Abstract

Pekerja rumah tangga selama ini tidak memiliki payung hukum yang cukup kuat untuk memperjuangkan hak-haknya secara layak. Hal tersebut terjadi karena banyak yang menganggap bahwa pekerja rumah tangga bukan berada pada sektor formal, melainkan pada sektor informal sehingga kedudukannya secara hukum belum tegas dan jelas. Perlindungan hukum pekerja rumah tangga sangat penting untuk menjamin kepastian hukum dan memberikan posisi yang jelas bagi kedudukan hukum pekerja rumah tangga dalam hubungan kerja sesuai hak konstitusi mereka. Penelitian ini bertujuan untuk memahami sejauh mana peraturan normatif yang ada di Indonesia dapat melindungi hak-hak pekerja rumah tangga serta mengetahui pola-pola dan efektivitas pengaturan informal antara majikan dan pekerja rumah tangga dalam hubungan kerja dalam menjamin hak-hak pekerja rumah tangga. Pengaturan formal yang ada pada saat ini belum secara eksplisit mengatur mengenai pekerja rumah tangga, baik dari sisi pelindungan, hak dan kewajiban, pengawasan, maupun kesejahteraan pekerja rumah tangga. Praktik empiris pelaksanaan pekerjaan pekerja rumah tangga memperlihatkan bahwa ketiadaan undang-undang yang secara khusus mengatur mengenai pelindungan terhadap pekerja rumah tangga memberikan berbagai dampak antara lain tidak adanya standardisasi upah pekerja rumah tangga, jam kerja pekerja rumah tangga yang tidak menentu, ketiadaan perjanjian kerja sebagai dasar hubungan kerja antara pemberi kerja dan pekerja rumah tangga, dan ketiadaan jaminan kesehatan bagi pekerja rumah tangga.

Abstract

One of the crimes that occur in cyberspace which is a current problem is cyberbullying. Cyberbullying is a form of intimidation that uses information and communication technology for deliberate purposes, carried out continuously, with the aim of harming other people by intimidating, threatening, hurting/insulting other people's self-esteem, to cause hostility by an individual or group. This research is normative legal research which aims to analyze the concepts and regulations regarding cyberbullying and criminal acts in Indonesia. The results of this research are in article 27 paragraph (3) of the ITE Law which states that every person intentionally and without right distributes and/or transmits and/or makes accessible Electronic Information and/or Electronic Documents which contain insulting and/or defamatory content. Good. Then in article 27 paragraph (4) which states that every person intentionally and without right distributes and/or transmits and/or makes accessible Electronic Information and/or Electronic Documents which contain extortion and/or threats.

Abstract

In the latest research by Transparency International (TI) in 2022, Indonesia scores 34 out of a total of 100 and is ranked 110 out of 180 countries surveyed. This shows that responses to corrupt practices tend to be slow and even continue to get worse due to the lack of support from stakeholders. Efforts to formulate impoverishment crimes are one of the efforts in reforming criminal law in Indonesia. Impoverishment sanctions for corruptors are considered to be more effective in providing a deterrent effect than prison sentences. The formulation of the problem, namely: 1) What is the setting for impoverishment crimes against perpetrators of corruption as an alternative punishment for corruption 2) What are the obstacles faced in accepting impoverishment punishment as an additional punishment 3) How can the Asset Confiscation Bill accommodate the eradication of criminal acts of corruption in Indonesia. Normative juridical research approach. The research is descriptive analysis in nature, primary and secondary data sources, namely primary, secondary and tertiary legal materials, data were collected by means of library research. Data were analyzed qualitatively. The conclusion of the research results: The regulation of the crime of impoverishment against corruptors as an alternative punishment for corruption in Indonesia has not been regulated explicitly in the laws and regulations for eradicating corruption, where public prosecutors can confiscate and auction off corruptors' property originating from corruption as a substitute for losses of state money. At UNCAC 2003, confiscation of the assets of perpetrators of corruption can be carried out through criminal and civil channels. The criminal provisions contained in the Corruption Crime Eradication Law (UUPTPK) are considered unable to recover state financial losses, this is because, first, court decisions are not proportional to losses. Ideally, the calculation of state financial losses uses the concept of economic costs. The asset confiscation bill has a breakthrough needed by law enforcers to strengthen the legal system whereby asset confiscation is a crime without a court decision in criminal cases (non-conviction-based forfeiture). Through the Asset Confiscation Bill which has been initiated by the government, it is hoped that efforts to recover assets resulting from crime can be streamlined.

