Abstract

The aim of this study is to analyze the legal regulation of citizens' digital profiles in the context of the digital transformation of public authorities in Kazakhstan, and to compare it with the regulatory approaches of the EU and OECD countries. The study is based on comparative legal analysis, the normative-dogmatic method, an institutional approach, legal modeling, and a qualitative synthesis of legislative, judicial, and supervisory materials. The theoretical contribution of the study lies in conceptualizing citizens' digital profiles not as technical administrative tools but as legally regulated governance infrastructures that mediate relations between the state and the individual within centralized digital systems. The study identified three key legal risks of centralized digital governance in Kazakhstan: unlawful processing of personal data due to broad inter-agency access without differentiated regimes and procedural restrictions; the secondary use of personal data beyond the original administrative purpose due to the absence of clear prohibitions; systemic data breaches caused by fragmented cybersecurity regulation and the predominantly reactive nature of accountability mechanisms. In contrast, the EU and OECD approaches are based on convergent, rights-based governance models featuring independent institutional oversight, mandatory data protection impact assessments, and differentiated access regimes. The study substantiates the need for three priority areas of legal modernization in Kazakhstan: the introduction of mandatory preventive legal risk assessment procedures, the establishment of independent institutional oversight, and the implementation of differentiated access regimes for personal data.

Abstract

This study examines the institutional challenges of zakat distribution for persons with disabilities in Tana Toraja, a Muslim-minority region in Indonesia. Using a qualitative fieldwork design, data were collected through semi-structured interviews with BAZNAS officials, local government representatives, disability organization actors, and zakat beneficiaries. The findings show that zakat assistance for persons with disabilities remains at an early and fragmented stage. Productive assistance has been provided in the form of livestock, while consumptive assistance has addressed basic needs; however, the program has not yet been institutionalized in BAZNAS Tana Toraja’s short-, medium-, or long-term planning. The absence of an integrated disability database, weak coordination with local agencies, limited fiscal support, and the lack of local zakat regulation constrain program sustainability. Using Talcott Parsons’ AGIL framework, this study argues that adaptation and integration have begun but remain partial, while goal attainment and latency have not been fully achieved. The article contributes to Islamic economic law by highlighting the need for inclusive zakat governance in Muslim-minority regions.

Abstract

This study investigates the presence of Muslim diasporas within a predominantly Catholic society in eastern Indonesia, focusing on the Bimanese Muslim diaspora community in Manggarai. Despite growing scholarship on Muslim minorities in Catholic-majority regions of Indonesia, how everyday ritual practice mediates cultural identity at the contact zone between diaspora communities and host societies has received little systematic attention. This article focuses on their matrimonial customs and the determinants influencing their evolution and persistence, highlighting that marriage rite functions as a mechanism for negotiating identity and maintaining intercultural coexistence in a minority-majority religious setting. In such situation, social processes emerge as identity negotiations created and enacted by cultural agents within diaspora populations. This study adopts an interpretive paradigm and qualitative methodology, employing ethnography as its primary technique to conduct a thorough analysis of the Bima community and culture in Manggarai, encompassing West Manggarai, Manggarai, and East Manggarai districts. Drawing on the theory of cultures of hybridity, this article reveals a dynamic cultural hybridity shaped by three diasporic models: commercial, institutional, and da'wah. Through nuanced negotiations, the community navigates dual identities, fostering intercultural solidarity and redefining cultural boundaries. The coexistence arises from an interplay between the local community's "code of honor" and the diaspora's cultural-religious "code of conduct", creating a dynamic of mutual respect and adaptation. By balancing these codes, the Bimanese Muslim diaspora integrates into the host culture while preserving their religious identity. This study contributes to underscore that life cycle rituals, especially marriage, serve as a pivotal social performance and a powerful medium for intercultural dialogue, underscoring the agency of diasporic communities in shaping multicultural landscapes.

