Abstract

Since the Dutch colonial era, Bangka Belitung Province has been a rich province due to its abundanttin mining resources. However, the limitation of tin availability and the extraordinary environmental degradation caused by mining has changed people’s lives. This study aims to determine the level of land ownership inequality and the factors that influence such inequality. In addition, this study also describes the transformation causes of the livelihoods of the majority of the population in Bangka. This research was conducted through descriptive quantitative analysis, and the data was obtained through a survey of 140 head of households whowork as farmers or work as a farm labourers in Bangka and West Bangka. Analysisof land ownership inequality is done through the Gini index ratio measured using the Lorenz curve. The results of a study conducted on 140 respondents in Bangka and Bangka Barat show that the level of land ownership inequality reaches 0.45. Several things have an effect on the level of inequality. First, most of Bangka regions, almost 3/4 the areas have mining permits. Second, there has been a large-scale expansion of oil palm plantations and a lot of Cultivation Rights Permits/HGU. Third, most of the areas outside the mining and the cultivation rights permits are forest areas. The results of the study also show that the majority of the community shifted from miners to farmers due to limited tin sources and low tin prices. The high level of inequality in land ownership and the shifting of community’s main jobs can certainly affect the economic growth which is getting weaker and widening the inequality.

Abstract

Abstract: Recognition of tenure rights and access to forest use has always been a demand for indigenous people and non-government organizations that support indigenous peoples’ rights. However, focusing only on the recognition of rights is not enough to guarantee tenure access to indigenous people to use the forest. Indigenous people require not only recognition of rights from the state, but they alsoneed access to be able to use the forest. This article aims to understand the tenure rights and access of the Bengkunat indigenous people in forest use and the factors that influence the community’s access to use the forest. This article was produced by using the socio-legal approach to understand the social reality of tenure rights and access of the Bengkunat indigenous people in forest use. The results show that in addition to the recognition of Bengkunat indigenous people tenure rights to use the forest, they also need access to be able to use it. If there is no access, the community cannot benefit from the forest.Intisari: Pengakuan hak masyarakat hukum adat atas pemanfaatan hutan selalu menjadi tuntutan bagi masyarakat hukum adat dan organisasi non-pemerintah yang mendukung hak-hak masyarakat hukum adat. Meskipun demikian, hanya fokus pada pengakuan hak saja, tidak cukup memberikan jaminan akses tenurial kepada masyarakat hukum adat untuk memanfaatkan hutan. Masyarakat hukum adat tidak hanya membutuhkan pengakuan hak dari negara saja, tetapi juga membutuhkan akses untuk dapat memanfaatkan hutan. Artikel ini bertujuan untuk memahami bagaimana hak dan akses tenurial masyarakat Bengkunat atas hutan dan apa saja faktor-faktor yang memengaruhi akses masyarakat dalam memanfaatkan hutan tersebut. Artikel ini dihasilkan dari penelitian dengan menggunakan pendekatan sosio-legal untuk memahami realitas sosial hak dan akses tenurial masyarakat hukum adat Bengkunat dalam pemanfaatan hutan. Hasil penelitian menunjukkan bahwa disamping pengakuan terhadap hak tenurial masyarakat Bengkunat, mereka juga sangat memerlukan akses untuk dapat memanfaatkannya. Jika tidak ada akses, maka masyarakat tidak dapat menikmati hutan

