Abstract

This research tries to find legal solutions related to criminal liability carried out by autonomous agents of artificial intelligence (AI). In this research, problems related to the development of AI-based intelligent robots are increasingly sophisticated and have capabilities similar to humans. This resemblance of AI entities to humans has consequences with actions taken, especially those that can have a negative impact or attack legal interests. Therefore, further regulation is needed related to artificial intelligence accountability as one of the legal entities in criminal law in Indonesia. Then it is also necessary to include AI as a legal subject as a consideration in the future with the hope that AI can be held criminally responsible for their actions that attack legal interests, given the massive development of technology and information that allows everything to be done through AI intermediaries.

Abstract

Tujuan dari penelitian ini adalah untuk menganalisis penyalahgunaan pembukuan perusahaan. fraud merupakan perbuatan melawan hukum yang dilakukan dengan sengaja untuk tujuan tertentu, seperti manipulasi atau memberikan laporan keliru kepada pihak lain. Aktivitas itu bisa dilakukan oleh oknum dari dalam atau luar perusahaan. Tujuannya, untuk mendapatkan keuntungan pribadi atau kelompok yang merugikan pihak lain, baik secara langsung maupun tidak langsung. Kasus fraud dalam laporan keuangan semakin banyak ditemukan di Indonesia seiring dengan semakin kompleksnya bisnis dan meningkatnya peluang investasi. Perusahaan berupaya menyajikan laporan keuangan agar dapat menarik investor untuk berinvestasi di perusahaannya. Studi pustaka dari penelitian sebelumnya dalam penelitian ini. Hasil survey dan penelitian ACFE Global menunjukan bahwa setiap tahun rerata 5 persen dari pendapatan organisasi menjadi korban fraud. Di dalam situs Badan Pengawasan Keuangan dan Pembangunan (BPKP), perusahaan swasta bahkan Badan Usaha Milik Negara (BUMN) tidak terlepas dari risiko fraud. Hal itu terlihat dari kasus tindak pidana korupsi yang melibatkan pejabat BUMN meningkat drastis dalam dua tahun terakhir. Pada akhirnya, pengendalian fraud menjadi tanggung jawab perusahaan. Guna menguatkan budaya anti-fraud di perusahaan, maka perlu beberapa program antara lain, penguatan kode etik, peningkatan kesadaran terhadap aktivitas fraud, sikap pemimpin dan sosialisasi anti fraud, baik kepada internal maupun eksternal perusahaan. Tak hanya itu, untuk menangkal tindak kecurangan laporan keuangan dan memudahkan pengungkapan aktivitas terindikasi korupsi, organisasi bisnis juga perlu merancang sistem pengendalian risiko fraud secara spesifik.

Abstract

The implementation of forced marriages as a social problem has turned into a legal problem. In its development, forced marriage has become a form of criminal sexual violence as regulated in Law Number 12 of 2022 concerning Criminal Sexual Violence. This article will analyze forced marriage as a type of criminal act of sexual violence. The focus of the study is related to the definition of the criminal act of forced marriage and the form of criminal responsibility for perpetrators of the criminal act of forced marriage. The results of this research are that the criminal act of forced marriage is a violation of human rights and is a form of criminal sexual violence.

Abstract

The purpose of writing this article is to find out how the form of legal protection and legal certainty over the determination of abandoned land as a form of controlling abandoned land areas. This article uses normative legal research, with statute approach and conceptual approach and descriptive qualitative research analysis with deductive thinking method. The form of legal protection for the community against the determination of abandoned land is through the utilisation of abandoned land by the government which is a strategic stage and the mechanism must be able to ensure that efforts to curb abandoned land must be returned to the greatest prosperity of the people through the process of determining abandoned land that applies the values of the General Principles of Good Governance and in accordance with statutory regulations, starting from the Basic Agrarian Law, Government Regulation No. 18 of 2021 concerning Management Rights, Land Rights, Flat Housing Units, and Land Registration, Regulation of the Minister of Agrarian Affairs and Spatial Planning, Head of the National Land Agency No. 20 of 2021 concerning Procedures for the Ordering and Utilisation of Abandoned Areas and Land, as a form of guarantee in providing legal certainty in the issuance of the determination of abandoned land.

Abstract

The purpose of this research is to analyse how the balance of power in Indonesia is reflected through the harmonisation of judicial institutions, namely between the Constitutional Court (MK) and the Supreme Court (MA). This research is written through a normative juridical approach by relying on existing secondary data. The result of this research is that harmonisation between the Constitutional Court (MK) and the Supreme Court (MA) plays an important role in maintaining the balance of power in Indonesia, especially in the context of constitutional law. There is disharmony between the two institutions in several decisions, such as in the case of the nomination of DPD RI candidates in the 2019 simultaneous elections, which shows the need for better coordination between the two institutions to ensure clarity and harmony in constitutional law regulations. Proper coordination between the Constitutional Court and the Supreme Court, such as in the case of interfaith marriage, can provide clarity and harmony in regulations. In addition, efforts to maintain harmonisation between the Constitutional Court and the Supreme Court also include amending the 1945 Constitution and ensuring that decisions or actions of other government institutions remain within the corridors of the law. This shows the need for the aforementioned concrete efforts to strengthen cooperation between the two institutions in order to achieve harmonisation in Indonesia's legal system.

