Abstract

Penelitian ini menganalisis pengelolaan dana desa untuk pembangunan Balai Kemasyarakatan di Desa Likuang, Kecamatan Tabukan Utara, Kabupaten Kepulauan Sangihe, dengan menggunakan konsep fungsi manajemen George R. Terry (perencanaan, pengorganisasian, pengarahan, dan pengawasan). Metode penelitian kualitatif dengan pendekatan studi kasus dilakukan melalui wawancara, observasi, dan dokumentasi, yang dianalisis secara deskriptif kualitatif. Hasil penelitian menunjukkan bahwa perencanaan dana desa sudah sesuai dengan peraturan, namun belum sepenuhnya strategis. Pengorganisasian telah berjalan baik, meski partisipasi lembaga dan masyarakat terbatas. Pada pengarahan, pemerintah desa fokus pada pelaksanaan administrasi, tetapi sosialisasi kepada masyarakat kurang optimal. Pengawasan administrasi sudah ada, tetapi pengawasan fisik dan keterbukaan informasi masih kurang. Penelitian ini menyarankan perlunya perencanaan lebih realistis, koordinasi yang lebih baik antarperangkat desa, serta peningkatan partisipasi masyarakat.   Kata kunci : Pengelolaan, Dana desa, Pembangunan, Balai Kemasyarakatan ABSTRACT This study analyzes the management of village funds for the development of the Community Hall in Likuang Village, Tabukan Utara District, Kepulauan Sangihe Regency, using George R. Terry's management functions concept (planning, organizing, directing, and controlling). A qualitative research method with a case study approach was employed, collecting data through interviews, observations, and documentation, which was then analyzed descriptively. The results indicate that the village fund planning is in accordance with regulations, but it is not fully strategic. The organization of tasks within the village apparatus is well executed, though participation from village institutions and the community remains limited. In terms of direction, the village government focuses on technical and financial administration, but socialization to the community has been insufficient. Administrative supervision is in place, but physical oversight and public information transparency are lacking. This study suggests the need for more realistic planning, better coordination among village apparatus, and increased community participation.   Keywords: Management, Village Funds, Development, Community Center

Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana efektivitas penerapan Pasal 378 KUHP dalam menanggulangi tindak pidana penipuan di Indonesia serta untuk mengetahui bagaimana upaya harmonisasi antara Pasal 378 KUHP dengan peraturan lain, seperti UU ITE, dalam menangani penipuan digital. Penelitian ini menggunakan metode penelitian hukum normative dengan pendekatan historis. Temuan penelitian menggambarkan bahwa pasal 378 KUHP memiliki kekuatan normatif yang jelas dalam mengatur tindak pidana penipuan, dengan unsur-unsur yang harus dipenuhi dalam pembuktian, seperti penggunaan tipu muslihat, rangkaian ringkasan, nama palsu, atau keadaan palsu untuk menguntungkan diri sendiri secara melawan hukumPerkembangan teknologi telah mengubah cara pelaku penipuan, dari metode konvensional ke digital. Dalam hukum Indonesia, Pasal 378 KUHP masih menjadi dasar utama untuk menjerat pelaku penipuan, namun UU ITE juga relevan untuk menangani penipuan digital. Namun, dalam praktik penerapannya masih belum harmonis, sehingga sering menimbulkan persoalan hukum. Kata kunci : Penerapan, hukum tindak pidana, pasal 378 KUHP ABSTRACT This study aims to determine the effectiveness of the application of Article 378 of the Criminal Code in combating fraud in Indonesia and to determine how efforts to harmonize Article 378 with other regulations, such as the Electronic Information and Transactions Law (UU ITE), can be made to address digital fraud. This study uses a normative legal research method with a historical approach. The research findings illustrate that Article 378 of the Criminal Code has clear normative force in regulating fraud, with elements that must be met in proof, such as the use of deception, a series of summaries, a false name, or a false identity to gain unlawful personal gain. Technological developments have changed the methods of fraudsters, from conventional to digital methods. In Indonesian law, Article 378 of the Criminal Code remains the primary basis for prosecuting fraudsters, but the Electronic Information and Transactions Law is also relevant to addressing digital fraud. However, in practice, its application remains inconsistent, often leading to legal issues. Keywords: Implementation, criminal law, Article 378 of the Criminal Code
