Abstract

Currently, waqf is no longer identified with land that is given to educational institutions, cemeteries, places of worship or other things, but waqf can also be used as a source of strength for the welfare of the people and drives sectors of economic empowerment. The larger and more diverse waqf assets that can be managed professionally with proper management, the benefits derived from waqf management will be wider in designation so as to strengthen the role of waqf in improving the economy and welfare.

Abstract

In Indonesia, there are 2 (two) ways to resolve disputes between business actors and consumers, namely by litigation and non-litigation. Dispute resolution process dispute resolution process through court channels or what is also called litigation will take a relatively long time. relatively long time. Meanwhile, on the contrary, settlement through non-litigation litigation, namely through one of the quasi-judicial institutions, namely the Consumer Dispute Settlement Body, which is mandated by Law Number 8 Year 1999 on Consumer Protection. 1999 on Consumer Protection. The research results show that settlement of consumer disputes through the Consumer Dispute Settlement Body (BPSK) can be considered ineffective. This is evidenced by the fact that there are still many parties who do not agree with BPSK's decision. This is also supported by several obstacles contained in it.

Abstract

Indonesia merupakan negara kepulauan terbesar di dunia, terdiri dari 5 pulau besar dan 30 pulau kecil, tercatat sebanyak 17.504 pulau, 8.651 pulau telah diberi nama, 8.853 pulau belum diberi nama dan 9.842 pulau telah diverifikasi. sepanjang 5.150 km di benua Australia dan Asia serta membelah Samudera Pasifik di bawah garis khatulistiwa. Wilayah Negara Kesatuan Republik Indonesia terdiri dari daratan dan lautan, luas lautan 5,8 juta km2 atau 70% dari seluruh wilayah Negara. Seluruh wilayah laut Indonesia, 2,3 juta Km2 adalah wilayah perairan dan laut Nusantara, maka total ZEE Indonesia (ZEEI) adalah 2,7 juta Km2 dan panjang garis pantainya 95.181 Km2. Dalam hal ini, terkait produksi perikanan tangkap diatur oleh Pemerintah dalam Undang-Undang Nomor 31 Tahun 2004 tentang Perikanan, kemudian diubah dengan Undang-Undang Nomor 45 Tahun 2009 tentang Perubahan atas Undang-Undang Nomor 31 Tahun 2004 tentang Perikanan. Provinsi Sumatera Barat memiliki 7 kabupaten/kota yang terletak di wilayah pesisir dengan panjang total kurang lebih 1.973,24 Km, 185 pulau, dan luas laut 186.580 m2 padang lamun. Di perairan laut Sumatera Barat, luas kawasan mangrove diperkirakan mencapai 43.1866,71 Ha, terumbu karang seluas 36.693 Ha, dan padang lamun seluas 2000 Ha. Provinsi Sumatera Barat memiliki garis pantai yang cukup panjang dan memiliki laut teritorial, landas kontinen, dan ZEE yang cukup untuk kegiatan usaha perikanan. Beberapa wilayah pesisir di Kabupaten dan Kota di Provinsi Sumatera Barat telah mengembangkan usaha perikanan tangkap laut. Dengan hasil yang cukup menjanjikan, berdasarkan data Badan Pusat Statistik, Provinsi Sumatera Barat pada tahun 2018 menghasilkan ikan sekitar 218.084,10 ton.

Abstract

Waqf is a worship that is highly recommended by Rasulullah SAW. Waqf a practice that will always flow through his thighs even though he has passed away. In addition to the waqf, there was a manager who was asked by the waqif to manage the waqf assets that he gave, namely Nazhir. Nazhir existence in the development of waqf is very important, this can be likened to a manager in a company. He plays the role of developing waqf to produce something that is useful for religious and social interests in accordance with the hopes and intentions of the endowment. As a manager, Nazir can be formed from one or several people or institutions and also a Legal Entity. Waqf management should be able to manage waqf assets and the benefits of managing waqf are utilized for the welfare of the people.

Abstract

Pesatnya pertumbuhan perbankan syariah membuat munculnya potensi untuk terjadinya Pesatnya pertumbuhan perbankan syariah membuat munculnya potensi terjadinya sengketa perbankan syariah semakin tinggi, yang harapannya didukung regulasi untuk mengatasi setiap permasalahan yang muncul, agar tidak adanya kekosongan hukum dan terwujudnya kepastian hukum serta tidak bertentang dengan UUD 1945 sebagai dasar negara. Penelitian ini merupakan penelitian hukum normatif dimana produk hukum yang tediri dari peraturan perundang-undangan, norma, doktrin dan teori menjadi pokok kajiannnya. Penelitian ini bertujuan untuk menegtahui penyelesaian sengketa perbankan syariah menurut hukum islam serta Perkembangan Regulasi Penyelesaian Sengketa Perbankan Syariah Di Indonesia dalam perspektif Politik Hukum. Penelitian ini menyimpulkan Islam mengenal 4 cara penyelesaian sengketa yaitu : musyawarah, shulh (perdamaian), al-tahkim, dan alqadha.. Regulasi perbankan syariah semakin meningkat dan berkembang seiring dengan perkembangan perbankan syariah dibuktikan dengan berbagai peraturan perundang undangan yang diberlakukan. Konteks politik hukum dalam dimensi kebijakan pemberlakukan hukum (enactment policy) perbankan syariah dapat dijelaskan dalam dua faktor utama yaitu faktor internal dan faktor eksternal. Secara internal, hukum Islam diakui sebagai salah satu sumber dalam pembentukan sistem hukum nasional selain hukum adat (kebiasaan masyarakat) dan hukum Barat (Belanda) yang memiliki kedudukan yang sama dan seimbang.

