Abstract

This study aims to examine the strategic role of women in the development of sustainable palm oil through education from the perspective of constitutional law. Using a normative juridical approach, the research analyzes constitutional guarantees and legal instruments that affirm women's rights to education and equal participation in sustainable development. The analysis is based on primary legal materials such as legislation, secondary materials including academic journals, and tertiary sources like legal dictionaries. The findings show that although women significantly contribute to the palm oil sector, their access to education, training, and decision-making positions remains limited due to structural and cultural barriers. The 1945 Constitution of the Republic of Indonesia, along with CEDAW, mandates the state to ensure non-discriminatory access to education and active participation in development. However, current sectoral regulations have yet to fully integrate gender equality, particularly in human resource development. The study concludes that the state must adopt affirmative actions such as training quotas for women, gender-based institutional incentives, and mainstreaming gender perspectives in vocational education curricula. These efforts are essential to positioning women not only as beneficiaries but also as key actors in inclusive and sustainable palm oil development aligned with constitutional justice.

Abstract

Online loans in Indonesia are becoming a growing business. Every day there are more and more online loans, some of which are even illegal.This scientific article was written to examine the bankruptcy that can be occurred in online loan debtors. The purpose of this article is to provide answers to what can be done when an illegal online loan debtor goes bankrupt. because online loans are a type of debt, they can be a reason for bankruptcy. Therefore, this research is expected to help bankrupt debtors if they are caught in illegal loans. The research was conducted normatively using books, journal articles, and articles in online media as research sources. Using the sources, researcher make facts based on the writings. The study concluded that illegal online loan agreements are valid in the eyes of the law until the agreement is terminated by a judge.

Abstract

Retribution refers to the payment imposed for the provision of market service facilities carried out by the local government. Its implementation must be conducted properly and in accordance with statutory regulations to ensure optimal benefits for the community. However, in practice, the collection of retribution fees at Simpang Sari Market differs from the stipulations outlined in Article 18, Paragraph (2) of the Regent Regulation of West Lampung Regency, which states: “Retribution officers are prohibited from altering or increasing the amount of the retribution fee.” In reality, the amount of retribution collected by officers diverges from the officially prescribed tariff. This study aims to investigate and analyze the implementation of market service retribution collection at Simpang Sari Market, and to examine it from the perspective of Fiqh Siyasah Tanfidziyyah (the Islamic theory of administrative governance). The research adopts a field research methodology using a descriptive approach, with data gathered through interviews and direct observation. Data were collected from pre-selected informants to ensure accuracy and relevance for this study. Although the local government has established regulations and provided implementation guidelines for the collection of market service retribution, several issues have emerged in practice. These include a lack of understanding among market vendors regarding the retribution system, poor coordination among collection officers, and the involvement of unauthorized individuals who collect fees outside the formal governmental structure.

Abstract

Many cases of rape are not only committed by strangers but also by people close to them, including people with sensory disabilities. The limitations of people with sensory disabilities make it difficult for them to protect themselves or even fight the perpetrators. Based on this, this paper is written with the aim of discussing further about law enforcement in cases of rape against people with sensory disabilities who are victims. The research was conducted using a normative research method that focuses on secondary data and is supported by primary data from interviews with several sources. The data collected will be analyzed systematically and logically to be processed to obtain a brief overview. Based on the results of the study, it can be concluded that law enforcement against people with sensory disabilities who are victims of rape is still guided by the Criminal Procedure Code by paying attention to the provisions in the Law on Persons with Disabilities and adjusted to the needs of the victim.

Abstract

This study examines the legal status ambiguity of Indonesian illegal migrant workers, positioning them as both legal violators and victims of exploitation, with a focus on the tension between normative compliance and human rights protections. Employing a normative legal research method, the article analyzes the misalignment between national regulations such as Law No. 18/2017, which restricts protections to legally documented migrant workers and international instruments, including the 1990 CMW Convention and the 2000 Palermo Protocol, which guarantee fundamental rights regardless of legal status. Key findings reveal systemic contradictions: while illegal migrant workers technically violate immigration laws, they are frequently subjected to structural exploitation (forced labor, human trafficking, and violence) due to inadequate legal safeguards. The study’s novelty lies in identifying a protection paradox: national legal frameworks exacerbate vulnerabilities through punitive approaches, whereas international human rights norms demand restorative, victim-centered responses. The analysis not only highlights normative inconsistencies but also underscores practical implications for migration governance, such as victim criminalization, inaccurate data, and barriers to prosecuting trafficking networks. The research recommends harmonizing national-international laws, adopting a victim centered approach, and strengthening interagency coordination to resolve legal ambiguities and ensure substantive justice for illegal migrant workers. These findings stress the urgency of shifting policy from security centric frameworks to human rights-based paradigms in addressing irregular migration.

