Abstract

Kejahatan ekonomi berbasis teknologi merupakan ancaman signifikan di era transformasi digital dan perdagangan global. Penelitian ini bertujuan untuk mengembangkan konsep penanggulangan kejahatan berbasis teknologi dengan strategi makro yang bersifat multiaspek. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan komparatif, hasil studi menunjukkan pentingnya pendekatan sistemik yang melibatkan aspek sosial, budaya, ekonomi, teknologi, politik, dan hukum. Komparasi antara pendekatan yang diterapkan di Amerika, Eropa, dan Indonesia menunjukkan perbedaan signifikan dalam regulasi, kolaborasi, dan implementasi teknologi. Di Indonesia, tantangan utama meliputi regulasi yang adaptif, infrastruktur keamanan digital, dan literasi digital masyarakat. Penelitian ini menekankan perlunya strategi multiaspek yang terintegrasi untuk menghadapi kompleksitas kejahatan berbasis teknologi dalam konteks global.

Abstract

Tulisan ini mengkaji overcrowding sebagai permasalahan utama yang dihadapi mayoritas lembaga pemasyarakatan di Indonesia. Permasalahan overcrowding merupakan persoalan hilir yang tidak dapat diselesaikan secara parsial, sehingga dibutuhkan pemahaman yang komprehensif tentang politik dan kebijakan hukum di Indonesia. Tulisan ini merupakan penelitian doktriner, dengan studi kepustakaan dan perbandingan sejumlah negara dalam pengelolaan lembaga pemasyarakatan untuk dijadikan dasar penentuan penyebab dari covercrowding. Hasil penelitian menunjukkan sistem hukum dan peradilan di Indonesia masih berkontribusi secara aktif terhadap overcrowding dengan diberlakukannya masa tahanan yang panjang sebelum proses peradilan, jumlah aturan perundang-undangan yang mengedepankan fungsi punitif dengan menerapkan sanksi pidana kurungan dibandingkan dengan fungsi rehabilitatif. Dengan demikian, dibutuhkan sebuah transformasi hukum dan penerapan alternatif pidana tanpa kurungan, sebagai solusi jangka panjang mengatasi overcrowding di Indonesia.

Abstract

The rapid development of artificial intelligence (AI) presents complex challenges in legal theory, particularly regarding the question of AI as a legal subject. As AI becomes increasingly capable of creative work and decision-making, the question arises whether it should be recognized legally as an entity in its own right. This study explores the legal implications of recognizing AI as a legal subject through the lens of Immanuel Kant's philosophy, particularly focusing on human dignity. Kant argues that human dignity is intrinsic, grounded in the capacity for rational thought and moral responsibility, a characteristic AI lacks. Thus, recognizing AI as a legal subject risks undermining human dignity by equating human beings with entities that do not possess autonomy or ethical awareness. The study examines the current legal framework in Indonesia, highlighting the lack of clear regulation for AI, and explores the philosophical, ethical, and practical considerations involved in the legal treatment of AI. It argues that AI should be treated as a tool, not a legal subject, ensuring that human dignity remains the cornerstone of the legal system. The paper concludes by advocating for a fragmented, sector-specific approach to AI regulation in Indonesia, ensuring more focused oversight while protecting human dignity.

Abstract

This study explores the integration of technology in Indonesia’s Administrative Court system, particularly the impact of electronic justice (e-court) in the Society 5.0 era. With advancements in technology reshaping societal functions, the study examines how these changes have influenced legal proceedings within the Administrative Court. The research focuses on the implementation of Supreme Court Regulation No. 1 of 2019, which governs e-court proceedings, and how these technological advancements align with Indonesia’s legal culture and the values of Pancasila, particularly social justice. It highlights fundamental shifts, such as the introduction of electronic summons, electronic domicile, and online hearings, as part of the modernization of judicial processes. Through qualitative research and doctrinal legal analysis, this study emphasizes the significance of legal culture in ensuring the smooth transition to digital procedures and fostering public awareness of citizens’ rights and obligations. The findings suggest that while technological progress in the court system brings efficiency, the successful adoption of these changes requires legal culture to promote public understanding and participation, ultimately supporting the realization of social justice as outlined by Pancasila.

Abstract

This research explores the urgent need for a legal framework governing the use of Autonomous Vehicles (AVs) in Indonesia, focusing on the integration of Artificial Intelligence (AI) technologies in transportation. With traffic accidents accounting for a significant portion of global fatalities, the adoption of AVs powered by AI is seen as a potential solution to reduce human errors and enhance road safety. However, Indonesia’s existing traffic laws, primarily focused on conventional vehicles, lack provisions for AVs, creating a legal vacuum. This study compares the legal structures of AVs in the United Kingdom and Indonesia, highlighting the differences in recognition, liability, and regulation. Drawing on the concept of "Law as Integrity" by Ronald Dworkin, this paper argues for the construction of a new legal framework that integrates the evolving needs of society, technology, and legal principles. By applying a multi-disciplinary approach, the research emphasizes the importance of collaborative legal construction, involving government, academia, civil society, and manufacturers, to ensure safe, just, and efficient integration of AVs in Indonesia’s road systems. The study concludes with recommendations for regulatory reforms, including the establishment of specialized supervisory agencies and the mapping of AV operational areas.