Abstract

Abstract: Adat law as empirical knowledge found by judges through western legal thought grows to be normative knowledge. This research tried to prove the hypothesis that judges used positivist legal reasoning in finding adat law applicable in specific cases. This study, written in the form of a legal descriptive research with socio-legal approach, aims to identify and analyze the legal reasoning used by judges to find applicable adat law. This research proves that the judges applied western legal thought to find appropriate adat law by referring to jurisprudence, doctrines, and concepts on adat law to measure legal actions validity. Positivist legal reasoning practice helped judges to find adat law applicable in concrete cases, but it alienated adat law from its empirical reality since judges only considered particularities of each case which support normative claim found in the existing adat law concepts, doctrines, and jurisprudence.   Intisari: Hukum adat sebagai pengetahuan empiris berkembang menjadi pengetahuan normatif yang ditemukan melalui perspektif hukum Barat oleh hakim. Penelitian ini berusaha untuk membuktikan hipotesis bahwa hakim menggunakan nalar hukum adat positivistik dalam menemukan hukum adat yang berlaku dalam suatu sengketa. Sifat dari penelitian hukum ini adalah deskriptif dengan pendekatan sosio-legal untuk mengidentifikasi dan menganalisis nalar/reasoning yang digunakan hakim untuk menemukan hukum adat yang berlaku. Penelitian ini membuktikan bahwa hakim menggunakan perspektif pemikiran hukum Barat dalam melakukan penemuan hukum adat dengan mendasarkan pada yurisprudensi, doktrin, dan konsep tentang hukum adat untuk mengukur validitas suatu perbuatan hukum. Di satu sisi, praktek nalar positivistik dalam penemuan hukum adat oleh hakim memudahkan hakim untuk menerapkan hukum adat dalam kasus konkrit. Namun di sisi lain hal tersebut menjauhkan perkembangan hukum adat dari realitas empirisnya karena hakim hanya mempertimbangkan partikularitas masing-masing kasus yang sesuai dengan ketentuan/norma hukum adat dalam konsep, doktrin, dan yurisprudensi yang telah ada.

Abstract

The urban development in Bali, especially Denpasar City, as the capital city of Bali Province, is growing fast in all sectors, leading to dynamic of city and creating some issues as well. Some aspects which have changed due to those developments are the growth of economics, the adequate of facilities and utilities, the comfort, the safety and the local wisdom of Balinese tradition as well. The local wisdom of Bali, as the cultural value system of Balinese tradition, is a solid reliability between culture and religion which becomes the root and the base of all Balinese community life. The existence of Balinese cultural value has been kept sofar, it is not beyond the fundamental rules and meanings. In fact, the power of Balinese traditional sophistication value system is shaping the growth of DenpasarCity. This article will explore the aspects of Balinese local wisdom values such as: Balinese traditional spatial pattern, traditional community and religion systems, also how those aspects have strongly generated the development of Denpasar city, especially on city spatial and land use. The study shows that existence of the local wisdom has significant factors in shaping urban patterns and structures and  providing limitations to the use of urban space.

Abstract

Digital spatial data has the highest demand, especially for the needs of analysis in terms of mapping. Mapping is currently the focus of attention of many institutions because real objects in the field in a wide range can be visualized in a precision field with a specif ic scale. Many villages do not have digital spatial data; one ofthem is Wedomartani village. Therefore, an inventory of digital spatial data of important village objects needs to be done. This study aims to map the potential of village using satellite imagery data from Google Earth and Geotagging photographs and determine the zoning potential of the Land Use of Wedomartani village. The method used to map the potential of villages using satellite imagery data is the method of interpretation, then geotagging photo data obtained through surveys utilizing GPS tag technology from smartphones and the participatory role of village communities. The determination of village land-use zoning used the matching method of the potential map with validation of geotagging photo data. The results interpretation of satellite images shows that the potential in the village of Wedomartani in the form of important objects as the potential of the village is public facilities, tourism objects, theme parks, sports facilities, buildings, roads, rivers, and agriculture. The zoning results of the potential land use of the Wedomartani village consist of Trade and Service Zones in the form of micro, small and medium businesses spread along the main road as a sector of economicpotential (212.73 Ha); The Recreation Zone is in the form of Maguwoharjo Football Stadium, Jogja Bay Pirates Adventure Park Family Park, Tambak Boyo Reservoir and Gebang Temple Cultural Heritage Site as a potential tourism sector (23.48 Ha); Agricultural and Plantation Zones in the form of irrigated rice, maize and chili as potential for sustainable agriculture (661.19 Ha).

Abstract

Agrarian reform is a homework that will not be completed only with sectoral approach. The real agrarian reform is not just dividing and legalizing the land, but making the land parcels have better access. This study used the collaboration theory of Russell M. Linden. The collaborative approach requires institutions tounderstand the basis of collaboration, create relationships, commitment and support among them built by collaborative leadership models. Agrarian reform must make Indonesian society better. Based on Linden’s qualitative descriptive method, there are several steps that can be adopted so as to make it easier to implement agrarian reform. The support of the governor/regent regulations on the above rules which substantially support the agrarian reform program will accelerate the implementation of the program. In addition, the division of roles and functions in the access corridor of reform requires a concrete conceptual foundation, easy to understand and firm in the form of rules that are accepted by all parties. Furthermore, in order to obtain a comprehensive and effective solution, the roles of ministries / institutions, the private sector, the community, NGOs,academics and mass media summarized in stakeholders need to be built systematically so as to eliminate the complexity of agrarian problems in Indonesia.

