Abstract

This research is entitled Government Strategy in Implementing the Digital Population Identity (IKD) Application by the Cirebon Regency Population and Civil Registration Service in 2022. This research is motivated by the ineffectiveness of the efforts of the Cirebon Regency government, especially the Population and Civil Registration Service, in the outreach carried out to the community as it should be. completed in an appropriate manner regarding the implementation of the Digital Population Identity Application which, if implemented properly, will make it easier for the public to apply for services related to population administration. This research aims to analyze and describe the Government's Strategy in Implementing the Digital Population Identity (IKD) Application by the Cirebon Regency Population and Civil Registration Service in implementing the Digital Population Identity Application (IKD). The research method used is a descriptive method with a qualitative approach. The data obtained comes from research results through literature studies and field studies through observation, interviews and documentation. The objective component is related to the strategic objectives of the Cirebon Regency government in terms of implementing the Digital Population Identity Application. Environmental components, internal and external environmental conditions that contain potential threats in the Cirebon Regency government strategy in implementing the Digital Population Identity Application. Direction component, in its implementation there are directions given by the Cirebon Regency Population and Civil Registration Service to related parties. The action component is carried out by implementing the Digitak Population Identity Application through several programs which will have an impact on improving public services in Cirebon Regency. The learning component has advantages and disadvantages in implementation, so an evaluation is carried out. Based on the research results, it can be concluded that based on the explanation and analysis of the Government's Strategy in Implementing the Digital Population Identity (IKD) Application by the Cirebon Regency Population and Civil Registration Service, it has not been implemented effectively and is still far from optimal.

Abstract

In Indonesia, acts of terrorism that attack police officers and police facilities, it can be understood that terrorist groups actually do this because of feelings of revenge and also the motive that the authorities no longer have the trust of the community that they can provide security and maintain the peace of the country's life. Several cases that have occurred in Indonesia include the attack on the Headquarters of the Indonesian National Police on March 31, 2021 and the suicide bombing that occurred at the Astana Anyar Police Station on December 7, 2022. These two tragedies are clear examples of the urgency of increasing security at police stations. Things that make terrorist attacks on police facilities and officers can be described based on the existence of exposed, vital, iconic, legitimate, destructible, occupied, near, and easy. The success of an act of terrorism depends on several factors, including the terrorist group's ability to plan and execute an attack effectively, as well as security weaknesses at the target of the attack. To overcome this problem, it is necessary to improve the security system by applying the concept of Crime Prevention Through Environmental Design (CPTED) to prevent similar attacks in the future.

Abstract

This research examines the position of Letter C in the ownership of land rights and legal protection for creditors in credit agreements with Letter C collateral. The findings show that the use of Letter C as credit collateral has a high risk for creditors because it does not provide strong legal certainty. The process of registering land with Letter C at the National Land Agency also takes a long time, adding to the uncertainty for creditors. This research aims to provide recommendations on better legal protection for creditors who receive collateral in the form of uncertified land.

Abstract

Perjanjian, seperti jual beli, menciptakan hubungan hukum dan konsekuensi yang diinginkan dalam bisnis. Namun, wanprestasi menjadi masalah utama. Penyelesaiannya krusial untuk menjaga kepastian hukum, membutuhkan pemahaman dalam prosesnya, yang dapat memperkuat fondasi hukum dan kepercayaan bagi pertumbuhan ekonomi yang berkelanjutan. Dalam penelitian ini, diputuskan untuk mengadopsi metode pendekatan Yuridis Normatif. Pendekatan ini mengarah pada penelitian yang menelusuri norma-norma hukum yang tercantum dalam peraturan perundang-undangan yang berlaku serta norma-norma yang telah tumbuh dan berkembang dalam masyarakat. Hasil dari penelitian ini Wanprestasi adalah ketidakmampuan atau kelalaian dalam memenuhi kewajiban perjanjian antara kreditur dan debitur, baik disengaja maupun tidak. Pasal 1243 KUH Perdata mengatur tentang penggantian biaya, kerugian, dan bunga akibat ketidakpenuhian perikatan, menekankan pentingnya mematuhi komitmen yang disepakati. Dalam konteks yang lebih luas, wanprestasi dapat berupa tidak memenuhi, melaksanakan secara tidak sempurna, atau terlambat dalam memenuhi prestasi, dipengaruhi oleh faktor internal dan eksternal. Dampak hukumnya dalam perjanjian jual beli signifikan, memicu penyelesaian sengketa melalui litigasi yang meski menghasilkan keputusan yang mengikat, juga dapat panjang, mahal, dan berisiko publisitas negatif, mendorong pencarian alternatif penyelesaian yang lebih efisien.

