Abstract

The purpose of this study is to find out the efforts made by the Government towards the quality of public services, namely the provision of services for the community by the government to fulfill the initial needs of the community by creating community welfare, public services must guarantee the welfare of people's lives evenly. The community considers that public service is a human right because it has human rights that have been inherent in human beings since birth. Public service regulations in Indonesia have been regulated in Law Number 25 of 2009 which regulates public services. In Law Number 25 of 2009 Article 1 explains that service standards Public service at the Attorney General's Office of the Republic of Indonesia includes the scope of services and administration. Public services must be integrated with public information services aimed at providing transparent information to the public. Regulations for the quality of public services have been regulated in the attorney general's office itself, namely in the Regulation of the Attorney General of the Republic of Indonesia Number: PER-011/A/JA/06/2013 concerning Public Service Standards for the Attorney General's Office of the Republic of Indonesia, Article 1 explains that Public Service Standards at the Attorney General's Office of the Republic of Indonesia include scope of services and administrative services. Service and administrative services must be integrated with public information services which aim to provide information in a flexible and transparent manner to the public.

Abstract

Kekerasan merupakan perilaku seseorang kepada orang lain yang dapat menyakiti fisik, psikologis, mental yang dapat mengakibatkan kematian. Kekerasan terhadap perempuan terjadi karena perbedaan jenis kelamin, sehingga perempuan berpotensi mengalami penderitaan baik secara fisik, seksual bahkan mental. Metode penelitian yuridis normatif digunakan dalam analisis jurnal melalui bahan-bahan hukum. Pembunuhan dan kekerasan fisik dalam rumah tangga dipandang sebagai 2 (dua) hal yang berbeda dikarenakan KDRT rentan dilakukan terhadap keluarga. UU P-KDRT memperluas cakupan rumah tangga yang terdiri atas keluarga (suami, istri, anak-anak, orang tua, saudara sedarah, hongga asisten rumah tangga) selama tinggal dalam satu atap dan hidup bersama dalam sebuah rumah tangga. Dalam UU P-KDRT terdapat pidana tambahan berupa pembatasan kehidupan dan gerak pelaku KDRT dan kewajiban pelaku untuk ikut serta pada program konseling.

Abstract

Proses peradilan tindak pidana korupsi yang berlangsung di beberapa pengadilan tipikor, memperlihatkan bahwa korupsi tidak hanya dilakukan oleh individu (perseorangan) melainkan juga oleh korporasi. Dalam beberapa putusan perkara korupsi, indikasi tersebut bahkan tersurat pada pernyataan bahwa kerugian negara dalam kasus tersebut dinikmati oleh korporasi, sehingga korporasilah yang seharusnya dihukum untuk mengganti kerugian negara tersebut (putusan perkara IM2 dan Asian Agri). Namun praktik penegakan hukum terhadap pelaku tindak pidana korupsi hingga saat ini, mencatat hanya sedikit kasus dimana korporasi diadili dan kemudian dihukum sebagai pelaku tindak pidana korupsi, yaitu perkara PT. Giri Jaladhi Wana di PN Banjarmasin dan perkara PT NKE di Pengadilan Tipikor Jakarta. Padahal UU Pemberantasan Tindak Pidana Korupsi telah mengatur pertanggungjawaban pidana korporasi sebagai salah satu upaya luar biasa. Hasil penelitian memperlihatkan adanya kelemahan pada subtansi hukum, yaitu tidak jelasnya indikator menentukan tindak pidana korupsi yang dilakukan oleh korporasi, serta menentukan pihak yang dipertanggungjawabkan. Kelemahan pada subtansi hukum, menjadi salah satu faktor penyebab jarangnya diterapkan pertanggungjawaban pidana korupsi pada korporasi, disamping faktor pada struktur hukum dan budaya hukum internal. Penegak hukum belum memiliki persepsi yang sama tentang pentingnya menerapkan pertanggungjawaban pidana korporasi dalam tindak pidana korupsi dan batasan-batasan dalam menerapkan pertanggungjawaban pidana korporasi dalam perkara korupsi, sebagai bagian dari upaya percepatan pemberantasan korupsi. Pengaturan pertanggungjawaban pidana korporasi dalam UU Pemberantasan Pencucian Uang dapat dijadikan model dalam menentukan pertanggungjawaban korporasi. Proses peradilan terhadap individu dan korporasi dilakukan sekaligus dalam satu berkas. Ini disebabkan terbuktinya perbuatan pelaku sekaligus juga membuktikan perbuatan korporasi, karena korporasi bertindak melalui pengurusnya. Model ini tidak hanya akan mewujudkan asas peradilan cepat, sederhana dan biaya murah, tapi juga menghindari humiliation ganda pada pelaku individu, karena harus mewakili korporasi dalam proses tersebut. Guna meningkatkan penegakan hukum terhadap korporasi korup, perlu dilakukan revisi terhadap UU P-TPK yang dilakukan secara sinergis dengan aturan-aturan dalam UU Nomor 1 Tahun 2023 Tentang KUHP, khususnya pengaturan tentang kriteria penentuan tindak pidana dilakukan oleh korporasi, kriteria pertanggungjawaban korporasi, serta alternatif sanksi pidana yang lebih memenuhi rasa keadilan.