Abstract

Urban Muslim Toraja families face persistent tensions between ancestral reverence rituals, such as Rambu Solo’ and Ma’nene’, which are rooted in Aluk Todolo traditions, and Islamic legal norms that prohibit shirk. Existing studies have largely examined communal forms of religious-cultural negotiation, while the micro-family level remains underexplored. This study examines how urban Muslim Toraja families adapt ancestral rituals through Islamic legal reasoning and how these adaptations contribute to social integration. Using a descriptive-analytical qualitative approach, data were collected through semi-structured interviews with eight informants from five Muslim Toraja families in Tana Toraja and Makale, participant observation of family ritual practices, and analysis of local fatwa, customary texts, and ethnographic documents. The findings reveal three interrelated mechanisms of adaptation: the selective use of ‘urf as a secondary legal source, the application of maqasid al-shariah to legitimate ritual modification, and family ijtihad led by household religious authorities. These mechanisms allow families to replace elements considered incompatible with Islamic belief while preserving ritual structure and kinship solidarity. This study contributes to fiqh al-aqalliyyat scholarship by showing that minority legal reasoning can operate not only through communal institutions, but also through micro-family ijtihad in culturally plural Muslim-majority societies.

Abstract

Since decentralization, sharia-inspired local regulations have proliferated in Indonesia, yet scholarship often narrowly focuses on coercive enforcement and social conflict. Consequently, there is limited understanding of how these regulations function symbolically in normatively plural settings, especially among communities that are not their direct targets. This study employs a qualitative socio-legal approach to examine the positioning of sharia-inspired local regulations in relation to the Baduy indigenous community of Kanekes, Banten. The analysis is based on official documents, specifically three regional regulations: Banten Provincial Regulation No. 1 of 2021 on Halal Product Guarantee, Lebak Regional Regulation No. 8 of 2001 on the Protection of the Baduy Community, and Lebak Regional Regulation No. 6 of 2003 on the Prohibition of Alcoholic Beverages, as well as Constitutional Court Decision No. 97/PUU-XIV/2016 on the Recognition of Indigenous Faith Followers as a broader legal reference point. Findings reveal that these regulations do not operate through direct enforcement against the Baduy, but through the construction of normative hierarchies within the public legal sphere. For instance, halal-certified frameworks in buffer zones reorder sources of normativity, elevating state-institutionalized sharia norms while repositioning pikukuh (customary law) within a framework of conditional recognition. This article argues that the core issue of sharia formalization lies in how public law symbolically constructs these hierarchies. Its contribution lies in advancing a non-coercive approach to legal pluralism and clarifying the ethical limits of sharia formalization in systems that claim to respect normative diversity.

Abstract

This article examines the interpretation of regulatory and legal acts in Islamic law, the Romano-Germanic legal tradition, and the Anglo-Saxon legal tradition in the context of contemporary digital legal challenges. The study is based on the research gap that previous studies have generally examined these legal traditions separately, while limited attention has been given to how they reinterpret existing legal norms when facing similar new problems, such as artificial intelligence, crypto-assets, smart contracts, and electronic evidence. Using a normative juridical method supported by a comparative legal approach and limited content analysis, this article compares the sources of law, subjects of interpretation, dominant interpretative methods, institutional authority, and flexibility of each legal tradition. The study finds that Islamic law emphasizes moral legitimacy and public benefit through ijtihad, maslahah, and maqasid al-sharia; the Romano-Germanic tradition prioritizes legal certainty through codified norms, systematic interpretation, and teleological reasoning; while the Anglo-Saxon tradition offers flexibility through precedent, purposive reasoning, and case-based development of law. The article argues that no single legal tradition provides a complete model for interpreting law in the digital era. A more adaptive model requires the combination of normative certainty, institutional consistency, interpretative flexibility, and value-based justice. These findings contribute to comparative legal scholarship and provide a conceptual basis for improving legal interpretation in modern law enforcement and regulatory reform.

