Abstract

The existence of media, both mass media and social media, has recently resulted in a very important role in influencing public opinion and is even considered as a media that will open all information that actually occurs in Indonesia and even in the world. There are many mass media and social media used as tools by political elites to influence public views on framing images for both personal and group image interests. Even the difference between the two is that social media has a more capable scope for the implementation of this function. Social media will play a greater role because with the existence of a container to accommodate freedom of opinion, netizens can freely provide feedback on their views as a reaction to the news that is rolling so that it increasingly shows the direction of various netizen reactions and increasingly emphasizes the direction of the reaction in the form of comments, uploads, reactions from other people's opinions and even influences real actions in the real world. Social media can shape our views on various issues that are rolling. One way that is often used by social media is by the way they "package" the news, which in simple terms is called "framing." Media framing can greatly influence the way we view an issue with the access that every social media user can obtain and can leave a trail of opinions written on the basis of freedom of speech.

Abstract

This includes physical assaults, including actions against minors such as slapping, or more severe acts involving deadly weapons. Furthermore, physical violence may involve hitting, injuring the body with blunt objects, sharp weapons, or other technology-related means (e.g., electricity). The use of violence may cause various injuries such as bruises, stab wounds, lacerations, or even injuries that lead to death. Threats or acts of violence can occur directly, through speech, body language, or indirectly (via letters, phone calls, or third parties) with the intent of using physical force against another person. The purpose of this research is To analyze the enforcement of the law against perpetrators of physical domestic violence based on Law No. 23 of 2004 on the Elimination of Domestic Violence in the jurisdiction of the Pekanbaru Police Resort; To examine the legal process and effectiveness in the handling of physical domestic violence cases; To identify efforts to overcome obstacles in enforcing the law against perpetrators of physical domestic violence in the same jurisdiction. This study employs a sociological legal research method. Based on the research findings, it is known that the enforcement of the law against perpetrators of physical domestic violence in accordance with Law No. 23 of 2004 in the jurisdiction of the Pekanbaru Police Resort has not been running effectively. This is evident from the continued prevalence of domestic violence cases in society. The persistent occurrence of domestic violence reflects the fact that the law has not yet been fully felt by victims—especially women and children, who are most vulnerable to abuse. One of the fundamental underlying issues behind weak law enforcement in domestic violence cases is the strong influence of patriarchal culture embedded in the social structure. In a patriarchal system, men are positioned as the dominant authority in the household, while women are expected to be obedient and submissive.

Abstract

Business actors, as parties with stronger bargaining positions, ethically have the obligation to ensure that the products they manufacture and distribute are safe for use. Moral responsibility should drive business actors to actively ensure product quality and refrain from concealing defects or hidden faults that may harm consumers. Therefore, it is important to examine how the Consumer Protection Law regulates the legal responsibilities of business actors for hidden defective products, and how moral responsibility can strengthen their commitment to upholding consumer rights. This study employs normative legal research methods. Based on the findings, the legal responsibility of business actors for hidden defective products, as governed by Law No. 8 of 1999 on Consumer Protection, serves as a concrete form of consumer rights protection. A hidden defective product is one that appears normal at the time of purchase but contains a defect that is not immediately visible and only causes damage or harm after use. The Consumer Protection Law requires business actors to be fully responsible for the products they produce or trade, including their quality, safety, and the accuracy of the information provided to consumers. Article 19 of Law No. 8 of 1999 stipulates that business actors must provide compensation for damages caused by defective products, including physical harm, contamination, or financial losses. This form of liability is strict, meaning that even if the business actor was unaware of the defect, they are still held accountable for introducing a defective product into the market. This obligation reflects the principle of due diligence in business and reinforces protection for consumers, who are generally in a weaker position in legal and commercial relationships. The legal consequences faced by business actors who neglect or evade this responsibility are also regulated by the Consumer Protection Law.

