Many have a general criminal cases committed by members of the military of this country, but in law enforcement as if the members of the military as a criminal not touched by the criminal law, as a general jurisdiction to try criminal offenses committed by members of the TNI still under military justice. Moreover, the military justice system that are covered so much of the sense of justice. It should be criminal offenses committed by members of the military brought to the general court as mandated by the Constitution amendments 45 and MPR Decree No. VII / 2000, which regulates the separation of the role of the National Police Force constituted by the issuance of MPR NO.VI AND VII OF 2000 in Article 3, paragraph 4 of MPR Decree NO . VII / MPR / 2000, reads as follows: a) the Indonesian National Armed Forces are subject to the authority of the military court in the case of violations of military law and subject to the general judicial power in violation of the general criminal law, b) When the authority of the general court referred to in subsection ( 4a ) this article does not work then the soldiers subordinate judicial power which is regulated by law. This means that throughout the criminal law for military materiel ( KUHPM ) has not changed, it is difficult to apply an idea or a "political decision" contained in MPR Decree No. VII / 2000 , that the "soldiers are subject to the authority of the general court in the case of violation of the general criminal law". So keep referring to Law No. 31/1997 about the existing military justice governing the criminal justice common for soldiers, so that a wishful thinking will achieve "the principle of equality before the law" against members of the military and members of the military will continue to be the golden boy in this Republic.

Apa Saja Yang Harus Diperhatikan Dalam Melakukan Praperadilan. Pertama, Antisipasi Praperadilan dapat dilakukan mulai dari Proses Penyidikan yang dilakukan oleh Polisi sebagai Penyidik. Kedua, Hal Yang Perlu Diperhatikan Penyidik Sebagai Antisipasi Praperadilan Adalah mengenai Etika Penyidikan. Seorang penyidik dalam melaksanakan tugasnya memiliki koridor hukum yang harus dipatuhi, dan diatur secara formal apa dan bagaimana tata cara pelaksanaan, tugas-tugas dalam penyidikan. Artinya para penyidik terikat kepada peraturan-peraturan, perundang-undangan, dan ketentuan-ketentuan yang berlaku dalam menjalankan tugasnya. Dalam pelaksanaan proses penyidikan, peluang-peluang untuk melakukan penyimpangan atau penyalahgunaan wewenang untuk tujuan tertentu bukan mustahil sangat dimungkinkan terjadi, karena itulah semua ahli kriminalistik menempatkan etika penyidikan sebagai bagian dari profesionalisme yang harus dimiliki oleh seorang penyidik.Kata kunci: antisipasi; mekanisme; pidana; praperadilan; sistem peradilan.ABSTRACTPretrial is the authority of the District Court to examine and decide on whether or not an arrest and/ or detention is valid is the request of a suspect or his family or other party or the power of a suspect; whether valid or not the termination of the investigation or termination of prosecution at the request of law and justice; and requests for compensation or rehabilitation by the suspect or his family or other parties or their proxies whose cases are not brought to trial. By looking at legal phenomena as described in the background above, the authors are interested in making the subject matter in this research. What should be take into account in conducting pretrial. First, anticipation of pretrial can be carried out starting from the investigation process carried out by the police as investigators. Investigation aims to find and collect evidence to make a crime clear, investigators are authorized to carry out seizures.. Secondly, the Things to Look Out for Investigators as Anticipating Pretrial is concerning the Ethics of Investigation. An investigator in carrying out his duties has a legal corridor that must be obeyed and formally regulated and how the procedures for carrying out the tasks in the investigation. This means that investigators are bound to the regulations, legislation, and provisions that apply in carrying out their duties. In carrying out the investigation process, opportunities for deviating or misusing authority for a particular purpose are not impossible to occur, which is why all criminalist experts place the ethics of investigation as part of the professionalism that must be possessed by an investigator.Keywords: anticipation; mechanism; pretrial; system tort; trial.DOI: https://doi.org/10.23920/jbmh.v3n2.21

Speaking about victims and witnesses, we can not be separated rather than criminal proceedings. In the provision of Article 184 paragraph (1) letter a witnesses KUHAP positioned as "evidence" that major in criminal matters. So consequently, in every process of law enforcement if the witness does not meet the legitimate calls from investigators, prosecutors until trial, the investigator, the prosecutor can conduct a forced effort to pick up the forced witnesses. Because, criminal proceedings are still bound by doctrine in introdusir Criminal Procedure Code, Criminal Procedure Code where the witness in the formulation of concentrating on "no probative value". However, with the enactment of Law No. 13 of 2006 on Protection of Witnesses and Victims, is expected to address issues of law against prolonged witnesses and victims in criminal proceedings.