Abstract

Alasan pemberhentian (impeachment) Presiden dan/atau Wakil Presiden dalam masa jabatannya tidak hanya berdasarkan atas alasan pelanggaran hukum tetapi juga dapat didasarkan atas pelanggaran etik. Pelanggaran etik dan penegakannya terkait Presiden dan/atau Wakil Presiden secara tersirat dapat dikonstruksikan melalui analisa terhadap Pasal 9 ayat (1), Pasal 7A, Pasal 7B UUD Negara Republik Indonesia Tahun 1945 dan Undang-Undang Nomor 7 Tahun 2017 Tentang Pemilihan Umum.

Abstract

The interest of the people is the formation of rules that are able to accommodate the eye of the law. Article 20 paragraph (1) of the 1945 Constitution states that "The House of Representatives holds the power to make laws. The formation of a regulation carried out by the parliament is a manifestation as a state of law, the state is obliged to carry out the development of national law which is carried out in a planned, integrated and sustainable manner in the national legal system that guarantees the protection of the rights and obligations of all Indonesian people based on the Constitution of the Republic of Indonesia in 1945. This research is a normative law (doctrinal research), namely. In normative legal research, research is carried out through library research. The results of this study indicate that the Implications of the Constitutional Court Decision Number 91 of 2020 have the consequence of a formation of legislation without reflecting the principle of legal certainty and the principle of openness must be declared procedurally flawed in order to protect the public from the interests of legal product makers. The follow-up to the Constitutional Court Decision Number 91 of 2020 that tolerance for a legally defective product must not be re-applied even though the constitutional judge provides conditions as long as it is repaired for 2 (two) years, especially the Job Creation law. Thus, legal products must have concrete legal force in order to obtain legal certainty.

Abstract

Problems with pronunciation and accent in Japanese language learners often occur because learners have different mother tongues. This study aims to describe how the form of perception of consonant utterances in Japanese language learners whose native Javanese language is foreign when compared to native Japanese. The consonants that will be test are Japanese plosives and fricatives. The method used in this research is descriptive qualitative where the researcher will describe the results of data analysis and explain facts about perceptions of mother tongue speech, which interfere with foreign language learners, especially Japanese. The analysis was carried out based on the recording when testing words containing plosive and fricative consonants. Based on the results of the analyze in this study, it can be interpreted that Japanese language learners whose mother tongue is Javanese Mancanegari have differences from native Japanese speakers, both in terms of the frequency of the spoken consonants and in terms of the pitch-accent waves

Abstract

In traditional pawning in Tana Toraja, redemption of the pawned land is known as Ma'Sulang. Where the party who redeems the land has the right to get the land. However, in the context of Indonesian written law, this has not been accommodated in a written statutory regulation so that it could lead to different interpretations by the parties involved in the process of pawning the customary land, giving rise to legal uncertainty. The method in this research is empiricial that examinethe applicable legal provisions and what happens in reality in society. The results of the study confirm the difference between ma' sulang and the written legal provisions in Article 7 of Perpu No. 56 of 1960 concerning Determination of Agricultural Land Areas for redemption of pawns contains rules for a time limit of 7 years and the recipient of the pawn is obliged to return the pawned land to its owner with no right to demand a ransom payment, while the rules for redeeming traditional pawns (ma' sulang) do not recognize a time limit. but the obligation to return is binding. The lender is obliged to redeem his land if he wants the land back. The object of land from Ma' Sulang can also be applied for the issuance of a certificate of ownership of land rights while still adhering to the written legal provisions. making a letter of approval for the distribution of inheritancesigned by other heirs in the presence of witnesses and authorized officials.

Abstract

It is important to be careful when the directors assign the authority of substitution to someone else who will represent the company. The Directors shall set down in the Power of Attorney in specific and definite terms the scope of the legal activities authorized by the Power of Attorney. This does not, however, exclude the chance that the person who received the power of attorney might abuse that authority and cause damages for the agent of that power of attorney. In the Decision of the Supreme Court Number 4575 K/PDT/2022, the notary, who was the party who made the deed of power of attorney for the directors, bears responsibility for the legal ramifications of a forged directors' power of attorney on credit that has been disbursed. A normative-juridical research methodology with a case study approach was utilized to examine Supreme Court Decision Number 4575 K/PDT/2022. According to the study's findings, the credit agreement remained legally enforceable for the parties even though the power of attorney for directors was declared illegal because it failed to satisfy the subjective criteria for agreement validity. Therefore, even though the notary who created the forged power of attorney is not criminally liable, he is nonetheless held civilly liable for any losses brought on by the forged document.