Abstract

Perkembangan kecerdasan buatan (AI) telah membawa dampak signifikan terhadap berbagai aspek kehidupan, termasuk dalam sistem hukum dan perlindungan data. Penelitian ini bertujuan untuk menganalisis kebijakan dan regulasi terkait AI serta perlindungan data di Indonesia, dengan membandingkannya dengan standar internasional. Metode yang digunakan dalam penelitian ini adalah pendekatan normatif dengan analisis peraturan perundang-undangan, studi kasus, dan kajian literatur. Hasil penelitian menunjukkan bahwa regulasi AI di Indonesia masih dalam tahap awal, dengan beberapa tantangan utama terkait etika, keamanan, dan hak privasi. Sehingga, diperlukan langkah-langkah strategis dalam pembentukan kebijakan yang lebih adaptif dan berbasis prinsip keadilan serta kepastian hukum. Hasil penelitian menunjukkan bahwa regulasi terkait AI di Indonesia masih berada pada tahap awal dan belum sepenuhnya siap menghadapi tantangan yang ditimbulkan oleh pesatnya perkembangan teknologi ini. Beberapa tantangan utama yang ditemukan antara lain terkait dengan isu etika, keamanan data, serta hak privasi yang sering kali terabaikan. Oleh karena itu, dibutuhkan langkah-langkah strategis dalam pembentukan kebijakan yang lebih adaptif, transparan, dan berbasis pada prinsip keadilan serta kepastian hukum. Penelitian ini juga menyoroti perlunya pembaruan regulasi yang dapat menyeimbangkan inovasi teknologi dengan perlindungan hak-hak individu, agar Indonesia dapat memanfaatkan potensi AI secara maksimal tanpa mengorbankan privasi dan keamanan data.

Abstract

This study aims to analyze the legal resolution of traffic violations committed by military personnel within the framework of criminology, focusing on a case study in the Kogartap I/Jakarta area. Traffic violations involving military personnel raise complex issues related to legal authority, military jurisdiction, and the interaction between civil and military law. The research employs a qualitative approach with a criminological perspective to examine how military personnel are handled in cases of traffic violations, focusing on both the legal procedures and the sociological implications of these violations. The study found that military personnel involved in traffic violations are typically subject to military law, but the legal process often intersects with civilian law, leading to challenges in enforcement and adjudication. This research contributes to the understanding of the intersection between military and civilian legal systems, emphasizing the need for clearer protocols and more effective coordination between civil and military authorities to address such violations. The study also explores the criminological aspects of military involvement in traffic offenses, highlighting factors such as discipline, accountability, and the impact of military culture on behavior in the civilian sphere.

Abstract

The Jakarta riots of May 1998 marked one of the darkest episodes in Indonesia's contemporary history, characterized by widespread violence, looting, arson, sexual assaults, and targeted attacks against ethnic Chinese communities. Amidst the political upheaval that led to the fall of the New Order regime, allegations emerged regarding the involvement or negligence of the Indonesian Armed Forces (ABRI) in these human rights violations. Despite numerous reports and investigations, including by the National Human Rights Commission (Komnas HAM), legal proceedings remain stagnant. This study aims to conduct a juridical analysis of the alleged gross human rights violations committed by ABRI during the 1998 Jakarta riots, based on national legal instruments—particularly Law No. 26 of 2000 on Human Rights Courts—and international human rights norms. The research employs a normative juridical approach combined with transitional justice theory, emphasizing truth-seeking, justice, reparations, and institutional reform. By examining the legal responsibilities of state actors and the structural impediments to prosecution, this study identifies key legal and political gaps that have hindered the realization of justice. The findings underscore the absence of institutional accountability and the inadequacy of legal mechanisms in addressing past atrocities. This research contributes to the discourse on transitional justice in Indonesia and offers recommendations for strengthening legal frameworks to ensure state accountability and prevent future violations.

Abstract

The sale of hard drugs classified as Group G without meeting safety requirements has become a serious issue in Indonesia due to the high risk of misuse and the threat it poses to public health. In Timor Tengah Selatan Regency, several small kiosks have been found illegally selling these drugs without proper licenses and oversight. Commonly sold drugs include Mefenamic Acid, Amoxicillin Trihydrate, Piroxicam, Dexaharsen, and Antalgin. The main motive of the perpetrators is financial gain. This research to identify the factors that contribute to the sale of Class G prescription drugs without meeting safety requirements in Timor Tengah Selatan Regency, to examine the efforts made to address and mitigate the sale of Class G prescription drugs that not comply with safety regulations in Timor Tengah Selatan Regency. This research is empirical research with a legal sociological approach method that it is based on data obtained in the field through interviews with 8 respondents. The data collection techniques used in this study: observation, interviews, and literature review. Results study indicate that the factors contributing to the sale of Class G prescription drugs without meeting safety requirements in Timor Tengah Selatan Regency include a lack of legal awareness, economic motives (profit-seeking), and environmental factors specifically, unequal infrastructure development and the demands of the local community; efforts to address the sale of these drugs involve both preventive and repressive measures carried out by the Timor Tengah Selatan Resort Police.

Abstract

Legal protection for well-known trademarks is very important because trademarks not only function to distinguish similar goods and/or services, but also have an economic function. In the world of trade, there are often acts of reputation-hijacking which are motivated by various factors. The type of research used in this study is Normative Legal Research with the research approach used is the Case Approach. With the nature of the research, namely Descriptive Research and based on the form of research used is Prescriptive Research. Data sources are obtained through Secondary Data, which are divided into Primary Legal Materials and Secondary Legal Materials. The analysis is carried out qualitatively, namely by analyzing the data that has been obtained through a general and comprehensive description and then concluding the results of this study. Protection of foreign well-known trademarks nationally is regulated in Indonesian legislation, namely Law Number 20 of 2016 concerning Trademarks and Geographical Indications which is carried out in two ways, namely preventive legal protection and repressive legal protection. The legal considerations by the Judge in Decision Number 29/Pdt.Sus/Merek/2019/PN Niaga Jkt.Pst in determining bad faith in the registration of the Superman character by the Defendant (PT. Marxing Fam Makmur) did not show any distinguishing value between the Plaintiff's Superman and the Defendant's, which is a form of indicator of bad faith from the Defendant.
