mengevaluasi efektivitas regulasi yang berlaku saat ini. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan kajian literatur (literature review). Data sekunder diperoleh melalui penelusuran sistematis terhadap peraturan perundang-undangan, jurnal ilmiah, dan dokumen hukum terkait dalam dekade terakhir. Hasil penelitian menunjukkan adanya pergeseran paradigma hukum dari doktrin Safe Harbor yang pasif menuju tanggung jawab aktif berdasarkan Peraturan Pemerintah Nomor 80 Tahun 2019 tentang Perdagangan Melalui Sistem Elektronik. Meskipun platform sering kali dianggap sebagai perantara, secara hukum mereka memiliki kewajiban duty of care untuk melakukan verifikasi identitas pedagang dan kurasi produk yang berpotensi membahayakan kesehatan publik. Kelalaian dalam pengawasan preventif terhadap kosmetik berbahaya dapat dikategorikan sebagai Perbuatan Melawan Hukum (PMH) sesuai Pasal 1365 KUHPerdata. Kesimpulan penelitian ini menekankan bahwa perlindungan konsumen di era digital tidak cukup hanya melalui tindakan represif berupa penghapusan tautan produk. Diperlukan integrasi sistem verifikasi izin edar otomatis antara database BPOM dengan sistem internal marketplace untuk mencegah penayangan produk ilegal sejak hulu. Selain itu, penguatan Undang-Undang Perlindungan Konsumen diperlukan untuk mempertegas tanggung jawab spesifik penyelenggara platform dalam rantai distribusi digital guna menjamin kepastian hukum dan keselamatan konsumen.

Abstract

This study examines the relationship between business licensing and the effectiveness of public services, focusing on Micro, Small, and Medium Enterprises (MSMEs) in the service sector. The research is grounded in the transformation of licensing systems from conventional bureaucratic procedures to digital, risk-based approaches such as the Online Single Submission Risk-Based Approach (OSS-RBA). Using a qualitative descriptive method based on literature review, this study analyzes how licensing reforms influence efficiency, accessibility, transparency, and user satisfaction in public service delivery. The findings indicate that digital licensing systems significantly improve service effectiveness by simplifying procedures, reducing processing time, and enhancing transparency. However, challenges such as limited digital literacy, technological constraints, and institutional coordination issues still hinder optimal implementation. The study concludes that while licensing reform has a positive impact on public service effectiveness, its success depends on supporting factors including human resource capacity, infrastructure readiness, and policy consistency. This research contributes to the discourse on governance reform and MSME empowerment in developing economies. Keywords: Business licensing; Public service effectiveness; MSMEs; Digital governance