Abstract

An important aspect that cannot be separated from the evidentiary process is related to how to obtain and present evidence to the judge before the trial. Wiretapping as electronic evidence obtained secretly often gives rise to debate from the perspective of bewijsvoering, and the evidentiary value of electronic evidence obtained through wiretapping. This article will discuss the use of wiretapping results as electronic evidence in relation to its evidentiary value in court. The results of this research show that there is a dualism in bewijsvoering the results of wiretapping as electronic evidence, some are of the opinion that bewijsvoering the results of wiretapping as electronic evidence must be obtained legally, and other opinions state that bewijsvoering is a separate matter from proof, as long as the evidence is submitted to the front. the trial is in accordance with the facts and other evidence, then the evidence is considered valid.

Abstract

The problem with law enforcement for environmental crimes is that in prosecuting perpetrators of environmental crimes, the emphasis is still on the element of error. The implication of this problem is that it is difficult to prove environmental crimes, considering that the perpetrators of environmental crimes are not only people (natuurlijk person) but also include corporations (recht person). Legislation regarding the environment, especially Law Number 32 of 2009, has determined responsibility for perpetrators of environmental crimes using the strict liability theory. This article will discuss the implementation of strict liability theory to find the ideal concept for dealing with environmental crime. The method used in writing this article is normative legal research with a statutory approach. The results of this research are the ideal concept of corporate responsibility for the occurrence of environmental crimes in the form of payment of compensation (civil) and punishment of perpetrators (criminal sanction).

Abstract

Seiring majunya waktu, muncul berbagai inovasi, termasuk Rokok Elektrik. Rokok jenis ini mengandalkan daya listrik dari baterai dan menggunakan Liquid sebagai substansi untuk menghasilkan uap. Pada dasarnya, Rokok Elektrik dirancang sebagai alternatif untuk mengurangi konsumsi Rokok konvensional yang tinggi kandungan nikotinnya. Namun, banyak Liquid Rokok Elektrik yang masuk ke Indonesia tidak mengikuti prosedur yang sesuai, dan jika dikonsumsi, dapat menjadi lebih berbahaya daripada rokok konvensional. Penelitian ini menggunakan pendekatan filosofi yuridis normatif, yang menyimpulkan bahwa perlindungan hukum bagi konsumen yang terkait dengan Rokok Elektrik dapat dievaluasi dengan merujuk pada Undang-Undang Nomor 8 Tahun 1999 tentang Proteksi Pelanggan dan Undang-Undang Nomor 36 Tahun 2009 tentang Kesehatan. Terdapat juga tanggung jawab terhadap konsumen yang mengalami kerugian akibat konsumsi Liquid Vape. Pihak distributor atau industri yang memproduksi dapat dikenakan sanksi hukum dalam bentuk ganjaran administratif. Jenis ganjaran ini mungkin melibatkan peringatan lisan, peringatan tertulis, pencabutan produk dari peredaran, saran untuk menghentikan produksi, atau pun saran untuk menaikkan standar keamanan sesuai dengan ketentuan dalam Peraturan Perundang-undangan.

Abstract

The protection of a just and civilized humanity can be planned with rational protection through non-penal policies in crime prevention efforts. Criminal policy aims to provide protection to society in order to realize people's happiness in living a healthy and refreshing cultural life. The purpose of this study is to describe and analyze efforts to overcome physical violence against women in Labuhanabatu Regency at the office of women's empowerment and child protection. The method used in this research is empirical research located in Labuhanbatu Regency, namely at the Labuhanbatu Regency (P2TP2A) unit. The results of this study are that it was found that the data on physical violence against women in Labuhanbatu Regency. Labuhanbatu is that in 2021 there were 3 cases and in 2022 it increased to 9 cases. The forms of violence that occur are in the form of beatings, slaps, kicks, jambakan, strangulation which result in bodily damage such as bruises, facial injuries. Activities to Prevent Physical Violence Against Women carried out by the P2TP2A Office of Labuhanbatu Regency are Socialization and counseling on "Protection of Women and Children" to the community, Skills training, Labor market and employment opportunities, Start-up capital assistance program, Women's cooperatives, Small micro businesses, Opening a culinary business, Tailoring services. The Recovery Activities for Victims of Violence Against Women carried out by P2TP2A Labuhanbatu Regency are: Rehabilitation, Services, Assistance, Education.

Abstract

The main focus of Pilkada's implementation in this pandemic is that the protection of basic rights in the form of the fulfillment of political rights and the right to health must be placed on an equal footing rather than contradictory to each other. That is. This study aims to identify and analyze the urgent reasons for the fulfillment of basic rights in the 2020 regional leader elections in the Covid-19 pandemic. The problem approach in this study uses normative law. This approach explores theories, concepts, legal principles, and laws related to this study, with a focus on examining the application of rules or norms in positive law. The urgency of fulfilling political and health rights may have been addressed appropriately, but violations of health protocols should be monitored during the preparation and implementation of Pilkada. From the perspective of three basic legal values, only the value of legal certainty regarding the enforcement or imposition of sanctions in the event of a breach of a health protocol is not finely and clearly regulated by PKPU.