Abstract

This study explores the role of economic rationality in legislative processes, particularly in the context of local regulations in Indonesia. Focusing on the Kutawangi Regional Regulation on Cultural Heritage, the research highlights how economic interests shape legislative actions, leading to inefficiencies and failures in legal protection for cultural heritage. Through ethnographic case studies, the research examines the interactions among legislators, NGOs, and other stakeholders, revealing a pattern of pragmatic economic rationality that prioritizes personal and institutional benefits over policy substance. The study finds that such practices—such as outsourcing academic text production and manipulating legislative procedures—undermine the quality and effectiveness of laws. The research further uncovers the widespread use of symbolic legislation and bureaucratic pathologies as strategies to meet performance targets without addressing substantive policy issues. The findings suggest that these practices not only compromise legislative integrity but also reflect broader systemic issues in governance. To improve legislative quality and restore public trust, the study advocates for interventions such as ethics training, anti-corruption programs, and enhanced transparency in legislative processes.

Abstract

In the era of the “Participative Web,” copyright regulations are increasingly seen as inadequate for fostering creativity, as they hinder the ability of users to remix and create new works from existing ones. This research explores the limitations and exceptions in Indonesia's copyright law, specifically Law Number 28 of 2014, and their relevance in the digital age. It highlights the growing role of internet users not only as consumers but also as active content creators, blurring the lines between creators and consumers. The study argues that current copyright law, with its rigid structure, restricts freedom of expression and cultural development. It proposes that more flexible copyright limitations and exceptions could facilitate creativity in the participative web, benefiting both creators and users. By comparing Indonesian law with the more flexible "fair use" doctrine in the United States, the research suggests that Indonesia could benefit from adopting a more adaptive approach, including the transformative use doctrine. This would allow for more creativity while balancing the rights of copyright holders. Ultimately, the study calls for a reevaluation of Indonesia’s copyright framework to better align with the needs of the participative web.

Abstract

Agriculture plays a vital role in sustaining the economy and livelihoods, particularly in developing countries. In Indonesia, the agricultural sector faces several challenges, including widespread farmer poverty, low incomes, climate change impacts, and inadequate agricultural insurance. These issues underscore the need for a reformed agricultural legal system focused on empowering family-based farmers and ensuring sustainable agricultural practices. This research examines the existing agricultural legal framework in Indonesia, identifying the limitations in farmer welfare and social protection mechanisms. The study emphasizes the importance of transforming informal agricultural employment into formalized agricultural work, aligning with the Sustainable Development Goals (SDGs) of eradicating poverty and hunger. It also highlights the need for a comprehensive Agricultural Legal System that guarantees social security, implements agricultural insurance, and provides a legal foundation for family-based agricultural operations. The findings suggest that a paradigm shift toward recognizing farmers as individual legal subjects, alongside policy reforms in agricultural insurance and social security systems, is crucial for improving the livelihoods of farmers and achieving sustainable agricultural development. This research proposes the establishment of a dedicated Farmer Social Security system, ensuring health, pension, and accident coverage, to promote farmer welfare and facilitate the transition to a formal agricultural economy.

Abstract

This study examines the socio-economic and health challenges faced by female workers in the Kretek and Beedi industries in Indonesia and India, respectively. These industries, while culturally significant, involve labor-intensive processes that predominantly employ women in rural areas. However, the working conditions are hazardous, exposing workers to respiratory illnesses, musculoskeletal disorders, and chronic diseases, compounded by low wages and insufficient labor protections. This research highlights the disparity in regulatory frameworks between the two industries, with Indonesia’s Kretek industry benefiting from better safety standards compared to the informal Beedi sector. Despite the challenges, both industries contribute significantly to the local economy, particularly through the employment of marginalized women. The study proposes policy reforms that aim to improve occupational safety, wage equality, and social security for female workers, ensuring their economic and social empowerment. Recommendations include strengthening labor laws, formalizing employment structures, and offering skill development and healthcare initiatives. By creating a protective legal environment and prioritizing gender equality, this research calls for collaborative efforts from governments, industries, and NGOs to foster a sustainable, inclusive future for these workers. The findings emphasize the urgent need to balance cultural preservation with worker welfare, ensuring long-term stability for both sectors.

Abstract

Art has increasingly become a target for political agendas, often subjected to legal restrictions that limit freedom of expression. This phenomenon is evident in countries like Myanmar, where several laws have been enacted to criminalize speech, surpassing international legal standards. In Indonesia, the rise of authoritarian tendencies has been linked to the weakening of artistic freedom, as reflected in the rising number of cases of artistic repression. This study explores the legal and practical realities of artistic freedom in Indonesia, addressing how the legal system handles attacks on artistic expression and the involvement of state and non-state institutions in strengthening legal protection for artists. It discusses the theoretical framework of artistic freedom, its protection under international human rights law, and Indonesia’s legal context, particularly through laws like the 1945 Constitution and various international agreements such as the ICCPR. The research highlights the challenges of balancing artistic freedom with public morality, security, and order, and critiques the misuse of legal restrictions that often result in excessive censorship. By examining historical and contemporary legal cases, the study proposes an ideal legal framework to ensure robust protection for artistic expression in a democratic society, advocating for a balanced approach between law enforcement and fundamental human rights.
