Abstract

Psychological recovery and disguising the government's identity as a victim of sexual violence is a concrete problem. The government needs to provide support and protection for all existing legal mechanisms for victims of such violence. Although certain victims of sexual violence and harassment receive national media coverage, we must remember that the extent of the victims remains a secret. Too many victims remain afraid to come forward or lack confidence in complaints institutions. Based on this, preventing sexual assault and harassment from occurring must be of the utmost importance and for victims of previous incidents. This is to reduce the risk of the victim returning. recovery center, healing, their ability to rebuild their life and ongoing safety. Prevention is becoming more and more challenging. Many parents may find it difficult to talk to their children about the risks of sexual violence and abuse.

Abstract

The formulation in the context of overcoming cyber crimes in the banking sector, where the existence of the establishment of cyber institutions within the Indonesian Police is inseparable from the cases that have hit the banking world. Online-based loans do not only have a good impact on society, but also have negative effects, such as fraudulent persons. The mode of online loan-based fraud occurs in people who are in a state of economic problems or it could also be due to negligence because the lure of easy loans and very low interest. This problem can actually be overcome by triggering factors from the community to learn and participate in pursuing the development of existing technology.

Abstract

Crime as an act that has been determined by the State as a crime in its criminal law and is threatened with a sanction. By studying and researching acts that are declared by law as criminal acts. Crime as a legal delict is in the form of actions which, although not specified in law as a criminal event, are perceived as acts that are contrary to the legal system. It is very possible for a crime against life to occur for anyone who becomes a victim of a crime committed by the perpetrator. Crimes that kill a person can be intentional or negligent on the part of the perpetrator against the victim. The intention to kill almost all of a person's life because of an intention or plan to kill the victim by the perpetrator because there is a clear intention and the goal is that even life is negligent, for example, it is not an intention to kill so that as a result of the perpetrator's actions a person may lose his life. Surgical obligations in resolving crimes against lives has an important role because it is very possible for everyone to become a victim of a crime by the perpetrator. Crimes that kill a person can be intentional or negligent on the part of the perpetrator against the victim. So that there are cases of murder that require evidence of post-mortem examination. It is very interesting indeed when a case where the murder victim is not known with certainty the cause of someone's death requires the discipline of forensic medicine.

Abstract

Current land crime practices that need to be understood and straightened out are related to the problem of multiple certificates that occur and are often experienced by people who have multiple certificates, so far the problem of overlapping certificates of ownership of land is being questioned as a civil matter even though every action and individual official The National Land Agency, in carrying out its duties, must reasonably be suspected of an unscrupulous National Land Agency official who deliberately issued a certificate even though the certificate had previously been issued. Even though in the case of the issuance of overlapping certificates, why is it still happening so often, this is because the practice of land crimes is high which has led to the practice of bribery against officials of the National Land Agency who often do not want their positions and positions to be criminally investigated so they use the pretext of overlapping certificates. This was a technical error made by surveyors and officials in collecting physical and juridical data related to the land so that in the future problems arose between the party that previously had a certificate of ownership rights and the party that had just been issued by the National Land Agency.

Abstract

Government affairs in resolving issues of legal needs in the regions must be initiated and started from fundamental changes, especially by gathering and mobilizing citizens so that they can become small organs. This organ has a vital role in providing smoothness in building progress in the villages in administering governance in the villages. The urgency needed to have a rukun desa coordinating body is to provide strengthening of institutional aspects in the Rukun Desa Coordinating Board in the spirit of building self-reliance, mutual cooperation and the welfare of its citizens by providing institutional improvements within the scope of government in the villages. So that harmonization will be formed in villages administration through the Institutions that will be built later with the aim of providing direction for self-management in each Rukun Desa Coordinating Board.

Abstract

Perbuatan melawan hukum dalam hukum perdata bisa terjadi dalam hal peralihan hak tanah, oleh karena itu manuscript ini bertujuan mendeskripsikan bentuk – bentuk perbuatan melawan hukum dalam hal peralihan hak atas tanah. Penelitian yang digunakan adalah penelitian normative/doctrinal, sumber data utama adalah data sekunder berupa dokumen hukum, jurnal dan literatur yang relecan dengan masalah yang diteliti. Hasil penelitian menunjukkan bahwa bentuk perbuatan melawan hukum dalam hal peralihan tanah itu adalah Tergugat tidak bersedia melakukan pemecahan hak atas tanah yang telah dibeli oleh Penggugat secara terang dan tunai, akibatnya Penggungat mengalami kerugian materiil disamping juga kerugian immaterril (depresi) yang tidak bisa dihitung secara materiil. Aplikasi dari penelitian memberikan informasi kepada masyarakat bahwa peralihan hak atas tanah dilakukan dengan jual beli secara terang dan tunai adalah sah dan memiliki akibat hukum jika penjual tidak segera melaksanakan kewajiban nya terhadap pembeli, tanpa alasan yang sah. Adapun akibat hukum pembayaran uang ganti rugi sebagai pengganti kerugian yang dialami oleh Penggungat (pembeli).

