Abstract

The primary purposes of this research are to investigate the multifaceted role of health workers in the delivery of health services and to explore the legal aspects surrounding medical malpractice within the healthcare system. Specifically, this study aims to examine the evolving perception of health workers in society, moving beyond their traditional role as “healers” to encompass their broader responsibilities. Additionally, it seeks to understand the legal implications of medical errors and malpractice within the healthcare system, with a focus on negligence as a central factor. The issue of malpractice, because of the legal awareness of patients who feel aggrieved, results in the prosecution of doctors who commit medical errors (malpractice) which end up in criminal prosecution of patients who feel aggrieved, it is realized by all parties that doctors are only human beings who can one day be negligent and make mistakes, so that violations of the code of ethics can occur even to the point of violating applicable health regulations.This study employes a normative legal research approach to comprehensively examine the multifaceted role of health workers and the intricate legal dimensions surrounding medical malpractice within the healthcare sector. The result of the study found hospital criminal liability for malpractice committed by the hospital or by its health workers can be based on the doctrines of vicarious liability, hospital liability, and strict liability. Doctor’s medical malpractice in medical services can be intentional or negligent. What can be accounted for in medical malpractice is only a doctor’s negligence in carrying out medical procedures.

Abstract

The goal of the 2004 Law Number 23 on the Elimination of Domestic Violence is to end domestic violence in all of its manifestations. Cases of domestic abuse surged eightfold or by 792 per cent. The purpose of this research is to examine how domestic abuse prevention initiatives are being carried out in Indonesia. A qualitative descriptive literature review is the methodology used. This research shows that community outreach and education are two ways that prevention may be implemented, including a variety of stakeholders. Policy goals may be supported by providing chances for non-implementing agency actors to engage in policy implementation. In order to sustain stakeholder commitment, enhance the ability of implementing officers to undertake education, lessen sectoral ego, and promote stakeholders' comprehension of policy aims, coordination between stakeholders must enhance integrated collaboration and communication. The availability of human resources is one of the elements that impact a policy or program's implementation and success. Incompetent or underqualified policy implementers may be the cause of a policy's lacklustre execution. The reason that the community does not always recognize the Law on the Elimination of Domestic Violence is partly due to the variety of cultural values and social behaviours. It becomes more difficult to create strict and unambiguous standards the more diverse the services offered, the more diverse the conduct that is governed. As a result, it is advised to optimize preventative initiatives by fortifying family dynamics, improving cooperation with non-governmental organizations in the field of education, and putting digital anti-violence campaigns into action. The effectiveness of policy implementation depends on all policy implementers including the prevention of domestic violence into their work.

Abstract

Low quality of service system is Indonesian orphanages problem. This is indicated by the orphanages function, which tend to provide access to education rather than as the last alternative care institution for children. Responding to these problems, the government designed a national standard of care to position orphanages as institutions that function as service centres for neglected children and their families, namely the Child Social Welfare Institution (CSWI). This literature study aims to provide an overview of the social service standard set in Indonesian CSWI, as an effort to address Indonesian neglected children and their families’ problems. The method of this research is descriptive analytical which aims to analyse the Regulation of Indonesian Minister of Social Affairs No. 30/2011 concerning Service Standards for CSWI and provide a description of the service standard based on the child neglect assessment and intervention guidelines by experts. The result shows that the neglected children protection standard in the Indonesian CSWI, is appropriate with the guidelines of child neglect assessment and intervention suggested by experts. Based on the regulation, the assessment process by the CSWI includes identification of the child condition, also the types and causal factors of neglect. In addition, besides providing alternative care services for neglected children, the institutions are also directed to provide services for families by increasing them family care capacity, to achieve reunification. However, further research is needed to examine whether the implementation of the service is in accordance with the Indonesian regulation concerning on the Service Standards for CSWI.

Abstract

This study aims to find out, the factors that influence the perception of the customer value of Islamic Banks or IB in Indonesia. These factors are product knowledge by staff, service quality, and marketing communications. Customer value is one of the indicators of a company’s performance. The results show that the customer value of IB in Indonesia is perceived by its customers well by their understanding of IB products by staff, improving service quality and marketing communication. Service quality contributes greater than product knowledge by staff while marketing communication less than both. The method used in this study is descriptive which aims to obtain an overview of variable characteristics. Carried out through data collection, involving 200 respondents. The research methods used a descriptive survey and descriptive development. The type of investigation of this research is the analysis of quality. In this study analyzes the influence of independent variables on the dependent variable. The unit of analysis of this research is individuals, in this case, the prospective customers and customers of IB in Indonesia. The time period of data collection this research is a cross-section. Data collection is conducted from June to August 2018, where the data is processed using the SEM-PLS approach. The research results show that product knowledge, service quality and marketing communications have a positive and significant impact on customer value perceptions. Service quality has a more dominant influence on customer value perceptions than product knowledge and marketing communications.

Abstract

The Covid-19 pandemic has changed the order of all activities of human life, including in the field of education. The use of information system technology is very helpful in online learning, from elementary school to college level. Smartphones are intelligent communication tools that have many features to support online learning. The high use of smartphones has an impact on customer buying interest, especially since the Covid 19 pandemic. This study tries to analyze the interest in buying Samsung brand smartphones in online learning. The sample of this research is 98 students of Putra Indonesia University YPTK Padang. This research model is a structural equation modelling (SEM) model with SmartPLS 3 analysis tool. The results show that buying interest in Samsung brand smartphones is influenced by celebrity endorsers and brand image factors. The research findings state that the contribution of figures in the form of celebrities and brand image is a determining factor in buying Samsung brand smartphones. While the mediating effect of brand image cannot strengthen the influence of celebrity endorsers on the purchase intention of Samsung brand smartphones. This means that consumer buying interest in Samsung brand smartphones does not always pay attention to the brand image, but sometimes it is more to the celebrity endorser factor. This finding recommends that companies can further maintain and strengthen the celebrity endorser factor and be able to improve the quality of their product brand image so that consumer buying interest becomes higher in marketing their products.