Abstract

The legal political system greatly influences the Indonesian state to become a state based on law, thus requiring the involvement of community components in the process of formulating laws. This is so, because the legal political system will have a vital role in making the law. This is because the direction of the Indonesian state in the application as a state of law uses the concept of Continental European Civil Law, where written law is a very important part of the formation process, and is used as the basis for the implementation of governance. In order to ensure the implementation of legal protection for all people, as well as justice in treatment, and guarantee protection of citizens' rights, it is necessary to establish concrete guidelines in planning and drafting laws. This is intended to be the basis for regulating the process of law-making, starting from the beginning until the time when the law is enacted or applied in regulating the life of the state society. Thus, by creating concrete guidelines and guidelines, each law-making process can be carried out in a definite, consistent, and standardised manner.

Abstract

The use of advanced technology, sophisticated operandi modes, cross-border operations, and extensive network of organizations in support of international drug crime have caused many victims, especially among the younger generation, and have had a serious impact on the lives of individuals, communities, and nations. This research uses a methodological approach to normative law, involving legal theory and comparative law research. This article aims to evaluate the effectiveness of the agreements implemented in Thailand and Indonesia in stopping illicit drug trafficking. Nevertheless, the policies that have been implemented to end the illicit drug trade from both countries have not shown success in attempts to stop or mitigate the problem.

Abstract

This provision is reinforced in Article 108, which stipulates that any person who carries out land burning as referred to in Article 69 paragraph (1) letter h shall be subject to imprisonment for a minimum of 3 (three) years and a maximum of 10 (ten) years, and a fine of at least IDR 3,000,000,000 (three billion rupiah) and at most IDR 10,000,000,000 (ten billion rupiah). This behavior not only disrupts public comfort due to the smoke produced but also causes environmental damage and air pollution, even though regulations prohibit such practices. The purpose of this research is to analyze the implementation of the prohibition on land clearing by burning based on Law Number 32 of 2009 in the jurisdiction of the Rokan Hulu Police, to examine the obstacles in its implementation, and to identify efforts to overcome these obstacles. The research method used is sociological juridical research. Based on the findings, the implementation of the prohibition has been carried out but not optimally. Communities continue to engage in small-scale burning in secret, especially at the beginning of the dry season. Although warning signs and banners prohibiting burning have been installed in several locations, supervision and patrols remain uneven. The main obstacles include the low awareness and understanding of the community regarding the environmental and legal impacts of burning, limited human resources and environmental investigation equipment, as well as difficulties in obtaining sufficient evidence and witnesses in the criminal process. Efforts to overcome these obstacles include enhancing environmental education and awareness programs for communities—particularly among farmers in fire-prone areas increasing the technical capacity of investigators through training on environmental law and fire forensics, and strengthening evidence collection using aerial monitoring technologies such as drones and GPS-based surveillance cameras to document burning locations as part of legal evidence.

Abstract

This study examines the application of criminal law to the offence of money laundering derived from fraudulent activities, using the Supreme Court Decision Number 77 K/Pid.Sus/2018 as a case study. Within the Indonesian legal system, money laundering is regulated under Law Number 8 of 2010 and classified as an offence outside the Penal Code (KUHP). The research adopts a normative juridical approach with a descriptive qualitative method to analyse both the normative provisions and judicial implementation relevant to the case. The findings indicate that money laundering constitutes a follow-up crime, requiring a predicate offence—such as fraud—as its basis. In the examined decision, the Supreme Court held that although the elements of fraud were not legally proven at the first and appellate court levels, the defendant’s actions fulfilled the elements under Article 5 of the Anti-Money Laundering Law, thus leading to the cassation being granted and a sentence imposed. The judgment reflects a proportional application of juridical, sociological, and philosophical principles by the judges. Furthermore, the study highlights the increasing complexity of modern banking systems and technology in facilitating money laundering practices. Consequently, a more integrative and adaptive law enforcement strategy is required to address the evolving dynamics of financial crime.

Abstract

This study aims to examine the legality of labor inspection determinations issued by Labor Inspectors in resolving disputes over overtime wages, in light of Law No. 2 of 2004 on Industrial Relations Dispute Settlement and Law No. 30 of 2014 on Government Administration. The research method employed is normative legal research with a statutory approach and a conceptual approach. The findings reveal that the authority of Labor Inspectors to issue determinations or re-determinations regarding overtime wage disputes, as regulated in Minister of Manpower Regulation No. 33 of 2016 jo. Minister of Manpower Regulation No. 1 of 2020, lacks a strong legal foundation, as it contradicts the dispute settlement mechanisms stipulated in Law No. 2 of 2004. Furthermore, such actions violate the principles of good governance under Law No. 30 of 2014 and potentially prolong the resolution process of industrial relations disputes. Therefore, the provisions within the Ministerial Regulation granting authority to Labor Inspectors to issue determinations or re-determinations are legally invalid.

