Abstract

In the industrial and trade sectors where brands are a part of intellectual property rights, they have a position as a differentiator and identity for a business, one of which is micro, small and medium enterprises (MSMEs). In order to obtain the trademark rights, every micro, small and medium enterprise actor must submit an application for trademark registration in order to obtain the trademark rights when it is used. Even though regulations regarding marks have been expressly regulated by the state in a statutory regulation, namely Law Number 20 of 2016 concerning Marks and Geographical Indications, in practice there are still many MSME actors who have not registered their trademarks. This study aims to determine the implementation and inhibition of MSME actors in Bukittinggi in registering their trademarks. The method used in this study is a qualitative method with an empirical juridical approach. The registration of MSME trademarks is fundamental to obtaining exclusive rights to brands. In addition, to register a business actor must fulfill administrative requirements for his trademark. The obstacles in registering a trademark for MSME actors in Bukittinggi are the lack of information and knowledge obtained and concerns about financing when registering their trademarks.

Abstract

One form of marriage in the Lampung Pesisir custom is called "perkawinan jujur" or "honest marriage." This type of marriage is conducted by involving "jujur" money (jojokh), which is given by the prospective groom to the family of the prospective bride before the marriage contract (akad nikah). However, during the actual akad nikah ceremony, the jojokh money is not mentioned. In practice, the amount of jojokh money requested by the woman can sometimes be quite high. This paper examines how Islamic law views such a practice by referring to legal reading methods in ushul fiqh and fiqh. The analysis shows that jojokh can be likened to a dowry (mahar) in many aspects. Jojokh also fulfills the conditions of being a valid 'urf (acceptable custom). Regarding the specific amount of jojokh money, Islamic law only sets the minimum limit for the dowry (mahar) that must be given. However, there is no set maximum limit. As long as the amount of jojokh does not burden the prospective groom, any nominal amount of jojokh remains acknowledged and valid in Islamic law. Abstract

Tourism is the activity of temporary travel of one or more people to a location other than their place of residence. In Batu Bengkung, residents depend on tourism for their livelihood. This study discusses legal protection for tourists by focusing on two aspects. First, Law no. 10 of 2009 concerning Tourism regulates legal protection for tourists and tourism industry players in the event of loss from both parties. Second, the manager's obligation to guarantee the security and safety of Batu Bengkung beach visitors if an incident occurs. The research method used is an empirical research technique with a sociological legal perspective. The results of the study show that Law Number 10 of 2009 concerning Tourism provides fair protection for travelers and tourism industry players. This protection covers the full rights and obligations of both parties. The responsibility of the manager for the safety and security of Batu Bengkung Beach tourists is to provide insurance claims and hospital medical expenses for victims.

Abstract

Marital Rape is something that makes a household unhappy, in fact it is a criminal act. Against this background, this research was conducted. This research is intended to reveal what causes the occurrence of Marital Rape, what is the modus operandi, how does the law protect victims and efforts to overcome them. This research is a normative juridical research in which data related to the Marital Rape problem are collected from library materials, both from journals, books and other library materials, the data obtained is then analyzed, identified, analyzed and concluded with inductive logic. The results of this study state that there are several reasons for Marital Rape, both direct causes, namely rejection by the wife; unbalanced libido and drunken husband. While the indirect causes are forced marriages; lack of communication and dependence of the wife because of economic difficulties. Furthermore, based on the analysis of several cases, the perpetrators tended to use violence and threats against the victim as well as threats of divorce so that the victim felt threatened and inevitably had to comply with the perpetrator's sexual desires regardless of the victim's condition. Legal protection for victims of Marital Rape has been regulated in a law, namely UU-TPKS. This law threatens to punish the perpetrators of Marital Rape. In addition, this law also regulates recovery efforts for victims of Marital Rape. Efforts that can be made to overcome cases of marital rape are as follows: Awareness and Education Raising; Effective Law Enforcement; Victim Support; Women empowerment; Collaboration between agencies.

Abstract

In this type of online gambling, players must first choose a betting table before entering and choosing one of the many options available. Therefore, the loser will pay the bet according to the agreed amount. The formulation of the research problems are as follows: 1) How is electronic slot gambling regulated in criminal law? 2) Is it possible to bring charges against online gambling actors under the Information and Electronic Transactions (ITE) Act?. This research uses normative research methodology and data collection strategies for literature studies. According to the findings of his study, the Criminal Code does not clearly regulate the rules for electronic-based slot gambling, but the regulatory changes have provided a legal framework for the ITE Law. As a result, it is certain that online gambling players will face sanctions based on Law Number 19 of 2016 concerning Electronic Information and Transactions, namely Law Number 19 of 2016 concerning Electronic Information and Transactions.