Abstract

Notaries are public officials who are appointed and dismissed by the state through the Minister of Law and Human Rights of the Republic of Indonesia. Apart from the duties and obligations, Notaries also have the authority regulated in the Notary Position Law and receive legal protection from the state. The problems of this research: What is the relationship between Notaries as Public Officials in the criminal justice system regarding the authority to make authentic deeds, What is the legal protection for Notaries as Public Officials in the criminal justice system related to the authority to make authentic deeds, and the role of the Notary Honorary Council in providing legal protection for Notaries as Officials General in the criminal justice system regarding the authority to make authentic deeds?. The connection between a Notary's deed and the occurrence of a criminal act is that the authentic deed and its protocol are used as evidence of a criminal act or if there is a criminal element in its preparation which is the Notary's fault or the parties' error in providing information; or there is an agreement made between the Notary and one of the presenters. Legal protection for Notaries as Public Officials in the criminal justice system in the form of the rights and obligations of the Notary, and the approval of the Notary's Honorary Council to take photocopies of the minutes of the deed and/or letters attached to the minutes of the notary's deed or protocol in the Notary's custody; and the Notary to attend examinations relating to the Notary's deed or protocol which is in the Notary's custody. The Notary Honorary Council carries out examinations of Notaries regarding criminal allegations related to authentic deeds. It is recommended that Notaries in carrying out their duties act honestly, carefully, independently, impartially, and safeguard the interests of the parties. The guidance and supervision of Notaries by the Notary Honorary Council should be further improved, as an effort to prevent the execution of authentic deeds related to criminal acts.

Abstract

Tanah publik ( public land ) dikuasai oleh negara dan dipergunakan sebesar-besarnya untuk kemakmuran rakyat. Tujuan penelitian ini untuk mengetahui bagaimana hukum mengelola lahan yang bukan hak milik. Pengelolaan tanah bukan hak milik tanpa izin merupakan tindakan ilegal yang melanggar hukum, baik dari perspektif hukum negara maupun hukum syariah. Tujuan penelitian ini mengeksplorasi permasalahan pengelolaan wisata alam ilegal di Desa Botung, Kabupaten Padang Lawas, Sumatera Utara, dengan fokus pada Persepktif Wahbah Az-zuhaili. Hasil penelitian menyoroti kompleksitas masalah tersebut dan perlunya mematuhi hukum yang mengatur hak atas tanah serta memperoleh izin dari pemerintah dalam pengelolaan sumber daya alam atau wisata alam. Konflik antara persepktif hukum negara dan syariah islam menjadi sorotan dalam penelitian ini. Solusi yang sesuai dengan hukum yang berlaku perlu ditemukan untuk memastikan pengelolaan sumber daya alam yang adil dan sesuai dengan hukum yang berlaku. Metode penelitian yang digunakan adalah metode penelitian yuridis empiris dengan pendekatan kualitatif.

Abstract

The implementation of the Notary's duties and position is based on the high level of integrity and honesty of the Notary, the results of the work in making deeds and maintaining protocols as authentic evidence regarding the interests of justice seekers, both personal interests and business interests, so that the implementation of the Notary's duties and positions must be supported by moral will. which can be accounted for. The problem of this research: what are the legal regulations regarding the procedures for making authentic deeds by Notaries as Public Officials, the legal relationship between Notaries and Facing Parties in making authentic deeds, as well as the Notary's legal responsibility for authentic deeds in connection with criminal acts of forgery? Notary is a Public Official, authorized to make authentic deeds regarding all acts, agreements and stipulations which are required by a general regulation to be stated in an authentic deed, guarantee certainty of date, keep the deed and provide grosses, copies and quotations throughout the making of such a deed by a general rule is also not assigned or excluded to officials or other people. The presenter comes to the Notary, so that the actions or deeds are formulated into an authentic deed according to the authority of the Notary, and then the Notary makes a deed at the request or desire of the Presenter, in this case providing a basis for the Notary and the Presenter that a legal relationship exists. The legal responsibility of a Notary as a Public Official regarding authentic deeds related to criminal acts of forgery is: A Notary can be said to be free from legal responsibility if the authentic deed he has made and/or executed in front of him has fulfilled the formal requirements. If the Notary is proven to have violated the provisions of the law, namely fulfilling the criminal elements contained in the Criminal Code, then the notary can be held criminally responsible. Notaries in carrying out their duties must be careful, act honestly, impartially, and safeguard the interests of related parties. In making a deed, introduce the person present, based on identity, ask, then listen and pay attention to the wishes of the parties, examine documentary evidence, provide suggestions and create a framework for the deed to fulfill the wishes or desires of the parties, fulfill all administrative techniques for making the deed such as reading, signing, provide copies and filings for minutes, and carry out other obligations related to the duties of the Notary position.