Abstract

Data statistik menunjukkan bahwa jutaan video di YouTube mengandung konten musik berhak cipta yang digunakan tanpa otorisasi yang proper, menciptakan pelanggaran hak cipta dalam skala masif yang berpotensi merugikan pemegang hak yang sah dalam miliaran dollar per tahun. Penelitian ini menggunakan pendekatan hukum normatif (yuridis normatif) yang bertujuan untuk menganalisis dan mengkaji permasalahan hukum terkait kegiatan monetisasi ilegal reupload konten pada platform YouTube dalam perspektif hukum bisnis. Pendekatan normatif dipilih karena penelitian ini berfokus pada analisis peraturan perundang-undangan, doktrin hukum, dan asas-asas hukum yang relevan dengan permasalahan monetisasi ilegal konten digital, khususnya dalam konteks pelanggaran hak kekayaan intelektual dan implikasinya terhadap hukum bisnis di Indonesia. Analisis terhadap implikasi hukum potensial dari mekanisme fasilitasi lisensi yang diusulkan menunjukkan bahwa peran YouTube dalam memfasilitasi perjanjian lisensi pencipta-pengguna dapat berimplikasi pada klasifikasi sebagai Lembaga Manajemen Kolektif sebagaimana diatur dalam Pasal 87-92 UU Hak Cipta, yang akan menimbulkan kewajiban regulasi tambahan terkait pengumpulan dan distribusi royalti, persyaratan transparansi, dan pengawasan pemerintah. Analisis komprehensif ini mengungkap bahwa meskipun Indonesia telah memiliki kerangka hukum yang relatif memadai untuk perlindungan hak cipta dalam konteks monetisasi YouTube, optimalisasi implementasi memerlukan penguatan dimensi kelembagaan, peningkatan kapasitas enforcement, dan pengembangan mekanisme koordinasi multi-stakeholder yang lebih efektif. Penelitian ini menunjukkan bahwa mekanisme monetisasi YouTube telah menciptakan ekosistem ekonomi digital yang kompleks namun menghadapi tantangan signifikan dalam penegakan hak cipta. Meskipun platform telah mengimplementasikan kerangka kebijakan yang komprehensif melalui sistem deteksi otomatis, persyaratan ketat untuk monetisasi, dan integrasi dengan Google AdSense. Implementasi perlindungan hak cipta dalam ekosistem digital masih menghadapi tantangan struktural yang signifikan, khususnya dalam hal efektivitas penegakan hukum yang terhambat oleh ketergantungan pada sistem pengaduan manual dan ketiadaan mekanisme koordinasi sistematis antara otoritas nasional dengan platform global seperti YouTube.

Abstract

Article 14 of Law Number 29 of 2004 concerning Medical Practice states that the Indonesian Medical Discipline Honorary Council (MKDKI) is the body authorized to determine whether doctors and dentists have made mistakes in the application of medical and dental disciplines and to impose sanctions. This provision indicates that any medical dispute appears to be resolved through the Indonesian Medical Discipline Honorary Committee. However, the current medical dispute settlement through MKDKI is not in accordance with the principle of impartiality, as seen from the process of resolving medical disputes which takes a long time and may not necessarily be executed, including whether the applicant/patient won the case in the Indonesian Medical Discipline Honorary Council (MKDKI) session. What is the legal certainty of equitable medical dispute resolution? And how to realize a just MKDKI decision? The research method is carried out in a normative juridical manner. The results of the study show that justice can be obtained through civil lawsuits, either unlawful acts or defaults on the implementation of therapeutic agreements between patients and doctors in district courts. Legal certainty will be realized if medical dispute resolution arrangements are formed. Meanwhile, the applicant/patient in resolving medical disputes using the MKDKI mechanism, in this case between the patient and the doctor, has not received justice because the MKDKI decision does not contain an unlawful act clause, but rather the application of medical science to patients.