Abstract

This article discusses the practice of pre-mortem property distribution among Javanese Muslims in Karang Tengah Village, Bantul, Yogyakarta. The purpose of this study is to explain how local Muslim families distribute family property before the death of parents and to analyze the legal problems that may arise from this practice. This study is based on qualitative field research conducted in Karang Tengah through interviews with village officials, religious figures, and community leaders. The findings show that the distribution of family property in Karang Tengah is generally carried out through family deliberation. In this process, parents may first indicate the share or property to be received by each child, a practice locally known as dicungke. The distribution is often based on dumdil, namely equal distribution among children, although in certain cases a child who cares for ageing parents may receive additional property known as harta gantungan. Village-level recognition is also exercised in the practice of ugeran, exclusion of the surviving spouse from direct shares and customary recognition of adopted children. Local families understand these practices as a way to keep harmony and avoid conflicts among heirs. However, the study also noted that arrangements of this nature may result in legal uncertainty unless they are made in the form of legally recognised instruments like gifts, wills, written family agreements, documented mediation settlements or formal land transfers. Therefore, the pre-mortem property distribution practice in Karang Tengah cannot be considered as a mere deviation from the formal inheritance law. It is a traditional mechanism used by local families to prevent conflict but it is legally vulnerable when it is not linked to valid legal procedures. It argues that pre-mortem property distribution should be legally translated into gifts, wills, written family agreements, documented mediation settlements, or formal land transfers to preserve family harmony while ensuring legal certainty.

Abstract

The Constitution as the legal basis is a general agreement of the citizens regarding basic norms and basic rules in the state, which became known as the 1945 Constitution. As a general agreement, the 1945 Constitution is an attempt to find common ground and reconciliation of various values and interests of citizens, including the values and norms of Religion, in this case Islam. This paper will provide reference naqliyyah arguments for the provisions contained in the 1945 Constitution. The authors focus on taking part one that is article 29 of the 1945 Constitution. To find where the intersection between al Quran texts with the sounds of article 29 the author uses a comparative analysis of the text. The result between the constitution with the source of Islamic teachings that the Quran, have the same spirit substantially, fight for humanity and uphold justiceKonstitusi sebagai dasar hukum merupakan kesepakatan umum warga negara mengenai norma dasar dan aturan dasar dalam bernegara, yang kemudian dikenal dengan Undang-undang Dasar 1945. Sebagai, kesepakatan umum, UUD 1945 merupakan usaha pencarian titik temu dan rekonsiliasi dari aneka nilai dan kepentingan warga negara, termasuk di dalamnya nilai dan norma Agama, dalam hal ini Islam. Tulisan ini akan memberikan rujukan dalil-dalil naqliyyah untuk ketentuan yang dimuat dalam UUD 1945. Penulis fokus mengambil satu bagian yaitu pasal 29 UUD 1945.Untuk mencari dimana titik temu antara teks al Quran dengan bunyi pasal 29 penulis menggunakan pendekatan analisis komparatif atas teks. Hasilnya antara konstitusi dengan sumber ajaran Islam yakni al Quran, punya semangat yang sama secara substansial, memperjuangkan kemanusian dan menegakkan keadilan.

Abstract

Selama 32 tahun, mulai 1966 sampai 1998, Indonesia diperintah sebuah rezim yang bernama orde baru dengan one manusia show, Soeharto. Orde mana star awal dengan komit-men dan kinerja akan membangun demokrasi dan kesejahteraan rakyat, tetapi kemudian berkembang menjadi otoriter (dictator konstitusional, istilah Prof. Dr. Ismail Sunny, SH. LLM) dan berbudaya KKN yang menyengsara-kan rakyat pinggiran. Akibat dari performance orde baru tersebut, akhir paru 1998 muncul gerakan reformasi yang dipelopori kala-ngan Perguruan Tinggi, yang akhirnya hanya dalam waktu empat pekan berhasil ditumbangnya, seraya melahirkan orde reformasi. Orde ini hingga kini telah dipresideni tiga orang, BJ. Habibie, Abdurrahman Wahid dan Megawati Soekarnoputri. Dari rentang ketiga presiden ini, mengawali esensi orde reformasi itu. Yang mencolok malah aksi unjuk rasa yang berstandar ganda. Tulisan ini akan menyorot bagai-mana Kontribusi perspektif agama (baca Islam) dengan melalui pemahaman refor-masi yang benar dapat mengantar Indonesia ke suatu wajah Indonesia baru. Kata Kunci : Refonnasi, Hak Asasi dan al-Qur'an.