Abstract

This study aims to analyze the settlement of defaults in steel construction services projects between PT Indotrans Construction, PT Bima Agung, and PT Duta Mas, which are discussed in Decision Number 394/Pdt.G/2021 PN Smg. The research method used is a normative legal research method with statutory, case conceptual, and qualitative analysis approaches. The results of the study show that Decision Number 394/Pdt.G/2021 PN Smg is in accordance with the principles of contract law. The legal consequences experienced by PT Bima Agung and PT Duta Mas Indah as the defendants who were declared in default by the panel of judges were required to pay for the losses suffered by the plaintiffs.

Abstract

Based on data from Indonesia Corruption Watch (ICW), the village budget is the most vulnerable to corruption. In the last seven years, there have been 592 cases of corruption, and ICW noted that the village government was the institution that carried out the biggest corruption cases. This research uses a type of normative juridical research that refers to statutory law, namely PP No. 43 of 2014 concerning implementing regulations for the Village Law and other literature as a support for literacy with the aim of knowing the effectiveness of these regulations for the high number of village fund corruption cases in Indonesia and their studies according to fiqh siyasah. The results of this study indicate that PP No. 43 of 2014 when analyzed based on a juridical approach, namely Law no. 12 of 2011 concerning the procedure for forming laws and regulations, there are elements that do not work effectively in society, namely elements of usability and efficiency, PP No. 43 of 2014 does not clearly provide oversight over the use of Village Funds by the village government, it should be as implementing regulations of the Village Law PP No. 43 of 2014 provides effective efficiency, especially in limiting cases of village fund corruption in Indonesia.

Abstract

In essence, social media gave birth to new concerns, including the emergence of the development of the spread of pornography with pornographic sites in sharing various types of site views which are very tempting and have a major influence on the nation's morals and personality which will have a negative impact on Indonesia so that it threatens life and social order. Indonesian society. The development of pornography in society has also resulted in an increase in immoral acts. Related to the Internet and communication tools, of course very closely related to Cybercrime (Crime in cyberspace). According to the Organization of European Community Development (OECD) Cybercrime is all forms of illegal access to a data transmission. That is, all types of illegal activity in a computer system is a crime. In this thesis entitled "Criminological Analysis of the Spread of LGBT Pornographic Content in Cyberspace (Study of Court Decisions Number: 343/Pid.Sus/2020/PN.Pbr)".)" discusses the problem, namely: What are the factors that cause the spread of LGBT pornographic content in cyberspace and what is the modus operandi of perpetrators in spreading LGBT pornographic content in cyberspace. The method used to answer the problems mentioned above. In terms of the type of data studied, this study uses two types of research, namely normative juridical research that is analytically descriptive by reviewing court decisions and analyzing them. The results of the research namely; the factors that led to the spread of LGBT pornographic content in cyberspace were technological sophistication, sexual needs, lack of attention in the field of religion, and weak attention from the government. The perpetrator's modus operandi in spreading LGBT pornographic content is none other than because the perpetrator wants to vent his sexual desires and inform social media that he is gay.

Abstract

Money politics is a serious problem in the implementation of elections in Indonesia. Currently money politics has become a culture and commonplace in the eyes of the Indonesian people, so that people have no fear of practicing money politics, either by giving rewards or receiving certain rewards by the candidates. The practice of money politics must be prevented in order to create a good, transparent and accountable democratic system. This research is a normative juridical research. The approaches used in this study include a conceptual approach, a statutory approach, and a case approach. Sources of data obtained from primary and secondary data sources. From the results of the study it was found that the factors for the occurrence of money politics include: first, People's views that are used to money politics in elections, second, money politics become a bad culture every Indonesian election, third, weak law enforcement in Indonesia, fourth, weak faith factor, fifth, poverty factor. Sixth, the lack of public understanding of politics and the impact of money politics. The prevention efforts include: the establishment of an electoral justice system (EJS), providing understanding to the public about politics and the impact of money politics, and eradicating poverty in various sectors. Strengthen law enforcement and regulations as well as sanctions both criminal and administrative to deter perpetrators of money politics. lack of public understanding of politics and the impact of money politics.