The primary purposes of this research are to investigate the multifaceted role of health workers in the delivery of health services and to explore the legal aspects surrounding medical malpractice within the healthcare system. Specifically, this study aims to examine the evolving perception of health workers in society, moving beyond their traditional role as “healers” to encompass their broader responsibilities. Additionally, it seeks to understand the legal implications of medical errors and malpractice within the healthcare system, with a focus on negligence as a central factor. The issue of malpractice, because of the legal awareness of patients who feel aggrieved, results in the prosecution of doctors who commit medical errors (malpractice) which end up in criminal prosecution of patients who feel aggrieved, it is realized by all parties that doctors are only human beings who can one day be negligent and make mistakes, so that violations of the code of ethics can occur even to the point of violating applicable health regulations.This study employes a normative legal research approach to comprehensively examine the multifaceted role of health workers and the intricate legal dimensions surrounding medical malpractice within the healthcare sector. The result of the study found hospital criminal liability for malpractice committed by the hospital or by its health workers can be based on the doctrines of vicarious liability, hospital liability, and strict liability. Doctor’s medical malpractice in medical services can be intentional or negligent. What can be accounted for in medical malpractice is only a doctor’s negligence in carrying out medical procedures.

The problem at hand is the low interest and ability of rural youth in entrepreneurship, as a significant portion of the community relies on limited employment opportunities in palm oil plantations. With the aim of enhancing the quality of human resources in Sungai Manasib village, the proposer intends to carry out community service activities. The proposed solution to address the partner's issues involves conducting an educational program on Sharia-based entrepreneurship, introducing Sharia financial institutions for business financing, organizing online entrepreneurship field trips, and providing digital marketing assistance to the youth/rural community of Sungai Manasib. The outcome of this dedication is expected to assist the village of Sungai Manasib in enhancing the quality of its human resources/community through the growth of youngpreneurs who operate businesses in accordance with Sharia principles, with the hope of providing a solution to the issue of unemployment in Sungai Manasib village. In addition, the mandatory output of this community service activity will be published in local mass media, and an additional output will be published in a nationally accredited Sinta 5 community service journal. The PkM activity will be carried out in several stages, starting with the planning stage, followed by counseling and mentoring, and ending with a measurable evaluation. The PkM activity has a positive impact on the improvement of human resources in the village and is able to provide more knowledge and interest for young people to engage in entrepreneurship.

Syariah stocks have recently gained attention in the Islamic community, which relies on Shariah principles to guide investment decisions. Islam emphasizes the importance of profitable investments that benefit all parties involved, while prohibiting investments that involve uncertainty or exploitation. This article provides an overview of the position of stock shares in Islamic law. Using a normative legal research method, this study analyzed the relevant Islamic texts, including the Quran, Hadith, and Fatwas issued by scholars. Syariah stocks are specifically designed to meet the requirements of Islamic law, which emphasizes transparency, fairness, and ethics in financial transactions. The National Sharia Council of the Indonesian Ulama Assembly (DSN MUI) issued a Fatwa No. 80/DSN-MUI/III of 2011, outlining the implementation of Islamic principles in equity securities trading. The Fatwa stipulates that the means of payment must be known in terms of amount and form, whether in the form of money or goods, and that there should be no payment in the form of debt. Additionally, the time and place of delivery must be clearly specified based on the agreement between parties. This type of contract involves multiple parties, including banking institutions, and must be conducted in accordance with Islamic principles. The Fatwa has contributed to clarifying the terms of stock trading under Islamic law, providing a framework for Syariah stocks to operate within the boundaries of Islamic law.

The use of the death penalty in drug-related crimes remains a contentious issue globally, raising concerns about fundamental human rights and policies designed to curb drug trafficking. While some countries retain the death penalty as a tool to address drug offenses, citing its deterrent effect and its role in protecting public health, the human rights viewpoint strongly challenges such practices, focusing on the sanctity of the right to life. International legal frameworks set limits on the death penalty's application and urge states to refrain from actions deemed inhumane and ineffective. This article explores the implementation of the death penalty for drug crimes, considering both human rights perspectives and its relationship with international criminal law.