Abstract

Abtract: The global food regime has failed and led to a food crisis. However, food regime can transform from time to time in order to dominatethe food system globally. The current food regime is also known as the corporate food regime. In this period, capital accumulation reorganization is no longer centered in the state, but in multinational corporations. Therefore, there needs to be a framework to address the transformation in order to provide an effective alternative food system, especially for the Global South. This study elaborates on how land sovereignty initiated by La Via Campesina can be a counter-hegemony against the corporate food regime to get out of the crisis of capital accumulation through massive land investments, especially in the Global South. Moreover, this paper refers to Friedmann and McMichael’s (1989) concept about the food regime and examines such conditions by using Gramsci’s (1971) ideas on hegemony. In conclusion, the land sovereignty concept can be considered to be an effective alternative framework to deal with the hegemony of neoliberal globalism for five reasons, namely: 1) the possibility of using various property rights systems; 2) the possibility to be implemented through land reform redistribution policy with several adjustments;  3) the probability to be a common platform because the concept recognizes land not only as a resource but also as culture and as a landscape; 4) the probability to be connected with other campaigns; and 5) the probability to be connected with political work of the broader working community globally.Intisari: Rezim Korporasi Pangan telah gagal dan memicu terjadinya krisis pangan. Meskipun demikian, rezim pangan dapat bertransformasi dari waktu ke waktu untuk menghegemoni sistem pangan secara global. Rezim pangan saat ini juga juga dikenal sebagai rezim korporasi pangan. Dalam periode ini, reorganisasi akumulasi kapital tidak lagi berpusat pada negara, tetapi pada korporasi-korporasi multinasional. Oleh karena itu perlu adanya sebuah kerangka untuk menjawab transformasi tersebut sehingga mampu menawarkan sebuah sistem pangan alternatif yang efektif, khususnya bagi negara-negara Global Selatan. Kajian ini mengelaborasi bagaimana kedaulatan tanah yang diinisiasi oleh La Via Campesina dapat menjadi kontra hegemoni melawan rezim korporasi pangan untuk bisa keluar dari krisis akumulasi kapital akibat investasi-investasi tanah yang masif terutama di Global Selatan. Tulisan ini merujuk pada konsep dari Friedmann dan McMichaels (1989) mengenai rezim pangan dan mengkaji beberapa situasi dengan menggunakan ide Gramsci mengenai hegemoni. Kesimpulannya, konsep kedaulatan tanah dapat dipertimbangkan sebagai sebuah alternatif kerangka yang efektif untuk menghadapi hegemoni globalisme neoliberal untuk 5 alasan, yaitu: dimungkinkannya menggunakan berbagai sistem hak kepemilikan, kemungkinan untuk diimplementasikan melalui kebijakan land reform redistributif dengan sejumlah penyesuaian, peluang untuk menjadi platform umum karena konsep tanah tidak lagi hanya dipahami sebagai sumberdaya, tetapi sebagai budaya dan lanskap, peluang untuk menghubungkannya dengan kampanye yang lain serta kerja politik pada tataran kerja komunitas luas secara global.

Abstract

Abstract: This paper chronicles a case of land dispute through a sociospatial lens (Gottdiener, Hutchison and Ryan, 2015) with a specific case of the dynamic of urban spatial management of the city of Surabaya. Key structural changes of public spaces in Surabaya have been running starting from the late 1990s for the local government was given authority to manage its space. Simultaneously, the plethora of freedom spirit since Reformasi 1998 has been reshaping citizens’ politics towards their city as public space. Relying on secondary data, this paper argues that the dynamic of city spatial management has been colored by struggles of various actors in reclaiming public places. Surabaya, like other big cities all over the world, is an open field for power contestations over a space for living. Intisari: Paper ini mengurai sebuah kasus sengketa lahan menggunakan lensa sosiospasial (Gottdiener, Hutchison and Ryan, 2015) dengan mengangkat dinamika pengaturan ruang urban di Kota Surabaya. Perubahan-perubahan penting atas tempat-tempat umum di Surabaya terjadi sejak era akhir 1990an akibat peralihan kewenangan pada pemerintah daerah untuk melakukan penataan ruangnya. Pada saat bersamaan, luberan semangat kebebasan sejak Reformasi 1998 telah mengubah model strategi politik warga atas kotanya sebuah ruang bersama. Mengandalkan data sekunder, paper ini menunjukkan bahwa dinamika penataan ruang kota selalu diwarnai oleh perjuangan beragam aktor dalam memperebutkan tempat-tempat umum. Seperti halnya kota-kota besar lainnya, Surabaya adalah sebuah arena pertarungan terbuka bagi pelbagai kepentingan atas sebuah ruang kehidupan.

