Abstract

This research investigates the judges’ perception and tendency to refer to the Books of Fiqh (Kitab Kuning). This research focuses on sharia economic dispute settlement in Indonesian religious courts. The research method used combines normative legal and empirical socio-legal research. The results found that the perception and tendency of judges towards several sources of legal rules in assessing, weighing, and deciding a sharia economic case in the Indonesian Religious Courts, did not always rely on one KHES as a material source. In Indonesian law, judges cannot use only one source in resolving sharia economic disputes, such as the Book of Fiqh (Kitab Kuning) only. However, it is an equally important combination, and it can be seen from several decisions of the Religious Courts in Indonesia.

Abstract

Religious harmony is a coveted hope in building a nation and state community in an effort to achieve a safe, peaceful, and prosperous life. The interaction of people who have different beliefs is not a trivial matter to be addressed. However, collective awareness is needed to understand the importance of harmony in building community life with various religions. This study takes the theme of the role of local culture in preserving harmony, as well as the impact of globalization on inter-religious relations in Pelang Lamongan Village. The purpose of this research is to understand the role of local culture in preserving religious harmony, and to know the impact of globalization on inter-religious relations in the Pelang Lamongan village community. As for the analysis knife, this research uses the Trilogy theory of religious harmony, Mukti Ali, with the model of internal harmony between religious communities, inter-religious communities, and religious communities with the government. Research using a qualitative approach seeks to examine more deeply the pattern of inter-religious harmony in the village of Pelang Lamongan. With the findings, that culture is one of the efforts to build religious harmony such as local traditions, namely earth alms and life cycle rites, they become routines that they do continuously and continuously. This directly or indirectly has the consequence that it can foster and strengthen inter-religious harmony. An inclusive religious attitude also underlies the tolerant attitude of the Pelang village community, this attitude is manifested in the practice of gotong royong in carrying out socio-religious activities involving Muslims (NU, Muhammadiyah) and Christians. In addition, globalization can be used as capital in strengthening the intensity of social interaction among the people of Pelang Lamongan village.

Abstract

In the last two years, there has been a lot of discussion about the integration of religion and science. The discussion emerged as a response to the split in the logic of religious and scientific thinking regarding the handling of COVID-19. By conducting research based on qualitative methods and in-depth analysis through the theory of Islamization of science, this study found two findings; First, The religion-science polarization in the dynamics of dealing with COVID-19 is reflected in the selfishness of the two in responding to COVID-19. The orthodox religious perspective tends to be metaphysical-dogmatize, while science tends to be positivistic-empirical; Second, Al-Faruqi's idea of ​​Islamization of science emphasizes the five principles of unity (tawhid), namely the unity of God, creation, truth-knowledge, humanity, and the unity of life. In the context of dealing with COVID-19, the five units cover two dimensions; 1) Methodology, a dimension that specifically targets religious areas to be more transformative and not fatalistic; 2) Content, dimensions related to the world of science so as not to be trapped in the view of secular positivism.

Abstract

Every communication behaviour in society has a concept of mindset and ideology called behaviour as a structure in culture. This study examines the gender communication of community groups based on the NU and Muhammadiyah traditions. The research method used in this research is qualitative research with a critical ethnographic approach. The results show that the gender identity of the Tanggulangin Sidoarjo community comes from the teachings of religion and local Javanese culture. Religious sources are taken by studying holy books, and local cultural authorities are taken through four Javanese expressions: wanito, short for wani ditoto, Javanese terms macak, cook, manak, and konco wingking, swargo nunut neroko katut.

Abstract

Religious people realize the importance of maintaining religious harmony, tolerance in religion is needed in conditions of heterogeneous community areas. Theologically religion teaches its people to be tolerant in religion, this is reflected in the various lives in Besowo village, Kediri, where conditions of religious life run in harmony and peace. This study will look comprehensively at the portrait of the relationship between diverse people in Besowo, the factors that encourage the creation of religious harmony, the role of religious leaders and public perceptions in seeing the era of globalization in the eyes of religious harmony. The results showed that the Besowo community had built religious harmony from generation to generation, culture became one of the adhesive fields in inter-religious relations, while religious leaders played a role in encouraging the development of moderate religious attitudes both in mindset and behavior, in addition to facing the era of globalization. Global society is required to be wiser and behave positively on social media.