Abstract

Nagari is a potential place for a country's economy. The amount of potential that the Nagari has can increase the income of the Nagari community, but there are still many people who are not aware of the potential they have. One of the government's efforts to overcome this problem is by empowering the community by improving the management of Nagari-Owned Enterprises (BUMNag). This study uses a qualitative approach. Data obtained while in the field were recorded in field notes. After all the data has been collected, the next step is to analyze all the data, both primary and secondary data obtained by the researcher from the beginning to the end of the study. The results of this study indicate that community empowerment through improving the management of Nagari-Owned Enterprises is going well through the stages of increasing knowledge and skills, training, mentoring, and evaluation, and having several business units within it such as sharia savings and loans, waste banks, and agriculture. In this study, BUMNag management and the community were actively involved in every business program and with this community involvement community empowerment through BUMNag could utilize the natural potential and the potential of the community in the area.

Abstract

The study aimed to determine motivation, employee performance, and work environment that have a significant effect on the Personnel and Human Resources Development Agency (BKPSDM) Kota Pariaman. The method used in this research is descriptive with quantitative techniques. Data analysis used descriptive analysis, classical assumption test, and hypothesis test. The results of this study are Motivation and Work Environment affect the Performance of BKPSDM Employees in Pariaman City, West Sumatra Province. From this test, the R Square value is 95.8% where this figure indicates that Motivation and Work Environment affect the Performance of BKPSDM Employees in Pariaman City.

Abstract

Penolakan karantina di zaman pandemi adalah hal yang sangat berbahaya pada saat itu. Untuk hukum di negara Indonesia sendiri, masih kurang tegas dalam menegakkan keadilannya bahkan yang sudah tertulis sekalipun tidak cukup kuat untuk menegaskan keadilan yang ada. Penolakan karantina ini juga kerap kali dilakukan oleh oknum-oknum yang tidak bertanggung jawab karena merasa memiliki jabatan yang cukup besar untuk tidak menaati peraturan yang ada. Seperti pada contoh kasus yang kami berikan, penolakan karantina yang dilakukan oleh salah satu public figure yang ada justru merugikan banyak pihak, tidak hanya merugikan dirinya sendiri tetapi juga merugikan orang-orang yang membantunya serta masyarakat sekitar. Namun, dia dan rekan-rekannya yang melanggar kekarantinaan ini justru tidak mendapat hukuman yang sepantasnya sedangkan orang-orang yang membantunya untuk melanggar kekarantinaan ini mendapat sanksi yang lebih berat. Tujuan dari penelitian ini, adalah untuk mengetahui penegakan sanksi hukum serta mengetahui etika, hukum dan keadilan terhadap pelaku penolakan karantina. Dan juga sama seperti yang sudah-sudah, hukum yang berlaku bergerak tumpul ke atas dan runcing kebawah. Etika, hukum dan keadilan adalah hal yang berkesinambungan dan memiliki satu kesatuan yang padu termasuk pada hal penolakan karantina itu sendiri, dimana hak masyarakat, ketentuan hukum dan sifat dasar menolak dan menerima menentukan segala aspek. Menurut temuan penelitian ini, seharusnya untuk pelaku penolakan karantina, dikenakan sanksi yang lebih tegas dan sama rata, tanpa terkecuali agar tidak terjadinya kecemburuan sosial. Kecemburuan sosial itu sendiri, sangat merugikan seperti orang-orang yang tidak memiliki kekuasaan atau jabatan yang penting untuk bisa membantunya lari dari tanggungjawab, sedangkan orang-orang yang memiliki kekuasaan dengan tenang kabur begitu saja.

