Abstract

The study aimed to discover an understanding of the handling of government officials who do not carry out the decisions of the State Administrative Court. In the mechanism for implementing decisions, the State Administrative Court has no implementing agency, and hence, the State Administrative Officers often disobey and do not implement the decisions of the State Administrative Court. Therefore, citizens' constitutional rights to justice decided by the State Administrative Court can be threatened. This study aimed to compare the state administrative justice systems in Indonesia and Thailand. This research uses doctrinal research with a statutory approach. The results of this study are that there is no institution for implementing the decisions of the State Administrative Court in Indonesia. Meanwhile, in Thailand, there is already an implementing agency, and functionally the executive body executes litigants. Therefore, regulation and implementation of State Administrative Officers who do not implement State Administrative Court Decisions is an urgency to increase the effectiveness of implementing State Administrative Court decisions in Indonesia.

Abstract

This research discusses the relationship between green open space (RTH) and good environmental governance (good environmental governance). Good environmental governance is an extension of good government, which refers to the principles of good governance in the context of the environment. The government's role in providing green open space that can be enjoyed by the wider community is closely related to public policy making. This public policy involves a policy-making process that leads to certain goals and involves steps taken by the government. Green open space has various benefits, both ecologically, socio-culturally, and aesthetically. Green open space provides comfort, improves the microclimate, increases oxygen reserves, and serves as a means of recreation, social interaction and regional identity. The existence of green open space is also important in maintaining a balance between the natural environment and the built environment in urban areas. In managing green open space, it is important to apply the concept of good environmental governance by taking into account the sustainability of natural resources. Environmental governance understands environmental management through interactions between the state and its people. Green open space management also involves the process of planning, utilization and control which plays an important role in forming a planned urban spatial layout. This study focuses on Karawang Regency, where there is an imbalance between the amount of green open space with public facilities and private buildings. Even though there is still empty land that can be used as green open space, its utilization has not been optimal. In the Karawang Regency strategic plan, an analysis of land use and green open space needs is carried out based on the area and population. Good green open space management efforts in Karawang Regency can help achieve good environmental governance and improve the quality of the environment and the quality of life of its people.

Abstract

Along with the national development program carried out by the government, a work copyright law was enacted which is expected to provide ease of doing business, inflow of investment, so as to create jobs and improve people's welfare. This study aims to examine the impact of Article 88C paragraphs 1 and 2 of the work copyright law number 11 of 2020 on district minimum wages in Indonesia. Because there were many controversies, demonstrations by workers and students emerged who understood that this article is more detrimental to workers because it lowers the district or city minimum wage. The research method used is descriptive and normative methods in the form of literature studies. In the perspective of Indonesian law, this article provides protection for workers and companies in order to create economic stability. However, there are still challenges and problems in determining efforts to determine the District/City Minimum Wage, such as if it only follows the Provincial Minimum Wage then the District/City Minimum Wage may be lower and vice versa. Therefore, discussions and in-depth studies are needed to consider the interests of all parties, including workers, employers, and the general public.

Criminal Sexual Violences or Sexual Violences, in fact, do not only occur in the midst of ordinary society, but also within active institutions of the Indonesian National Armed Forces (TNI). Abstract

In essence, Indonesia is a state based on law as stated in the Constitution of the Republic of Indonesia Article 1 paragraph 3, so that every community activity is regulated by using law as a tool to carry out order, justice, security and development. One form of guarantee provided by law in its products is the legal relationship between legal subjects and other legal subjects in the economic field which cannot be separated from everyday human activities with the existence of arrangements regarding agreements. One that relates to agreements is online-based arisan which is based on written or oral agreements, thus providing protection to legal subjects to avoid unwanted things such as not having good faith in carrying out online arisan activities, especially those that can be a default form. Therefore the researcher uses a type of normative research method with a statutory approach. The results of this study are that the legal consequences arising from non-payment of online arisan funds can cause losses and are included in the category of default in the agreement so that they are required to compensate for losses and the conclusion in this study is that repayment can be carried out by means of litigation and non-litigation.

This study aims to analyze the actualization of legal philosophy in the criminal justice system and review critical theory in efforts to deal with crime in society. Legal philosophy has an important role in shaping the basics of legal thinking and directing the development of an effective criminal justice system. This research uses a descriptive-analytical research method by reviewing the relevant literature and literature. The analysis is carried out by studying the concepts of legal philosophy in the context of criminal justice, as well as analyzing critical theoretical reviews of the legal system and efforts to deal with crime in society. The results of the research show that the actualization of legal philosophy in the criminal justice system is important for ensuring justice and protecting individual rights. Principles such as the presumption of innocence, legal certainty and proportionality of punishment form the basis for carrying out the functions of criminal justice. In addition, a critical theory review highlights the importance of understanding the social, economic, and political factors that are at the root of crime problems. Abstract

This study aims to analyze the legal efforts undertaken in the context of protecting witness-victims in corruption cases, particularly related to the return of assets of corruption, based on the judge's decision Number 34/Pid.Sus-TPK/2020/PN.Jkt.Pst concerning the Jiwasraya Case. The focus of this research is to identify and analyze the protective measures provided to witness-victims in order to be able to provide information that supports the asset recovery process. The research method used is a normative approach using laws, regulations, and court decisions as a reference. Data was collected through a literature study and analysis of documents related to the Jiwasraya case and the legal framework related to the protection of victim witnesses. The results of the study show that in the judge's decision, there are legal efforts made to protect witness victims in order to return the assets of corruption. These protection efforts include safeguarding the identity of witnesses, providing physical and psychological protection, as well as granting privileges to witness-victims in giving testimony in court. However, several obstacles were found in efforts to protect victim witnesses. Some of them are intimidation or threats against witness-victims, lack of understanding and awareness about witness protection, and difficulties in providing long-term security guarantees for witness-victims. The conclusion of this study is that legal efforts to protect victims-witnesses in corruption cases are very important in returning the assets of corruption. Effective protective measures can increase the confidence of witness-victims to provide accurate testimony and support a fair and transparent asset recovery process.