Abstract

The rise of theft, robbery, gambling and drug users by the youth of Negorejo Village, Lumbang District, Probolinggo Regency causes mental loss, addiction, and prolonged depression that can affect their peers and minors. The presence of Hadratus Shaykh Habib Ali Bin Muhammad al-Habsyi in 2017 brought solutions and significant changes in overcoming one of these problems by establishing the Pettengan Shalawat Council. The Pettengan Shalawat Assembly is a prayer assembly held at night to instill character values. Since the implementation of Shalawat Pettengan, youths are more civilized and have character; this is evidenced by the low level of drug users by young people, who are starting to realize the true meaning of life and the purpose of life. The implementation of the Pettengan Shalawat aims to grow awareness in shaping the character of youth and society so that they can communicate and establish good relationships with God (hablun min Allah) and others (hablun minannas). In this case, the existence of the Pettengan prayer meeting can direct, guide, and make people moral, dignified, and have a character so that they are helpful to the nation and religion.

Abstract

Moroccan family code reform (mudawanah al-usrah) passed in 2004 after a long and dramatic process promoted by Moroccan women against retreating Islamists and male domination. This paper reviews Muslim family law (mudawanah al-usrah) in Marocco. Based on a literature research method that uses a normative juridical approach with a statutory approach, this paper aims to discuss the challenges and opportunities in guaranteeing women's rights in Moroccan family law. The study indicates that mudawanah al-usrah is a meeting point between Islamic rules and international conventions, providing a new identity for Moroccan society, especially women and their rights. This reform was also influenced by the Islamic feminist movement, which produced reforms to improve gender equality in Moroccan society. That was also expected to provide an overview of the protection of women's rights in family law, especially in Morocco, and become material for evaluation in its implementation in society. This study is also expected to be a reference for activists of family law studies to continue to develop the protection of women's rights in Islamic family law.

Abstract

This study aims to unravel the phenomenon of digital society in understanding and learning Islam through the internet. The current human tendency to rely on information available through smartphones has given birth to the reality of shifting learning patterns that do not have to meet directly with the teacher. Even the presence of a virtual teacher is considered sufficient to justify an excellent religious way. This study uses a qualitative method with a netnographic approach that intends to reveal social phenomena in cyberspace. This method uses a particular analytical technique offered, AMS (Siber Media Analysis), which goes through 4 levels: Media room level, media document level, media object level, and experience level. This study found that online internet users can access information about religious rituals and procedures for doing them. So, internet users are part of the world's religious adherents who carry out the same religious creed. On the other hand, religious authority as a source of knowledge in learning Islam on the internet is not always institutional but can also be individual. As a result, the Islamic pattern of understanding Islam among netizens is more accessible, inclusive, egalitarian, and shows multidimensional interactions between individuals and other religious groups.

Abstract

Juvenile delinquency occurs anywhere and anytime, including in Islamic boarding schools. Several studies have shown that students’ problematic behavior is sometimes strange and deviates from the rules of the Islamic boarding school. Therefore, the researcher seeks to deeply examine the juvenile delinquency of students in the Islamic boarding school community. This research is literature research, descriptive research, qualitative research, and exploratory which examines in-depth literature based on General and Social Psychology on Islamic boarding schools to find new aspects related to juvenile delinquency of santri. The analysis used a content analysis study and an in-depth discussion of the written information contents. The results indicated that juvenile delinquency students stem from unhealthy behavior; among the causes; are psychic instability, superego deficiency, control, and defective perceptual function. The therapy for problem students is cognitive behavioral therapy or Cognitive Behavior Modification, which combines cognitive and behavioral approaches to solve problems. Some efforts were: first, initial assessment and diagnosis; second, looking for the root of the problem from negative emotions, thought process deviations, and central beliefs related to the disorder; third, an intervention plan prepared by the counselor to provide positive-negative consequences for counseling; fourth, status formulation, therapeutic focus, behavioral intervention, and fifth is relapse prevention and self-help training