Abstract

Foreign capital has become a popular topic in the world of international business. Its presence in the recipient country is considered to bring many benefits to the country. Foreign capital can create new jobs, which can help solve the unemployment problem in the recipient country. The influx of foreign capital also brings new technologies that are not mastered by developing countries. With the influx of foreign investment, it is expected that technology that is generally controlled by developed countries can also be controlled by developing countries through the transfer of knowledge. However, the positive impacts brought by foreign capital do not always benefit the recipient country. Sometimes, foreign investment also has a negative impact on the recipient country. In the viewpoint of International Law, foreign capital needs to be protected. This aims to ensure that foreign capital can operate safely and is protected from various regulations or laws that can harm them. However, this protection should not be done without regard to human rights and the welfare of local communities. In this case, the recipient country must take appropriate measures to ensure that foreign capital companies do not violate human rights and have a positive impact on local communities. In addition, recipient countries must also ensure that they have clear and enforceable laws to protect the rights of local communities.

Abstract

Drug abusers should get rehabilitation punishment because rehabilitation is an alternative form therefore abusers are guaranteed by the narcotics law to get rehabilitation sentences instead of imprisonment, Such as the case of Buchari Hy Bin Hamdan Yahya, legally proven and convinced guilty of committing the crime of "Class I Non-Plant Narcotics Abusers" which ended in a prison sentence. The subject matter raised is Analysis Does the Defendant Fulfill the Elements of Article 112 Paragraph (1) and/or 127 Paragraph (1)?, (Study of Decision Number 621/Pid.Sus/2020/PN.Jkt.Brt) and Analysis What Are the Types of Punishment for Drug Abusers? (Study of Decision Number 621/Pid.sus/2020/PN.Jkt.Brt). This research uses a type of normative legal research that is descriptive analytical, using secondary data obtained from literature studies and also primary data obtained by interviews, and data processed qualitatively by drawing deductive logic conclusions. The conclusion of the study is (1) The defendant with Article 112 paragraph (1) seems similar to the article of abuser, but this article is contrary to the purpose of Law Number 35 of 2009 concerning Narcotics article 4d where the abuser is guaranteed to get rehabilitation efforts but with article 112 paragraph (1) this abuser is justri imprisoned, if viewed from article 127 paragraph (1) point a the defendant who is sentenced to 2 years 6 months in prison should be a judge can decide to pay attention to article 127 paragraph (2) of Law Number 35 of 2009 concerning Narcotics, "In deciding the case of the judge as referred to in paragraph (1) of Law Number 35 of 2009 concerning Narcotics, the judge is given the authority to decide the defendant to undergo treatment through medical rehabilitation and social rehabilitation, both guilty and innocent. (2) Abusers shall be punished in the form of rehabilitation instead of imprisonment, because rehabilitation is an alternative form of punishment Abusers are guaranteed by the Narcotics Law to be rehabilitated and judges must consider the condition of the level of drug dependence (Article 55 of Law Number 35 of 2009 concerning narcotics), and pay attention to the authority of Article 103 regulated in the Narcotics Law.

Abstract

Attorney is Indonesia government institution who has a duty which regulated in Indonesia Constitution. In this case the attorney authorized to monitoring the activity in capital or stocks markets. Capital markets is one of the key instrument for Indonesia economical growth which is important, but in the Capital markets activity sometimes there’s a things that can make a negative impact and cause a violation of law like fraudulency, embezzlement, forgery, information disclosure and even corruption and the example in Indonesia is PT. Jiwa Sraya Insurance case. Then Indonesia government formed the institution who has a authority to monitoring and organizing capital markets activity including attorney in that. This things is the reason for a writer to make a research about attorney position in law enforcement on a capital markets activity. About how the problems arise in capital markets case with PT. Jiwa Sraya insurance as an example. This research have a purpose to understanding and analyzing the attorney authority and the regulation for capital markets in Indonesia based on Indonesia Constitution 8 of 1995 about capital markets, Indonesia constitution No 20 of 2001 and No. 19 of 2019 about corruption crime.

Abstract

Indonesia views SOEs and their subsidiaries as companies operating in the public sector, even though on the other hand, SOEs and their subsidiaries are companies formed as limited liability corporations. As a legal entity, there are legal consequences that give the corporation the ability to have its own assets and wealth, which should rightfully belong to humans. Although a legal entity cannot act on its own, it can establish its governing body, in this case, the Board of Directors. However, the government's view of SOEs and their subsidiaries as a public legal entity has caused conflicts, namely, how the legal accountability of the Directors of SOEs and their subsidiaries is determined in making business decisions and what standards of Business Judgment Rule violations lead to losses to be borne by the Directors.
