Abstract

This study examines the role of groundwater conservation tax in Bantul regency. We will analyse the enforcement of groundwater conservation in Bantul and what role that the tax serves for the conservation policy. The study will also discuss the allocation of taxation revenue for the continuation of Bantul groundwater conservation. Penelitian ini menguji peran pajak air bawah tanah air konservasi di Kabupaten Bantul, yaitu pelaksanaan konservasi air bawah tanah di Bantul dan apa peran yang diberikan dari pajak air pada konservasi air bawah tanah dan berapa banyak hasil pajak air dialokasikan untuk program konservasi air bawah tanah di Kabupaten Bantul.

Abstract

Following the abolishment of all controlling measures except repressive control, decentralisation triggers fundamental changes in local government administration. Tight control may obstruct regions’ autonomy and hamper central-regional relation. Proportional control is indispensable for balancing out local governments’ freedom. All monitoring measures outside Act 32/2004 are unwarranted without improvement of legal instruments at central government.Dengan menghapuskan semua bentuk pengawasan kecuali pengawasan represif, desentralisasi menciptakan perubahan fundamental dalam penyelenggaraan pemerintahan daerah. Pengawasan yang ketat dapat mengekang daerah dan mengganggu hubungan pusat-daerah. Pengawasan otonomi yang proporsional diperlukan sebagai penyeimbang kebebasan pemerintahan daerah. Bentuk pengawasan di luar UU 32/2004 cenderung berlebihan tanpa perbaikan instrumen hukum tingkat pusat.

Abstract

Albeit the absence of standing for ultra petita verdicts, our Constitutional Court has in several rulings issued such verdict. Consequently, citizens’ constitutional rights that initially should be protected by the Court are being deprived of instead. Therefore, the Court shall stop producing ultra petita verdicts until it acquires decent standing.  Walaupun tidak ada payung hukum untuk menaungi pengeluaran putusan ultra petita, beberapa kali Mahkamah Konstitusi memutus secara ultra petita. Sebagai akibatnya, hak-hak konstitusional warganegara yang seyogyanya dilindungi oleh Mahkamah malah dilanggar. Dengan demikian, sudah selayaknya Mahkamah tidak lagi mengeluarkan putusan ultra petita selama dasar hukumnya belum ada.

Abstract

The effectivity of banking disputes settlement through banking mediation benefits the customers and the bank. This research analyses the role of Bank of Indonesia in mediating disputes. Results show that banking mediation has not been utilized optimally and that BI is actually not in the position to handle such mediation. Efektifitas penyelesaian sengketa perbankan melalui mediasi perbankan sangat bermanfaat baik bagi nasabah maupun bank. Penelitian ini menganalisis peran Bank Indonesia dalam menengahi sengketa perbankan. Hasil penelitian menunjukkan bahwa mediasi perbankan ini belum dimanfaatkan secara optimal dan bahwa BI sebenarnya tidak memiliki tugas untuk memediasi sengketa perbankan.

Abstract

Religious Courts were established with mandate to serve Indonesia Moslem in case settlement based on Islamic Law. The Religious Courts are Courts of limited or special jurisdiction and party (as specified in their Statutes). They differ from the General Courts which have a general jurisdiction. The jurisdiction are limited on marriage, inheritance, will (wasiat), gift (hibah), waqf (wakaf), tithe (zakat), infaq, alms (shadaqah) and Shariah Economic (Act Number 3 of 2006 on Amendment of Act Number 7 of 1989 on Religious Court ). The courts take exclusive jurisdiction in marriage affairs concerning a Moslem husband and wife relating to marriage, revocation, reconciliation and divorce where the intervention of a religious court judge is necessary. Practically, the Courts jurisdiction extends to same range in divorce matters but the party in the case is non-Moslem. The jurisdiction is based on Islamic Personality principle; first, she or he was Moslem when marriage was conducted and second, the contract based on Islamic Law.

Abstract

There is an effort to adopt an internationally-accepted legal definition for ‘terrorism’ since such definition will enhance international cooperation in fighting terrorism, which at the moment is fragmented and ineffective. However, various obstacles e.g. political heterogeneity or ideological discrepancy arise when seeking a uniformed definition of terrorism, hence this study. Dunia internasional berupaya untuk menetapkan definisi legal ‘terorisme’ yang diterima secara umum karena definisi ini dapat meningkatkan kerjasama internasional dalam melawan terorisme yang saat ini masih terkotak-kotak dan tidak efektif. Tulisan ini membahas pelbagai kesulitan yang muncul dalam upaya mencari definisi tersebut, seperti masalah keragaman politik dan kesenjangan ideologi antarnegara.

Abstract

The 1992 Traffic and Transportation Act perceives transportation as an important and strategic tool to improve economic development. However, problems such as traffic jam and bad infrastructure remain unsolved; with community behaviour as one of its root. Therefore, transportation problems ought to be resolved through socio-cultural approach besides physical improvement.  Undang-Undang Lalu Lintas dan Angkutan Jalan 1992 memandang transportasi sebagai alat yang penting dan strategis untuk mendorong perkembangan ekonomi. Namun demikian, banyak masalah yang belum terselesaikan, seperti kemacetan dan infrastruktur yang buruk. Masalah-masalah itu berakar dari perilaku masyarakat. Dengan demikian, masalah transportasi mesti dipecahkan melalui pendekatan sosial-budaya selain perbaikan fisik.

Abstract

This research focuses on the application of the internationally-standardized rights to healthcare and education during the course of decentralization in Yogyakarta. Local government must ensure citizens’ Ecosoc rights before passing education or healthcare-related policies. Results show that the implementation of international standards on healthcare is better than on education.  Fokus penelitian ini adalah penerapan standar internasional dalam hak atas kesehatan dan pendidikan selama kebijakan desentralisasi di Yogyakarta. Pemerintah setempat harus menjamin hak-hak Ekosob masyarakat sebelum menerbitkan kebijakan yang berkaitan dengan pendidikan dan kesehatan. Hasil penelitian menunjukkan bahwa penerapan standar internasional di bidang kesehatan lebih berhasil daripada di bidang pendidikan.

Abstract

This paper focuses on the concept of corporate social responsibilities (CSR), particularly its implementation on environmental issues. The main question aimed to be answered is on how can environmental performance be adequately signaled to the market? It assumes by performing proper environmental performance, companies could benefit from financial incentive for future improvement and reputation benefit for the companies’ image, which eventually influence the bargaining position of companies in the market.

Abstract

This research shows that several factors have caused the unavailability of worker union. The factors include the government, the companies, the laws and the workers. The government does not actively socialize and supervise worker unions. Moreover, employers prefer an unofficial worker union rather than the official one. The Indonesian Industrial Relationship Law and Worker Union Law regard worker union as a right rather than an obligation. However, the workers do not fully aware of the benefit of the union. Rather, the workers consider the requirement of providing article of association and financial autonomy as burdens in establishing the union. The condition is getting worse with the fact that the workers do not have opportunity to establish the worker union.