Abstract

Indonesia and other countries must deal with the COVID-19 pandemic with limited information control amid uncertainty. Handling a pandemic that has become a crisis places great demands on the government to provide agile and dynamic policies. Variations of policies that the Indonesian government has issued raise doubts in the public sphere. The government changed several policies quickly and easily, giving the impression that they did not go through a thorough formulating process. It shows that the handling of COVID-19 requires a policy system that is quite complex due to the many interactions of various sectors. By using qualitative methods, this study attempts to discuss the dynamics of changing public policies by using the concept of incremental policy amid demands for agile governance implementation by looking at the cases of policies issued by the Indonesian government in response to COVID-19. The dynamic of the policy network will be explored further to dismantle the discussion of policies for handling COVID-19 in Indonesia. Therefore, the results of this research show the challenges in implementing agile principles simply by changing and adapting policies to empirical conditions. In its application, agile governance shows several dominant actors who gather resources and support, shape policy outcomes, and advance their interests.

Abstract

Management in each laboratory school is different from other schools in general. This research is a description of the policy evaluation on the regulation of laboratory schools that will provide educational services to students as expected (vision and mission of the lab school), become a place for developing various teacher and educational practices in teacher professional education, and a place for the development of various educational innovations. Laboratory schools are places where prospective professional teachers practice and develop educational innovations and act as model schools for creative and innovative learning practices for prospective professional teachers. By using a qualitative approach and a case study method, this study seeks to provide an overview of the laboratory school regulations in UPI. The results showed that, UPI PTNbh already has a special regulation on laboratory school governance, namely Rector Regulation No.4439 / UN40 / HK / 2019 concerning UPI School Organizing Bodies. Management of educational units at a certain level by educational units at other levels, needs to be affirmed by strong rules and needs to be operated effectively. Good and fair which is reflected in the dynamics of management, there is a proportional distribution of authority and a strategic distribution of power. The strategic division of power is characterized by the sharing of legal powers that are binding and obeyed which do not create multiple perceptions and harm the community using education.

Abstract

Child marriage has become a growing issue in the last 20 years. Even the United Nations 10 years ago warned Indonesia of an emergency for child marriage. As is well known, the Ministry of PA released the number of child marriages in 2000 as many as 63,382 cases, decreased in 2021 to 61,459 cases, and in 2022 decreased drastically to 50,673 cases. The decline in child marriage or Marriage with dispensation is due to better socialization of changes to Law Number 16 of 2019 concerning Amendments to Law Number 1 of 1974 concerning Marriage and several efforts made by the government and regional governments. The decline occurred in several regions in Indonesia, as was the case in Central Java Province. The problem of child marriage is quite complex because it is not only an internal family problem but includes a complicated social security issue and requires collaboration to solve it. Collaboration between the government and stakeholders has been initiated but has not yet been strengthened, so it is necessary to find a way to overcome child marriage. This research was conducted using the mixed method, namely exploring children who were already married to find out conditions before and after Marriage and children’s responses to child marriage. The purpose of this research is to analyze the roles of the government and stakeholders in the prevention and management of child marriage. This research is expected to address how the government and stakeholders collaborate in preventing and dealing with child marriage. This study focuses on patterns of child marriage, children’s responses to child marriage, the role of government and stakeholders, and models of collaboration between local government and stakeholders in preventing and controlling child marriage with the locus of Central Java Province.

Abstract

This research aims to develop a peatland management plan for Riau province that is based on the ideas of public-private collaboration. Data from this qualitative descriptive research were collected through a multimodal manner: interviews, in-depth literature reviews, and secondary data sources. The data analysis approach employed an interactive model that was inspired by Emerson and Nabatchi’s work on the dynamics of collaborative governance. Interviews were conducted with members of the public and commercial sectors, as well as local communities and experts. This study found that there are recurring barriers in peatland management in Riau, such as the need for more active and robust collaboration between the government and private sectors. Although the government functions within defined boundaries, the private sector often designs programs aligned with the interests of specific stakeholder groups. This situation frequently leads to incomplete projects, overlapping programs, and inadvertent strategies. The findings show there are concerns about the future adoption of sustainable methods in peatland management due to the divide between the public and private sectors. For this reason, resolving these issues is essential to protecting Riau’s peatlands and their ecological and economic significance for future generations.

Abstract

This research aims to analyze the implementation of business education at the As-Sa’adah Vocational School, East Jakarta. Business education at this school is the main focus to understand how the material is taught, the teaching methods used, and its impact on students’ interest and involvement in the world of business carried out by the As-Sa’adah Vocational School. The research method used is qualitative research with a case study approach. Data collection was carried out through interviews with students in grades X, XI, and XII and alumni of As-Sa’adah Vocational High School, East Jakarta, selected randomly with 10 individuals from each cohort. The results show that entrepreneurship education at As-Sa’adah Vocational High School provides positive contributions and can cultivate entrepreneurial tendencies among students, especially after graduating from As-Sa’adah Vocational High School. The implication of this research is the need for increased support and resources to support the effective implementation of business education at As-Sa’adah Vocational High School.