Abstract

Abstract: This study aims to examine the perspective of citizenship as a way to resolve conflicts in commons management in the natural tourism of Bleberan Village, Gunungkidul. This study departed from the reality of the challenge of strengthening the market in guiding village public life, including the commons. At the same time, the village faced a decline in the role of the state as a bulwark for the presence of a sustained commons interest in the form of redistribution of citizens' welfare. This research used qualitative approach with an instrumental case study strategy. Case studies were chosen with the aim of perfecting or building new knowledge. Data was collected by a combination of techniques including interviews, FGDs, observations, and documentation with informans like entrepreneur, tourism unit operator, village government, village-owned enterprises management, and residents. This study found that conflict management in the commons in Bleberan rooted in the formation of contestation citizenship but without adequate negotiation capacity. The communitarian social building of citizens is interconnected with defective liberal citizenship which leads to exclusion, inequality, and concentration of welfare. Meanwhile, the republican model has not been able to offset the dominance of both. Weak negotiating capacity for membership, rights, and burdens on how the commons should be managed resulted in unmanaged contestation. This article concludes that it is important to track citizenship formations as a basis for finding a road map for conflict resolution in managing the commons.Intisari: Kajian ini bertujuan menguji perspektif kewargaan sebagai cara mengurai konflik pengelolaan the commons berupa wisata alam di Desa Bleberan Gunungkidul. Kajian dilatarbelakangi tantangan menguatnya pasar dalam memandu kehidupan publik desa, termasuk the commons. Pada waktu yang sama, desa dihadapkan pada merosotnya peran negara sebagai benteng keberlangsungan commons interest berupa redistribusi kesejahteraan warga. Penelitian ini berjenis kualitatif dengan strategi studi kasus instrumental. Studi kasus dipilih dengan tujuan menyempurnakan atau merintis  pengetahuan baru. Data dikumpulkan dengan kombinasi teknik wawancara, FGD, observasi, dan dokumentasi dengan narasumber pelaku usaha, pengelola wisata, pemerintah desa, pengurus BUMDesa, serta warga. Hasil kajian menemukan konflik pengelolaan the commons di Bleberan berakar dari formasi kewargaan yang kontestatif namun tanpa diimbangi kapasitas negosiasi secara memadai. Bangun sosial komunitarian warga  berkelindan dengan kewargaan liberal yang cacat memunculkan eksklusi, ketidaksetaraan, dan pemusatan kesejahteraan. Sementara itu model republikan belum mampu tampil mengimbangi dominasi keduanya. Lemahnya kapasitas negosiasi atas keanggotaan, hak, dan beban tentang bagaimana the commons seharusnya dikelola berimplikasi pada kontestasi yang tidak terkelola. Artikel ini menyimpulkan pentingnya melacak formasi kewargaan sebagai basis menemukan peta jalan resolusi konflik pengelolaan the commons.

Abstract

Yellow-crested small cockatoo (Cacatoasulphureaabbotti) is an endangered species lives in residential area with private ownership in Masakambing Island, Sumenep Regency, East Java, Indonesia. Recently, the population of the bird only remains between 22-25 birds. Their habitat requires 3 important trees to support their living: nesting trees, sleeping trees and feeding trees. However, conservation efforts are not easy as they share space for living with human. Besides that, in a small island, land is scarce and available resources are limited. Therefore, its conservation effort needs community involvement. Generally, sharing access to the land resources are intended to social and economic aspects. The study was aimed at findingout the distribution of important treesas habitat for yellow-crested cockatoo and propose land management policy in supporting its conservation activities in Masakambing. The analysis uses qualitative method with interactive model. The results showed that 90% of the bird’s habitat was in a residential area with private ownership. The Private Land Conservation policy with conservation easement approach can be implemented to conserve yellow-crested cockatoo in Masakambing. Unfortunately, the Private land Conservation Policy and conservation easement approach hasnot been regulated clearly.