Abstract

Janji kawin merupakan janji dari seorang laki-laki untuk menikahi kekasihnya ataupun sebaliknya Banyak kasus yang muncul mengenai adanya ingkar janji kawin antara para pihak, sehingga salah satu pihak menggugat pihak lainnya karena merasa dirugikan akibat adanya ingkar janji tersebut. Rumusan masalah yang akan menjadi pembahasan di dalam penulisan ini yaitu mengenai bagaimana pengaturan terkait pengingkaran janji untuk menikahi dalam perspektif hukum perdata. Metode yang digunakan dalam penulisan ini yaitu dengan menggunakan penelitian normatif dengan spesifikasi penelitian preskriptif. Jenis dan teknik pengumpulan data yang digunakan adalah dengan menggunakan studi pustaka dimana penulis mengumpulkan data melalui bahan hukum primer, sekunder, dan tersier. Pendekatan yang digunakan penulis yaitu dengan pendekatan undang-undang (statute approach) dan pendekatan kasus (case approach) serta teknik analisis data secara deduktif. Janji kawin diatur di dalam Pasal 58 Kitab Undang-Undang Hukum Perdata. Mengenai ingkar janji terdapat yurisprudensi Putusan Mahkamah Agung Nomor 3191 K/Pdt/1984 yang memutus bahwa perkara pembatalan perkawinan secara sepihak merupakan perbuatan melawan hukum yang diatur pada Pasal 1365 Kitab Undang-Undang Hukum Perdata.

Abstract

Indonesian broadcasting Commission is an Independent public departmen, which established for holding the regulation, supervision, and law enforcement toward national broadcast departmen. Beside, that Indonesia Broadcasting Commission role, also directed for supporting govermment’ts duty in educating the nation toward broadcasting. This expectation appropriate to Indonesian national broadcasting purposes which’s included in law number 32 year 2002 aboaut broadcasting.The role of Indonesian Broadcasting Commission in ordor to support government’s duty in educating the nation through broadcasting is by making broadcasting regulation. Supervision and law enforcement are for the violations of broadcasting regulation. Indonesian Broadcasting Commission’s role is expected in order to supervise the broadcasting and together provide protection to the Indonesian society, so that indonesian society can enjoy national broadcasting which enlightens, nurture and educate. So That, national broadcasting purposes which’s mandated by Law number 32 year 2002t about broadcasting can be achieved.

Abstract

The government provides convenience for Micro and Small Enterprises (hereinafter abbreviated as UMK) by making a breakthrough through Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law. Article 109 of Law Number 6 of 2023 concerning Job Creation reads: "A Limited Liability Company, hereinafter referred to as the Company, is a legal entity that is a capital partnership, established based on an agreement, carrying out business activities with authorized capital entirely divided into shares or individual Legal Entities that meet the criteria for Micro and Small Enterprises as stipulated in the laws and regulations regarding Micro and Small Enterprises." If an individual PT no longer meets the criteria for Micro and Small Enterprises and/or its shareholders become more than 1 person, the Individual PT must change its status to a Capital Partnership as stipulated in Article 17 of the Regulation of the Minister of Law and Human Rights of the Republic of Indonesia Number 21 of 2021 concerning Terms and Procedures for Registration of Establishment, Change and Dissolution of Limited Liability Company Legal Entities. The purpose of this study is to determine and analyze the change of Individual PT to Capital Partnership PT, as well as the legal benefits in changing Individual PT to Capital Partnership PT. This research uses normative juridical methods by taking a statutory approach and a conceptual approach. The nature of the research uses descriptive analysis by reviewing, describing, and explaining legal problems or issues regarding the change of Individual PT to Capital Partnership PT in terms of legal benefits. The results showed that the change of Individual PT to Capital Partnership PT creates legal benefits for Micro and Small Enterprises in the ease of doing business and investing.