Abstract

The purpose of writing this article is to be able to understand and analyze the application of the precautionary principle as preventive protection in making authentic notarial deeds. This article uses a normative research type with a statutory and regulatory research approach and a conceptual approach, and uses qualitative descriptive data analysis with deductive thinking methods. The form of the precautionary principle referred to above is a principle that is not regulated and strengthened in the UUJN, which causes notaries in carrying out their duties as public officials who make authentic deeds to often encounter legal problems, such as forgery of identity letters of the parties, certificates and false statements from the parties. . In this way, the notary will be vulnerable to being caught in a crime, namely falsifying documents due to negligence or committing a criminal act due to negligence. Based on Article 50 of the Criminal Code, it confirms that "whoever commits an act to carry out statutory regulations, must not be punished." Article 50 of the Criminal Code provides legal protection for the actions of Notaries as stated in Article 48 paragraph (1) of Law no. 2 of 2014, which regulates that the contents of the Deed are prohibited from being changed, which has the implication of binding the Notary in the criminal act of Negligence

Abstract

The main task of a notary is to create or record events authentically. For parties who make an agreement before a Notary, if a dispute arises related to the deed, then usually the first person to ask for advice is the Notary concerned. The main problem in this research is how the notary plays the role of the peace settlement agreement carried out by the parties before the notary regarding the dispute over the Deed of Jual Beili Peingikatan Agreement (PPJB). This legal research uses an empirical juridical method, namely a method of approaching problems by looking at applicable legal norms and then connecting them with legal facts found in the field. Meanwhile, this type of research is descriptive analytical, namely providing a clear and detailed description of an event that occurred. The results of the research, the role of a notary in the selection process of the Deed of Juial Beili Agreement (PPJB) made by the parties in front of him is that the notary can act by providing input regarding disputes between the parties in the deed made by the notary. This function is the role of the notary voluntarily as a party. who understands his duties and functions as a notary, and in this case the notary is also considered to really understand the essence of the ongoing problems and the peace litigation carried out by the parties before the notary regarding disputes over the Deed of Juial Beili Peining Agreement (PPJB), namely that the notary has the same ideals. Intuitive signatures provide legal guidance as well as providing information related to the execution of authentic deeds, as stipulated in Article 15 Paragraph (2) huiruif eiUiUiJN. In this case, the notary provides legal counseling to make the next deed after the parties have reconciled, namely in the form of a peace deed accompanied by a power of sale deed.

Abstract

Universally it can be stated that the objects that have been determined by IPR are various works that appear or are born due to the ability of human thinking. This research aims to find out whether the UUHC has provided protection against the transfer of copyright and to find out the validity period of this protection as well as sanctions for people who violate copyright. The research method used is normative juridical. The source and type of research data is primary legal material based on Law Number 28 of 2014 concerning Copyright and other related laws and regulations. Secondary legal materials consist of research results and books related to this article and tertiary legal materials consist of legal dictionaries and the internet. The data collection method in this juridical-nomative research requires secondary data with primary, secondary, tertiary and other legal materials. This data was obtained from literature or document studies. The results of the research concluded that the “UUHC has provided protection for inventors and given special rights that are closely related to the creations produced. There are three ways that can be done to resolve disputes regarding Article 95 of the UUHC through court, through arbitration, or through alternative dispute resolution.

Abstract

The local wisdom of the Indonesian people can be the basis for the concept of sustainable development. However, the challenge is that the complexity of legal rules can cause clashes in the context of the relationship between the right to control the state and the local wisdom values ​​that live and grow in the Nagari Pariangan community, Tanah Datar Regency, West Sumatra. This condition needs to be studied to find an appropriate legal construction that is integrated with the social system. This research aims to identify local wisdom values ​​with an environmental legal perspective possessed by the people of Nagari Pariangan. Examining and describing customary institutions in Nagari Pariangan in integrating customary norms with environmental law. This research used a qualitative approach with descriptive methods, which aimed to analyze and describe the integration of environmental law with local wisdom values. The subjects of this research were the Nagari Traditional Leaders, the Nagari Government, Tuangku Nagari and the local community. Research data collection used observational methods, focus group discussions, interviews and documentation from various sources that were related and support data analysis using data reduction, data presentation and drawing conclusions. The results of the research showed that, 1) The local wisdom values ​​of Nagari Pariangan as guidelines for community life in protecting the environment are manifested in customary norms that natural resources in the form of land/fields/rice fields, forests and rivers cannot belong to individuals but rather belong to groups/groups. traditional tribes and their management must obtain approval from Ninik Mamak; 2) The Tigo Tungku Sajarangan government integrates Nagari Pariangan traditional norms with environmental law which is realized in consensus deliberation between Ninik Mamak in every development plan launched by the Nagari Government, Regency, Provincial and Central Governments. If the results of the consensus deliberation are unanimous then it becomes the final decision made by each of the children/nephews/community, which supports the integration of environmental law with customary law and local wisdom.