Abstract

Penelitian ini bertujuan untuk Untuk mempelajari dan menganalisis mengenai pertanggung jawaban pidana terhadap kejahatan yang dilakukan oleh anak, dan untuk mengetahui dan menganalisis faktor-faktor yang mempengaruhi pertanggung jawaban pidana terhadap kejahatan yang dilakukan oleh anak. Metode penelitian yang digunakan dalam penulisan ini adalah metode empiris, dengan cakupan data premier dan data sekunder, penelitian dilakukan di lapangan yakni di Kota Makassar. Hasil penelitian ini menunjukkan bahwa Pertanggungjawaban pidana terhadap kejahatan yang dilakukan oleh anak adalah apabila anak telah berumur 14 (empat belas tahun) maka dapat dijatuhi pidana dan anak dibawah umur 14 (empat belas tahun) dapat dikenakan sanksi tindakan. Hasil penelitian ditemukan fakta dari 152 (seratus lima puluh dua) kasus anak yang diperiksa dan diadili di Pengadilan Negeri Makassar terdapat tiga orang anak yang berusia 11 (sebelas tahun), salah satu diantaranya berusia 12 (dua belas tahun) yang melakukan pelanggaran perjudian (pasal 30 KUHP) yang dijatuhkan hukuman 5 (lima bulan) kurungan. Dan faktor-faktor yang mempengaruhi Pertanggungjawaban Pidana Terhadap Kejahatan Yang Dilakukan Oleh Anak yakni pertama Faktor penegak hukum, faktor fasilitas/sarana, dan yang ketiga faktor yang mempunyai pengaruh kuat terhadap pelaksanaan penegakan hukum terutama mengenai pertanggungjawaban pidana terhadap kejahatan yang dilakukan oleh anak. Rekomendasi penelitian Pertanggungjawaban Pidana Terhadap Kejahatan yang dilakukan oleh anak, penulis memberikan saran yaitu Diharapkan kepada pemerintah bahwa perlu dilengkapi rumah penahanan anak karena sampai sekarang belum ada rumah tahanan anak yang khusus. Kemudian usia anak perlu ditinjau kembali karena menurut undang-undang system peradilan pidana anak bahwa anak yang dapat dihukum adalah yang berumur 12 (dua belas tahun) ke atas, tetapi jika masih berstatus anak tidak boleh dihukum tetapi diberikan pembinaan. Seharusnya yang dapat dihukum adalah yang sudah dewasa tetapi dalam Undang-Undang Hukum Pidana (KUHP) batas dewasa adalah 16 (enam belas tahun).

Abstract

The government, in carrying out its duties as a public servant for the welfare of society, sometimes encounters various problems that must be resolved as soon as possible, but there is no legal regulation governing this matter. As a solution to this condition, government officials are given the authority to use discretion in the Government Administration Law. With the passing of the Job Creation Law, the concept of discretion changed which is regulated in the Government Administration Law. The problem is regarding how discretion is regulated after the Job Creation Law and whether this discretion can be used as an object of the lawsuit in the state administrative court. This research is a normative juridical research with a conceptual and statutory approach. The conclusion is that the concept of discretion in the Government Administration Law adheres to the concept of limited discretion, this has been changed by the Job Creation Law which adheres to the concept of discretion broadly by eliminating the requirement that discretion must comply with applicable laws and regulations. Even so, discretion as the object of a lawsuit in the state administrative court can still base a lawsuit that the discretion is contrary to statutory regulations. Suggestions for government officials using discretion must be careful and pay attention to the applicable laws and regulations.

Abstract

In the history of the formation of laws and regulations in Indonesia, the Law of the Republic of Indonesia Number 11 of 2020 Concerning Job Creation, is a product of laws and regulations that used the Omnibus Method for the first time in drafting its laws. The Mechanism for Forming Law Number 11 of 2020 refers to Law of the Republic of Indonesia Number 12 of 2011 concerning Formation of Legislation and as amended by Law of the Republic of Indonesia Number 15 of 2019 concerning Amendments to Law Number 12 of 2011 concerning Formation of Legislation, these two laws do not regulate the Omnibus Method. Arrangements related to the new Omnibus Method are included in the Law of the Republic of Indonesia Number 13 of 2022 concerning the Second Amendment to Law Number 12 of 2011 concerning the Formation of Legislation.

Abstract

Tanggung gugat merupakan tanggung jawab hukum (liability) yang diperoleh oleh subjek hukum berdasarkan timbulnya hubungan hukum. Masyarakat melakukan hubungan hukum dengan perusahaan transaksi sebagaimana untuk melindungi kepemilikannya, jiwa serta Kesehatan secara ekonomis bila terjadinya masalah atau resiko bersifat evenement. Namun, terdapat beberapa kasus perusahaan asuransi tidak dapat melaksanakan kewajibannya atas klaim atau resiko yang dialami oleh tertanggung. Bentuk pengalihan resiko terhadap perusahaan asuransi yang tidak mampu melaksanakan kewajibannya maka dapat dilakukan oleh perusahaan reasuransi berdasarkan Undang-Undang Nomor 40 Tahun 2014 tentang asuransi. Hasil penelitian menerangkan bahwa tanggung gugat reasuransi terhadap perusahaan asuransi adalah prinsip kontribusi atau saling menanggung demi kepentingan pihak tertanggung. Penyelesaian hukum apabila perusahaan reasuransi tidak dapat membayar resiko perusahaan asuransi adalah melakukan pengalihan dengan perusahaan asuransi, perusahaan reasuransi lainnya baik konvensional maupun syariah sehingga dapat mem-cover resiko yang tidak terbayarkan kepada tertanggung berdasarkan Pasal 1317 KUHPerdata atau memberikan peringatan dini bila terindikasinya bahwa perusahaan asuransi berpotensi tidak dapat membayarkan klaim tertanggung