Abstract

Financial Technology (Fintech) dan platform digital menawarkan model bisnis dan alternatif solusi yang dapat membantu pemerintah dan institusi finansial lainnya untuk memperluas jangkauan pemberian layanan finansial yang memadai. Masyarakat perlu mendapat edukasi untuk menambah pengetahuan dan pemahaman yang baik terkait kredit keuangan elektronik melalui perusahaan fintech khususnya Peer To Peer (P2P) Lending yang telah menjadi salah satu alternatif peminjaman dana dengan cepat. Metode pelaksanaan yang dilakukan dalam kegiatan PkM ini adalah melakukan penyuluhan dalam proses penyampaian pengetahuan mengenai obyek terkait, serta membuat rancangan metode penyampaian pengetahuan dan pemahaman regulasi dan kebijakan dalam pinjaman online atau fintech. Penyuluhan ini dilengkapi juga dengan contoh pelanggaran atau kasus pelanggaran hak debitur (konsumen) oleh perusahaan fintech yang menimbulkan kerugian bagi masyarakat. Kegiatan penyuluhan ini melibatkan beberapa penyuluh, yakni Otoritas Jasa Keuangan (OJK-RI), dosen hukum Bisnis Fakultas Hukum Universitas Trisakti, dan pengacara/advokat yang merupakan perwakilan dari pihak mitra, gereja St. Matius Penginjil, Bintaro. Adapun tujuan penyuluhan disesuaikan dengan tema PkM adalah untuk meningkatkan pemahaman kepada masyarakat khususnya masyarakat di sekitar Gereja St. Matius Penginjil akan manfaat dan risiko dalam melakukan pinjaman online. Adapun permasalahan dalam penyuluhan ini adalah kurangnya pemahaman masyarakat setempat mengenai bentuk perlindungan konsumen (debitur) apabila gagal melakukan pengembalian utang, baik perlindungan atas ancaman, kekerasan, maupun terhadap data pribadi. Hal ini diungkapkan pada pengajuan surat yang disampaikan pihak mitra kepada Fakultas Hukum Universitas Trisakti. Adapun solusi dari permasalahan ini adalah memberikan pengetahuan kepada masyarakat agar memahami risiko-risiko yang mungkin terjadi apabila tidak dapat mengembalikan pinjaman sesuai waktu yang dijanjikan.

Abstract

The application of restorative justice in a criminal case must involve coordination from all levels of law enforcement agencies. Theft is an action that falls into the criminal category where the perpetrator of the theft takes property belonging to another person illegally without the owner's permission. Of course, this act of theft harms one party, namely the victim. At this time, many thefts are found to occur within the environment, not far from those close to the environment itself, it is not uncommon for theft to be carried out by those closest to us. Basically, every person who commits theft must be proven to have fulfilled all the elements of a criminal act as stated in the formulation of Article 362 of the Criminal Code, stealing here is defined as taking something that wholly or partly belongs to another person with the intention of possessing it unlawfully, punishable by a maximum sentence of five years. prison and fine... As for the Problem Formulation: 1. How are the Principles of Restorative Justice Applied to Judges' Considerations in Decisions to Release All Legal Claims (Case Study Decision Number: 28/Pid.B/2022/PN.LBB)? and 2. What are the obstacles in applying the principles of restorative justice to the judge's considerations in making a decision to release all legal claims? The conclusions of this research are: 1. The panel of judges who handled the cases in this research were not guided by the Decree of the Director General of the General Justice Agency Number: 1691/DJU/SK/PS.00/12/2020 concerning guidelines for implementing restorative justice in the General Court environment .The defendant Dedi's case does not meet the requirements for restorative justice as stipulated in National Police Regulation no. 8 of 2021 concerning Handling Criminal Acts Based on Restorative Justice and Attorney General Regulation no. 15 of 2020 concerning Termination of Prosecution based on Restorative Justice and does not fulfill legal objectives, namely the principles of legal certainty, justice and expediency and conclusion 2. The implementation of the concept of restorative justice in the integrated criminal justice system in Indonesia has not been implemented in an integrated manner with the absence of high-level regulations regarding implementation of restorative justice, including clear technical instructions with the aim of ensuring that the perpetrator truly recovers and is accepted back into society. This is why the criminal justice sub-systems (police, prosecutor's office, judiciary, correctional institutions) in Indonesia do not fully understand what is actually meant by the concept of restorative justice.

Abstract

Tulisan ini akan mendiskusikan salah satu modus penyelundupan hukum yaitu pendirian Perseroan Terbatas berdasarkan perjanjian pinjam nama dan tanggung jawab Notaris dalam pembuatan akta pendirian Perseroan Terbatas terkait. Penulisan ini menggunakan metode penelitian doktrinal dengan jenis data sekunder. Berdasarkan penelitian dipahami bahwa Notaris berperan dalam proses pendirian Perseroan Terbatas dengan membuat Akta Pendirian Perseroan Terbatas sebagaimana dalam Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas. Tindak pidana pencucian uang dan pembatasan terhadap penanaman modal asing menjadi dasar adanya modus pendirian perseroan terbatas berdasarkan perjanjian pinjam nama sebagai bentuk penyelundupan hukum. Para pendiri Perseroan Terbatas hadir dihadapan Notaris dengan menyertakan bukti identitas bahwa dirinya adalah yang berwenang dalam melakukan perbuatan hukum dalam akta. Namun ditemukan terdapat hal-hal yang tidak diterangkan para penghadap kepada Notaris seperti adanya perjanjian pinjam nama di balik pendirian suatu perseroan. Hal ini diluar dari tanggung jawab Notaris karena Akta Pendirian Perseroan merupakan akta partij yaitu keterangan dari Para Penghadap sehingga kebenaran yang tidak dinyatakan oleh Para Penghadap kepada Notaris di luar tanggung jawab Notaris karena Notaris hanya memiliki kewajiban untuk mencari kebenaran formil.
